Aana Taylor -Smith of the Winston-Salem Regional Office of the NC Division of Energy, Mineral, and Land
Resources (DEMLR) conducted a compliance evaluation inspection at the subject facility on 13 January 2014. Your
assistance and cooperation, as well as that of Ms. Pam Bartlett, were greatly appreciated. An inspection checklist
is attached for your records and the inspection findings are summarized below.
This facility is located at 331 Burton Avenue in High Point, Guilford County, North Carolina. Stormwater related to
industrial activity is discharged from the site to the City of High Point's Municipal Storm Sewer System to Payne
Creek, which is currently classified as Class C waters, in the Yadkin -Pee Dee River Basin.
Documentation & Monitoring Review
For the most part, the facility's Stormwater Pollution Prevention Plan (SPPP) is thorough and up to date. However,
a list of significant spills occurring over the past three years must be kept with the SPPP. Analytical monitoring has
been completed for pH, TSS, and Oil & Grease, but COD results were missing. Please conduct COD monitoring as
required by Section B of the permit. Qualitative monitoring has been completed as required, but it is
recommended that Piedmont Chemical use the monitoring form provided with the NCG060000 permit to ensure
accuracy and completion. Additionally, please review and update the SPPP annually and record that reviews have
occurred on the coversheet.
Site Review
There is one true Stormwater Discharge Outfall (SDO) at this site that discharges stormwater related to industrial
activity. Stormwater is discharged from the roof to a series of pipes along Burton Avenue, which is the SDO and
where monitoring is conducted. Most stormwater from the site is contained and either sent to the on -site
wastewater treatment plant via floor drains and sump pumps or diked and sent to the City of High Point sewer
system. Some sheet flow may occur during heavy rains as well.

The facility is clean and well -maintained. Secondary containment is implemented as required. The outfall was
inspected and found to be in good order. No evidence of erosion or instability at the SDO was observed. The
receiving storm sewer and surrounding area was free of pollution indicators.
Thank you for your attention to this matter. Remedial actions must be taken to correct the aforementioned
deficiencies. Unresolved deficiencies may lead to the issuance of.a Notice of Violation and/or assessments of civil
penalties by DEMLR. No additional response to this letter is required at this time. Should you have any questions

In response to your renewal application for continued coverage under stormwater General Permit NCG060000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG060000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portaLncdenr.org/web/`wg/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

for your specific General Permit carefully.

Some of the changes include:
• Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/l for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting' Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

On November 21, the Stormwater Services Division received a call about a milky substance entering
into the stormwater drainage system that runs along Westchester Drive. It was determined that the
source of flow was coming from the facility located at 331 Burton Avenue (Piedmont Chemical
Industries I, LLC).
After further inspection, it was determined that the facility was in the process of replacing the
pretreatment equipment. The facility had reached holding capacity and was in the process of
"bleeding" the holding tanks to the sanitary sewer. According to employees, the temporary pump
that was being used had a higher capacity and was not located in the same location as the
pretreatment area, which increased the discharge rate. This caused the flow of effluent material to
"bubble up" through the grate on the North side of the building and runoff to the stormwater
drainage system. (Please see attached photos)
The discharge of pollutants into the stormwater drainage system is prohibited under the City of High
Point Illicit Discharge and Connection Ordinance (copy enclosed). Per Section 12-3-9 of the City of
High Point Code of Ordinances, failure to comply with the City of High Point Illicit Discharge and
Connection Ordinance could result in civil penalties.
It was noted that the normal operations would resume on Friday November 23, and efforts to
decrease the rate of flow to the sanitary sewer would be made to avoid reoccurrence of a potential
spill over into the nearest stormwater drainage system. The new pre-treatment equipment was
predicted to be up and running on Monday November 26.

In order for this facility to be brought back into compliance the following improvements must be
made:
1. Any additional material that leaves your site must be collected and removed, and properly
disposed of. This is to ensure that all illicit discharges into the stormwater drainage system
have been abated and further harm cannot be caused downstream.
2. Please be sure that you are meeting all requirements of the Stormzater Pollittion Prevention Plan
(SWPPP) that was developed for your facility to comply with the National Pollutant Discharge
Elimination System (NPDES) permit (#NCG060041). This includes educating and training
employees on proper pollution prevention and good housekeeping measures.
3. The use of spill kits must be identified and known by employees to ensure that any further
accident in the future is handled in the appropriate manner to avoid releasing material to the
stormwater drainage system.
Please notify me once these steps have been completed, so that a follow-up inspection can be
performed and a notice of compliance can be mailed to you. The Stormwater Services Division will
continue to monitor the Westchester Drive drainage system for potential illicit discharges.
Please ensure that any potential pollutants are kept on your site and do not enter the stormwater
drainage system. I greatly appreciate your willingness to work with the Stormwater Services
Division to improve the water quality in High Point. Please do not hesitate to contact me if you have

Dear Mr. Chestnut:
On February 13, 2009, Jenny Graznak of this office performed a General Stormwater
Permit Inspection at Piedmont Chemical Industries located at 331 Burton Avenue in High Point,
North Carolina. This facility holds General Stormwater Permit No. NCG060041 under the
National Pollutant Discharge Elimination System (NPDES) to discharge Stormwater from Food
and Kindred Products, etc. Piedmont Chemical Industries Is a specialty chemical company.
You, Pam Bartlett, and Tim Whitley were present for the inspection. This type of inspection
consists of two basic parts: a review of facility files and self -monitoring data, and an on -site
inspection of the facility's outfalls. This particular inspection evaluated five (5) areas, and
observations from each area are addressed below:
1. Permit
The permit became effective November 1, 2007 and expires October 31, 2012. A copy of the
permit and monitoring forms is attached to this correspondence.
2. Records/Reports
As required by the Permit, the facility has a Stormwater Pollution Prevention Plan (SPPP) that
was available for review during the inspection. The SPPP, which was created in September
2005 by Blue Ridge Geological Services, includes preventive maintenance procedures and a
site plan listing potential stormwater pollutants and best management practices used at the site.
Employee Training of the SPPP occurs on an annual basis. However, the SPPP did not
include a site map showing the facility buildings, Stormwater discharge points, and industrial
activities occurring in each area. Please refer to permit text Part.2 Section A for a list of the
requirements of the SPPP,
3_. Facility Site Review
For the most part, Stormwater does not leave this site. The outdoor manufacturing area has a
series of floor drains and four sump pumps, which collect process water and Stormwater and
send it to the on -site wastewater treatment plant. The water is chemically pretreated and then
sent to City of High Point. This facility has a diked truck pad, which is a contained area where
products are transferred from incoming tanker trucks into the building for manufacturing use and
vice versa. All water collected in this area goes to city sewer, sometimes with pretreatment if

necessary. Employees fill out a Stormwater Observation Form for the truck pad each time it
rains. If the water meets criteria, it is sent directly to City of High Point. If the Stormwater has
an odor, suspended solids, or sheen, it is sent to the pretreatment plant on site. At present, the
City of High Point accepts Stormwater from Piedmont Chemical. However, it was mentioned
during the inspection that Piedmont Chemical might have to adjust this system in the future
should City of High Point refuse to accept if. The site also contains a covered dumpster. Totes,
drums, and pallets are stored under a protective cover.
4. Effluent/Receiving Waters
Stormwater discharges from this site drains through the City of- High Point Municipal Storm
Sewer System to Payne Creek (Class C) in the Yadkin Pee Dee River Basin. The only truew .�,,- .
outfall on the property discharges Stormwater from the roof through a series of pipes along:_;
Burton Avenue. This is the monitoring point for the facility. During a heavy rain, it is possible for
some sheet flow from the manufacturing facility area to reach the storm sewer system. .
5. Self -Monitoring Program
The stormwater permit requires semi-annual analytical and qualitative monitoring at stormwater„ s'
outfalls. It was determined during the inspection that you have not been performing the_4.,
self -monitoring requirements as defined by the General Permit. Permit text Part II Sections
B and C describe the qualitative and analytical monitoring requirements, which'are to:be.,,,'' `,-
performed on a semi-annual basis. The last analytical sample was taken in 2003.
The failure to comply with the above monitoring requirements is a violation of the'
General Permit. Therefore, this inspection report is being sent as a Notice of - Violation. "
According to permit text Part III Section A, "the permittee must comply with all conditions of this,'.-'"-'
permit. Any permit noncompliance constitutes a violation of the Clean Water Act and is grounds ,
for enforcement action; for permit termination, revocation and reissuance, or modification; or =
denial of a permit upon renewal application." Under state law, a daily civil penalty of not more,.. -�->
than twenty-five thousand dollars ($25,000) per violation may be assessed against any person
who violates or fails to act in accordance with the terms, conditions, or requirements of a permit.

You must respond in'writing to this office within 15 days of receipt of this letter, :�-
advising us of the actions taken to abate the violations. Failure to do so could result in a
recommendation by this office in favor of the pursuit of formal enforcement actions against you.
Please include in your response a detailed description of why these violations occurred and how
