We have identified our source of exposure as the facilities' dumpsters which contain scrap parts, and trash. To eliminate the source of exposure we have installed canopies over the dumpsters, which will prevent storm water from being contaminated by contact with raw materials. Sullins, Director Division of Water Quality The National Pollutant Discharge Elimination System (NPDES) program was established under the federal Clean Water Act and then delegated to the Division of Water Quality (DWQ) for implementation in North Carolina. Industrial facilities that fall into one of ten subject categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. Recently Mr. Brian Crutchfield of Southland Associates contacted this Office inquiring about stormwater permitting at your Mooresville North Carolina facility. Mr. Crutchfield stated that this facility provides engineering services under Standard Industrial Classification (SIC) code 8711. SIC code 8711 does not trigger a requirement to obtain a permit under any of the 19 active general stormwater permits. In addition, Mr. Crutchfield described a 40,000-gallon testing tank on site that has or may contain various liquids include water, a clay/water slurry, and slightly alkaline water. Please ensure that any liquids other than pure water contained within the testing tank are properly disposed of in conjunction with federal, state, and local laws and regulations including any pre- treatment requirements for the Town of Mooresville POTW and the future Town of Mooresville Phase II Stormwater permit. If the Division of Water Quality determines, at some point in the future, that the NuVision Engineering facility is contributing a significant amount of pollutants to waters of the State the Division can require your facility to obtain an individual stonnwater permit. The Regional Office may inspect your facility for compliance with no exposure conditions prior to that approval. The Regional Office may also inspect your facility at any time in the future for compliance with the No Exposure Exclusion.
