To continue processing your application, we need additional information. Mine dewatering at your site has the potential to impact adjacent wetlands. You must have an approved Pumping Operation and Monitoring (0&M) Plan before mine dewatering discharges occur at your facility. The proposed Pumping 0&M Pla 'n.cclluded with your application needs to be expanded before it can be approved. Please address the following items in your revised Pumping O&M Pla 10c" B?Q, v Clearly indicate stormwater and/or mine dewatering outfalls on the Minl Site = `= Plan map. • The submitted plan refers to a 10 foot buffer (first paragraph) and 100 foot buffer. Please correct the inconsistency. a Include a copy of US Army Corps of Engineers wetland delineation or approved wetland delineation. The mining site plan notes that wetland information was taken from a survey by W.D. Daniels, Jr. from 1998. Any certification from that long ago will have expired. Please contact the USACE or a consultant qualified to perform a wetland delineation. Sediment and Erosion Control Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices and if applicable, comply with the specific conditions and requirements of the NPDES Construction Stormwater Permit issued to the site: a. Design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal or exceed the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor -owned or leased borrow pits associated with the project. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. c. Reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act and the Mining Act of 1971. d. Sufficient materials required for stabilization and/or repair of erosion control measures and stormwater routing and treatment shall be on site at all times. e. For PNA, 5A, WS-1, WI -II, HQW, ORW waters. The sediment and erosion control designs must comply with the requirements set forth in 15A NCAC 048 .0124 Design Standards in Sensitive Watersheds. 5. Turbidity Standard The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as described in 15 A NCAC 0213 .0200. Appropriate sediment and erosion control practices must be used to meet this standard. 6. All mechanized equipment operated near surface waters or wetlands will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a hydrocarbon or chemical spill, the permitee/contractor shall immediately contact the Division of Water Resources, between the hours of 8 am to 5 pm at the Wilmington Regional Office at 910,796.7215 and after hours and on weekends call (800) 858-0368. Management of such spills shall comply with provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act. 7. Appropriate measures should be installed prior to any land clearing activities to protect waters and wetlands from turbidity and/ or sedimentation. These measures should be routinely inspected and properly maintained, and excavated materials should be contained outside the wetland boundary. Excessive silt and sediment loads can have numerous detrimental effects on aquatic resources including destruction of spawning habitat, suffocation of eggs, and clogging of gills of aquatic species. The applicant/permitee and their authorized agents shall conduct all activities in a manner consistent with State Water Quality Standards (including any requirements resulting from compliance with 303(d) of the Clean Water Act), and any other appropriate requirements of State and Federat law. if the Division determines that such standards or laws are not being met, including failure to sustain a designated or achieved use, or that State or Federal law is being violated, or that further conditions are necessary to assure compliance, than the Division may reevaluate and modify this General Water Quality Permit. A copy of this Permit shall be.included in the construction_ contract and available on the iob site at all times. 9. This permit grants permission to the director, an authorized representative of the Director, or DEN staff, upon the presentation of proper credentials, to enter the property during normal business hours. 10. Certificate of Completion Upon completion of the project, the Applicant shall complete and return the enclosed "Certificate of Completion" form to notify NCDWQ when all work included in the §401 Certification has been completed. Styron. To get to the mine from NC HWY 70 in Newport, travel west on Nine Foot Road (SR1124) approximately 4 miles and turn south on Nine Mile Road (SRI 124) and travel approximately 1 mile, then turn west onto Anna Wink Road. The latitude is N34°47'04", longitude W76°56'08". The mine itself will have a surface area of approximately 10 acres and a depth of 12 feet at completion. A 30 foot buffer will be maintained along the property boundary, and a 100 foot minimum buffer will be maintained along the western wetland boundary until approval is obtained to fill the isolated wetlands. Dewatering Dewatering will take place as needed but will not occur on a daily basis. The pump to be used is approximately 10 HP and delivers around 300 gpm maximum. The pump will pump to a temporary ditch that will discharge to a sediment trap that will flow to a vegetated swale that will eventually discharge to the western prong of the Newport River. In order to reduce effects to the wetlands, the dewatering operation will be held to flow less than 100,000 GPD. Assuming that the pump operates at 300 gpm, the run time can be computed as follows: 100,000 gpd/(300 gal/min x 60 min/hr) = 5.5 hrs/day By limiting the pump time to 5.5 hrs/day and the excavation to 12 feet, along with maintaining a minimun 100 foot buffer, no adverse effects on the wetlands are anticipated. The Skaggs analysis attached shows the lateral effect to be 78.6 ft. Discharge Monitoring The mine area generally has good clean sand up to a depth of 12 feet. We propose to have personnel monitor the discharge a minimum of once per day when excavating from 0 to 10 feet and a minimum of twice per day when excavating from 10 to 12 feet. Styron. To get to the mine from NC HWY 70 in Newport, travel west on Nine Foot Road (SR1124) approximately 4 miles and turn south on Nine Mile Road (SRI 124) and travel approximately 1 mile, then turn west onto Anna Wink Road. The latitude is N34°47'04", longitude W76°56`08". The mine itself will have a surface area of approximately 10 acres and a depth of 12 feet at completion. A 30 foot buffer will be maintained along the property boundary, and a(i-OP-foot buffer will be maintained along the western wetland boundary. Dewatering 10 0 ` Dewatering will take place as needed but will not occur on a daily basis. The purnp to be used is approximately 10 HP and delivers around 300 gpm maximum. The pump will pump to a sediment trap and will eventually discharge to the western prong of the Newport River. In order to reduce effects to the wetlands, the dewatering operation will be held to flow less than 100,000 gpd. Assuming that the purnp operates at 300 gpm, the run time can be computed as follows: 100,000 gpd/(300 gal/min x 60 min/hr) = 5.5 hrs/day By limiting the pump time to 5.5 hrs/day and the excavation to 12 feet, along with maintaining a 100 foot buffer, no adverse effects on the wetlands are anticipated. Discharge Monitoring The mine area generally has good clean sand up to a depth of 12 feet. We propose to have personnel monitor the discharge a minimum of twice per day when excavating from 0 to 10 feet and a minimum of once per hour when excavating from 10 to 12 feet. 'SPU.DWO Central Office'Reviewer:(if;applicable): Rev: Septernber.2010 Pumping Operation and Monitoring Plan For Anna Wink Mine #2 Overview Anna Wink Mine #2 is located on a 27.27 acre tract of land owned by Larry W. Styron. To get to the rnine from NC HWY 70 in Newport, travel west on Nine Foot Road (SR1124) approximately 4 miles and turn south on Nine Mile Road (SRI 124) and travel approximately 1 mile, then turn west onto Anna Wink Road. The latitude is N34°47'04", longitude W76°56'08". The mine itself will have a surface area of approximately 10 acres and a depth of 12-feet at completion. A 30 foot buffer will be maintained along the property boundary, and a 10 foot buffer will be maintained along the western wetland boundary. 11 Dewatering Dewatering will take place as needed but will not occur on a daily basis. The pump to be used is approximately 10 HP and delivers around 300 gpm maximum. The pump will pump to a sediment trap and will eventually discharge to the western prong of the Newport River. In order to reduce effects to the wetlands, the dewatering operation will be held to flow less than 100,000 gpd. Assuming that the pump operates at 300 gpm, the run time can be computed as follows: 100;000 gpd/(300 gal/min x 60 min/hr) = 5.5 hrs/day By limiting the pump time to 5.5 hrs/day and the excavation to 12 feet, along with maintaining a 100 foot buffer; no adverse effects on the wetlands are anticipated. Discharge Monitoring The mine area generally has good clean sand up to a depth of 12 feet. We propose to have personnel monitor the discharge a minimum of twice per day when excavating from 0 to 10 feet and a minimum of once per hour when excavating from 10 to 12 feet.
