Enclosed are the monitoring results from the laboratory analyses performed on the discharge from the roof
drain at the subject facility. The samples analyzed were grab samples collected during the sampling
investigation performed on October 12, 2009, by Ron Eubanks of Charlotte -Mecklenburg Storm Water
Services.
This sampling investigation was conducted as part of a cooperative working agreement between Mecklenburg
County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of
Charlotte in compliance with the City's NPDES Permit, NCS000240, Part 11 Section H.
The enclosed monitoring results indicate that the stormwater discharged on October 12, 2009, had a pH of
5.17 SU and elevated concentrations of zinc and copper compared with the Division's benchmarks developed for
individual stormwater permits (copper - 7 µglL, zinc - 67 µglL, and pH — 6.0 SU minimum). These values also
exceed the applicable stream standards (copper - 7 µglL and zinc - 50 µg1L [toxic substances), and pH 6.0 - SU
minimum). Since the stormwater sample was not collected in -stream, the stream standards do not apply; however,
these standards can be used to indicate the potential of your runoff to impact the receiving stream.
Please review your manufacturing processes to reduce the noted pollutants in the stormwater leaving your site.

From our conversation earlier today, please find attached the analytical results from the storm water sample collected
on October 12, 2009 at the American Circuits facility located at 513 West 24'h Street. The sample was collected from the
roof drain located on the side of the building adjacent to manufacturing area (see attached photos). The runoff from the
parking lots was negligible during the first flush and no other samples were collected at the site during the October 12,

I have a response date of 7/24/09 in my tracking sheet but cannot find a paper copy of a response. When
reviewing the No -Exposure Application from American Circuits it is dated 7/24/09. 1 do not believe we received
a paper response to the NOV. When I look up NOV-2009-PC-0637 (Using the Query function in BIMS) it
states in the Comments field next to 7/24/09 (Applied for No Exposure).
I think either you or I had chatted with them and stated that applying for No Exposure would be an acceptable
response to the NOV.

Ron,
I had a question on the following comment you had in the American Circuits BIMS Checklist under "Permit and
Outfalls".
From the site inspection, stormwater runoff from the site discharges via sheet flow to Little Sugar Creek via the
Charlotte storm sewer system.
From my understanding of MS4s there should be a pipe that discharges the stormwater to surface waters so I
don't think this would be considered sheet flow. Also if the facility does not have an outfall pipe but has its
stormwater flow offsite through curb and gutter to the Charlotte MS4 this would be considered an outfall (even
if the water just flows through a driveway or some other concentrator of flow).
Please give me some clarification on the outfall(s) at American Circuit based on my comments.

The Division has reviewed your submittal of the No -Exposure Certification form for Exclusion from NPDES Stormwater
Permitting. Based -on your submittal and signed certification of no exposure at the above referenced facility, the site visit
of August 19, 2009, the photo documentation of the revamped air compressor condensate collection, and a fo€low-up
with the Mecklenburg County Air Quality program the Division is granting your conditional exclusion from permitting as
provided for under 40 CFR 126.22(g), which is incorporated by reference in North Carolina regulations. We are also
hereby rescinding your current stormwater permit Certificate of Coverage, NCG030395.
Please note that by our acceptance of your no -exposure certification, you are obligated to maintain no -exposure
conditions at your facility. If conditions change such that your facility can no longer qualify for a no -exposure
exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge.
Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your conditional no -
exposure exclusion expires in five years (September 11, 2014). At that time you must re -certify with the Division, or
obtain NPDES permit coverage for any stormwater discharges from your facility.
Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental
permits that may be required under other federal, state, or local regulations or ordinances.

National Pollutant Discharge Elimination System application for exclusion from a Stormwater Permit based
on NO EXPOSURE:
Submission of this No Exposure Certification constitutes notification that your facility does not require a
permit for stormwater discharges associated with industrial activity in the State of North Carolina because
It qualifies for a no exposure exclusion. A condition of no exposure at an Industrial facility means all
Industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to
prevent exposure to rain, snow, snowmelt, and/or runoff.
For permitted facilities in North Carolina, DWQ must approve your application for No
Exposure Certification before this exclusion is effective. Until you are issued a No
Exposure Certification and your NPDES permit Is rescinded, your facility must continue
to abide by the terms and conditions of the current permit.
Industrial materials or activities Include, but are not limited to: material handling equipment or activities,
Industrial machinery, raw materials, Intermediate products, by-products, final products, or waste products.
Mlaterlal handling activities Include the storage, loading and unloading, transportation, or conveyance of
any raw material, Intermediate product, final product or waste product A storm resistant shelter Is not
required for the following industrial materials and activities: drums, barrels, tanks, and similar containers
that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed" means
banded or otherwise secured and with locked or non -operational taps or valves; adequately maintained
vehicles used In material handling; and final products, other than products that would be mobilized In
stormwater discharges (e.g., rock salt).
A No Exposure Certification must be provided for each facllfty qualltying for the no exposure exclusion. In
addition, the exclusion from NPDES permitting Is available on a facility -wide basis only —not for Individual
outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility Is not
eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, you
certify that a condition of no exposure exists at this facility or site and arse obligated to comply with the
terms and conditions of 40 CFR 122.26(g).
You are required to reapply for the No Exposure Exclusion once everyfive (51 vears.

exposure" and obtaining an exclusion from NPDES stormwater permitting.
I certify under penalty of law that there are no discharges of stormwater contaminated by exposure to industrial activities
or materials from the industrial facility or site identified in this document (except as allowed under 40 CIF t 22.26(g)(2)).
I understand that I am obligated to submit a no exposure certification form once every five (5) years to the North Carolina
Division of Water Quality and, if requested, to the operator of the local municipal separate storm sewer system (MS4) into
which the facility discharges (where applicable). I understand that I must allow the North Carolina Division of Water
Quality, or MS4 operator where the discharge is into the local MS4, to perform inspections to confirm the condition of no
exposure and to make such inspection reports publicly available upon request.
In the event that the site no longer qualifies for a No Exposure Exclusion, I understand that I must obtain coverage under
an NPDES permit prior to any point source discharge of stormwater from the facility. Additionally, I certify under penalty of

Submission of this No Exposure Certification constitutes notice that the entity identified in Section A does not require permit authorization for its storm water
discharges associated with industrial activity in the State identified in Section B under EPA's Storm Water Multi -Sector General Permit due to the existence
of a condition of no exposure.
A condition of no exposure. exists at an industrial facility when all industrial materials and activities are protected by a storm resistant shelter to prevent
exposure to rain, snow, snowmelt, and/or runoff. Industrial materials or activities include, but are not limited to, material handling equipment or activities,
industrial machinery, raw materials, Intermediate products, by=products, final products, or waste products. Material handling activities include the storage,
loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter Is
not required for the following Industrial materials and activities:
— drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed"
means banded or otherwise secured and without operational taps or,valves;
-- adequately maintained vehicles used in material handling; and
— final products, other than products that would be mobilized in storm water discharges (e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from N P DES. permitting is
available on a facility -wide basis only, not for individual outfalls. If any industrial activities or materials are or will be exposed to precipitation, the facility is
not eligible for the no exposure exclusion,

Obtaining and Maintaining the No Exposure Exclusion
This form is used to certify that a condition of no exposure exists at the
Industrial facility or site described herein. This certification is only applicable
in jurisdictions where EPA is the NPDES permitting authority and must be
re -submitted at least once every five years.
The Industrial facility operator must maintain a condition of no exposure at
its facility or site In order for the no exposure exclusion to remain applicable.
If conditions change resulting In the exposure of materials and activities to
storm water, the facility operator must obtain coverage under an NPDES
storm water permit immediately.

You must type or print, using uppercase letters, in appropriate areas only.

Section A. Facility Operator Information
1. Provide the legal name of the person, firm, public organization, or any
other entity that operates the facility or site described In this certification.
The name of the operator may or may not be the same as the name of
the facility. The operator is the legal entity that controls the facility's
operation, rather than the plant or site manager.
2. Provide the telephone number of the facility operator.
3. Provide the mailing address of the operator (RO. Box numbers may be
used). Include the city, state, and zip code. All correspondence will
be sent to this address.
4. Indicate whether the industrial facility is operated by a department or
agency of the Federal Government (see also Section 313 of the iean
Water Act).
5. Enter the latitude and longitude of the approximate center of the facility
or site In degrees/minutes/seconds. Latitude and longitude} can
be obtained from United States Geological Survey (USGS) quadrangle
or topographic maps, by calling 1-(888) ASK-USGS, or by accessing

Latitude and longitude for a facility in decimal form must be conYerted

I, Donna Cavaliere, spoke to Mr. Vic Gondha, President, on June 18, 2008. He stated that they do soldering and
electronic circuit board manufacturing. He stated that they do not use any products which contain volatile
organic compounds. I asked about the type of flux used and any machines located on site. He stated that they
use an alcohol based flux and only have soldering irons, drilling, and routing machines. I asked if any of the
machines were vented to the outdoor atmosphere. He said that they are not.
Because the facility does not emit any regulated air pollutants, they do not need an Air Quality permit.

Street) with Ms. Marcia Allocco (NCDENR - Division of Water Quality) earlier this week to determine if the facility met the
criteria for a No Exposure Certification for their NPDES Stormwater Permit. From the inspection, all manufacturing
operations are performed inside the main building. During the inspection, we inquired about emissions from the
manufacturing operations in the facility. Mr. Vic Gondha (American Circuits Inc.) indicated that the facility has been
inspected by the Mecklenburg County Air Quality Program, but he indicated that no air permits were required. I wanted to

Hope you are well and not as busy as Jen seems to be these days. I wanted to forward this question to you
since the issue of driveways as "discrete conveyances" of stormwater is not addressed in your DRAFT
Guidance that was circulated recently. It is my understanding from prior conversations between MRQ and
yourself that driveways are considered point sources if they convey stormwater to the associated MS4 (or
directly to a stream). This would make sense because the City of Charlotte is required by their Phase
stormwater permit to inspect industrial facilities that discharge stormwater to their collection system - hence the
need for the inspection. Also the County at their Motor Fleet Maintenance facility has noted one entrance/exit
driveway as an outfall since it conveys stormwater from around the fueling islands off their property.
After reviewing the Mecklenburg County GIS website, the aerial Ron provided, and the street pictures on
Google Maps which allows you to do a 360 degree pan the American Circuits property has three driveways
which as Ron notes conveys stormwater off site and into the Charlotte MS4 on the two adjoining streets.
I would consider each an outfall. However, it appears the two at the front of the property convey stormwater
from what appears to be employee parking and are therefore categorically excluded from the stormwater
permit. The driveway at the back of the property would be the only one which would have industrial actives
(i.e. shipping/receiving) so it would be covered under the stormwater permit and should be noted in the SPPP
and monitored.
Would you agree?

Also just so I am clear, we only use "sheet flow" to note flow of water over pervious surfaces such as grass, not
impervious surfaces such as asphalt, correct?
The separate issue of No Exposure would be handled by a site visit from MRO should they apply ( I would be
interested in what exhausts through the building and onto the roof before making a determination).

Please find attached a copy of the aerial photo and a site photo from the American Circuits inspection. The photo is taken
from the American Circuits property facing towards Bancroft Street. From the site inspection, it appeared that the majority
of the stormwater runoff from the site discharges via sheet flow into the storm drain gutters located on Bancroft Street and
W. 24th Street. There are stormwater inlets on Bancroft Street and W. 24th Street that are connected to the Charlotte
storm sewer system, which discharge into Little Sugar Creek. From the inspection, it was confirmed that all
manufacturing operations and storage areas are located inside the main building at the site. I apologize for the delay in
completing my inspection reports; no excuses. I plan to complete the remaining reports by the end of the week and send

had a question on the following comment you had in the American Circuits BIMS Checklist under "Permit and
Outfalls".
From the site inspection, stormwater runoff from the site discharges via sheet flow to Little Sugar Creek via the
Charlotte storm sewer system.

From my understanding of MS4s there should be a pipe that discharges the stormwater to surface waters so I
don't think this would be considered sheet flow. Also if the facility does not have an outfali pipe but has its
stormwater flow offsite through curb and gutter to the Charlotte MS4 this would be considered an butfall (even
if the water just flows through a driveway or some other concentrator of flow).
Please give me some clarification on the outfall(s) at American Circuit based on my comments.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.

required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
stormwater pollution prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.

forms, and a Notice of Intent [which is the application of for coverage under a NPDES General Stormwater
Permit] can be found at this web site.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. That said, please see
the above mentioned web site in order to obtain a copy of the permit such that you may fully comply with all the
conditions therein. Failure to properly comply with conditions of the permit, like those bulleted below,
constitutes violations and are subject civil penalty assessment of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point source discharge to surface water of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly-, however, most of the
permits have following condition requirements (you must read your entire permit to ensure full
compliance):

c Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on -site. The Permittee shall retain records of ail monitoring information,
including all calibration and maintenance records and all original strip chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of least 5 years for the date of the sample measurement, report or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to expiration date. Any permittee that has not requested renewal at
least 180 days prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested renewal at least 180 days prior to expiration, will be subject to
enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes required you to complete
a Name/ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
c Proper Operation and Maintenance is a requirement of the permit.

exposure" and obtain inglmaintaining an exclusion from NPDES stormwater permitting.
I certify under penalty of law that there are no discharges of stormwater contaminated by exposure to industrial activities
or materials from the industrial facility or site identified in this document (except as allowed under 40 CFR 122.26(g)(2)).
I understand that I am obligated to annually self re -certify No Exposure and, if requested, submit this re -certification to
DWQ or the operator of the local municipal separate storm sewer system (MS4) into which the facility discharges (where
applicable). I understand that I must allow the North Carolina Division of Water Quality, or MS4 operator where the

Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, of other
document filed or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false
statement of a material fact in a rulemaking proceeding or contested case under this Article; or who falsifies, tampers with, or knowingly
renders inaccurate any recording or monitoring device or method required to be operated or maintained under this Article or rules of the
[Environmental Management] Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine
not to exceed ten thousand dollars ($10,000).
