On October 10, 2019, Paul Wojoski of DWR, conducted an on -site determination to review the features labeled as "Stream B" an unnamed tributary to Little Creek, and "C/Pond 1", for applicability to the Neuse River Riparian Area Protection Rules 15A NCAC 02B .0233. During the review, Mr. Wojoski evaluated "Feature B" using the DWR Stream Classification Form and "C/Pond 1". The results are below and photographs of these locations are attached. Salisbury Street Raleigh, NC 27604 Re: Appeal Request for Riparian Buffer Determination Baker Estate (10133 Old Stage Road) Wake County, NC RRO #19-178 Dear Ms. Higgins and Mr. Wojoski: On June 14, 2019 Ms. Erin Deck of the North Carolina Division of Water Resources (NCDWR) conducted a buffer determination on the Baker Estate property located at 10133 Old Stage Road in Wake County, NC. Ms. Deck determined that two streams and the upper portion of a pond were subject to the riparian buffers (15A NCAC 2B .0233), however at the time of the evaluation Ms. Deck was not able to access the adjacent property downgradient of the pond to determine if a stream exists that drains from the pond. Ms. Deck's findings are reflected in the attached copy of the Buffer Determination Letter (RRO #19-178) dated August 01, 2019. The current property owners asked that Sage Ecological Services, Inc. (Sage) review the property and act on their behalf in requesting an appeal of the determination if necessary. Sage has reviewed the drainage below the pond and does not believe that it contains a stream and does not believe that the pond is buffered.
