REGAN Secretary LINDA CULPEPPER Director NORTH CAROLINA Environmental Quality November 19, 2019 DWR # 20191518 Guilford County Keystone Group Inc Attn: Scott Wallace 3708 Alliance Drive Greensboro NC 27407 Subject: REQUEST FOR ADDITIONAL INFORMATION Avondale Subdivision Dear Mr. Wallace: On October 30, 2019, the Division of Water Resources — Water Quality Programs (Division) received your application dated October 14, 2019, requesting a 401 Water Quality Certification and Buffer Authorization from the Division for your project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: The buffers are regulated by the City and not DWR. Please ensure that you secure the appropriate buffer authorizations/approvals as necessary as the 401 will solely be for stream and wetland impacts. Also note that during the USACE/DWR site visit we did not confirm the start point of the stream that you are proposing to cross. This must be done by the local government in the field and then should be surveyed and shown on the plans so that the appropriate buffers may be shown. Depending on where the location of the start point it buffers may affect some lots in a way that limits development 2. On Sheet C1 at the very western edge of the property there are some lines that appear that they may be a utility corridor, but the scale is too small to read any of the text. Can you please confirm what these areas are and whether there are any new impacts to streams, wetlands or buffers from any new activities in this location. [15A NCAC 02H .0502(g)] 3. Sheet C1 does not appear to include all wetlands found on the property, specifically there appear to be some wetland areas missing along the property boundary with Sumner Church Rd. Please update the plans to include all the features found during the USACE/DWR site visit. Per Condition 11.9 of GC 4139, all work must be done "in the dry". Therefore, dewatering methods will be necessary to temporarily dewater the stream channel during pipe installation. Please provide a construction sequence that details the method of dewatering to be utilized at the site and the sequence of construction events to be followed to ensure compliance with this condition. In addition, please ensure that the location of the temporary impacts are shown on the construction drawings and clearly indicated in the revised impact table. [15A NCAC 02H .0502(b)(3)] Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond in writing within 30 calendar days of receipt of this letter by sending one (1) copy of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by submitting all of the above requested information through this link: https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on the link is referenced above). If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Water Quality Certification Rules for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
