The Division has reviewed your recent submittal (received by the. Division on December 3, 2010) of the No -
Exposure Certification form for Exclusion from NPDES Stormwater Permitting. Your submittal did not note
possession of an existing No -Exposure Certification, However, a file review found that the facility was
previously issued a No -Exposure Certification (NCGNE0222) on October 7, 2005: with an expiration date of
September 30, 2010,
In August 2010 the Division removed the expiration date from all active No-Expcsure Certifications. With
removal of the expiration dates for No -Exposure Certification, the Division instituted an annual self re-
certification program. Therefore, your current No -Exposure Certification (NCGNE0222) is still active and
your recently submitted No -Exposure application will be withdrawn.
Since your original No -Exposure Certification was issued without a site inspection the opportunity was taken
to conduct an inspection of the facility for No -Exposure conditions. On January 20, 2011, Ms. Marcia Allocco
and Ms. Donna Hood from the Mooresville Regional Office of the Division of Water Quality (DWQ)
conducted a site inspection of the Tufco Technologies, LLP facility located at 1205 Burris Road in Newton,
Catawba County, North Carolina. The site drains to an unnamed tributary to McLin Creek, Class C waters
located in the Catawba River Basin.
The inspection found that No -Exposure conditions exist at the site and Tufco Technologies, LLP is compliant
with their No -Exposure certification. However, a possible illicit discharge to the ground surface was noted in
the rear of the building from a drain in the maintenance shop. The drain was not actively discharging at the
time of the inspection but it was evident discharges had historically occurred from the erosion below the
drain pipe. Tufco Technologies personnel submitted photo documentation on February 7, 2011, noting the
closure of the drain pipe to prevent any future discharges.
Please use the enclosed self re -certification form to annually self re -certify your No -Exposure conditions at
the facility.

Inspection Summary:
The facility was visited through a new No -Exposure Certificaticn request. However, a file review fcund the permittee has
prior coverage under NCGNE0222.
From the Catawba County G15 system it was ascertained that the facility discharges to an unnamed tributary to McLin
Creek on 'the southwesterh side of the facility.
The facility has the following storage outside:
• One covered waste dumpster
A possible illicit wastewater discharge was noted on the rear of the facility from a drain in the maintenance shop. The
drain was not discharging at the time of the inspection although erosion under the discharge pipe indicates historical
discharges had occurred.
Facility personnel forwarded photo documentation of the closure of the drain on
February 7, 2011.

NPDES Storm Water Permitting
Submission of this No Exposure Certification constitutes notice that the entity identified in Section A does not require permit authorization for its storm water
discharges associated with industrial activity in the State identified in Section B under EPA's Storm Water Multi -Sector General Permit due to the existence
of a condition of no exposure.
A condition of no exposure exists at an industrial facility when all industrial materials and activities are protected by a storm resistant shelter to prevent
exposure to rain, snow, snowmelt, and/or runoff. Industrial materials or activities include, but are not limited to, material handling equipment or activities,
industrial machinery, raw materials, intermediate products, by-products, final products, or waste products. Material handling activities include the storage,
loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is
not required for the following industrial materials and activities:
— drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. 'Sealed"
means banded or otherwise secured and without operational taps or valves:
— adequately maintained vehicles used in material handling; and
— final products, other than products that would be mobilized in storm water discharges (e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is
available on a facility -wide basis only, not for individual outfalls. If any industrial activities or materials are or will be exposed to precipitation, the facility is
not eligible for the no exposure exclusion.
By signing and submitting this No Exposure Certification form, the entity in Section A is certifying that a condition of no exposure exists at its facility or site,
and is obligated to comply with the terms and conditions of 40 CFR i22.26(g).

allow the NPDES permitting authority, or MS4 operator where the discharge is into the local MS4, to perform inspections to confirm the condition of no
