Based on your submittal and signed certification of no exposure at the above referenced facility, as well as observations made during a site visit conducted by Mike Lawyer with the Fayetteville Regional Office on August 18, 2009, the Division is granting your conditional exclusion from permitting as provided for under 40 CFR 126.22(g), which is incorporated by reference in North Carolina regulations. As discussed during the site visit, coverage under Stormwater General Permit NCG060000 is "...applicable to all owners or operators of stormwater point source discharges associated with activities classified as establishments primarily engaged in activities classified as Food and Kindred Products [standard industrial classification (SIC) 201, Tobacco Products (SIC 21), Soaps, Detergents and Cleaning Preparations; Perfumes, Cosmetics and Other Toilet Preparations (SIC 284), Drugs (SIC 283). and Public Warehousing and Storage (SIC 4221-4225). During the site visit, it was confirmed that the SIC code for the processing facility does fall into one of the above categories and that your facility has at least four outfalls that convey stormwater from the property. However, based on observations made at the time of the site visit, it was also determined that the facility could potentially qualify for the No Exposure Certification. Based on this information, I provided you with a copy of the Notice of Intent application form for coverage under the NCGO60000 general stormwater permit and have enclosed with this letter a copy of the application for No Exposure Certification. Our office requests that you submit the Notice of Intent form or application for No Exposure Certification within 30 calendar days from receipt of,this letter. Please be advised that continued operation of your facility without proper permit coverage or No Exposure Certification could result in the issuance of a Notice of Violation as well as the assessment of civil penalties of up to $25,000 per day, per violation. A condition of no exposure at an industrial facility means all industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to prevent exposure to rain, snow, snowmelt, and/or runoff. For permitted facilities in North Carolina, DWQ must approve your application for No Exposure Certification before this exclusion is effective. Until you are issued a No Exposure Certification and your NPDES permit is rescinded, your facility must continue to abide bythe terms and conditions of the current permit. Industrial materials or activities include, but are not limited to: material handling equipment or activities, industrial machinery, raw materials, intermediate products, by-products, final products, or waste products. Material handling activities include the storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is not required for the following industrial materials and activities: drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. `Seated" means banded or otherwise secured and with locked or non -operational taps or valves; adequately maintained vehicles used in material handling; and final products, other than products that would be mobilized in storm water discharges (e.g., rock salt).. A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is available on a facility -wide basis only —not for individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, you certify that a condition of no exposure exists at this facility or site and are obligated to comply with the terms and conditions of 40 CFR 122.26(g). (Peanut Processors, Inc.). Waste peanut hulls located behind the processing plant. There were trucks and a backhoe on site when I arrived loading the hulls for removal from the sight. 1 spoke with the driver of one of the trucks and Ile stated that they were in the process of hauling the hulls/shells to McGill I -Environmental in Sampson County for disposal. The waste shells covered close to 'Ws of an acre total. The odor was pretty bad and there was some black, stagnant water (leachate) adjacent to the drive way as well. I could not verify if any of the water was going off -site due to equipment lying adjacent to rile fence and the thickly vegetated area behind the fence. Mr. David Cox, plant manager, arrived and informed him that i was responding to a complaint about the peanut shells being dumped behind the plant and that it was alleged that this had been going oil for some time. Mr. Cox stated that this was not the typical method for managing the waste and that they were selling the shells to Carroll Farms out of Warsaw at one time but the buyer could not or had not been able to pick the shells up. Mr. Cox further stated that this was the only option he had at the time other than closing down his facility. I informed Mr. Cox that the shells are an industrial waste and that he should've taken them to the landfill or contact other facilities that could possibly use the shells in their compost process or even for boiler fuel if' possible. He stated that he had contacted McGill and would be sending, all of the shells to McGill and the site cleaned up with 10 clays of my visit. I informed Mr. Cox that he should also remove any soils that may have been impacted by the stagnant water (leachate) or the decomposition of the shells. He stated that he would take care of it.
