Thanks for the heads -up regarding the fecal coliform monitoring, we appreciate you taking a look into this benchmark. I have some clarifying questions, which may or may not be covered in the up -coming letter from your office. Since this benchmark already has a semi-annual monitoring frequency (we were performing monthly monitoring as required for our Tier 2 response), how is this frequency "reduction" that you provide below any different from our existing permit? Are we being relieved of any future Tier 1 and Tier 2 responses for fecal coliform? Can you please shed some light on this? As for your question regarding the source of the COD, we have no absolute answer at this time, however, our analyses indicate the fertilizer used by our landscaper is a contributor to our COD levels. We have also identified issues with the slope drain tiles which were installed to drain storm water off the top of the landfill into the sediment basin while preventing erosion of the slopes. Over the years, the entrances to the drain tiles have become buried and so they are acting more like a leach line than a drain tile. Since the water isn't being drained through the tile, we are seeing signs of erosion on the slopes. In early April as soon as weather permits, work will begin in preparation for the permitted landfill expansion project. Part of that preparatory work includes improved storm water management via a reconstructed sediment basin and weir. We will uncover the slope drain tile entrances and we will improve the storm water conveyance and maintenance at both outfalls. As the growing season commences, we will also be examining "greener" alternatives to the past site fertilization and cover vegetation maintenance practices. Currently, monthly Fecal Coliform sampling is required in response to two consecutive benchmark exceedences. , Our office concurs that the Energizer landfill. as a single source landfill for scrap batteries; is not a source of the Fecal Coliform levels detected in samples. Therefore, your request to reduce the sample frequency for Fecal Coliform is granted for both Oufall 9 1 and Outfall 4 2. Please note that Energizer Battery must continue semi-annual Fecal Coliform monitoring at both outfails per Section B of the permit. You will not, however. be required to institute more frequent monitoring for any future benchmark exceedences of Fecal Coliform. The tiered response requirements for TSS and COD still apply. Pyramid Environmental Inc. was retained to perform the required stormwater sampling, which was conducted on January 21, 20I0. The location of our site is shown on the maps in Attachment A. A qualitative monitoring report for both outfalls describing the visual appearance of the stormwater run-off at the time of the sampling event is presented in Attachment B. Laboratory results are presented in Table 1, Attachment C. The completed monitoring report is included as Attachment D. Outfall # 1 and Outfall #2 require a Tier Two Response of monthly monitoring per Part II Section B of General Permit No. NCG 120000. The results of the 1/21/10 sampling conclude Outfall #1 and Outfall #2 continue to be in exceedence for COD. Our Corrective Action Plan to reduce COD levels is as follows: a) Improve stormwater conveyance at both outfalls, b) Implement better stormwater maintenance at both outfalls, and c) Determine and correct the root cause. Items a) and b) will be implemented as soon as the weather permits. Our investigation into the root cause is on -going. We will continue to monitor and report stormwater COD levels at both outfalls on a monthly basis per Section I1 Section B ol' General Permit No. NCG 120000. Outfall #1 has been in exceedence three ()) times for Fecal Coliform under the existing permit and Energizer has initiated monthly stormwater monitoring per Part 11 Section B of General Permit No. NCG 120000. The Fecal Coli form measured in the 1/21/10 monitoring sample was 4.00 col/nil, which is below the cut-off concentration. Even though this result is below the cut- off concentration, the landfill still has it large deer population, which Energizer believes is the source of the Fecal Coliform. This industrial landfill is it single source landfill for scrap batteries frorn Energizer's Asheboro operations and is not a source of Fecal Coliform. Energizer again requests the monitoring fi-equency for Fecal Coliform be reduced or deleted altogether. Ener. izer. The 1/21/10 monitoring sample found Outfall 42 TSS to be 271 mg/l, which is above the TSS benchmark cut-off concentration. Our Corrective Action Plan to reduce TSS levels is as follows: a) Improve stortnwater conveyance at both outfalls, b) Implement better stormwater maintenance at both outfalls, c) Reshape the sediment basin, and d) Determine and correct the root cause. Items a), b) and c) will be implemented as soon as the weather permits. Our investigation into the root cause is on -going, however, we believe that our upcoming landfill construction and reconfiguration work will substantially contribute to resolving the TSS problem. As per Part II Section B of Energizer's permit, Outfall 92 will continue to be monitored on a monthly basis until three consecutive samples are below the benchmark values. The location of the site is shown on the site location map included in Attachment A. The Energizer Landfill is located within the Randolph County solid waste landfill and includes two outfalls (#01 & #02). A map showing the location of the outfalls is included in AttachmentA. The stormwater samples were successfully collected during a representative rain event on January 21, 2010 by Brett Higgins of Pyramid. Qualitative monitoring reports for each outfall were completed by Pyramid and are included in Attachment B. The qualitative monitoring reports describe the visual appearance of the stormwater run-off at the time of the sampling event. The stonnwater samples were placed on ice and transported to R&A Laboratories, Inc. in Kernersville, North Carolina. The samples collected from Outfall #01 were analyzed for fecal coliform and chemical oxygen demand (COD). The samples collected from Outfall #02 were analyzed and total suspended solids (TSS) and COD. The laboratory results of the stormwater samples are presented in Table 1, which is included as Attachment C. As shown in Table 1, the detected concentrations of COD at outfall #01 and #02 exceed the cut-off concentrations specified in General Permit NCG120000. The TSS concentration at #02 also exceeds the cut-off concentration. The fecal colifonn concentration at Outfall 401 is below the cut-off concentration. The arithmetic mean for COD and TSS for the past fifteen sampling events exceeds the cut- off concentrations for both outfalls; therefore, continued analysis of these parameters will be required. The arithmetic mean for fecal coliform at outfall 01 over the past thirteen sampling events also exceeds the cut-off concentration and continued analysis will be P.O. The inspection evaluated the four (4) areas designated on the attached inspection foriii and found the Energizer Battery Landfill to be in violation of the state issued stormwater permit. Specifically, the required Tier One and Tier Two responses were not initiated when benchmark values were exceeded. Observations from each area are addressed below: 1. Permit Energizer Battery holds Certificate of Coverage 9 NCG120006 which allows for the discharge of stormwater from the battery landfill site. The permit, reissued on November 1, 2007, is current and will expire on October 31. 2012. 2. Facility Site Review The Energizer Battery landfill consists of two separate landfill cells, one active and one closed. Stormwater from the closed cell drains to outfall 401. Observations of this cell noted an eroded area above the v-notch weir and the possible surfacing of leachate at this denuded area. Stormwater from the active cell drains to outfall 4002. Observations at this cell noted sediment runoff occurring on the south facing slope due to poor groundcover. In addition, discarded batteries in this cell -,were being exposed to stormwater due to a deteriorating gray tarp and an undersized black tarp that were not adequately covering the disturbed area. 3. Effluent/Receiving Waters StormiNvater from the two outfalls combines shortly after flowing over separate v-notch weirs. Page #2 4. Monitoring Program Part II Section B of the permit requires collection of semi-annual analytical samples from both outfalls during a representative storm event. These semi-annual analytical monitoring results are to be submitted to the Division on form SWU-248-102107 within 30 days from the date the facility receives the sampling data from the laboratory. A review of facility records indicates that these samples were collected as required. The permit also establishes benchmark values that, if exceeded, require tiered responses. For Outfall 4001 a Tier One response should have been initiated for the single COD and TSS values that exceeded benchmark values and a Tier Two response with monthly sampling should have been initiated for the consecutive fecal coliform results that exceeded the benchmark value. For Outfall 9002 a Tier Two response with monthly sampling should have been initiated for the COD and TSS results that exceeded benchmark values. Energizer Battery should initiate the monthly sampling specified in the Tier Two response. If future sampling shows benchmark values to be exceeded for a specific parameter at any specific outfall on more than four occasions, the DWQ Water Quality Regional Supervisor must be notified in writing within 30 days of receipt of the fourth analytical results. Energizer Battery may then be required to: 1) increase or decrease the monitoring frequency, 2) apply for an individual stormwater permit, 3) install structural stormwater controls, or 4) install other sto=vater control measures. Part II, Section C of the permit requires that qualitative (visual) monitoring be performed and documented weekly to evaluate the effectiveness of the sedimentation and erosion control measures. It is our understanding that these observations have only been documented semi-annually by Pyramid Environmental. Please institute weekly inspections per the permit requirements. Note that these qualitative records do not need to be submitted to the Division, however, the records must be kept on file at the facility for a period of five years. Failure to comply with any permit conditions is a violation of the General Permit. Per the permit text in Part 111, Section A (2): "The permittee trust comply with all conditions of this general permit. Any permit noncompliance constitutes a violation of the Clean Water Act and is grounds for enforcement action...". Here are a couple of my questions; 1) Since the Notice of violation was written, I believe another benchmark has been elevated to a Tier Two response. (Correct, It is COD at Outfall #1). At Outfall #1 the Tier Two benchmarks are Fecal Coliform and -T-SS (COD), while at Outfall #2 the Tier Two benchmarks are COD and TSS. Is that correct? 2) Does the DWQ receive the results from each of the monthly samplings? If so, to whom should I send them to? (Part III, Section E of the permit requires that any samples analyzed be submitted Central Files. This also includes the monthly Tier 2 sampling. The only required report for the regional office is when a benchmark value is exceeded for a specific parameter at any outfall on mo 3) The letter states that if we get a benchmark in exceedence for more than 4 occasions, does the monthly ---- sampling count as an occasion or is an occasion specific to the semi-annual sampling? (The monthly sampling counts toward the four occasions). 4) The qualitative monitoring report is to be performed weekly after a rain event, what do we do if it doesn't rain during that week? (Part II, Section C states that "If no stormwater discharge is occurring during the time of the weekly inspection a check to ensure that all sedimentation and erosion controls are being properly implemented will be performed". Basically, you need weekly documentation that the measures were inspected/visited). 5) Is the monitoring done at the sampling Weir or upstream on the sedimentation basin? (Either the sediment basin or weir works for sampling at Outfall #2 [open cell]. The report form just need to note the location. Pyramid Environmental Inc. was retained to perform the required stormwater sampling, which was conducted on October 14, 2009. The location of our site is shown on the maps in Attachment A. A qualitative monitoring report for both outfalls describing the visual appearance of the stormwater run-off at the time of the sampling event is presented in Attachment B. Laboratory results are presented in Table 1, Attachment C. The completed monitoring report is included as Attachment D. The results show that Outfall #01 is in exceedence for COD and Fecal Coliform, and was in exceedence for TSS during the previous reporting period. As a Tier l response, we will investigate the source ofthe high COD values so that we may identity the proper corrective actions for reducing the COD levels. Additionally, to address the TSS exceedences the are clearing out the weir, clearing out the sedimentation basin located before weir, and implementing better erosion control measures (e.g.,'hydro-seeding; use of mesh fabric barriers, etc.). We will begin monthly sampling for Fecal Coliform due to consecutive samplings in exceedence, as a Tier 2 response identified in General Permit No. NCG 120000. However, please note that the Fecal Coliform is due to the large quantities of deer droppings found throughout Cell 91. which feeds the stormwater to Outfall #1. On November 2, 2009, Micheal Mickey of NC DWQ inspected the site and noted that Cell 401 is not fenced and is a sole source for fescue and clover, a favored food source for deer during the summer. The results also show Outfall #2 is in exceedence for COD and was in exceedence for TSS during the previous several reporting periods. As with Outfall 91, we will begin monthly sampling of Outfall #2 for COD and TSS, as required by General Permit No. NCG 120000 for a Tier 2 response. As noted above we will investigate the source of the COD and once identified rill take corrective actions. The qualitative monitoring reports describe the visual appearance of the stormwater run-off at the time of the sampling event. The stormwater samples were placed on ice and transported to Research and Analytical Laboratories, Inc. in Kernersville, North Carolina and analyzed for chernical oxygen demand (COD), total suspended solids, (TSS), and fecal coliform. As indicated in Table I, the detected concentrations of COD at outfall #01 and #02 and the fecal colifonn concentration at outfall #01 exceed the cut- off concentrations specified in General Permit NCG 120000. The arithmetic mean for COD and TSS for the past thirteen sampling events exceeds the cut-off concentrations for both outfalls; therefore, continued analysis of these parameters will be required. The arithmetic mean for fecal colifonn at outfall 401 over the past thirteen sampling events also exceeds the cut-off concentration and continued analysis will be required. The arithmetic mean of.the fecal coliforin detected at outfall #02 over the past ten sampling events is below the cut-off concentration. Copies of Table 1 and the laboratory report are included in Attachment C. Pyramid also completed the stormwater discharge monitoring report for each outfall as required by NCG 120000. The site is utilized for disposal of off spec and defective dry cell alkaline batteries generated from the Energizer I Battery Company manufacturing facility located on Art Bryan Drive. 2. The site has two landfall cells, Cell 1 is closed and Cell 2 is the current operational cell, 3. Cell 1 has established vegetative growth and is frequently mowed, 4. Cell 2 is completely enclosed by fencing and the entrance gate remains locked at all times, excepting ingress and egress of trucks for battery disposal. 5. Proper signage was observed at the entrance gate to the site. 6. The facility is minimally utilized with monthly disposal tonnages of 30-90 tons. 7. During the 2008-2009 reporting period 347.3 tons of batteries were disposed at the site. 8. Reviewed revised Operations Plan approved in the Permit to Construct issued April 22, 2009. fi 9. Construction for Phase 3A is scheduled for early 2010. 10. Reviewed operating records, including semiannual ground water monitoring. 11. Analysis of the October 22, 2009 semiannual monitoring report indicated iron, manganese, 1,2-dichloroethane, and tetrachloroethene exceeded the NCAC 2L groundwater standards. 12. Batteries are covered after each incoming load, cover tarps are utilized, and soil cover is utilized when necessary. 13. Most recent battery disposals were well covered by soil. Note: Side slopes of the landfill should be maintained at a 3:1 ratio at all times. 14. Permanent edge of waste markers are required to be installed on both landfill cells. The permanent edge of waste markers have been ordered and are scheduled for installation 15. Gravel has been placed over the most recent disposal areas for a road base for incoming disposal vehicles. I& Seeding and fertilizing of intermediate soil cover has been conducted. 17. The top of the active landfill is graded to a slope drain. Note: Openings to two additional slope drains on the top of the landfill appear to have become covered with soil. These slope drains should be repaired or removed if the existing slope drain has adequate capacity for storm water removal. 18. Storm water is diverted from the active, Cell 2 landfill area to a sedimentation basin and exits the site via a weir system. 19. The closed Cell 1 area storm water flows to a central area to a separate drainage area 20. The facility has an active Storm Water Permit. The Storm Water sampling points are identified as Outfall 41 for Cell 2 and Outfall #2 for the closed Cell 1. 21. Leachate is collected by a sump system, which is periodically pumped and taken to the Energizer Battery, Plant 2, wastewater treatment plant. A sump is located on the down gradient side of both landfill cells. 22. For the period January 14- November 11, 2009 a total of 28,872 gallons of ieachate have been pumped_ . FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section Page 3 of 3 23. The site was visited on 12/01/09 in response to a referral from the Division of Water Quality. A Storm Water inspection by the Division of Water Quality observed discolored water in the Cell 2 sedimentation basin and possible vegetative distress in the drainage areas of Cell 1. 24. No observable leachate releases were observed around the landfill areas during the 12/01/09 visit. Photos were taken at the site. 25. During the audit inspection of 12/07/09 the side slopes and areas around Cell 1 and 2 were inspected for evidence of leachate releases. No evidence of leachate releases was found. Photos were taken at the site. 26. As per our discussions Energizer Battery is to collect water samples from the sedimentation basin and analyze for contaminants. Upon review of the analysis a decision will be made whether to pump and treat the water from the sedimentation basin.
