On April 24, 2009, and April 28, 2009, staff from the Mecklenburg County Water Quality Program
(MCWQP) conducted site inspections of the Southern Resources property at 3826 Raleigh Street in
Charlotte, NC. The site inspections by MCWQP staff were completed as part of a cooperative
agreement between Mecklenburg County and the Division of Water Quality. As a result of the site _
inspections this Office issued a Notice of Violation and Recommendation for Enforcement
(NOV/NRE) on May 28; 2009, for the discharge of hydraulic oil and the operation of a facility without
a General Stormwater permit.
The \TOV/NRE requested a response that was to include a report of the cause, significance; and extent
of the hydraulic oil release; a clean-up plan of the affected areas; a consultation with MCWQP
regarding the backfilling of any excavated areas; the disposal location of removed materials; a plan to
prevent future releases; an explanation of why the scrap metal facility was operating with a General
Stormwater permit; and submittal of an application form (Notice of Intent) for Coverage under the
Division's Scrap Metal General Stormwater permit, NCG20000.
You provided a response to the NOVINRE letter on June 11, 2009, and coordinated with Ms. Heather
Sorensen of MCWQP in the hydraulic oil release clean-up and disposal of contaminated soils. In
addition, you applied for and received coverage under Stormwater General Permit NCG200000 and
were issued Certificate of Coverage NCG200461. On August 19, 2009, a site review was completed
by Ms. Sorensen of MC' VQP. Ms. Marcia Allocco of this Office, and Mr. Craig Miller of the City of
Charlotte Stormwater Program. During the site visit analytical data was reviewed and subsequently
forwarded to the Division of Waste Management Underground Storage Tank Unit (DWMUST) for
approval of -the disposal of the contaminated soils. During the week of August 3 1, 2009, the Division
of Water Quality learned that your documentation was reviewed and approved and that separate
closure documentation would be issued by DWMUST.

Therefore, as of the date of this letter you have fulfilled the requirements set out in our May 28, 2009,
NOV/NRE letter and we consider this matter closed. Further, the Division of Water Quality has
decided not to take an enforcement action against Elan Trading, Inc. for violations noted in the
NOV/NRE letter.
It is our understanding that you will continue to work with Ms. Sorensen of MCWQP as you develop
the Stormwater Pollution Prevention Plan required by General Stormwater permit NCG200000 and
conduct your required monitoring of stormwater discharges from your site. We appreciate your
prompt attention to the violations which we discovered at your facility and encourage you to contact
our Office at (704) 663- 1699 if you have any questions regarding your Certificate of Coverage under
the General Stormwater permit.

This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October
15, 2007 (or as.subsequentty amended).
Please take. notice that this certificate of coverage is not transferable except after -notice to the Division
of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the
certificate of coverage. This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or -permits required by the Division of Land Resources; Coastal.Area
Management Act or any other federal, or local governmental permit that may be required.
Please note that the attached.permit expires on June, 30; 2009.buthas been temporarily extended
through 12f31 /2009.. Your COC will be automatically renewed to cover the €utl 5.year term of the soon to be
reissued permit. In the interim you must abide by the terms of the expiring permit. You can. review the proposed
