3. NCG020212 & NCG020218, Madison Pomona Mine
Both the. NCG020212 and NCG020218 permits appear to be for the Madison Pomona Mine.
However, according to Mr. Boone, you stated that active mining no longer occurs at this mine and
that the site is now used only to store equipment. Therefore, Pine Hall Brick Co. should request
rescission of both permits. To do so, please submit a letter to the Division's Stormwater
Permitting Unit (SPU) at the following address:
Stormwater and General Permits Unit
Division of Water Quality
1617 Mail Service Center
Raleigh, North Carolina 27699-1617
In the letter be sure to state the reason for the rescission request. Please be aware that if the
mine ever reopens for active mining, Pine Hall Brick Co. will have to obtain another NCG02 permit
before any stormwater discharge related to mining activities can begin. In the interim, because
this mine is located on plant #31#4 property, Pine Hall Brick Co. should treat it as part of plant
#31#4, regulated by NCG070119.

9. Pine Hall Production Plants_ #3_&_#4, NCG070119
Site Review -
The facility is located at 634 Lindsey Bridge Road, in Madison, Rockingham County, NC. The
facility currently has four SDOs, all of which discharge directly to the Dan River. This section of
the Dan River is currently classified as WS-IV, CA waters in the Roanoke River Basin. SDOs 001
through 003 discharge industrial stormwater only, whereas SDO 004 discharges both industrial
stormwater and stormwater related to vehicle maintenance activities. The facility produces brick
using materials taken from the mines. Mr. Boone reports that the facility appeared exceptionally
clean and noted no issues at the site. For the purposes of this permit, the customer service area
and the former Madison Pomona mine, which are both on the east side of Lindsey Bridge Road,
opposite of plant #31#4, are considered part of the plant #31#4 property, and as such are also
regulated under this permit.
Documentation Review
The Stormwater Pollution Prevention Plan (SP3) for this plant needs some improvement. There is
currently no general location map and the site map does not meet all permit conditions. Individual
spill records are kept, so this meets all intent of the permit with regards to spill records (i.e. spill
list). The certification of the outfalls, as required by Part II, Section A, para. le, has not been
accomplished. Finally, training has not been conducted and recorded annually, although initial
stormwater training has. been provided to all employees that required it due to their duties.
Please review the permit in detail to ensure Pine Hall Brick Co. is meeting all requirements.
QM is currently being conducted at all four SDOs semi-annually and AM is being conducted at
SDO 004 semi-annually because it receives runoff from the vehicle maintenance area. All records
are current and complete. Please take special note of the new tiered requirements in the
permit, which tell the permittee what they have to do if any of the parameter benchmarks
are exceeded at any time during the permit cycle.
Mr. Boone has reported that the facility location latitude/longitude coordinates loaded in the DWQ
database are not accurate for the site (36.385000,-79.953333); these coordinates actually point
to the bridge that crosses the Dan River on the eastern side of Madison, just east of Water Street.
Please provide Mr. Boone with updated accurate coordinates for the site and he will see to it that
our database is updated.
10. Pine Hall Production Plant #5, No Permit
This facility is located on the south side of Hwy 311, at the south end of Teague Road, adjacent to
the Dr. Martin Mine on the northeast side and the Pine Hall Brick Co. Research and Development
facility on the northwest side. There is currently no permit for this site because Pine Hall Brick Co.
thought it was regulated under the Plant #344 permit. However, because the Plant #5 and Plant
#31#4 properties are not adjoining, Plant #5 should have its own permit. The Research &
Development facility can be regulated under the Plant #5 permit, because its property does adjoin

11.The Division greatly appreciates Pine Hall Brick Co's efforts to maintain a well developed
stormwater program. Please continue with your efforts. However, you are strongly urged to
thoroughly review both the NCG02 and NCG07 permits in detail as soon as possible to help
ensure you meet all permit requirements. Both permits were recently rewritten and underwent
significant changes. Some of the more notable changes involve the frequency and rules for both
QM and AM and the tiered requirements that permittees must conduct when permit benchmarks
are exceeded. Mr. Boone can answer any questions you may have.
12. You are reminded that the Division may assess civil penalties of no more than $25,000 per day,
per violation of both the NCG02 and NCG07 stormwater permits. Please reply in writing to this
letter within 30 days of receiving it. Your reply should detail corrective actions and
implementation schedules for each deficiency detailed above. Thank you for your cooperation in
this matter. Should you have any questions regarding this letter or the inspections, please feel
free to contact Mr. Boone or me at (336) 771-5000.

through 003 discharge industrial stormwater only, whereas SDO 004 discharges both industrial
stormwater and stormwater related to vehicle maintenance activities.
Finally, training has not been conducted and recorded annually, although initial
stormwater training has been provided to all employees that required it due to their duties.
10. Pine Hall Production Plant #5. No Permit
#344 properties are not adjoining, Plant #5 should have its own permit. The Research &
Development facility can be regulated under the Plant #5 permit, because its property does adjoin
Pine Hall Brick Co.

11. The Division greatly appreciates Pine Hail Brick Co's efforts to maintain a well developed
stormwater program.

Subject: NPDES Stormwater Permit Coverage Renewal
Pine Hall Brick Co -Rockingham
COC Number NCG070119
Rockingham County
Dear Permittee:
In response to your renewal application for continued coverage under stormwater General Permit NCG070000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.)
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG070000
• A copy of a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit.
The more significant changes in the General Permit since the your last Certificate of Coverage include the following:
• Permit cover page — Coverage is expanded to include industrial activities similar to the categorically identified industries.
• Part i Section A — This part explains that the No Exposure Exclusion from permitting option may be available to the
permittee.
• Part II Section A — Several minor expansions and clarifications of the required content of the Stormwater Pollution
Prevention Plan have been added. Please be sure that your plan is updated to comply with the new requirements.
• Part II Section B — Qualitative monitoring must now be conducted during a representative storm event.
• Part II Section B — The permittee is required to keep a written record of his response to problems identified by his
qualitative monitoring observations.
• Part II Section C - For facilities with vehicle maintenance activities using more than 55 gallons of new motor oil per month,
new provisions require that discharges from the vehicle maintenance areas be sampled twice per year, and that the
sampling results be compared to new numerical benchmark values. (The previous cutoff concentrations have been
eliminated.)
• Part II Section C — For facilities with vehicle maintenance activities using more than 55 gallons of new motor oil per month,
new provisions require the permittee to execute Tier One and Tier Two response actions, based on the first benchmark
exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the
permittee institute monthly monitoring instead of twice -per -year monitoring, untll three consecutive monitoring events
show no benchmark exceedences.
• Part II Section C — This part contains a new provision that four exceedences of any particular benchmark will trigger
increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the
permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control
measures.

Your facility is currently covered for stormwater discharge under General Permit NCG070000. This permit expires
on March 31, 2003. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by early spring of 2003. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage.' To make this renewal process easier, we are informing you in
advance that your permit coverage will be expiring. Enclosed you will find a Permit Coverage Renewal
Application Form. The application must be completed and returned by October 2, 2002 in order to assure
continued coverage under the general permit. Due to staff and budget constraints, letters confirming our receipt of
the completed application will not be sent.
Failure to request renewal within the time period specified, may result in a civil assessment'of at least $250,00.
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater frorn y our
facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1
and could result in asscssmenis of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I 1 categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facility industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
information contact the Central Office Stormwater Staff member listed below or check the Stormwater & General
Permits Unit Web Site at hltp://l12o.enr.state.nc.us/su/storniwatcr.hti,-,.'
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.
If you have any questions regarding the permit renewal procedures please contact Corey Basinger of the
