The Division has reviewed your submittal of the No -Exposure Certification for Exclusion from NPDES Stormwater
Permitting form. Based on your submittal and signed certification.of no exposure at the above referenced facility,
observations made during a site visit conducted by Mike Lawyer and Mark Brantley with the Fayetteville Regional Office
on July 8, 2009, and completion of work to address the lime storage area, the Division is granting your conditional
exclusion from permitting as provided for under 40 CFR 126.22(g), which is incorporated by reference in North Carolina
regulations. We are also hereby rescinding your current permit Certificate of Coverage, NCG110016.
Please note that by our acceptance of your No -Exposure Certification, you are obligated to maintain no -exposure
conditions at your facility. If conditions change such that your facility can no longer qualify for a no -exposure exclusion,
you are obligated to immediately obtain NPDES permit coverage for your Stormwater discharge. Otherwise, the discharge
becomes subject to enforcement as an un-permitted discharge. Your conditional no -exposure exclusion expires in five
years (November 8, 2014). At that time you must re -certify with the Division, or obtain NPDES permit coverage for any
stormwater discharges from your facility.
Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental
permits that may be required under other federal, state, or local regulations or ordinances.

Dear Mr. Lawyer:
This letter is in response to the correspondence you sent concerning the status of
the Rockfish Creek WRF's No Exposure Certification for Exclusion from NPDES
Permitting form. In order to eliminate the exposure concern found during your site
inspection, Taylor Grading and Utilities has been selected to perform the work identified
as being an acceptable remedial measure. A curb inlet will be installed between an
existing plant drain and the storm drain that is at risk for contamination. The new inlet
will drain back into the facilities head works structure. This work should be completed no
later than September 11, 2009, 1 will forward you photos of the new inlet installation and
a follow-up site visit would be welcomed if you deem necessary.

the Rockfish Creek WRF's No Exposure Certification application. If you have any

Your response should include a Plan of Action along with a reasonable time frame that you expect this matter to be
addressed. Once addressed, a follow-up site visit will be conducted for visual confirmation and further processing of your

Industrial materials or activities include, but are not limited to: material handling equipment or activities,
industrial machinery, raw materials, intermediate products, by-products, final products, or waste products.
Material handling activities include the storage, loading and unloading, transportation, or conveyance of
any raw material, intermediate product, final product or waste product. A storm resistant shelter is not
required for the following industrial materials and activities: drums, barrels, tanks, and similar containers
that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed" means
banded or otherwise secured and with locked or non -operational taps or valves; adequately maintained
vehicles used in material handling; and final products, other than products that would be mobilized in
stormwater discharges (e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In
addition, the exclusion from NPDES permitting is available on a facility -wide basis only —not for individual
outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not
eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, you
certify that a condition of no exposure exists at this facility or site and are obligated to comply with the
terms and conditions of 40 CFR 122.26(g).
You are required to reapply for the No Exposure Exclusion once every five (5) years.

exposure" and obtaining an exclusion from NIPDES stormwater permitting.
I certify under penalty of law that there are no discharges of stormwater contaminated by exposure to industrial activities
or materials from the industrial facility or site identified in this document (except as allowed under 40 CFR 122.26(g)(2)).
understand that I am obligated to submit a no exposure certification form once every five f5) years to the North Carolina
Division of Water (duality and, if requested, to the operator of the local municipal separate storm sewer system (MS4) into
which the facility discharges (where applicable). I understand that I must allow the North Carolina Division of Water
Quality, or MS4 operator where the discharge is into the local MS4, to perform inspections to confirm the condition of no
exposure and to make such inspection reports publicly available upon request.
In the event that the site no longer qualifies for a No Exposure Exclusion, I understand that I must obtain coverage under
an NPDES permit prior to any point source discharge of stormwater from the facility. Additionally, I certify under penalty of
law that this document and all attachments were prepared under my direction or supervision in accordance with a system
designed to assure that qualified personnel properly gathered and evaluated the information submitted. Based on my
inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the
information, the information submitted is to the best of my knowledge and belief true, accurate and complete. I am aware
that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for
knowing violations.

Please note: This application for the No Exposure Exclusion is subject to approval by the
NCDENR Regional Office prior to issuance. The Regional Office may inspect your facility for
compliance with no exposure conditions prior to that approval. The Regional Office may also
inspect your facility at any time in the future for compliance with the No Exposure Exclusion.
North Carolina General Statute 143-215.6 B(i) provides that:
Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, or other
document filed or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false
statement of a material fact in a rulemaking proceeding or contested case under this Article; or who falsifies, tampers with, or knowingly
renders inaccurate any recording or monitoring device or method required to be operated or maintained under this Article or rules of the
[Environmental Management] Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine
not to exceed ten thousand dollars ($10,000).

This letter is in response to a recent inquiry made by Chad Hani concerning two Notices of Violation and
Rcvocation For Non Payment letters dated.12/8/2003 that had been received by PWC. Those notices, for permits
NC(r 1 100 15 and NCG 110016 indicated that payment of the required annual administering and compliance
monitoring fee for 2003 had not been received by the Division of Water Quality (DWQ).
Based on the inquiries made by Mr. Ham, the information he provided and information provided to me by
the DWQ Central Office, I have determined that the subject notices were incorrectly issued and this letter serves as
retraction for both.

Payment of the required annual administering and compliance monitoring fee of $80.00 for this year has not
been received for the subject permit. This fee is required by Title 15 North Carolina Administrative Code 2H.0105, under
the authority of North Carolina General Statutes 143-215.3(a)(1), (1a) and (1b). Because this fee was not fully paid within
30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 15 ncac 2H.0105(b) (2) (k)
(4), and G.S. 143-215.1 (b) (3).
Effective 60 days from receipt of this notice, subject permit is hereby revoked unless the required Annual
Administering and Compliance Monitoring Fee is received within that time. Discharges without a permit are subject to the
enforcement authority of the Division of Water Quality. Your payment should be sent to:

This letter is in response to your November 5, 2002 letter concerning Notices of Violation (NOVs) issued to the
two above referenced facilities in October 2002 by the Division of Water Quality. These NOVs were issued by the
Division for failure to submit permit renewal requests for these facilities. After review of your letter, consideration of the
issues raised there and the status of your facilities, we have made the decision to retract the previously issued NOVs for
both facilities.
As mentioned in your letter, the current permit indicates that covered facilities do not need to apply unless
directed to do so by the Division. In September of 2002 the Division sent letters to all facilities covered under the
NCG110000 general stormwater permit. These letters notified the facilities of their need to reapply for permit coverage
180 days prior to the expiation of the permit. NOVs were then issued to facilities that did not respond within the 180 day
time period. Your letter indicated that you did not receive the original letters for your facilities in September 2002 and we
are sorry for any confusion that this has created.
Please note that the new permit will have a modification, consistent with other general and individual permits, to
require that covered facilities request renewal 180 days prior to permit expiration. This change will assure adequate
continued coverage for facilities during the renewal process.

and could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 11 categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facility industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and
regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the
Federal Water Pollution Control Act, as amended,

Rockfish Creek WRF

Cumberland County
to receiving waters designated as Rockfish Creek, class C, in the Cape Fear River Basin
in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts 1, II, Ill
and IV of General Permit No. NCG 110000 as attached.
This Certificate of Coverage shall become effective October 11, 1990.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
