In response to your renewal application for continued coverage under stormwater General Permit NCG210000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit has been reissued pursuant to
the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Stormwater Permit NCG210000
• A copy of the Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of Stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit.
The more significant changes to the General Permit include the following:
• Permit cover page, second paragraph — The General Permit now may cover activities that DWQ determines to be similar in
either the process, or in the exposed materials, to the Timber Products Industry.
• Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL,
may not be eligible for continued coverage at the next renewal of the General Permit.
• Part I Section B second paragraph — A new clarification that the permit does not authorize discharges that DWQ determines
are wastewaters.
• Part 11 Section A — The required contents of the Stormwater Pollution Prevention Plan have been expanded and clarified.
• Part 11 Section B Table 1 — A new requirement to sample stormwater discharges twice per year for those facilities with
exposed piles of certain materials remaining on site longer than seven days.
• Part 11 Section B Tables 2 and 3 and following — For permittees with exposed piles, there are new provisions requiring the
permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the
second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring
instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences.
• Part 11 Section B — For permittees with exposed piles, a new provision that four exceedences of any particular benchmark
will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct
the permittee to apply for an individual permit, or may direct the implementation or installation of specific Stormwater control
measures.
• Part II Section C — Clarification that under the qualitative monitoring provisions of the permit, the permittee is obligated to
respond to repeated observations of stormwater pollution. DWQ may impose additional stormwater management
requirements if the permittee is non -responsive, or if the responses are ineffective.
Your coverage under the General Permit is transferable only through the specific action of DWQ.

On November 6, 2007, the Division of Water Quality received your application for
an individual NPDES stormwater discharge permit. The submittal included a
transmittal letter, a check for $860, and three copies each of: EPA Form 1, EPA
Form 2F, EPA Form 2E, a site location map, and two site drainage drawings. We
have completed our initial screening review and we are returning the submittal
unprocessed.
Please note:
1. Based on our recent telephone conversation, it is now clear to us that you
submitted EPA Form 2E for wastewater condensate flows so that those flows
could be combined into a single individual stormwater permit. Note that a
stormwater permit (whether a general permit or an individual permit) issued
by DWQ's Stormwater Permitting Unit would only authorize the discharge of
those flows that we determine are stormwaters, not wastewaters. Aren't
these flows already permitted under your Certificate of Coverage
NCG500348?
2. We now understand that you are requesting that DWQ rescind your
coverage under NCG210000, and subsequently issue a new individual
stormwater permit, based on your understanding of verbal comments from
either your consultant or DWQ personnel during discussions around the
Settlement Agreement. DWQ's process for the renewal of your coverage
under your stormwater General Permit Certificate of Coverage NCG210301
has already begun, and it is not necessary for you to apply for an individual
permit.

3. However, if your intent is still to request rescission of NCG210301, and to
apply for a new individual permit, then we need additional information on
the two site drainage drawings. Specifically:
a. The site drainage drawings should show topographic contours rather
than flow arrows so that we can confirm for ourselves the direction of
surface flows. Typically a recent topographic and physical features
survey is necessary to present sufficient information.
b. The site drainage drawings should show the location of the surface
irrigation system permitted under WQ0028749.
c. The site drainage drawings should show the location of the
wastewater recycle system proposed under WQ0031170. What is the
time frame for installation of this system?
d. The site drainage drawings should show the location of all curbs,
ditches, storm sewers, inlets, berms, swales, etc. intended to control,
direct, and convey stormwater on the site.
e. Now that there has been some rain since your November submittal,
we would expect that you will be able to resubmit the application with
the missing information required in Section VII of EPA Form 2F.
4. Your letter reports, "We are applying for an individual National Pollutant
Discharge Elimination System (NPDES) permit in order to more specifically
monitor these stormwaters." We are confused about your intent, since you
could easily incorporate an expanded monitoring regimen without being
compelled by a specific permit condition. Please clarify for us if you decide
to re -submit an individual application.
If you intend to resubmit for an individual permit authorizing the discharge of
stormwaters only, please ask your consultant to contact me to review the specifics
of a sufficient application and a sufficient site drainage plan.
