Based on your submittal and signed certification.of no exposure at the above referenced facility, observations made during a site visit conducted by Mike Lawyer and Mark Brantley with the Fayetteville Regional Office on July 8, 2009, and completion of work to address the lime storage area, the Division is granting your conditional exclusion from permitting as provided for under 40 CFR 126.22(g), which is incorporated by reference in North Carolina regulations. We are also hereby rescinding your current permit Certificate of Coverage, NCG110016. Please note that by our acceptance of your No -Exposure Certification, you are obligated to maintain no -exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no -exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your Stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your conditional no -exposure exclusion expires in five years (November 8, 2014). At that time you must re -certify with the Division, or obtain NPDES permit coverage for any stormwater discharges from your facility. Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. In order to eliminate the exposure concern found during your site inspection, Taylor Grading and Utilities has been selected to perform the work identified as being an acceptable remedial measure. A curb inlet will be installed between an existing plant drain and the storm drain that is at risk for contamination. The new inlet will drain back into the facilities head works structure. This work should be completed no later than September 11, 2009, 1 will forward you photos of the new inlet installation and a follow-up site visit would be welcomed if you deem necessary. I would like to thank you for your recommendations and further consideration of the Rockfish Creek WRF's No Exposure Certification application. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion. These NOVs were issued by the Division for failure to submit permit renewal requests for these facilities. After review of your letter, consideration of the issues raised there and the status of your facilities, we have made the decision to retract the previously issued NOVs for both facilities. As mentioned in your letter, the current permit indicates that covered facilities do not need to apply unless directed to do so by the Division. In September of 2002 the Division sent letters to all facilities covered under the NCG110000 general stormwater permit. These letters notified the facilities of their need to reapply for permit coverage 180 days prior to the expiation of the permit. NOVs were then issued to facilities that did not respond within the 180 day time period. Your letter indicated that you did not receive the original letters for your facilities in September 2002 and we are sorry for any confusion that this has created. NCG110016 STORMWATER DISCHARGES NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the Federal Water Pollution Control Act, as amended, City of Fayetteville Public Works Commission is hereby authorized to discharge stormwater from a facility located at Rockfish Creek WRF State Road 2218 Fayetteville Cumberland County to receiving waters designated as Rockfish Creek, class C, in the Cape Fear River Basin in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts 1, II, Ill and IV of General Permit No. NCG 110000 as attached. This Certificate of Coverage shall become effective October 11, 1990. This Certificate of Coverage shall remain in effect for the duration of the General Permit. Signed this day October 11, 1996.
