Your O & M Plan for the Cape Fear Sand Mine was received by this office on April 17,
2012. The O & M plan indicates that a non jurisdictional ditch will be used to settle
solids from the mine pit discharge using a number of rock check dams in series. It is
expected that if these best management practices do not result in a discharge that
meets the permit limitations that you will immediately discontinue the discharge and
construct a settling basin of sufficient design to meet the permit limits. Please ensure
that all monitoring required by the NPDES NCG020000 permit is followed.
The plan did not mention the size of the pump or its maximum pump rate. Please
provide that information to this office via email. You can send that information to me at
linda.willis@ncdenr.gov. Your O & M Plan will be approved concurrent with the
issuance of your certificate of coverage for your mine pit. Should you have any

Mining Operations
Water that collects in the mine pit will be pumped out into an existing outfall ditch on the
subject property (Outfall #1, See Figure 1). Sediment from the water will be collected in
ditch by use of a rock dams and a flashboard riser in the ditch. The water will flow out of
the flashboard riser and flow south approximately 3,000 feet into Pike Creek. The areas
around the mine pit will be maintained so that rainwater and runoff water from stockpiles
will flow into the mine pit. When mining is completed, the entire mine area will form a
pond per the reclamation plan in the State Mining Permit Application.
Pumping Frequency
The mine in Phase I of the mining process will be pumped as needed to keep the area dry
for mining. Hour meters attached to the pumps will monitor pump periods. For pumps
with no hour meters a pump log will be maintained. These records will be used to
determine the Total Flow per the monitoring requirements in Table 1.
Hydrology,Monitoring
Hydrology monitoring will not be required as there are no wetlands near the mine pit that
could be affected by mine dewatering.
Maintenance
The outfall ditch and the discharge outlet will be checked regularly and sediment will be
removed as -needed. The ditch downstream of the flashboard riser will be checked
regularly and sediment will be removed if needed. The rock check dam(s) will be
inspected regularly and repaired as needed. The flashboard riser will be checked on a
regular basis and maintained as needed.
Discharge Monitoring
Discharge monitoring and reporting will be performed as specified in Table 1. If the
effluent limitations are greater than specified in Table 2 the monitoring frequency will be
modified to monthly monitoring of the effluents.
Monitoring Reports
Discharge monitoring results in accordance with the terms of this permit, NCG020000,
shall be submitted no later than 30 days from the end of the monitoring period. Duplicate
signed copies of all reports required shall be submitted to the NC DENR Division of
Water Quality, Water Quality Section, ATTENTION: Central Files, 1617 Mail Service
Center, Raleigh, North Carolina 27699-1617.

Dear MRS. GOODSON:
Reference is made to your request for rescission of the subject NPDES Permit. Staff
of the Wilmington Regional Office have confirmed that this Permit is no longer required.
Therefore, in accordance with your request, NPDES Permit No. NCG020185 is
rescinded, effective immediately.
If in the future you wish to again discharge stormwater to the State's surface waters,
you must first apply for and receive a new NPDES Permit. Operating a facility without a
valid NPDES Permit will subject the responsible party to a civil penalty of up to $10,000
per day.
If it would be helpful to discuss this matter further, I would suggest that you contact
the Water Quality staff, Wilmington Regional Office at (910) 395-3900.

The Division of Environmental Management has recently evaluated all existing individual permits for potential
coverage under general permits currently issued by the Division. 15A N.C.A.C. 2H .0127 allows the Division to
evaluate groups of permits having similar discharge activities for coverage under general permits and issue
coverage where the Division finds control of the discharges more appropriate in this manner. The Division has
determined that the subject discharge qualifies for such coverage. Therefore, the Division is hereby issuing the
subject Certificate of Coverage under the state-NPDES general permit no. NCG020000 which shall void NPDES
Permit NC0076864. This Certificate of Coverage is issued pursuant to the requirements of North Carolina and the
US Environmental Protection Agency Memorandum of Agreement dated December 6, 1983 and as subsequently
amended.
If any parts, measurement frequencies or sampling requirements contained in this general permit are unacceptable to
you, you have the right to submit an individual permit application, associated processing fee and letter requesting
coverage under an individual permit. Unless such demand is made, this decision shall be final and binding. Please
take notice this Certificate of Coverage is not transferable. Part II, EA. addresses the requirements to be followed
in case of change of ownership or control of this discharge.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action, including those as may be required by this Division, such as the
construction of additional or replacement wastewater treatment or disposal facilities. Construction of any
wastewater treatment facilities will require issuance of an Authorization to Construct from this Division.
Failure to abide by the requirements contained in this Certificate of Coverage and respective general permit may
subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C. Please note that the general permit does require
monitoring in accordance with federal law. The monitoring data is required to be submitted to the Division no later
than January 31 for the previous year in which sampling was required to be performed.

The issuance of this Certificate of Coverage is an administrative action initiated by the Division of
Environmental Management and therefore, no fees are due at this time. In accordance with current rules, there
are no annual administrative and compliance monitoring fees for coverage under general permits. The only fee
you will be responsible for is a renewal fee at the time of renewal. The current permit expires August 31, 1997.
This coverage will remain valid through the duration of the attached general permit. The Division will be
responsible for the reissuance of the general permit and at such time, you will be notified of the procedures to
follow to continue coverage under the reissued permit. Unless you fail to follow the procedures for continued
coverage, you will continue to be permitted to discharge in accordance with the attached general permit.
The issuance of this Certificate of Coverage does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be required by the Division of Environmental Management
or permits required by the Division of Land Resources, the Coastal Area Management Act or any Federal or
Local other governmental permit that may be required.
