In accordance with your request, Certificate of Coverage Number NCGNE0153 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the fixture you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. Sullins Director April 29, 2011 Natural Resources Subject: Compliance Evaluation Inspection No -Exposure Certification NCGNE0153 Oiles America Corporation at 4510 Enterprise Drive NW, Concord, NC 28057 Catawba County Dear Mr. Brickner: Dee Freeman Secretary You requested a technical assistance visit in conjunction with the recent issuance of your Certificate of Coverage under the North Carolina Industrial Stormwater permit for Metal Fabrication (NCG0300000). A file review prior to the visit found that Oiles America Corporation also held an active No -Exposure Certification. Since permittees are required to have either coverage under a general stormwater permit or a No -Exposure Certification a site inspection was conducted on April 28, 2011, to determine which coverage was appropriate. The site drains to an unnamed tributary to Afton Run, Class C waters, located in the Yadkin -Pee Dee River Basin. The inspection found that No -Exposure conditions do not exist at the site and Oiles America Corporation is non- compliant with No -Exposure certification NCGNE0153 as noted in the enclosed inspection report. Since you already have coverage under Industrial Stormwater permit NCG030000 the Division is requiring that Oiles America Corporation rescind No -Exposure Certification NCGNE0153, Please complete the enclosed Rescission Request and submit it to the address noted on the form. A file review before the site visit found that the facility currently held a No -Exposure Certification — NCGNE0153 (issued 4/29/05) in addition to COC NCG030602 From the Cabarrus County GIS system it was ascertained that the facility discharges to an unnamed tributary to Afton Run on the north side of the facility. A walk through of the facility found the following exposure of industrial activities outside • Multiple uncovered waste dumpsters (general waste, scrap metal, wood, etc.) These sources of exposure from industrial activities would prevent continued coverage under a No -Exposure Certification. The permlttee should rescind NCGNE0153 since coverage has been obtained under NCG030000 - general stormwater permit for metal fabrication. Misc Is the facility compliant? Comment: Facility does not qualify for No -Exposure Certification due to exposure of wastes to stormwater in the open -topped waste dumpsters (general garbage, wood, scrap metal, etc.). We apologize for the extended period it has taken us to get back to you on this request and we appreciate your patience as we have worked through this process. Based on your submittal and signed certification of no exposure at the above referenced facility the Division is granting your certification as provided for under 40 CFR 126.22(g) which is incorporated by reference in North Carolina regulations. Please note that by our acceptance of your no exposure certification, you are obligated to maintain no exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no - exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your conditional no -exposure exclusion expires in five years (April 30, 2010). At that time you must re -certify with the Division, or obtain NPDES permit coverage for any stormwater discharges from your facility. Your certification of no exposure does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances.
