Dear Mr. Baxley:
The Division of Energy, Mineral and Land Resources has reviewed your submittal of the No Exposure
Certification for Exclusion from NPDES Stormwater Permitting. Based on your submittal and signed
certification of no exposure at the above referenced facility as well as observations made by Mike Lawyer
with the Fayetteville Regional Office on August 25, 2015, the Division is granting your conditional exclusion
from permitting as provided for under 40 CFR 122.26(g), which is incorporated by reference in North
Carolina regulations. We are also hereby rescinding your current permit Certificate of Coverage,
NCG 110015.
Please note that by our acceptance of your No Exposure Certification, you are obligated to maintain no
exposure conditions at your facility. If conditions change such that your facility can no longer qualify for the
No Exposure Certification, you are obligated to immediately obtain NPDES permit coverage for your
stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted
discharge. You must self re -certify annually using the enclosed form or obtain NPDES permit coverage for
any stormwater discharges from your facility. The annual self re -certification does not need to be submitted
unless requested. Your conditional exclusion from permitting does not affect your facility's legal requirements
to obtain environmental permits that may be required under other federal, state, or local regulations or
ordinances.

On August 25, 2015, a site inspection was conducted for the Fayetteville -Cross Creek WRF facility located at
601 North Eastern Blvd in Fayetteville, Cumberland County, North Carolina. A copy of the Compliance
Inspection Report is enclosed for your review. Your time and assistance during the inspection is greatly
appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater
General Permit NCG110000, Certificate of Coverage NCG110015. Permit coverage authorizes the discharge
of Stormwater from the facility to receiving waters designated as Big Cross Creek and the Cape Fear River,
both Class C waterbodies in the Cape Fear River Basin.
As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG110000
permit. Please refer to the enclosed Compliance Inspection Report for additional comments and
observations made during the inspection.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil
penalty assessment of up to $25,000 per day for each violation. If you or your staff has any questions,

Inspection Summary:
Compliance inspection conducted in conjunction with site visit in response to submittal of an application for a No Exposure
Certification, Made observations of stormwater BMPs, stormwater outfalls and secondary containment for ASTs. Site
appeared to be very well operated and maintained. Facility's SWPPP is complete and semi-annual Qualitative Monitoring
records were reviewed. Facility determined to be in compliance with the conditions of Stormwater General Permit
NCG 110000.
Based on overall site conditions as well as recent modifications to areas of the facility where potential exposure of
stormwater to pollutants has been eliminated, i.e. installing curbing around locations where septagelindustrial process
water is off-loaded into the headworks, the No Exposure Certification will be granted under separate letter.

National Pollutant Discharge Elimination System application for exclusion from a Stormwater Permit based
on NO EXPOSURE:
Submission of this No Exposure Certification constitutes notification that your facility does not require a
permit for stormwater discharges associated with industrial activity in the State of North Carolina because
it qualifies for a no exposure exclusion. A condition of no exposure at an industrial facility means all
industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to
prevent exposure to rain, snow, snowmelt, and/or runoff.
For permitted facilities in North Carolina, DEMLR must approve your application for No
Exposure Certification before this exclusion is effective. Until you are issued a No
Exposure Certification and your NPDES permit is rescinded, your facility must continue
to abide by the terms and conditions of the current permit.
Industrial materials or activities include, but are not limited to: material handling equipment or activities,
industrial machinery, raw materials, intermediate products, by-products, final products, or waste products.
Material handling activities include the storage, loading and unloading, transportation, or conveyance of
any raw material, intermediate product, final product or waste product. A storm resistant shelter is not
required for the following industrial materials and activities: drums, barrels, tanks, and similar containers
that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed" means
banded or otherwise secured and with locked or non -operational taps or valves; adequately maintained
vehicles used in material handling; and final products, other than products that would be mobilized in
stormwater discharges (e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. Ir
addition, the exclusion from NPDES permitting is available on a facility -wide basis only —not for individual
outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not
eligible for the no exposure exclusion. By signing.and submitting this No Exposure Certification form, you
certify that a condition of no exposure exists at this facility or site and are obligated to comply with the
terms and conditions of 40 CFR 122.26(g).
If approved, your conditional no -exposure exclusion must be self re -certified at least annually.

I certify under penalty of law that I have read and understand the eligibility requirements for claiming a condition of "no
exposure" and obtaining an exclusion from NPDES stormwater permitting.
I certify under penalty of law that there are no discharges of stormwater contaminated by exposure to industrial activities
or materials from the industrial facility or site identified in this document (except as allowed under 40 CFR 122.26(g)(2)).
I understand that I am obligated to submit a no exposure certification form once every five (5) years to the North Carolina
Division of Water Quality and, if requested, to the operator of the local municipal separate storm sewer system (MS4) into
which the facility discharges (where applicable). I understand that I must allow the North Carolina Division of Water
Quality, or MS4 operator where the discharge is into the local MS4, to perform inspections to confirm the condition of no
exposure and to make such inspection reports publicly available upon request.
In the event that the site no longer qualifies for a No Exposure Exclusion, I understand that I must obtain coverage under
an NPDES permit prior to any point source discharge of stormwater from the facility. Additionally, I certify under penalty of
law that this document and all attachments were prepared under my direction or supervision in accordance with a system
designed to assure that qualified personnel properly gathered and evaluated the information submitted. Based on my
inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the
information, the information submitted is to the best of my knowledge and belief true, accurate and complete. l am aware
that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for
knowing violations.

Please note: This application for the No Exposure Exclusion is subject to approval by the
NCDENR Regional Office prior to issuance. The Regional Office may inspect your facility for
compliance with no exposure conditions prior to that approval. The Regional Office may also
inspect your facility at any time in the future for compliance with the No Exposure Exclusion.
North Carolina General Statute 143-215.6 B(i) provides that:
Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, or other
document filed or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false
statement of a material fact in a rulemaking proceeding or contested case under this Article; or who falsifies, tampers with, or knowingly
renders inaccurate any recording or monitoring device or method required to be operated or maintained under this Article or rules of the
[Environmental Management] Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine
not to exceed ten thousand dollars ($10,000).

In response to your renewal application for continued coverage under Stormwater General Permit
NCG 110000, the Division of Water Quality (DWQ) is forwarding herewith the reissued Certificate of Coverage
and stormwater General Permit. This permit is reissued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S.
Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.) The following
information is included with your permit package:
• A new Certificate of Coverage
• A copy of the stormwater General Permit
• A copy of a Technical Bulletin for the General Permit
• Copies of the Discharge Monitoring Report (DMR) Form
• Copies of the Annual Discharge Monitoring Report Form (if applicable)
• Copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to
stormwater discharge controls, management, monitoring, and record keeping. Please review the new permit to
familiarize yourself with all changes in the reissued permit. Significant changes to the General Permit are
outlined in the attached Technical Bulletin.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it relieve
the permittee from responsibility for compliance with any other applicable federal, state, or local law, rule,
standard, ordinance, order, judgment, or decree.

On September 18, 2012, a site inspection was conducted for the Cross Creek WRF located at 601 North Eastern
BLVD, Cumberland County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your
review. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as
Big Cross Creek, a Class C stream in the Cape River Basin. The site visit and file review revealed that the subject
facility is covered by NPDES Stormwater General Permit-NCG110000, Certificate of Coverage-NCG110015.
As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG110000
permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations
made during the inspection.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty

Payment of the required annual administering and compliance monitoring fee of $80.00 for this year has not
been received for the subject permit. This fee is required by Title 15 North Carolina Administrative Code 2H.0105, under
the authority of North Carolina General Statutes 143-215.3(a)(1), (1a) and (1 b). Because this fee was not fully paid within
30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 15 ncac 2H.0105(b) (2) (k)
(4), and G.S. 143-215.1 (b) (3).

Dear Mr. Ham:
This letter is in response to your November 5, 2002 letter concerning Notices of Violation (NOVs) issued to the
two above referenced facilities in October 2002 by the Division of Water Quality, These NOVs were issued by the
Division for failure to submit permit renewal roquests for these facilities. After review of your letter, consideration of the
issues raised there and the status of your facilities, we have made the decision to retract the previously issued NOVs for
both facilities.
As mentioned in your letter, the current permit indicates that covered facilities do not need to apply unless
directed to do so by the Division. In September of 2002 the Division sent letters to all facilities covered under the
NCG110000 general stormwater permit. These letters notified the facilities of their need to reapply for permit coverage
180 days prior to the expiation of the permit. NOVs were then issued to facilities that did not respond within the 180 day
time period. Your letter indicated that you did not receive the original letters for your facilities in September 2002 and we
are sorry for any confusion that this has created.
Please note that the new permit will have a modification, consistent with other general and individual permits, to
require that covered facilities request renewal 180 days prior to permit expiration. This change will assure adequate
continued coverage for facilities during the. renewal process.

This letter is in response to a recent inquiry made by Chad Ham concerning two Notices of Violation and
Revocation For Non Payment letters dated 12/8/2003 that had been received by PWC. Those notices, for permits
NCG110015 and NCG 110016 indicated that payment of the required annual administering and compliance
monitoring fee for 2003 had not been received by the Division of Water Quality (DWQ).
Based on the inquiries made by NIr. Ham, the information he provided and information provided to me by
the DWQ Central Office; I have determined that the subject notices were incorrectly issued and this letter serves as
retraction for both.

In response to your renewal application for continued coverage under the subject permit, the Division
of Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit
is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency
dated December 6, 1983.
The following information is included with your permit package:
■ A copy of the stormwater general permit.
■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
-permit.--This form must be completed and returned to the Division within 30 days of receipt of
this letter. DO NOT send the SPPP with the signed form.
■ Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program which outlines program components
and addresses frequently asked questions.
■ A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.
