Yes, the remediation system related to permit NCO084492 is still shut down. No activity since last time we communicated.
Also, in case you did not know CEMEX sold the block operation to Adams -Oldcastle. They run the site now however we
remain with control of the remediation system due to environmental liability.

A Compliance Evaluation Inspection was performed on the CEMEX stormwater facility on September 15, 2010 by Corey
Basinger of the Winston-Salem Regional Office. The inspection consisted of two parts: an on -site inspection of the
stormwater facilities and an in -office file review. The following are the findings from the subject inspection.
1. Permit
The NPDES permit for CEMEX became effective on June 1, 2008 and expires on May 31, 2013.
11. Records/Reports
A review of the qualitative monitoring data demonstrated compliance with NPDES General Permit requirements. All
applicable data was collected as per the NPDES permit requirements. All other documentation is well organized and
comprehensive.
Ill. Facilitv Site Review
All outfalls noted in the Stormwater Plan were inspected and found to be satisfactory.
1V.. Effluent &: Receiving``'l'aters
CEMEX discharges stormwater to an unnamed tributary to Deep River (Class WS-IV CA waters in the Cape Fear River
Basin)
V. Self -Monitoring Program
A review of the qualitative monitoring reports (DMRs) showed that CEMEX was in compliance with the self -monitoring
requirements contained in the NPDES General Permit. It is recommended that the qualitative monitoring be conducted at
the actual outfall (off the CEMEX property) or as a sufficient number of storm drains on the CEMEX property to accurately
depict the quality of the stormwater being discharged from the entire CEMEX site.

Your facility is currently covered for stormwater discharge under General Permit NCG070000. This permit expires
on March 31, 2003. The Division staff' is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by early spring of 2003. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your pert -nit coverage. To make this renewal process easier, we are informing you in
advance that your permit coverage will be expiring. Enclosed you will find a Permit Coverage Renewal
Application Form. The application must be completed and returned by October 2, 2002 in order to assure
continued coverage under the general permit. Due to staff and budget constraints; letters confirming our receipt of
the completed application will not be sent.
Failure to request renewal within the time period specified, may result in a civil assessment of at least $250.00.
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your
facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215. l
and could result in assessments of civil penalties ol' up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the f 1 categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facility industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
information contact the Central Office Stormwater Staff member listed below or check the Stormwater & General
Permits Unit Web Site at http://h2o.enr.state.nc.us/su/stormwatcr.htini
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom ol'the form. You will be notified when the
rescission process has been completed.
