NCGNE w DOC TYPE fZ HISTORICAL FILE DOC DATE ❑ YYYYMMDD North Carolina Beverly Eaves Perdue Governor Mr. Vic Gondha, President American Circuits Inc. 513 West 24In Street Charlotte, NC 28206 Dear Mr. Gondha: • A. . NCDENR Department of Environment and Natural Resources Envision of Water Quality Coleen H. Sullins Dee Freeman Director Secretary May 14, 2010 Subject: Stormwater Monitoring Results American Circuits Inc., 513 West 24th Street Charlotte, INC 28206 No -Exposure Certification NCGNE0630 Mecklenburg County Enclosed are the monitoring results from the laboratory analyses performed on the discharge from the roof drain at the subject facility. The samples analyzed were grab samples collected during the sampling investigation performed on October 12, 2009, by Ron Eubanks of Charlotte -Mecklenburg Storm Water Services. This sampling investigation was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part 11 Section H. The enclosed monitoring results indicate that the stormwater discharged on October 12, 2009, had a pH of 5.17 SU and elevated concentrations of zinc and copper compared with the Division's benchmarks developed for individual stormwater permits (copper - 7 µglL, zinc - 67 µglL, and pH — 6.0 SU minimum). These values also exceed the applicable stream standards (copper - 7 µglL and zinc - 50 µg1L [toxic substances), and pH 6.0 - SU minimum). Since the stormwater sample was not collected in -stream, the stream standards do not apply; however, these standards can be used to indicate the potential of your runoff to impact the receiving stream. Please review your manufacturing processes to reduce the noted pollutants in the stormwater leaving your site. The enclosed results should be self-explanatory; however should you have any questions concerning the sampling results, please do not hesitate to contact Ron Eubanks with CMSWS or myself at (704) 235-2204. Subject: RE: American Circuits industrial reports Ron, I had a question on the following comment you had in the American Circuits BIMS Checklist under "Permit and Outfalls". From the site inspection, stormwater runoff from the site discharges via sheet flow to Little Sugar Creek via the Charlotte storm sewer system. From my understanding of MS4s there should be a pipe that discharges the stormwater to surface waters so I don't think this would be considered sheet flow. Also if the facility does not have an outfall pipe but has its stormwater flow offsite through curb and gutter to the Charlotte MS4 this would be considered an outfall (even if the water just flows through a driveway or some other concentrator of flow). Please give me some clarification on the outfall(s) at American Circuit based on my comments. Thanks, Marcia From: Hall, Erin R. Based -on your submittal and signed certification of no exposure at the above referenced facility, the site visit of August 19, 2009, the photo documentation of the revamped air compressor condensate collection, and a fo€low-up with the Mecklenburg County Air Quality program the Division is granting your conditional exclusion from permitting as provided for under 40 CFR 126.22(g), which is incorporated by reference in North Carolina regulations. We are also hereby rescinding your current stormwater permit Certificate of Coverage, NCG030395. Please note that by our acceptance of your no -exposure certification, you are obligated to maintain no -exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no -exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your conditional no - exposure exclusion expires in five years (September 11, 2014). At that time you must re -certify with the Division, or obtain NPDES permit coverage for any stormwater discharges from your facility. Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. A condition of no exposure at an Industrial facility means all Industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to prevent exposure to rain, snow, snowmelt, and/or runoff. For permitted facilities in North Carolina, DWQ must approve your application for No Exposure Certification before this exclusion is effective. Until you are issued a No Exposure Certification and your NPDES permit Is rescinded, your facility must continue to abide by the terms and conditions of the current permit. Industrial materials or activities Include, but are not limited to: material handling equipment or activities, Industrial machinery, raw materials, Intermediate products, by-products, final products, or waste products. Mlaterlal handling activities Include the storage, loading and unloading, transportation, or conveyance of any raw material, Intermediate product, final product or waste product A storm resistant shelter Is not required for the following industrial materials and activities: drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed" means banded or otherwise secured and with locked or non -operational taps or valves; adequately maintained vehicles used In material handling; and final products, other than products that would be mobilized In stormwater discharges (e.g., rock salt). A No Exposure Certification must be provided for each facllfty qualltying for the no exposure exclusion. In addition, the exclusion from NPDES permitting Is available on a facility -wide basis only —not for Individual outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility Is not eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, you certify that a condition of no exposure exists at this facility or site and arse obligated to comply with the terms and conditions of 40 CFR 122.26(g). You are required to reapply for the No Exposure Exclusion once everyfive (51 vears. For questions, please contact the DWQ Regional Office for your area. Latitude and longitude for a facility in decimal form must be conYerted to degrees (°), minutes ('), and seconds (") for proper entry on the certification form. To convert decimal latitude or longitrde to degrees/minutes/seoonds, follow the steps in the following example. Example: Convert decimal latitude 45.1234567 to degrees (°), minutes ('), and seconds ("). a) The numbers to the left of the decimal point are the degrees: 45°. b) To obtain minutes, multiply the first four numbers to the right of the decimal point by 0.006: 1234 x 0.006 = 7.404. c) The numbers to the left of the decimal point in the result ob arced in (b) are the minutes: 7'. r d) To obtain seconds, multiply the remaining three numberso the right of the decimal from the result obtained in (b) by 0.06: 404 x 0.06 = 24.24. Since the numbers to the right of the d cimal point are not used, the result is 24'. e) The conversion for 45.1234567 = 45" 7' 24". 6. Indicate whether the facility was previously covered under an N DES storm water permit. If so, include the permit number. 7. Enter the 4-digit SIC code which identifies the facility's primary activity, and second 4-digit SIC code identifying the facility's secondary activity, if applicable. SIC codes can be obtained from the Standard Industrial Classification Manual, 1987. 8. Enter the total size of the site associated with Industrial activity in i 1cres. Acreage may be determined by dividing square footage by 43,5 0, as demonstrated in the following example. Example: Convert 54,450 ft2 to acres Divide 54,450 ft2 by 43,560 square feet per acre: 54,450 112 - 43,560 112/acre = 1.25 acres. 9. Check "Yes" or "No" as appropriate to indicate whether you have paved or roofed over a formerly exposed, pervious area (i.e., lawn, me dow, dirt or gravel road/parking lot) In order to qualify for no exposure. Donna Cavaliere did the investigation, but I'm not sure that she was at the site. She will not be back to the office until 8/25. Please talk with her before you include air quality information in your report. Thank you. The following are the information I copied from our EPIC: Service Requested Review American Circuits @ 3525 Latrobe Drive, Charlotte for air permit applicability. Business is listed on Charlotte Chamber's 3rd Quarter 2007 report. Activit I, Donna Cavaliere, spoke to Mr. Vic Gondha, President, on June 18, 2008. He stated that they do soldering and electronic circuit board manufacturing. He stated that they do not use any products which contain volatile organic compounds. I asked about the type of flux used and any machines located on site. He stated that they use an alcohol based flux and only have soldering irons, drilling, and routing machines. I asked if any of the machines were vented to the outdoor atmosphere. He said that they are not. Because the facility does not emit any regulated air pollutants, they do not need an Air Quality permit. Subject: FW: American Circuits industrial reports Hi Joan, The Mecklenburg County Water Quality Program performed a site inspection at American Circuits Inc. (513 West 24th Street) with Ms. Marcia Allocco (NCDENR - Division of Water Quality) earlier this week to determine if the facility met the criteria for a No Exposure Certification for their NPDES Stormwater Permit. From the inspection, all manufacturing operations are performed inside the main building. During the inspection, we inquired about emissions from the manufacturing operations in the facility. Mr. Vic Gondha (American Circuits Inc.) indicated that the facility has been inspected by the Mecklenburg County Air Quality Program, but he indicated that no air permits were required. I wanted to verify this information with you, so we could include any air permitting information on their No Exposure Certification request to NCDENR-DWQ. Please send me an e-mail or contact me at (704) 336-5446 to discuss this matter at your convenience. Thank you. Have a great weekend! I wanted to forward this question to you since the issue of driveways as "discrete conveyances" of stormwater is not addressed in your DRAFT Guidance that was circulated recently. It is my understanding from prior conversations between MRQ and yourself that driveways are considered point sources if they convey stormwater to the associated MS4 (or directly to a stream). This would make sense because the City of Charlotte is required by their Phase stormwater permit to inspect industrial facilities that discharge stormwater to their collection system - hence the need for the inspection. Also the County at their Motor Fleet Maintenance facility has noted one entrance/exit driveway as an outfall since it conveys stormwater from around the fueling islands off their property. After reviewing the Mecklenburg County GIS website, the aerial Ron provided, and the street pictures on Google Maps which allows you to do a 360 degree pan the American Circuits property has three driveways which as Ron notes conveys stormwater off site and into the Charlotte MS4 on the two adjoining streets. I would consider each an outfall. However, it appears the two at the front of the property convey stormwater from what appears to be employee parking and are therefore categorically excluded from the stormwater permit. The driveway at the back of the property would be the only one which would have industrial actives (i.e. shipping/receiving) so it would be covered under the stormwater permit and should be noted in the SPPP and monitored. Would you agree? 1 Also just so I am clear, we only use "sheet flow" to note flow of water over pervious surfaces such as grass, not impervious surfaces such as asphalt, correct? The separate issue of No Exposure would be handled by a site visit from MRO should they apply ( I would be interested in what exhausts through the building and onto the roof before making a determination). Subject: RE: American Circuits industrial reports Hey Marcia, Please find attached a copy of the aerial photo and a site photo from the American Circuits inspection. The photo is taken from the American Circuits property facing towards Bancroft Street. From the site inspection, it appeared that the majority of the stormwater runoff from the site discharges via sheet flow into the storm drain gutters located on Bancroft Street and W. 24th Street. There are stormwater inlets on Bancroft Street and W. 24th Street that are connected to the Charlotte storm sewer system, which discharge into Little Sugar Creek. From the inspection, it was confirmed that all manufacturing operations and storage areas are located inside the main building at the site. I apologize for the delay in completing my inspection reports; no excuses. I plan to complete the remaining reports by the end of the week and send to Erin Hall to review. Subject: RE: American Circuits industrial reports Ron, had a question on the following comment you had in the American Circuits BIMS Checklist under "Permit and Outfalls". From the site inspection, stormwater runoff from the site discharges via sheet flow to Little Sugar Creek via the Charlotte storm sewer system. From my understanding of MS4s there should be a pipe that discharges the stormwater to surface waters so I don't think this would be considered sheet flow. Also if the facility does not have an outfali pipe but has its stormwater flow offsite through curb and gutter to the Charlotte MS4 this would be considered an butfall (even if the water just flows through a driveway or some other concentrator of flow). Please give me some clarification on the outfall(s) at American Circuit based on my comments. Thanks, Marcia From: Hall, Erin R. The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is applicable to both the general permits and individual stormwater permits is the requirement to develop and implement site -specific comprehensive stormwater pollution prevention plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge. Copies of the general permits and accompanying documents can be accessed from the following webpage: http://h2o,enr.state.nc.us/su/Forms Documents.htm Permit text, technical bulletins, discharge monitoring forms, and a Notice of Intent [which is the application of for coverage under a NPDES General Stormwater Permit] can be found at this web site. The following items are a subset of permit requirements and are listed to assist you and help bring your attention to certain permitting issues, process and condition requirements of your permit. That said, please see the above mentioned web site in order to obtain a copy of the permit such that you may fully comply with all the conditions therein. Failure to properly comply with conditions of the permit, like those bulleted below, constitutes violations and are subject civil penalty assessment of up to $25,000.00 per day. • Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit • All persons desiring to have facilities covered by a General Permit must register with the Division of Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees. • This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any discharge of stormwater associated with the industrial activity, process wastewater, and/or mine dewatering. • Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked. • Any other point source discharge to surface water of the state is prohibited unless it is an allowable non-stormwater discharge or is covered by another permit, authorization or approval. • There are currently 19 active general permits. Permit conditions vary accordingly-, however, most of the permits have following condition requirements (you must read your entire permit to ensure full compliance): o Development and compliance with the Stormwater Pollution Prevention Plan o Collection, reporting, and recording of Analytical Monitoring Mooresville Regional Office Location: 610 Past Center Ave., Suite 301 Mooresville, NC 28115 Phone: (704) 653-1699 i Fax: (704) 663-60401 Customer Service: 1-877-623-6748 Internet: mmi- crraterquality.arg An Equal Opportunity 1 Aifrmalive Ackn Em Icyer - 30% Recycledi70°a Post Consumer paper None rthCarolina ,/ aturally 141E Vic Gondha, American Circuits NOV-2009-PC-0637, Page 4 July 17, 2009 o Collection, reporting and recording of Qualitative Monitoring c Collection, reporting and recording of Vehicle Maintenance Monitoring c Records — Visual monitoring shall be documented and records maintained at the facility along with the Stormwater Pollution Prevention Plan. Governor Director August 16, 2010 Mr. Vic Gondha American Circuits Inc 513 W 24th St Charlotte, NC 28206 Subject: No -Exposure Certifica2 NCGNE0630 American Circuits Ir1' Mecklenburg County Dear Mr. Gondha: Dee Freeman Secretary . As a current holder of a No -Exposure Certification, please note the following important change to the Division's implementation of this program. The No -Exposure Certifications no longer will have an expiration_ date. Previously your no -exposure exclusion had to be re -certified with the Division every 5 years. This will no longer be required. Please disregard the expiration date on your original certification. However, in order to assure that your facility stays in compliance with all of the conditions in the no -exposure certification, you must'self re -certify your facility at least annually. Please see the attachment for information on self re-certi fGation.,r!e- rfYl If you are waiting for a response from the Division for a renewal 6ertification you already subm ed, please consider this letter the'Division's approval for renewing your No -Exposure exclusion" " Please note that this does not change your obligation to maintain no -exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no -exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. State statute provides for fines of up to $25,000 per dgy for un-permitted discharges. Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. If you have any questions or need further information, please contact your Regional Office, or Robert Patterson in the Stormwater Permitting Unit at (919) 807-6375, robert.patterson@ncdenr.gov.
