A condition of no exposure exists at an industrial facility when all industrial materials and activities are protected by a storm resistant shelter to prevent exposure to rain, snow, snowmelt, and/or runoff. Industrial materials or activities include, but are not limited to, material handling equipment or activities, industrial machinery,. raw materials, intermediate products, by-products, final products, or waste products. Material handling activities include the storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is not required for the following industrial materials and activities: — drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed" means banded or otherwise secured and without operational taps or valves; — adequately maintained vehicles used in material handling; and — final products, other than products that would be mobilized in storm water discharges (o.g„ rock salt). A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is available on a facility -wide basis only, not for individual outfalls. If any industrial activities or materials are or will be exposed to precipitation, the facility is not eligible for the no exposure exclusion. I conducted some site visits at most of the National Guard facilities in our region that applied for No Exposure. My understanding in speaking with Mr. Tom Morris, Environmental Performance Assessment Manager with the National Guard, who met with me at each of the sites, is that they had tried some years ago to get a military exemption from permitting, but were denied per Bradley. So they applied for and received coverage under the NCG08 permit for Transit and Transportation since each facility is basically a meeting place for Guardsmen to be transported to Fort Bragg for trainings and they conducted vehicle maintenance. Since vehicle maintenance has ceased at each facility, they discussed with DWQ (not sure who specifically) the possibility of rescinding permit coverage altogether, but were again told that couldn't happen. So, they're pursuing the option of No Exposure Certification, which I feel based on my site visits is a viable option. Almost all of the facilities are similar in nature (building and parked military vehicles in fenced area with drip -pans underneath to catch any leakage and no longer performing vehicle maintenance). The facility in Clinton is slightly different in that it is a headquarters and has above ground storage tanks, which are double -walled. I would _relate the facilities to a shipping/warehousing terminal where there are vehicles parked outside, but all activities (in this case there are no activities) are conducted indoors and we have issued No Exposures to those facilities. would recommend proceeding with issuing No Exposure Certification for these facilities con anQent upon v ca Bradley, Can you confirm the information given by Mr. Morris regarding denial of military exemptions and permit rescission?
