Dear Mr. Hennessy:
We appreciate the Division's assistance with the Mud Creek Sewer Extension project. As you may
know this project will extend public sewer to Fletcher Academy and will allow for abandonment of
their wastewater treatment facility (Fletcher Academy WWTP NC0036641). Fletcher Academy has
been operating their wastewater treatment facility under a Special Order by Consent (EMC WQ 517-
006) until such time as they can connect to the new sewer extension.
Cane Creek Water and Sewer District/Henderson County is under contract with Buchanan and Sons to
complete the construction of the Mud Creek Sewer Extension. The contract was executed in 2018,
and the Contractor has been working on the project for since late 2018. There were some delays in
the contractor's ability to begin work in certain areas due to acquisition of easements and the
issuance of the required 404/401 permits for the project. The Corps would not issue the final permit
until all easements were in hand.
The contract, which included extensions in addition to the sewer line to Fletcher Academy, required
that the construction be completed in early December 2019. Several unforeseen conditions have
delayed this completion date. As you know, much of the sewer line route is located in the flood
fringe areas associated with Mud Creek. This area was inundated due to heavy rains and was
flooded for several weeks. The Contractor was able to move the construction operation further along
the route and out of the area that was inundated, but this certainly caused a delay. In addition to
delays related to weather, the Contractor has encountered significant rock along the route that has
to be excavated. This has impacted a roadway bore at North Rugby Road and two separate sections
of the sewer line construction.
I have attached correspondence from the Contractor outlining the items above and the associated
delay timelines. I have also attached their current schedule which projects a completion date of the
lineFletcher Academyof March 30, 2020. Asyou know this project has other components

beyond the sewer line to Fletcher Academy. Cane Creek has directed the Contractor to focus all
efforts on completing the sewer line to Fletcher Academy. All other sections of the project will be
delayed until the sewer line to Fletcher Academy has been completed and can be put into service.

Based on our review of the delay requests with Cane Creek, we believe these are reasonable
requests. The Contractor is on site working toward the completion of the project. They have
committed to provide additional resources to try and complete the projects as quickly as possible.
Along with this letter and the documentation referenced earlier, please find attached an executed
copy of the application for an amendment to a special order by consent and a check from Fletcher
Academy for the review fee. If you have any questions or need additional information, don't hesitate

II. SOC COMPLIANCE HISTORY:
Please attach a listing of all violations of the existing SOC. Include any violation of interim
dates,relaxed permit parameters, and existing permit limits.
III. ADDITIONAL FLOW OR REALLOCATION OF EXISTING FLOW:
Only facilities owned by a unit of government may request to add additional flow to the
treatment system as part of this SOC Amendment in accordance with NCGS 143-215.67(b).
Additional flow may be allowed under an SOC amendment only in specific circumstances.
These circumstances may include eliminating discharges that are not compliant with an NPDES
or Non-discharge permit as specified in the original SOC. These circumstances do not include
failure to perform proper maintenance on treatment systems, collection systems or disposal
systems. When requesting additional flow, the facility must include its justification and
supporting documentation. If the requested additional flow is non-domestic, the facility must be
able to demonstrate the ability to effectively treat the waste and dispose of residuals. The
applicant must provide a detailed analysis of all constituents in the proposed non-domestic
wastewater.
NPDES SOC Amendment Application
The total domestic additional flow requested: 0 gallons per day.
The total non-domestic additional flow requested: 0 gallons per day.
The total additional flow(sum of the above): 0 gallons per day.
If a reallocation of existing additional flow is needed the facility must provide justification as to
why this reallocation is needed.
Any additional flow that may be allowed will be determined by an analysis of projected adverse
impacts on the wastewater treatment facility and/or surface waters.
IV. WHY AN SOC AMENDMENT IS NEEDED:
Please provide a detailed explanation as to why the SOC amendment is being requested. Include
actions already taken to avoid noncompliance with the existing SOC. Also provide details on
activities that were delayed.
THE DIVISION WILL NOT ACCEPT THIS APPLICATION PACKAGE UNLESS ALL OF
THE APPLICABLE ITEMS ARE INCLUDED WITH THE SUBMITTAL.

a. The original, completed and appropriately executed application form, along with all
required attachments.
• If the SOC Amendment is for a City / Town, the person signing the SOC must be
a ranking elected official or other duly authorized employee.
• If the SOC Amendment is for a Corporation / Company / Industry / Other, the
person signing the SOC must be a principal executive officer of at least the level
of vice-president, or his duly authorized representative.
• If the SOC Amendment is for a School District, the person signing the SOC must
be the Superintendent of Schools or other duly authorized employee.

Carolina Administrative Code [T15A NCAC 2H.1206(a)(3)].

RE: Mud Creek Interceptor Project—Request for Time Extension
Dear Mr, Buie,
As you are aware,this winter has been extremely wet.Due to inclement weather,saturated conditions and
delays in approval of 401 and 404 permits,we have faced numerous obstacles in making progress on this
project. These issues have resulted in an overall delay of 92 days.
Therefore,BSI is requesting a time extension of 92 days to the Contract. This would result in a new Completion
Date of January 01,2020 for Lines A and C;and June 1,2020 for the remaining work.
Please let me know if you have any questions,or need to discuss this request in greater detail.

RE: Mud Creek Interceptor Project—Request for Time Extension#2
Dear Mr.Buie,
Please accept the following correspondence as a request for additional time for the Mud Creek Interceptor
project. As you are aware,competent rock has been encountered at the beginning of the project. The rock was
initially encountered as BSI mobilized a second crew to construct a roadway from station 10+00 to 16+00 to
help reduce the excavation depths for the sewer line installation. The proposed rock excavation was approved
during our 10/17/2019 meeting by Marcus Jones and the work was scheduled accordingly. Currently,the
drilling subcontractor is on-site and performing the required work.
I am including our updated schedule with this correspondence. As you will see,the rock that has been
encountered will affect project completion. In order to alleviate the impacts of this delay we have moved the
sewer line installation crew to start sewer installation at station 20+68,which correlates with manhole#4.
McAbee&Associates assisted with elevation control to ensure that grade accuracy is maintained since the line
is being placed at minimum grade. Based on the current schedule,the encountered rock has caused a delay of
10 days. BSI,respectfully requests that this time be added to the contract time.

Comments Buchanan and Sons have continued working on the Mud Creek Sewer Interceptor. (3/18/19)The installation
of the 12"sewer line has continued up to station 32+00.#57 stone is being used during pipe installation. (3/20/19) Rock has been
encountered at manhole#44. Test pits have determined the rock rapidly extends up to 6.5+/ feet deep in the trench location.
Buchanan and Sons is planning on blasting this area to help remove the rock. The creek crossing was temporarily repaired after
clearing was completed. Clearing has started on the other side of 1-26.

Comments Work on the Mud Creek Sewer extension has continued. Buchanan &Sons have started removing excess
soil in the sewer line right of way so that the sewer line installation depth is not to deep helping the installation go faster. During th-
soil removal a large amount of rock was uncovered. It seems explosives will be needed to remove the rock in the areas of
manhole#1 through to manhole#2. I have asked Buchanan&Sons to keep a good drill log to help track the depth of the rock.
