Sullins Dee Freeman Director Secretary May 14, 2010 Subject: Stormwater Monitoring Results American Circuits Inc., 513 West 24th Street Charlotte, INC 28206 No -Exposure Certification NCGNE0630 Mecklenburg County Enclosed are the monitoring results from the laboratory analyses performed on the discharge from the roof drain at the subject facility. The samples analyzed were grab samples collected during the sampling investigation performed on October 12, 2009, by Ron Eubanks of Charlotte -Mecklenburg Storm Water Services. This sampling investigation was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part 11 Section H. The enclosed monitoring results indicate that the stormwater discharged on October 12, 2009, had a pH of 5.17 SU and elevated concentrations of zinc and copper compared with the Division's benchmarks developed for individual stormwater permits (copper - 7 µglL, zinc - 67 µglL, and pH — 6.0 SU minimum). These values also exceed the applicable stream standards (copper - 7 µglL and zinc - 50 µg1L [toxic substances), and pH 6.0 - SU minimum). Since the stormwater sample was not collected in -stream, the stream standards do not apply; however, these standards can be used to indicate the potential of your runoff to impact the receiving stream. Please review your manufacturing processes to reduce the noted pollutants in the stormwater leaving your site. The sample was collected from the roof drain located on the side of the building adjacent to manufacturing area (see attached photos). The runoff from the parking lots was negligible during the first flush and no other samples were collected at the site during the October 12, 2009 storm event. When reviewing the No -Exposure Application from American Circuits it is dated 7/24/09. 1 do not believe we received a paper response to the NOV. When I look up NOV-2009-PC-0637 (Using the Query function in BIMS) it states in the Comments field next to 7/24/09 (Applied for No Exposure). I think either you or I had chatted with them and stated that applying for No Exposure would be an acceptable response to the NOV. Subject: RE: American Circuits industrial reports Ron, I had a question on the following comment you had in the American Circuits BIMS Checklist under "Permit and Outfalls". From the site inspection, stormwater runoff from the site discharges via sheet flow to Little Sugar Creek via the Charlotte storm sewer system. From my understanding of MS4s there should be a pipe that discharges the stormwater to surface waters so I don't think this would be considered sheet flow. Also if the facility does not have an outfall pipe but has its stormwater flow offsite through curb and gutter to the Charlotte MS4 this would be considered an outfall (even if the water just flows through a driveway or some other concentrator of flow). A condition of no exposure at an Industrial facility means all Industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to prevent exposure to rain, snow, snowmelt, and/or runoff. In addition, the exclusion from NPDES permitting Is available on a facility -wide basis only —not for Individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility Is not eligible for the no exposure exclusion. Business is listed on Charlotte Chamber's 3rd Quarter 2007 report. Activit I, Donna Cavaliere, spoke to Mr. Vic Gondha, President, on June 18, 2008. He stated that they do soldering and electronic circuit board manufacturing. He stated that they do not use any products which contain volatile organic compounds. I asked about the type of flux used and any machines located on site. He stated that they use an alcohol based flux and only have soldering irons, drilling, and routing machines. I asked if any of the machines were vented to the outdoor atmosphere. He said that they are not. I wanted to forward this question to you since the issue of driveways as "discrete conveyances" of stormwater is not addressed in your DRAFT Guidance that was circulated recently. It is my understanding from prior conversations between MRQ and yourself that driveways are considered point sources if they convey stormwater to the associated MS4 (or directly to a stream). This would make sense because the City of Charlotte is required by their Phase stormwater permit to inspect industrial facilities that discharge stormwater to their collection system - hence the need for the inspection. Also the County at their Motor Fleet Maintenance facility has noted one entrance/exit driveway as an outfall since it conveys stormwater from around the fueling islands off their property. After reviewing the Mecklenburg County GIS website, the aerial Ron provided, and the street pictures on Google Maps which allows you to do a 360 degree pan the American Circuits property has three driveways which as Ron notes conveys stormwater off site and into the Charlotte MS4 on the two adjoining streets. I would consider each an outfall. However, it appears the two at the front of the property convey stormwater from what appears to be employee parking and are therefore categorically excluded from the stormwater permit. The driveway at the back of the property would be the only one which would have industrial actives (i.e. shipping/receiving) so it would be covered under the stormwater permit and should be noted in the SPPP and monitored. Would you agree? 1 Also just so I am clear, we only use "sheet flow" to note flow of water over pervious surfaces such as grass, not impervious surfaces such as asphalt, correct? The separate issue of No Exposure would be handled by a site visit from MRO should they apply ( I would be interested in what exhausts through the building and onto the roof before making a determination). From the site inspection, it appeared that the majority of the stormwater runoff from the site discharges via sheet flow into the storm drain gutters located on Bancroft Street and W. 24th Street. There are stormwater inlets on Bancroft Street and W. 24th Street that are connected to the Charlotte storm sewer system, which discharge into Little Sugar Creek. From the inspection, it was confirmed that all manufacturing operations and storage areas are located inside the main building at the site. I apologize for the delay in completing my inspection reports; no excuses. I plan to complete the remaining reports by the end of the week and send to Erin Hall to review. The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is applicable to both the general permits and individual stormwater permits is the requirement to develop and implement site -specific comprehensive stormwater pollution prevention plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.
