This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Energy, Mineral, and Land Resources. The Division may require modification or revocation and reissuance of the certificate of coverage. Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Part III, Section E of your permit. You must have an approved Operation and Monitoring Plan before mine dewatering discharges occur at your facility. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action. An Operation and Monitoring Plan for your facility must be maintained and any changes to the plan sent to the Wilmington Regional Office for approval. Any discharge of this water (and any stonnwater commingled with it) is subject to the effluent limitations in this permit. Also, facilities that discharge to waters classified as SA are required to monitor for fecal coliform as stated in Section D of this permit. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges. Also, please note the special conditions fisted in the Certificate of Coverage. This project is located in one of North Carolina's 20 coastal counties. Coastal stormwater management rules (I5A NCAC 2H .1000) may require an additional State Stormwater Permit (different from the NPDES mining activities discharge permit). There are a number of shellfish leases in this area as well. Historically, water quality outside Wading Creek has been high, but since the beginning of 2014, we have begun seeing problems arise with the bacteriological water quality in the area. While it is difficult to connect these water quality problems to any one source, it is notable that these issues began to arise at the same time that dewatering from this borrow pit began. Because of these ongoing water quality issues, it is recommended that strict fecal coliform limits be included in the permit conditions for this discharge. Currently, the fecal coliform limit for -1 shellfishing waters is 14 fecal coliform1100 mL. It is also requested that a copy of the results from the quarterly fecal coliform sampling be sent to the Division of Marine Fisheries Shellfish Sanitation and Recreational Water Quality Section as they are received. Finally, it is requested that the mitigation requirements that will result from exceedances of the fecal coliform limits be included in the permit conditions as well. The current dewatering by NCDOT takes place 24/7 with a pump discharging at a rate of 450 GPM 90% of the time, the flow rate. During high water events another pump is used to make the flow rate 900 GPM.
