Madeline Hall Pit, Certificate of Coverage-NCG020776 NPDES General Perm it-NCG020000 Harnett County Dear Mr. Kirkpatrick: Dee Freeman Secretary On September 20, 2012, Michael Lawyer, Environmental Specialist from the Fayetteville Regional Office of the Division of Water Quality, conducted a site inspection for the Madeline Hall Pit facility located on Claude White Road in Harnett County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. Mr. Jason Rollins, General Manager, and Mr. Sammy Reagan, Supervisor, were also present during the inspection and their time and assistance is greatly appreciated. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as Cypress Creek and Middle Run, Class C waters in the Cape Fear River Basin. The site visit and file review revealed that the subject facility is covered by NPDES General Permit-NCG020000, Certificate of Coverage-NCG020776, As a result of the site inspection, the following permit conditions violations are noted: 1) Qualitative Monitoring Qualitative monitoring has not been conducted and recorded in accordance with permit requirements. 2) Analytical Monitoring Analytical monitoring has not been conducted and recorded in accordance with permit requirements. Other Observations: Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Requested Response: You are asked to respond to this office, in writing, within 30 catendar days from receipt of this notice. Your written response should include a reasonable explanation as to why the aforementioned violations have occurred as well as a Plan of Action to prevent these violations from re -occurring. Met with Mr. Jason Rollins, General Manager, and Mr. Sammy Reagan, Supervisor. An overall Stormwater Pollution Prevention Plan (SWPPP) has been developed to cover multiple mines that are owned and operated by GS Materials as they are all located adjacent to one another, but have coverage under separate mining and stormwater permits. Site specific information for each mine along with copies of the applicable Certificate of Coverage is also contained within the SWPPP. Documentation of weekly BMP inspections from July 2010 to present was reviewed. Qualitative Monitoring records were available for the second half of 2010, first half of 2011 and first half of 2012. All indicated 'No Flow' during a representative storm event. There was no record for the second half of 2011. An Annual Summary DMR for Analytical Monitoring for calendar year 2010 showed `No Flaw' for all basins. There were no records of Analytical Monitoring for 2011 or first half of 2012. Discussed monitoring requirements with Mr. Rollins who had worked at the mine several years ago, but just recently returned to oversee mining operations. After the records review, rode through the mine site with Mr. Rollins and Mr. Reagan to make observations of site conditions and basins. Expressed to Mr. Rollins that the site appeared to be in need of better operation and maintenance as several internal areas had experienced major erosion and some of the basins contained significant amounts of sediment. All sediment basins should be continually maintained so that any discharges are free of turbid water and/or sediment. Any accumulated sediment in the basins should be removed and the dimensions (length, width, depth) as well as outlet structures properly maintained so they function as intended. The establishment of vegetation is encouraged near and around the sediment basins and other areas where excavation or grading is not being conducted. In reviewing the USGS topo map, it appears that the origin of the stream is a good distance away from the pond (approximately 400' using Terrain Navigator) with potential wetlands in between. In short, what is depicted on the USGS map is an accurate representation of what is on the ground. Belinda and I were able to traverse the wooded area beyond the pond for about 150' and other than obvious wetland areas could not locate a well-defined stream channel. In speaking with Branch and mine personnel, the "farm pond" was present when GS Materials purchased the property about 3 years ago. The pond had no outlet structure or pipe, simply an earthen berm separating the pond from the adjacent wetlands. They basically expanded the pond and installed a rock overflow structure within a section of the berm. In my opinion, what I believe is the case here is that the previous landowner MAY have installed the pond in a wetlands area, although this would be near impossible to prove at this point, and it is NOT part of the classified stream. With the installation of the rock overflow, stormwater from the pond would discharge into a wetlands area and then eventually the stream. I'm unclear as to how the GIS layer picks up the pond as being classified. The screen shots you provided simply refer to the classification of Cypress Creek as being from the source to Gum Swamp. I do not think the pond is the source, but rather the source is several hundred feet from the pond, which is what the USGS map shows. Please advise if I'm missing something or you require further information. On Sept. 8, 2008, personnel of this office inspected your mine, copy of inspection report attached, and determined that one or more of the conditions contained in your mining permit are being violated. The conditions being violated are as follows: Operating Condition No. 4A: Adequate mechanical barriers, including but not limited to diversions, earthen dikes, sediment retarding structures, riprap pits or ditches, shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surfaces areas or into any lake, wetland or natural watercourse in proximity to the affected land. The berm on the northeast side of the site had been breached, resulting in off -site sediment (approximately 0.45 acres impacted). The berm was also shorter than its specified height of 5.5' and the diversion berm around the mine area had not been seeded and mulched as approved in the mine application. 2. Operating Condition No. 4113: Mining activities including installation and maintenance of the approved sediment basins and associated diversions shall be conducted as shown on the mine maps — revised May 5, 2007 and supplemental information received on March 14. 2007, April 24, 2007 and May 5, 2007. The sediment basin on the northeast side of the site was not placed in the specified location (adjacent to the berm) shown on the mine map last revised on May 5, 2007. It also did not have the specified 37' long x 4.5' high stone section, nor did the southwest sediment basin have the specified 34' long x 4.5' high stone section. The isberm was also lower than its specified height of 5.5'. r ,. 3. Operating Condition No. 5: All mining permit boundaries and the affected boundaries shall be permanently marked at the site at 100' foot intervals unless the line of site allows for larger spacing intervals. The mining permit boundaries have not permanently marked. 4. Operating Condition No. 9: Sufficient buffer (min. 30' undisturbed) shall be maintained between any excavation and any mining permit boundary or right- of -way to protect adjacent property, with the exception that a minimum 75 foot undisturbed buffer shall be maintained along the Faith Baptist -Church property line and a minimum 50 foot undisturbed buffer shall be maintained along property lines of the residential lots along the southeast section of the proposed mine site. A minimum 30' undisturbed buffer between the mining excavation and the mining permit boundary has not been maintained. 5. Operating Condition No. 12: An Annual Reclamation Report shall be submitted by Feb. 15f of each year until reclamation is completed and approved. An Annual Reclamation Report was not submitted for 2007. Install the sediment basin on the northeast side of the site in the -- correct location as shown on plans and additional measures as necessary to prevent from leaving the mine site. The Sediment , basin on east side is supposed to have a 37' long and 4.5' high stone section and sediment basin on west side is supposed to have a 34' long and 4.5' high stone section. Install sediment basins according to specifications of the site plan in mining permit application. C. Regrade/repair and stabilize with groundcover the areas where gully erosion is occurring along slopes near berm on northeast side of mine. D. Permanently mark all mining permit boundaries at 100' foot intervals unless line of site allows for larger spacing intervals. E. Provide and/or reestablish the required 30' buffer on northeast side of mine as stated in mine permit to protect adjacent property. F. Submit an Annual Reclamation Report for 2007. If the above violations are not corrected within 30days following your receipt of this Notice, appropriate enforcement action will be taken and a civil penalty may be assessed against your company. Sufficient buffer (minimum 50 foot undisturbed) shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland. B. Any mining activity affecting waters of the State, water of the U. S., or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the N. C. Environmental Management Commission. . + 4. A. All mining permit boundaries (138.2) and the affected area boundaries (141.56 acres) shall be permanently marked at the site on 100-foot intervals unless the line of sight allows for larger spacing intervals. 6. The angle for graded slopes and fills shall be no greater than the angle, which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with ground cover, devices or structures sufficient to restrain such erosion. Page 4 7. The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 8. Existing vegetation or vegetated earthen berms shall be maintained between the mine and public thoroughfares whenever practical to screen the operation from the public. 9. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14) of the N.C. Mining Act of 1971): 1. on -site generated land clearing debris 2. conveyor -belts 3. wire cables 4. v-belts 5. steel reinforced air hoses 6. drill steel D. If mining refuse is to be permanently disposed within the mining boundary, the following information must be provided to and approved by the Division of Land Resources prior to commencement of such disposal: the approximate boundaries and size of the refuse disposal area; Page 5 2. a list of refuse items to be disposed; 3. verification that a minimum of 4 feet of cover will be provided over the refuse; 4. verification that the refuse will be disposed at least 4 feet above the seasonally high water table; and - 5. -verification that a_permanent vegetative groundcover will be established. 12. An an.nual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and'approved. 13. The operator shall notify the Department in writing of the desire to delete, modify or otherwis :.:change any part of the mining, reclamation, or-erosion/sediment control plan contained in the approved application for a mining permit and -any approved revisions to it. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. 14. The security, which was posted pursuant to N.C.G.S. 74-54 in the form of a $564,100.00 surety bond, is required for this site, is sufficient to cover the operation as indicated in the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 15. A. Authorized representatives of the Division of Archives and History shall be granted access to the site to determine the presence of significant archaeological resources. B. Pursuant to N. C. G. S. 70 Article 3, "The Unmarked Human Burial and Human Skeletal Remains Protection Act, " should the operator or any person in his employ encounter human skeletal remains, immediate notification shall be provided to the county medical examiner and the chief archaeologist, North Carolina Division of Archives and History. Page 6 APPROVED RECLAMATION PLAN The Mining Permit -incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By. G.S. 74-53 1. The final slopes in all excavatici t in soil, sand, gravel and other unconsolidated materials shall be at such ar!,angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, or likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: Provided further, and subject to the Reclamation schedule, the planned reclamation shall be to regrade and satisfactorily revegetate any disturbed areas. 2. The specifications for surface gradient restoration to a surface suitable for planned future use are as follows: A. It also did not have the specified 37' long x 4.5' high stone section, nor did the southwest sediment basin have the specified 34' long x 4.5' high stone section. The berm was also lower than its specified height of 55. 3: Operating Condition No. 5: All mining permit boundaries and the affected boundaries shall be permanently marked at the site at 100' foot intervals unless the line of site allows for larger spacing intervals. Operating Condition No: 9: Sufficient buffer (min. 30' undisturbed) shall be maintained between any excavation and any mining permit boundary or right- of -way to protect adjacent property, with the exception that a minimum 75 foot undisturbed buffer shall be maintained along the Faith Baptist Church property line and a minimum 50 foot undisturbed buffer shall be maintained along property lines of the residential lots along the southeast section of the proposed mine site. A minimum 30' undisturbed buffer between the mining excavation and the mining permit boundary has not been maintained. 5. Operating Condition No. 12: An Annual Reclamation Report shall be submitted by Feb. 1" of each year until reclamation is completed and approved. Provide and/or reestablish the required 30' buffer on northeast side of mine as stated in mine permit to protect adjacent property. F. Submit an Annual Reclamation Report for 2007. The angle for graded slopes and fills shall be no greater than the angle, which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site -damage because of siltation, shall be planted or otherwise provided with ground cover, devices or structures sufficient to restrain such erosion. Page 4 7. The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 8. Existing vegetation or vegetated earthen berms shall be maintained between the mine and public thoroughfares whenever practical to screen the operation from the public. 9. Sufficient buffer (irirm-ruin 30 foot undisturbed toot undisturbed) shall be maintained between any excavation and'any mining permit boundary or right-of-way to protect adjacent property, with the exception -that a minimum 75 foot undisturbed buffer shall be maintained along the Faith Baptist Church property line and a minimum 50 foot undisturbed buffer shall be maintained along property lines of the residential lots along the southeast section of the proposed mine site., 10. A physical barrier consisting of a fence or earthen berm, etc., -shall be maintained around the perimeter of any highwall. 11. A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management.- No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14) of the N.C. Mining Act of 1971): 1. on -site generated land clearing debris 2. conveyor belts 3. wire cables 4. . v-belts 5. steel reinforced air hoses 6. drill steel D. If mining refuse is to be permanently disposed within the mining boundary, the following information must be provided to and approved by the Division of Land Resources prior to commencement of such disposal: the approximate boundaries and size of the refuse disposal area; Page 5 2. a list of refuse items to be disposed; 3. verification that a minimum of 4 feet of cover will be provided over the refuse; 4. verification that the refuse will be disposed at least 4 feet above the seasonally high water table; and 5. -verification that a permanent vegetative groundcover will be established. 12. An rinnual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 13. The operator shall notify the Department in writing of the desire to delete, modify or otherwis , change any part of the mining, reclamation;' or erosion/sediment control plan contained in the approved application for a mining permit and any approved revisions to it. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. 14. The security, which was posted pursuant to N.C.G.S. 74-54 in the form of a $564,100.00 surety bond, is required for this site, is sufficient to cover the operation as indicated in the approved application. This security must remain in force for this -permit to be valid. The total affected land shall not exceed the bonded acreage. 15. A. Authorized representatives. of the Division of Archives. and History shall be -granted access to the site to determine the presence of significant archaeological resources. B. Pursuant to N. C. G. S. 70 Article 3, "The Unmarked Human Burial and Human Skeletal Remains Protection Act, " should the operator or any person in his employ encounter human skeletal remains, immediate notification shall be provided to the county medical examiner and the chief archaeologist, North Carolina Division of Archives and History. As a reminder, mining permits can only be issued for up to 10 years; thus, all mine and reclamation maps must only denote those activities that are intended to be conducted during the life of the mining permit. Note that all buffers must be located within the mining permit boundaries.
