A condition of no exposure exists at an industrial facility when all industrial materials and activities are protected by a storm resistant shelter to prevent exposure to rain, snow, snowmelt, and/or runoff. Industrial materials or activities include, but are not limited to, material handling equipment or activities, industrial machinery, raw materials, intermediate products, by-products, final products, or waste products. Material handling activities include the storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. "Sealed" means banded or otherwise secured and without operational taps or valves; — adequately maintained vehicles used in material handling; and — final products, other than products that would be mobilized in storm water discharges (e.g., rock salt). A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is available on a facility -wide basis only, not for individual outfalls. If any industrial activities or materials are or will be exposed to precipitation, the facility is not eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, the entity in Section A is certifying that a condition of no exposure exists at its facility or site, and is obligated to comply with the terms and conditions of 40 CFR 122.26(g). (MCWQP) conducted an inspection of the subject facility. The inspection was conducted under authority granted by the Charlotte City Code; Chapter 18, Article II1, Section18-84. Mr. Steve Jadlocki, Charlotte Storm Water Services Attachment II Facility: Arjobex America Inspection Date: March 28, 2007 Purpose: The inspection was conducted as part of the Industrial Facilities Inspection Program as is required by the City of Charlotte Phase I Storm Water Permit. The purpose was to identify potential storm water pollution problems associated with this facility. Inspections are also conducted to review maintenance, storm water and training records to ensure the site is in compliance with all applicable Local, State and Federal Storm Water Regulations. Background: The Arjobex America complex is comprised of one building with mixed use office space, manufacturing and warehouse. There is also a wastewater pretreatment area, materials storage area and rail spur unloading area located on the property. Arjobex America manufactures a synthetic paper product called Polyarto. Polyart® is a high -density Polyethylene film 'Willi a matte clay coating on both sides. Mr. Dick Jalland is the Project Manager for Arjobex America's facility and handles environmental compliance concerns. Mr. Jalland conducted a brief facility tour that included manufacturing area, materials storage area, wastewater pretreatment area and rail spur delivery area. Records: A records review revealed the following: + Storm water runoff from the Arjobex America facility drains to Steele Creek, a Class C surface water in the Catawba River Basin. • The facility does not hold any storm water permits. • The facility has an active CMU Industrial Pre-treatment Permit and on -site wastewater treatment plant (WWTP). + MCWQP records revealed that there was a wastewater spill of approximately 1500 gallons from the pretreatment area on 11/30/04. Dick Jalland notified MCWQP when the spill occurred. A NOV was issued to Arjobex America for the release and subsequent clean up and repairs to high water alarm and equipment were made to correct the issue and prevent reoccurrence. Facility: Arjobex America Inspection Date: March 28, 2007 On -Site Inspection: The Arjobex America facility is situated on approximately 7 acres and is housed in one building. Outside of the building there is a WWTP, materials storage area, and railroad spur unloading area located on the property grounds. Storm water from the parking lot area drains to an open channel at the North East area of the property. All manufacturing activities occur inside the facility. There are floor drains in the facility around process equipment. All drains located in the facility discharge wastewater to the on -site WWTP. Wastewater consists mainly of municipal water, clay, and a small amount of ammonia. The outside material storage area contained totes of ammonia used in manufacturing process and flocculent used in WWTP. This area was bermed at the enterance and remaining three sides had retaining walls. There was also an above ground storage tank for ammonia contained within a sufficient secondary containment. The valves to both the containment areas were closed. The WWTP area was self contained inside retaining walls and there were also Boor drains that returned any run off to the WWTP system. The railroad spur delivery area is where polyethylene pellets are delivered by railcar. There was one storm drain located on the delivery pad. This storm drain was fitted with a screen to catch pellets that may be spilled during unloading process. The screen is inspected regularly and was in good working order. Conclusions/Recommendations: The Arjobex America facility appeared to be very clean and orderly. All manufacturing activities are contained within the building and there appeared to be minimal exposure of process material to storm water. The outdoor materials storage area and WWTP had sufficient secondary containment and drains that would catch spills and return wastewater to the WWTP. This facility is to be commended for their measures to minimize the potential for impacts to surface waters. Because of the minimal potential for material exposure to storm water at this facility, a storm water permit is not recommended.
