Hamilton, Executive Director i MEMORANDUM TO: Monte Matthews, USACOE Raleigh Regulatory Field Office FROM: Ron Linville, Regional Coordinator Habitat Conservation Program DATE: August 17, 2007 SUBJECT: North Carolina Department of Transportation (NCDOT) Pipe Addition/Permit Modification, SRI 127, Shawnee Road, Unnamed Tributary Shawneehaw Creek (Class C, Trout), Watauga County NCDOT proposes to install an additional CMP as they grade, drain, base, and pave SRI 127. Biologists with the North Carolina Wildlife Resources Commission are familiar with habitat values in the area. These comments are provided in accordance with the provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the North Carolina Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25). Previous permits have been issued for the bulk of this project. Total new stream impacts will be 30 linear feet. A temporary dewatering process will allow the project to be accomplished in the dry. Rainbow, brown and some brook trout are present throughout the project area. The Green floater, Lasmigona subviridis (NCE, FSC) has been documented for portions of the Watauga River drainage. The Beech Creek Bog, a NC Parks Natural Area is located along portions of Shawnee Road. Based on our review of the submittal and our knowledge of the area, we will not object to the project as proposed providing the following conditions are followed and properly implemented: 1. Instream work and land disturbance within the 25-foot wide buffer zone are prohibited during the brown and brook trout spawning season of October 15 through April 15 to protect the egg and fry stages of trout from off-site sedimentation during construction. Culverts 48" diameter or larger should be buried a foot into the streambed. Culverts less than 48" diameter should be buried to a depth equal to or greater than 20% their size to allow for aquatic life passage. These measurements must be based on natural thalweg depths. All waters must flow through without freefalling or damming on either end during low flow conditions to maintain aquatic life and/or fish passage. Any riprap used must be installed so as not to interfere with aquatic life movement during low flows. 3. The dimension, pattern, and profile of the stream above and below the pipe should not be modified by widening the stream channel or reducing the depth of the stream. Floodplains and streams associated with the road project should be maintained and/or restored to natural geomorphic conditions. 4. If concrete will be used, work must be accomplished so that wet concrete does not contact stream water. 5. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. Heavy equipment should be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce release of petroleum pollutants to waters. 6. Temporary or permanent herbaceous vegetation should be planted on all bare soil within five (5) days of ground disturbing activities in the twenty-five (25) foot trout buffer to provide long-term erosion control. We encourage NCDOT to utilize onsite vegetation and materials for streambank stabilization when practicable. Dear Mr. Willis: This letter is in response to a conceptual mitigation plan for the above referenced project proposed verbally by NCDOT. NCDOT has asked DCM to provide written assurance that the proposed mitigation activities will result in surplus CAMA coastal wetland enhancement credits over and above what was required by the original of CAMA Permit No. 100-04. DCM has not yet received a proposed written mitigation plan for the proposed activities. However, based upon verbal communication, it is DCM's understanding that NCDOT is considering the following mitigation activities: (1) purchase privately owned lands on the south side and immediately adjacent to the driveway that goes from US 264 to the Wildlife Resources Commission boat ramp within the project area; (2) install 3 additional pipes, for a total of 6, underneath the above referenced driveway; (3) spray the existing Phragmites within the subject wetlands with chemicals; and (4) modify the existing ditch within the subject wetlands as appropriate. All of the above activities would be conducted after receiving an approved mitigation plan and any other necessary approvals from the U.S. Army Corps of Engineers, N.C. Division of Water Quality and N.C. Division of Coastal Management. DCM appreciates NCDOT's proactive mitigation efforts on this project, and we believe that the proposed mitigation activities are likely to result in surplus CAMA coastal wetland enhancement credits over and above what was required by the original of CAMA Permit No. 100-04. These features were evaluated for applicability to the mitigation rules [15A NCAC 2H .0506(h)]. The map of the corridor was provided in the jurisdictional verification package received by this office on July 6, 2007 and jurisdictional features are approximated on this map. _ -llLith--the e ptkm of Wetland-2: all-wetaands-and-streams- ithin--the-prefect-corridor were-evaltra It was determined that all wetland delineations reviewed were accurate. It was also determined that all stream calls, with the exception of Stream 2.3 were accurate. Stream 2.3 was re-evaluated and determined to be a perennial stream. Based on the site reviews of the jurisdictional determinations made by The Catena Group, DWQ will consider all sites identified in the revised jurisdictional verification package as accurate (package revised 07/12/07 for Stream 2.3). This letter only addresses the applicability to the mitigation rules and does not approve any activity within buffers, Waters of the United States, or Waters of the State. Any impacts to wetlands, streams and buffers must comply with 404/401 regulations, water supply regulations (15A NCAC 2B .0216), applicable buffer rules, and any other required federal, state and local regulations. Please be aware that even if no direct impacts are proposed to any protected buffers, sheet flow of all new stormwater runoff as per 15A NCAC 2B.0250 is required. Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local Authority that a surface water exists and that it is subject to the mitigation rules may request a determination by the Director. A request for a determination by the Director shall be referred to the Director in writing c/o John Hennessy, DWQ 401 Transportation Permitting Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650. Individuals that dispute a determination by the DWQ or Delegated Local Authority that "exempts" a surface water from the mitigation rules may ask for an adjudicatory hearing. Applicants are hereby notified that the 60-day statutory appeal time does not start until the affected party (including downstream and adjacent landowners) is notified of this decision. P ............... ......................... 3 RESULTS Results of the August 2000 survey are included in the following table. The results. of the August 1994 and June 1996 surveys are also included in the table for comparison. Sample locations depicted in Figure 1. Two SAV species were identified during the course of the survey: A. Tapegrass (Vallisneria americana) B. Horned pondweed (Zannichellia palustris) The tapegrass averaged 1-2 feet in height, while the horned pondweed was no more than eight to ten inches high. During the August 2000 survey, water salinity was. 2.8 ppt and secchi depth was four feet. The June 1996 survey identified coontail (Ceratophyllum demersum) in addition to the two species above, but only in Lawson Creek. No SAV's were found at the Lawson Creek site (site 1) during the August 2000 survey at the bridge location, nor were any SAV's seen within 100 feet up or down the shoreline from the bridge. The August 1994 survey identified tpegrass and either coontail or horned pondweed, which were misidentified as eelgrass (Zostera sp.) and milfoil (Myriophyllum sp.). Areal. coverage of the SAV's, as determined from the 1996 and 2000 surveys, is presented in Table 1. Areal coverage in 1994 was 2.26 ac (minus Scott's Creek data), in 1996 coverage was 2.02 ac, and in 2000 coverage was 0.82 ac. The results of the 2000 survey reveal that there is a 1.2 ac (0.49 ha) reduction in SAV coverage from the 1996 survey. However, the 2000 survey did indicate that the tpegrass community remains relatively stable, with a slight increase in areal. coverage. Possible explanations for the reduction in overall SAV coverage include: • affects from project construction, • negative affects from recent/frequent hurricane activity, (habitat displacement from the affects of high water scouring, or sedimentation), • reduced water clarity, and/or, • . the horned pondweed may have naturally experienced a late season decline. It should be noted that horned pondweed, in the vicinity of New Bern, was observed to be extremely sparse or absent.
