Dear Mr. Williams:
In accordance with your application for a discharge permit received on March 27, 2008,
we are forwarding herewith the subject certificate of coverage to discharge under the subject
state — NPDES general permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently
amended),
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
Please be aware that mine dewatering at your site has the potential to impact adjacent
wetlands. The specific requirements for mine dewatering at facilities near. wetlands can be found
in Section C, Part 1 of your permit (Part III Page 5 of 9). You must have an approved
Operation and Monitoring Plan before mine dewatering discharges occur at your facility.
Discharging mine dewatering wastewater without Plan approval will be subject to enforcement
action. An Operation and Monitoring Plan for your facility must be submitted to the Wilmington
Regional Office within 60 days of your receipt of this permit. Contact Linda Willis at the
Wilmington Regional Office at (910) 796-7215 for more information about the approval
process.
Please note that mine dewatering wastewater includes wet pit overflows caused solely
by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of
this water (and any stormwater commingled with it) is subject to the effluent limitations in this
permit.
This general permit allows the discharge of stormwater and certain types of wastewater
from your facility. In your application, you specified that only mine dewatering water would be
discharged from this facility. If separate point -source discharges of stormwater occur (i.e.,
stormwater not combined with mine dewatering water), you will be required to adhere to the
conditions in this permit for stormwater discharges.

Additionally, new coastal stormwater management -rules (SESSION LAW 2008-211)
were implemented October 1st, 2008. Due to these new rules you may be required to apply for
an additional Coastal State'Stormwater Permit. Please contact Kelly Johnson in the
Wilmington, Regional Office at 910- 796-7345 to determine if you will be required to submit an
application for this additional permit.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land
Resources, Coastal Area Management Act or any other federal or local governmental permit that
may be required.

The Division of Water Quality's Stormwater Permitting Unit received a National Pollutant Discharge
Elimination System (NPDES) permit application for Williams Mine on March 27, 2008. The application
did not include a copy of an associated application for a mining permit submitted to the Division of Land
Resources (DLR). Please be aware that the issuance of an NPDES permit is contingent upon the issuance of
an associated mining permit from DLR. Our office will process your stormwater permit application once a
DLR mining permit has been issued for your project. Please provide the Mining Permit number and
submit a copy of your application.
We request that you obtain an approved wetlands delineation from the U.S. Army Corps of
Engineers. Wetlands shall be clearly delineated on the site plan and marked on site. Please note that we
request that along with wetlands boundaries being delineated, a 50' buffer around all wetlands and surface
waters be marked.
Additionally, mine dewatering activities that have the potential to drain wetlands or otherwise impact
surface water or groundwater MUST develop and implement an Operation and Monitoring (O&M) Plan
that has been approved by the Division. The O&M Plan should be submitted to the Regional Office and
must be approved prior to operation. The plan shall include, but is not limited to: (1) Groundwater
monitoring strategies to demonstrate the effect of pumping and to establish any pumping regime necessary
to reduce impacts, and (2) Detailed plans to maintain surrounding hydrology and respective monitoring to
demonstrate compliance.
A Plan for your facility must be submitted to the Wilmington Regional Office before your receipt of
an NPDES permit. We encourage you to contact Ed Beck and/or Linda Willis at the Washington
Regional Office at (910) 795-7215 to address any wetland concerns for your facility in order to ensure a
successful NPDES application review. and to schedule the date for receipt of your O&M.
Please be aware that your NPDES permit will require that dewatering operations do not impact
wetlands. The specific requirements for mine dewatering at facilities with the potential to impact
wetlands can be found in the text of the general NPDES mining permit number NCG 020000 available
on our website, http://h2o.enr.state.nc.us/su/Forrns_Documents.htm. See Part II, Section C, Item I of

3. 1 agree that bulk storage of petroleum products and other chemicals shall have adequate
protection so as to contain all spills on the site.
4. 1 agree that solid wastes will be disposed of in accordance with N.C. statutes and rules
governing solid waste disposal.
5. I agree that maintenance activities for vehicles and heavy equipment will be performed so as to
not result in contamination of the surface or ground waters.

BACKGROUND: MR. WILLIAMS HAS APPLIED FOR A MINING PERMIT FOR
PROPERTY HE OWNS 1N THE NEWPORT TOWNSHIP OFF OF MILLIS ROAD. IN
THE PROCESS OF THIS APPLICATION, HE HAS ALSO APPLIED FOR NPDES
GENERAL PERMIT NCG020000 FOR THE DISCHARGE OF STORMWATER FOR
NECESSARY MINE DEWATERING. THIS PROPOSED MINE IS FOR
EXTRACTION OF SAND AND 1S LIMITED TO 20 FT DEEP EXCAVATION FROM
THE SURFACE. THE SUBJECT PROPERTY IS OWNED BY MR. WILLIAMS.
PURPOSE: THIS OPERATION AND MAINTENANCE PLAN IS BEING
DEVELOPED TO ENSURE SITE OPERATIONS WILL NOT IMPACT ANY
ADJACENT WETLANDS AND SURFACE WATERS.
OPERATIONAL ACTIVITIES:
EXCAVATION ACTIVITIES ARE EXPECTED TO OCCUR IN ROUGHLY THREE
CYCLES PER YEAR. EACH CYCLE WOULD CONSIST OF DEWATERING THE

APPROXIMATELY FOUR DAYS OF SAND MINING OCCURRING. THIS WOULD
STOCKPILE APPROXIMATELY 200 LOADS OF MATERIAL PER CYCLE. THIS
COULD BE REPEATED, BASED ON DEMAND UPTO THREE TIMES OR MORE
PER YEAR, WITH EACH CYCLE LASTING LAST THAN TWO WEEKS. DURING
THE MINING PROCESS, IT IS EXPECTED THAT SMALLER PUMPS WOULD
KEEP UP WITH GROUNDWATER INFILTRATION. THESE PUMPS WOULD BE
1N THE 200 GPM RANGE.
STORMWATER BEST MANAGEMENT PRACTICES:
NO ACTIVITIES ARE PROPOSED ON THIS SITE OTHER THAN SAND MINING,
STOCKPILING AND HAULING OF SAND FOR SALE. DEWATERING
ACTIVITIES ARE PROPOSED TO BE PUMPED INTO SEDIMENT BASIN AS
SHOWN ON THE MINE MAP. THE SEDIMENT BASIN IS 60'XI00'X5' DEEP
AND CONTAINS A RIPRAP LINED OUTFALL IO'XIO'X2' BEFORE
DISCHARGING INTO AN EXISTING DITCH.
THE OWNER SHALL IMPLEMENT THE FOLLOWING ADDITIONAL BEST
MANAGEMENT PRACTICES:
1) SITE INSPECTIONS SHALL OCCUR DURING ALL MINING OPERATIONS
TO INSURE THAT CONTAMINENTS DO NOT ENTER SURFACE
WATERS. ADDITIONAL BERMS OR DIKES SHALL BE CONSTRUCTED
AS MAY BE REQUIRED TO ENSURE THAT STORMWATER RUNOFF
WILL DIRECTED BACK INTO THE MINING PIT OR THROUGH THE
SEDIMENT TRAP.
2) LAND DISTURBANCE SHALL BE MINIMIZED TO PREVENT SEDIMENT
FROM LEAVING THE SITE. ANY SEDIMENT THAT INADVERTENTLY
ACCUMULATES IN THE PROJECT DITCH SHALL BE REMOVED AND
THE DITCH RE -STABILIZED. SILT FENCE SHALL BE INSTALLED AS
NECESSARY TO PREVENT SEDIMENTATION FROM REACHING THE
OUTLET DITCH.
3) THE SEDIMENT STORAGE BASIN SHALL BE CLEANED OUT AND
RESTORED TO ITS ORIGINAL DEPTH UPON REACHING 50% OF ITS
CAPACITY.
4) EQUIPMENT UTILIZED 1N THE MINING OPERATION SHALL BE KEPT
IN GOOD REPAIR AND INSPECTED DAILY TO ENSURE NO LEAKING
OF FUELS, LUBRICANTS, COOLANTS, HYRAULIC FLUIDS OR OILS.
SHOULD ANY LEAKAGE OCCUR IT SHOULD IMMEDIATELY BE
CLEANUP TO PREVENT ENTRY INTO ANY SURFACE WATERS.
ANALYTICAL AND QUALITATIVE MONITORING
THE OWNER SHALL IMPLEMENT MONITORING ACTIVITIES AS REQUIRED
BY THE GENERAL PERMIT NCG020000. PART III SECTION A AND C APPLIES
AND REQUIRES TESTING. THE OWNER SHALL SECURE APPROPRIATE
TESTING PERSONNEL TO PERFORM THESE TESTS AS REQUIRED.
DEWATERING CONE OF INFLUENCE- WETLANDS DO NOT EXIST WITHIN
THE PROJECT BOUNDARY. WITH THE MAXIMUM EXCAVATION DEPTH OF
20' AND WITH THE MAXIMUM DEWATERING OCCURRING IN TWO WEEKS

BACKGROUND: MR. WILLIAMS HAS APPLIED FOR A MINING PERMIT FOR
PROPERTY FIE OWNS IN THE NEWPORT TOWNSHIP OFF OF MILLIS ROAD. I111\1
THE PROCESS OF THIS APPLICATION, HE HAS ALSO APPLIED FOR NPDES
GENERAL PERMIT NCG020000 FOR THE DISCHARGE OF STORMWATER FOR
NECESSARY MINE DEWATERING. THIS PROPOSED MINE IS FOR
E✓XTRP.CTION OF SAND AND IS LIMITED TO 20 FT DEEP EXCAVATION FROM
THE SURFACE. THE SUBJECT PROPERTY IS OWNED BY MR. WILLIAMS.
PURPOSE: THIS OPERATION AND MAINTENANCE PLAN IS BEING
DEVELOPED TO ENSURE SITE OPERATIONS WILL NOT IMPACT ANY
ADJACENT WETLANDS AND SURFACE WATERS.
OPERATIONAL ACTIVITIES:
EXCAVATION ACTIVITIES ARE EXPECTED TO OCCUR IN ROUGHLY THREE
CYCLES PER YEAR. EACH CYCLE WOULD CONSIST OF DEWATERING THE✓
EXISTING POND AND WOULD RANGE INITIALLY FROM APPROXIMATELY A
FIVE DAY DEWATERING CYCLE, ASSUMING 1500 GPM PUMPS, TO TEN
DAYS IN THE FUTURE, EXCAVATION ACTIVITIES WOULD BEGIN AND
APPROXIMATELY FOUR DAYS OF SAND MINING OCCURRING. THIS WOULD
STOCKPILE APPROXIMATELY 200 LOADS OF MATERIAL PER CYCLE. THIS
COULD BE REPEATED, BASED ON DEMAND UPTO THREE TIMES OR MORE
PER YEAR, WITH EACH CYCLE LASTING LAST THAN TWO WEEKS. DURING
THE MINING PROCESS, IT IS EXPECTED THAT SMALLIsR PUMPS WOULD
KEEP UP WITH GROUNDWATER INFILTRATION. THESE PUMPS WOULD BE
IN THE 200 GPM RANGE.
STORMWATER BEST MANAGEMENT PRACTICES:
NO ACTIVITIES ARE PROPOSED ON THIS SITE OTHER THANT SAND MINING,
STOCKPILING AND HAULING OF SAND FOR SALE, DFWATERING
ACTIVITIES ARE PROPOSED TO BE PUMPED INTO A SEDIMENT BASIN AS
SHOWN ON THE MINE MAP. THE SEDIMENT BASH IS 60'XI00'X5' DEEP
AND CONTAINS A RIPRAP LINED OUTFALL 10'XI0'X2' BEFORE
DISCHARGING INTO AN EXISTING DITCH.
THE OWNER SHALL IMPLEMENT THE FOLLOWING ADDITIONAL BEST
MANAGEMENT PRACTICES:
I) SITE INSPECTIONS SHALL OCCUR DURING ALL MINING OPERATIONS
TO INSURE THAT CONTAMINENTS DO NOT ENTER SURFACE
WATERS. ADDITIONAL BERMS OR DIKES SHALL BE CONSTRUCTED
AS MAY BE REQUIRED TO ENSURE THAT STORMWATER RUNOFF
WILL DIRECTED BACK INTO THE MINING PIT OR THROUGH THE
SEDIMENT TRAP.
2) LAND DISTURBANCE SHALL BE MINIMIZED TO PREVENT SEDIMENT
FROM LEAVING THE SITE. ANY SEDIMENT THAT INADVERTENTLY
ACCUMULATES IN THE PROJECT DITCH SHALL BE REMOVED AND
THE DITCH RE -STABILIZED. SILT FENCE SHALL BE INSTALLED AS
NECESSARY TO PREVENT SEDIMENTATION FROM REACHING THE
OUTLET DITCH.
3) THE SEDIMENT STORAGE BASIN SHALL BE CLEANED OUT AND
RESTORED TO ITS ORIGINAL DEPTH UPON REACHING 50% OFITS
CAPACITY.
4) EQUIPMENT UTILIZED IN THE MINING OPERATION SHALL BE KEPT
IN' GOOD REPAIR AND INSPECTED DAILY TO ENSURE NO LEAKING
OF FUELS, LUBRICANTS, COOLANTS, HYRAULIC FLUIDS OR OILS.
SHOULD ANY LEAKAGE OCCUR IT SHOULD IMMEDIATELY BE
CLEANUP TO PREVENT ENTRY INTO ANY SURFACE WATERS.
ANALYTICAL AND QUALITATIVE MONITORING
THE OWNER SHALL IMPLEMENT MONITORING ACTIVITIES AS REQUIRED
BY THE GENERAL PERMIT NCG020000. PART III SECTION A AND C APPLIES
AND REQUIRES TESTING. THE OWNER SHALL SECURE APPROPRIATE
TESTING PERSONNEL TO PERFORM T14ESE TESTS AS REQUIRED,
DEWATERING CONE OF INFLUENCE- WETLANDS DO NOT EXIST WITHIN
THE PROJECT BOUNDARY. WITH THE MAXIMUM EXCAVATION DEPTH OF
20' AND WITH THE MAXIMUM DEWA`I ERING OCCURRING IN TWO WEEKS
PER CYLE, IT IS NOT ANTICIPATED THAT THE HYDROLOGY OF ANY
ADJOINING PROPERTIES WILL BE SIGNIFICANTLY IMPACTED.
MONITORING WELL INSTALLATION- DUE TO THE LACK OF EXISTING
WETLANDS WITHIN THE PROJECT BOUNDARIES IT IS NOT ANTICIPATED
THAT ANY MONITORING WELLS SHALL BE NEEDED.
