On February 03, 2016 Glen White and Sue White of the North Carolina Department of
Environmental Quality - Minerals and Land Resources met with you at the subject facility
located at 1203 East Mountain Street, Kernersville, NC to conduct a compliance inspection for
the facilities Industrial Stormwater Permit. The prior inspection conducted on January 28, 2014
found the site non -compliant with the permit requirements. Inspection consist of review of the
Stormwater Pollution Prevention Plan, training and monitoring records and observation of the
general condition of the site and outfall. Significant progress has been made since that date.
Your assistance with the inspection was greatly appreciated.
Permit:
This facility holds General Stormwater Permit NCG070192 to discharge stormwater from
industrial activity associated with Stone, Clay, Glass & Concrete Products under the National
Pollutant Discharge Elimination System (NPDES). The permit became effective June 1, 2013
and expires on May 31, 2018. Initial site specific Certificate of Coverage was issued on May 08,
2009. A copy of the current permit is required to be maintained with the Stormwater Pollution
Prevention Plan (SPPP) documents. A copy of the current permit was available for review at the
time of inspection.
Records/Reports:
This facility was required to develop and maintain a Stormwater Pollution Prevention Plan
(SPPP) in accordance with Part II, Section A of the permit. At the prior inspection records were
not complete. At this inspection the SPPP was complete and available for review. No deficiency
noted. Ensure that the SPPP is updated annually. Even if there is no change to operating
procedures or the facility, note and provide revision date in on the SPPP.

Facility Site Review:
This facility fabricates granite, marble and manmade material stone products. The facility was
clean and well organized. Inspectors walked with the Owner through the facility. They were
allowed to observe facility's water filtering and recycling system. Even the production areas
were very clean. The site has one outfall near the right rear corner of the site located at the
creek. Water was flowing and clear at the time of inspection. No deficiency noted.

Effluent from this facility discharges into an unnamed tributary of Reedy Fork Creek, a class
WS-III; NSW waterbody of the Cape Fear River Basin.
Self -Monitoring Program:
The facility is only required to perform qualitative monitoring twice annually. Continue to
conduct monitoring at the outfall twice a year as permit requires. No deficiency noted.
Mr. Kalaf request a copy of the application for a new NCG 070000 permit to serve the facility
proposed at a different location. A copy of the permit application, general permit and monitoring
form is included with this letter. Please have permit application in the Raleigh office for review
before operations begin at the new facility.
The site was found to be compliant with its Industrial Stormwater Permit requirements. Thank

Dear Mr. Kalaf:
On January 28, 2014, Sue White of this office performed a Stormwater
Inspection at Amanzi Marble and Granite, located on East Mountain Street in Forsyth
County. You were present for this inspection which evaluated the areas designated on
the attached EPA inspection form. Observations from each area are addressed below:
1. Permit
This facility holds General Stormwater Permit No. NCG070182 to discharge Stormwater
from activities associated with Stone, Clay, Glass & Concrete Products under the
National Pollutant Discharge Elimination System (NPDES). The permit became
effective June 1, 2013 and expires May 31, 2018. The site specific Certificate of
Coverage was issued on May 8th, 2009.
2. Records/Reports
Part 11, Section A of the permit requires the development of a Stormwater Pollution
Prevention Plan (SP3). The SP3 plan should be printed and stored in a binder with
monitoring data, employee training records, etc. and updated yearly. There was no SP3
plan on site. A portion of the inspection was used going over the SP3 plan and what
was to go in it.
3_ Facility Site Review
Any items that have potential to carry leachate or solids off site during storm events
must be stored under cover. There were several areas of concern in the yard and along
the banks of the creek. Please be aware that any materials must be stored more than
25' from the top of bank of any creek or conveyance. The need for the site to be
cleaned up was discussed and agreed upon during the inspection.
4. Effluent/Receiving Waters
The facility's outfall discharges into an unnamed tributary to Reedy Fork, a class WS-III;
NSW waterbody in the Cape Fear River Basin.

5. Self -Monitoring Program
Analytical monitoring is not required at this site per Part II, Section B of the permit since
the facility uses < 55 gallons/month of new motor oil.
The semi-annual qualitative (visual) monitoring in Part II, Section C is required but is not
being performed and documented on a semi-annual basis. The'proper documentation
practices were also discussed during the inspection.
It was agreed that you would contact this office to schedule a follow up inspection at the
end of February. Our office appreciates the effort by the staff Amanzi Marble and
Granite to comply with the NPDES General Stormwater Permit. If you have any

l) An independent contractor was brought in to remove the sludge and run off and plant grass
where sludge was located.
2) Upgraded the water filtration system to minimize the amount of sludge produced.
3) An independent survey group was brought in to survey the property and give us a detailed
report on our property and how much was being used.
4) A Water Quality binder is made and being kept up front at Amanzi Marble & Granite for your
inspectors to see when they arrive for inspection.
5) Water filtration is monitored daily to insure we do not have any run off.

Ron Boone of the Winston-Salem Regional Office of the NC Division of Water Quality (DWQ or the
Division) conducted a compliance evaluation inspection (CEI) at the subject facility on September 13, 2012.
Your assistance and cooperation during the inspection was greatly appreciated. An inspection checklist is
attached for your records and the inspection findings are summarized below.
The facility is located at 1203 East Mountain Street, in Kernersville, Forsyth County, North Carolina, at
approximate coordinates 36.1124230,-80.0448540. The stormwater discharge outfalls (SDO) from the site
have yet to be identified but discharge of stormwater related to industrial activity is to an unnamed tributary to
Reedy Fork, which is currently classified as a Class WS-III (water supply), nutrient sensitive water (NSW)
located in the Cape Fear River Basin.
Documentation & Monitoring Review
The facility currently does not have a Stormwater Pollution Prevention Plan (SP3) as required in Part ll,
Section A, of the general permit.
Qualitative monitoring (QM), as required in Part II, Section B, of the general permit, has not been
conducted.
Analytical monitoring (AM) is only required for vehicle maintenance areas that use more than 55-
gallons of new motor oil per month. The permittee must assess whether activity at the site requires AM in
accordance with the permit.

This inspection was prompted by a complaint received by this office. The complaint stated that there
was a possible illicit discharge and scrap/junk piles in and around a stream that is adjacent to the facility. The
inspection revealed .that at some time in the recent past, the facility's water recycling system for its cutting
machines inside the facility, experienced a pipe failure, -which resulted in contaminated wastewater being
discharged onto the floor inside the facility. It appears as though the spilled wastewater then made its way
outside the facility and drained into the unnamed tributary that is adjacent to the facility. Also, there are several
piles of scrap marble and granite surrounding the backside of the facility. Some of this scrap material is in the
creek or just beside of it. Such discharges of wastewater and scrap materials into the stream are considered
illicit (illegal) discharges and must seize immediately.
Please correct all violations noted above as soon as practical. The discharge of wastewater and
materials into the stream, initiation of QM, and a determination as to whether AM is required, must be done
immediately. A fully compliant SP3 should be developed and implemented for the facility within 90 days.
Failure to meet any of these requirements may result in this office taking further enforcement actions.
Please reply in writing to this .letter within 30 days of receiving it. Your reply should provide proposed
corrective actions with implementation schedules for each of the violations outlined above. Please note that
violations of the NCG070000 general permit are subject to civil penalty assessments not to exceed
$25,000 per day, per violation. Your written response will also be considered in deciding whether further
enforcement action should be taken.

Hello Amy,
1 came across a stream in Forsyth County that appears to be receiving discharge from a nearby marble and granite
company (off East Mountain Street). It is a UT to Reedy Creek; I've attached a vicinity map and some photographs from
my visit. It looks like the marble and granite company is discharging water from the finishing operation directly into the
channel. The cloudy water is mainly in the headwaters of the stream where there isn't much flow. As the stream
continues behind the marble company it is partially obstructed by a large debris pile consisting of granite and marble
scraps. I just wanted to bring this site to your attention.

Dear Mr. Kalaf:
A complaint investigation was conducted at the Amanzi Marble & Granite. facility located at 1203 East Mountain St in
Kernersville NC on March 11, 2009 by Rose Pruitt of the North Carolina Department of the Environment and Natural
Resources Division of Water Quality, Winston-Salem Regional Office and Elizabeth Binkley and Cassidy Hey with the
Town of Kernersville Stormwater Division. Mr. Omar Kalaf, owner of Amanzi Marble & Granite was present at the
inspection. During the investigation it was noted that this facility was operating without required NPDES wastewater or
stormwater permits. An illicit discharge of process wastewater from the facility stone cutting operations was observed to
be flowing from an 8" PVC pipe to an Unnamed Tributary to Reedy Fork Creek, a Class WS-11I water in the.Cape Fear
River Basin.
Serious compliance issues and violations were noted as follows.
(1) Operating without a permit ..
The Division of Water Quality issues a General Permit No.NCG070000 to discharge stonnwaterunder the
National Pollutant Discharge Elimination System. Coverage under this general permit is applicable to•all owners
or operators of stormwater point soureb,discharges associated wiffactivities classified,as establishments primarily F"
engaged in: Stone, Clay, Glass, and 'Conerete Products [standard industrial classification (SIC) 32]; and like
activities deemed by DWQ to be similar in the process and/or the exposure of raw materials, products, by-
products, or waste materials. You must make application for this permit immediately.
(2) Making are illicit outlet to the waters of the state in violation of North Carolina general Statute 143-215.1:
§ 143-215.1. Control of sources of water pollution; permits required.
(a) Activities for Which Permits Required. —No person shall do any of the following
things or carry out any of the following activities unless that person has received a permit from
the Commission and has complied with all conditions set forth in the permit:
(1) Make any outlets into the waters of the State.
(2) Construct or operate any sewer system, treatment works, or disposal system
within the State.

any manner intennixed with the waters of the State in violation of the water
quality standards applicable to the assigned classifications or in violation of
any effluent standards or limitations established for any point source, unless
allowed as a condition of any permit, special order or other appropriate
instrument issued or entered into by the Commission under the provisions of this Article.
An illicit discharge of waste water was observed at the time of the inspection.
An illicit discharge of process wastewater from the facility stone cutting operations was observed to be flowing from an
8" PVC pipe to an Unnamed Tributary to Reedy Fork Creek, a Class WS-III water in the Cape Pear River Basin.
This Office_requires_that violations as_stated above, be abated immediately, -Also_please'note, these violations and
any future violations are subiect to civil penalty assessments of up to $25,000.00 per day, per violation.
jljis Office requests that you respond to this letter, in writing, .within 20 days'of receipt of this Notice. Your
response should address the following items:
(l) You must immediately cease the illicit discharges of process wastewater from your facility.
This Office will require documentation of all remedies.
(2) You must immediately begin the application process for General Permit No. NCG070000 to
discharge Stormwater under the National Pollutant Discharge Elimination System. (This is not
a permit to discharge process waste water.) Send a completed copy of our -Notice of Intent to
this office as well as the Raleigh office indicated on the enclosed forms.
(3) Please clearly discuss your efforts to abate/stem impacts to surface waters.
Thank you for your immediate attention to this matter. This office is considering sending a recommendation for
enforcement to the'Director of the Division of Water Quality. Your response to this correspondence will be considered in

A complaint investigation was conducted at the Amanzi Marble & Granite, facility located at 1203 East Mountain St in
Kernersville NC on September 9, 2009 by Rose Pruitt of the North Carolina Department of the Environment and Natural
Resources Division of Water Quality, Winston-Salem Regional Office. Mr. Omar Kalaf, owner of Amanzi Marble &
Granite was present at the inspection. During the investigation it was noted that an illicit outlet and bypass to discharge
process wastewater from the facility stone cutting operations was observed to exit the building next to an Unnamed
Tributary to Reedy Fork Creek, a Class WS-III water in the Cape Fear River Basin.
Serious compliance issues and violations were noted as follows.
(1) Making an illicit outlet to the waters of the state in violation of North Carolina General Statute 143-215.1:
§ 143-215.1. Control of sources of water pollution; permits required.
(a) Activities for Which Permits Required. — No person sliall do any of the following
things or carry out any of the following activities unless that person has received a permit from
the Commission and has complied with all conditions set forth in the permit:
(1) Make any outlets into the waters of the State.
(2) Construct or operate any sewer system, treatment works, or disposal system
within the State.
(6) Cause or permit any waste, directly or indirectly, to be discharged to or in
any manner intermixed with the waters of the State in violation of the water
quality standards applicable to the assigned classifications or in violation of
any effluent standards or limitations established for any point source, unless
allowed as a condition of any permit, special order or other appropriate
instrument issued or entered into by the Commission under the provisions of this Article.

This Office requests that you respond to this letter, in writing, within 20 days of receipt of this Notice. Your
response should address the following items:
(1) You must immediately cease the illicit discharges of process waste water from your facility.
This Office will require documentation of all remedies.
(2) Please clearly discuss your efforts to abate/stem impacts to surface waters.
Thank you for your immediate attention to this matter. This office is considering sending a recommendation for
enforcement to the Director of the Division of Water Quality. Your response to this correspondence will be considered in

spoke with Omar Kalaf owner at site. Bypass line from interior sediment settling equipment to outside the building.
Evidence of discharge by large erosion pool created at pipe outlet located approx 10 feet from strem. Spoke to Mr Kalaf
about removing the discharge pipe and bypass. Town of K'ville 5W had notified him before about removing but he argued
that manufacturers rep said it was ok. Explained that it was considered an unpermitted discharge of waste water and
