REGAN Secretary TRACY DAVIS Director On March 16, 2017, Rebecca Hersey and Mike Lawyer with the Fayetteville Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) conducted a site inspection for the Cumberland Quarry facility located on McCormick Bridge Road in Cumberland County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. Mr. Brian North, Division Environmental/Land Manager, and Mr. Todd Bouquin, Plant Manager, were also present during the inspection and their time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES General Permit NCG020000, under Certificate of Coverage NCG020676. Permit coverage authorizes the discharge of stormwater and mine dewatering from the facility to receiving waters designated as the Little River (Lower Little River), a Class C waterbody in the Cape Fear River Basin. As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG020000 permit. Please refer to the enclosed Compliance Inspection .Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. Mine site has been inactive (no excavation or material processing) for several years. Site access has been given to a contractor to occasionally obtain previously processed material from a stockpile. During the inspection, observations were made of the quarry pit, settling/recycle ponds and discharge outfalls. Since the site is inactive with no office or onsite personnel, records are maintained at the company's office in Raleigh. A request was made at the time of inspection to provide a copy of the site's Stormwater Pollution Prevention Plan (SPPP) and monitoring records from the previous three years to the regional office for review. An e-mail with the requested documents attached was received.on March 23, 2017. Facility's SPPP contains all permit -required components with the exception of documentation of an annual review/update per Part 111, item 8 of the NCG020000 General Permit. At a minimum, there should be annual documentation that the site has remained inactive. Monitoring records from 2014, 2015 and 2016 all indicate no discharges of stormwater or process wastewater. This is the case at Cumberland Quarry where we still have an active Mining Permit (#26-51). No activity (clearing/grading/excavating/mine dewatering) is taking place as the operation has been temporarily suspended due to slow economic activity and there are currently no employees at the site. This shut down will be temporary in nature, and as we discussed the Mine Permit will remain active. At this point it is uncertain when the quarry will be active, however the sale of rock products from existing material stockpiles will continue from time to time. Apparently, as part of their approval for their mining permit they were asked by DLR to submit a monitoring program and recharge plan to mitigate any wetland impacts. Martin Marietta responded back that they would install monitoring wells to obtain groundwater data and would develop a - recharge plan if the data ever indicated an impact. DLR then responded back that a quarterly report cn any ground water effects would need to be submitted and issued the mining permit. I feel that this information is sufficient enough in regards to a pumping plan and will keep the fax in with the permit file once issued. I recommend proceeding with permit issuance. MINING PERMIT EXPIRATION DATE: January 27, 2016 Page 2 In accordance with the application for this mining permit, which is hereby approved by the Department of Environment and Natural Resources hereinafter referred to as the Department, and in conformity with the approved Reclamation Plan attached to and incorporated as part of this permit, provisions must be made for the protection of the surrounding environment and for reclamation of the land and water affected by the permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or other security on file with the Department, and may survive the expiration, revocation or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. Expiration Date This permit shall be effective from the date of its issuance until January 27, 2016. Conditions This Permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and to the following conditions and limitations: Page 3 OPERATING CONDITIONS: Wastewater and Quarry Dewaterinq A. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. B. Any storm water runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Division of Water Quality to secure any necessary storm water permits or other approval documents. 2. Air Quality and Dust Control A. Any mining related process producing air contaminant emissions including fugitive dust shall be subject to the requirements and rules promulgated by the N.C. Environmental Management Commission and enforced by the Division of Air Quality. B. The permanent access (plant entrance) road shall be permanently stabilized. During processing operation, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. 3. Buffer Zones A. Any mining activity affecting waters of the State, waters of the U. S., or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the N. C. Environmental Management Commission. B. Sufficient buffer shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland. C. All buffer zones shown on the Mine Map last revised November 16, 2005 shall be maintained to protect adjoining property. These buffer zones, with the exception of the installation of required sediment control measures and approved earthen berms, shall remain undisturbed. Page 4 4. Erosion and Sediment Control A. The operator shall notify the Fayetteville Regional Office, Land Quality Section, at least 48 hours prior to beginning any of the initial land disturbing activities indicated in the approved application for a mining permit and any modifications to this permit thereafter. B. Adequate mechanical barriers including, but not limited to diversions, earthen dikes, check dams, sediment retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake, wetland or natural watercourse in proximity to the affected land. C. All mining activities, including the installation and maintenance of all erosion and sedimentation control measures, shall be conducted as indicated on the Mine Maps last revised November 16, 2005 and supplemental information received by the Land Quality Section on August 11, 2005 and September 23, 2005 and November 16, 2005. D. An erosion and sediment control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities not indicated on the revised erosion control plan or mine maps submitted with the approved application for a mining permit and any approved revisions to it. Such areas include, but are not limited to, expansion outside of the approved pit area, creek crossings, or expansion of overburden or waste disposal areas. 5. Groundwater Protection A. The observation wells denoted on the Mine Map last revised November 16, 2005 and the Memorandum from Kimberly -Horn and Associates, Inc. dated November 14, 2005 shall be monitored at least 180 days prior to initiating any excavations of consolidated material (rock) in the initial pit area to allow for the determination of pre-existing (static) groundwater levels. B. The observation wells shall be drilled wells cased into consolidated rock and grouted to the surface. The wells (boreholes) shall be extended at least 50 feet below static water level, or at least 50 feet into unweathered rock, whichever is deeper. The wells shall be secured against unauthorized entry with a lockable cap. The necessary permits or approvals to construct these wells shall be obtained from the N.C. Division of Water Quality. Page 5 C. The observation wells shall be monitored biweekly at the same day and approximate time of day. The static water levels shall be measured with an accuracy of plus or minus 0.1 foot and shall be referenced to a datum point and a record of the water levels maintained. The daily precipitation and the volume of pit water discharge shall also be recorded. Copies of these records shall be provided to the Department on or about the end of each quarter. Static water level monitoring frequency may be increased or decreased as deemed appropriate by the Department. Included with the reported data, a quarterly report on any observed affects on ground water levels in relation to wetland areas shall be submitted. D. In the event that monitoring indicates it appears mining activities are having an adverse effect on surrounding wetlands, an appropriate recharge plan shall be submitted to and approved by the Department to mitigate possible_ impacts to the wetland areas. $. Graded Slopes and Fills A. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with groundcover, devices or structures sufficient to restrain such erosion. B. Overburden cut slopes along the perimeter of the quarry opening shall be graded to a minimum 2 horizontal to 1 vertical or flatter and shall be stabilized within 60 days of completion. Furthermore, a minimum ten (10) foot wide horizontal safety bench shall be provided at the top of the rock and at the toe of any overburden slope. 7. Surface Drainage The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 8. Blasting The operator shall monitor each blast with a seismograph located at a distance no farther than the closest off site regularly occupied structure not owned or leased by the operator. A seismographic record including peak particle velocity, air overpressure, and vibration frequency levels shall be kept for each blast (except as provided under Operating Condition Nos. 8B and 8D of this permit). D = Distance from the blast site to the nearest inhabited building not owned or leased by the mine operator (feet). DS = Scaled distance factor. V = Peak Particle Velocity (inches per second). Page 7 The peak particle velocity of any component shall not exceed 1.0 inch per second, for the purposes of this Section. C. Air blast With Monitoring; Air blast overpressure resulting from surface blasting shall not exceed 129 decibels linear (dBL) as measured at the immediate location of any regularly occupied building not owned or leased by the operator outside of the permitted area such as a dwelling house, church, school, or public, commercial or institutional building, unless an alternate level based on the sensitivity of the seismograph microphone as specified below is being used: Lower Frequency Limit of Max Level, Measuring System, in Hz _ in dBL 0.1 Hz or lower -flat response 134 peak 2.0 Hz or lower -flat response 133 peak 6.0 Hz or lower -flat response 129 peak D. Air blast Without Monitoring: In the event of seismograph malfunction or other condition which prevents monitoring, blasting shall be conducted in accordance with the following formulas: To convert U (psi) to P (dBL): U = 82 (D/W4.33)-1.2 P = 20 x log (U/2.9x10-9) Confined Air blast/Overpressure (dBL) for quarry situation: A=P-35 U = Unconfined air overpressure (pounds per square inch). W = Maximum charge weight of explosives per delay period of 8.0 milliseconds or more (pounds). D = Distance from the blast site to the nearest inhabited building not owned or leased by the mine operator (feet). P = Unconfined air overpressure (decibels). A = Air blast or air overpressure for typical quarry situations (decibels). The air blast/overpressure shall not exceed 129 decibels, for the purposes of this Section. Page 8 E. Record Keeping: The operator shall maintain records on each individual blast describing: the total number of holes; pattern of holes and delay of intervals; depth and size of holes; type and total pounds of explosives; maximum pounds per delay interval; amount of stemming and burden for each hole; blast location; distance from blast to closest offsite regularly occupied structure; and weather conditions at the time of the blast. Records shall be maintained at the permittee's mine office and copies shall be provided to the Department upon request. F. Excessive Ground Vibration/Air blast Reporting: If ground vibration or Air blast limits are exceeded, the operator will immediately report the event with causes and corrective actions to the Department. Use of explosives at the blast site that produced the excessive reading shall cease until corrective actions approved by the Department are taken. However, blasting may occur in other approved areas within the permitted boundary. Authorization to blast at the blast site may be granted at the time of the verbal reporting of the high ground vibration or high air blast reading if the circumstances justify verbal approval. Failure to report will constitute a permit violation. G. Flyrock Prevention: The operator shall take all reasonable precautions to ensure that flyrock is not thrown beyond areas where the access is temporarily or permanently guarded by the operator. Failure to take corrective measures to prevent flyrock and repeated instances of flyrock shall be considered a violation of the Mining Permit. H. Flyrock Reporting: Should flyrock occur beyond the permitted and guarded areas, the operator shall immediately report the incident to the Department. Further use of explosives on the mine site shall be suspended until the following actions have been taken: A thorough investigation as to the cause(s) of the incident shall be conducted. 2. A report detailing the investigation shall be provided to the Department within 10 days of the incident. The report shall, at a minimum, document the cause(s) of the incident along with technical and management actions that will be taken to prevent further incidents. The report shall meet with the approval of the Department before blasting may resume at the mine site. Page 9 Studies: The operator shall provide to the Department a copy of the findings of any seismic studies conducted at the mine site in response to an exceedence of a level allowed by these blasting conditions. The operator shall make every reasonable effort to incorporate the studies' recommendations into the production blasting program. J. Notice: The operator shall, when requested by the Department, give 24-hour advance notice to the band Quality Section Regional Office prior to any blast during a period for which notice is requested. 9. High Wall Barrier A physical barrier consisting of large boulders placed end -to -end or fencing shall be maintained at all times along the perimeter of any highwall to prevent inadvertent public access. In addition, a minimum 10 foot wide horizontal safety bench shall be provided at the junction between the top of rock and the toe of any overburden cut slope. 10. Visual Screening A. Existing vegetation shall be maintained between the mine and public thoroughfares to screen the operation from the public. Additional screening methods, such as constructing earthen berms, shall be employed as deemed appropriate by the Department. B. Vegetated earthen berms shall be located and constructed as shown on the Mine Maps last revised November 16, 2005. In addition to grasses, long leaf and/or Virginia pines or other acceptable evergreen species shall be planted as deemed appropriate by the Department to improve visual and noise buffering. 11. Plan Modification The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit and any approved revisions to it. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. Page 10 12. Refuse Disposal A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14) of the N.C. Mining Act of 1971): 1. on -site generated land clearing debris 2. conveyor belts 3. wire cables 4. v-belts 5. steel reinforced air hoses 6. drill steel D. If mining refuse is to be permanently disposed within the mining permit boundary, the following information must be provided to and approved by the Division of Land Resources prior to commencement of such disposal- 1 . the approximate boundaries and size of the refuse disposal area; 2. a list of refuse items to be disposed; 3. verification that a minimum of 4 feet of cover will be provided over the refuse; 4. verification that the refuse will be disposed at least 4 feet above the seasonally high water table; and 5. verification that a permanent vegetative groundcover will be established 13. Annual Reclamation Report An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. Page 11 14, Bondin The security, which was posted pursuant to N.C.G.S. 74-54 in the form of a $500,000.00 blanket bond, is sufficient to cover the operation as indicated in the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 15. Archaeological Resources Authorized representatives of the Division of Archives and History shall be granted access to the site to determine the presence of significant archaeological resources. Page 12 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By-G.S. 74-53 The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, or are likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: Provided further, and subject to the Reclamation Schedule, the planned reclamation shall be to allow the quarry excavation to fill with water, provide a permanent barricade (fence) along the top of any high wall, and grade and revegetate any areas in unconsolidated material. 2. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: Page 13 A. All areas of unconsolidated material such as overburden or waste piles shall be graded to a 2 horizontal to 1 vertical or flatter slope and terraced as necessary to insure slope stability. B. Any settling ponds and sediment control basins shall be backfilled, graded, and stabilized or cleaned out and made into acceptable lake areas. C. The processing, stockpile, and other disturbed areas neighboring the mine excavation shall be leveled and smoothed. D. Compacted surfaces shall be disced, subsoiled or otherwise prepared before revegetation. E. No contaminants shall be permanently disposed of at the mine site. On -site disposal of waste shall be in accordance with Operating Conditions Nos. 1 Z.A. through D. F. The affected land shall be graded to prevent the collection of noxious or foul water. 3. In addition, the permittee shall consult with a professional wildlife biologist with the N.C. Wildlife Resources Commission to enhance post -project wildlife habitat at the site. 4. Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. Martin Marietta Materials is a mining company engaged in the production of crushed stone for the construction industry and as a mining company is regulated by the U.S. Department of Labor's Mine Safety and Health Administration (MSHA) rather than OSHA. If you have not worked with MSHA previously, there are several things you should be aware of: • MSHA inspects our plants at least twice a year. These are thorough inspections of the entire operation, including contractors, with nothing overlooked. • Asa contractor on mine property, you are also included in MSHA's jurisdiction and your equipment and operating methods are also subject to inspection. • As a contractor on mine property, you are subject to MSHA's training regulations, known as Part 46 training. This requires you to have a training plan which meets their requirements and maintain training records on your employees. These are subject to inspection by MSHA. Martin Marietta Materials requires these records and training plan to be kept on site or readily available. • If you are found to be not in compliance with MSHA regulations, your operation can be shutdown until it is brought into compliance. You may also be subject to fines which could go as high as $50,000.00 per infraction. • We, as the mining company, are responsible for our contractors and may also be fined if the contractor is found to be not in compliance. Therefore, it is in everyone's best interest to be aware of the regulations and make sure they are followed. • These safety rules are set forth as a minimum standard to be followed. The MSHA regulations offer greater detail and guidance and should be followed in all cases, keeping in mind that the safety of all of our employees is our goal. Or • The visitor has received site specific hazard training explaining the hazards encountered in mines in general and this mine in particular_ • Persons whose business requires them to be on mine property for 5 or more days or who will be frequent regular visitors will be required by MSHA to have comprehensive mine safety training. They must have a record of that training and should be able to readily produce the training plan for the MSHA inspector upon request. It should be noted that even those people who have had the comprehensive miner training must also have the site specific hazard training. • Customers are considered to be hazard trained by means of signs directing traffic and warning of the dangers of the mine site load -out area. Delivery trucks may also be hazard trained by means of the same signs until they leave the roadway and then they must be accompanied by a Martin Marietta Materials employee. • For questions regarding this policy contact the Plant Manager or Safety Department. • General Safety Rules I . Inspect your work area daily for unsafe conditions. Keep the work area clean and free of loose tools, trash and other unsecured items. Correct or report any defect observed before beginning work. 2. All incidents, injuries, and property damage (no matter how minor they appear) must be reported immediately. Injuries must also be — treated immediately. 3. Personal protective equipment (PPE), that must be worn by all employees as a condition of the contract, includes: • Hard hats and safety glasses at all times. Exceptions include designated safe areas such as the office, lunchroom, or restroom. • Other eye and face protection may be required for specialized tasks. Please see your supervisor or task training materials for details. • Safety toe shoes or boots in good condition. • Additional protective equipment may also be required for your protection. This equipment may include items such as respirators, hearing protection devices, safety harnesses and life lines, personal flotation devices (PFD), , self contained breathing apparatus (SCBA), gloves, etc. as required by MSHA or Martin Marietta Materials policy. 4. Wear a personal flotation device (PFD) while riding in or working from, a boat or where the danger of falling in water exists. S. Operate machinery and other equipment only if you have been properly task trained -- and are performing authorized work, or are under the direct supervision of the person training you. 6. Do not work or walk under Iifted loads. Use taglines, as needed, when handling or guiding a lifted load. 7. Observe safe lifting practices as described in your task training materials. 8. Obey all warning signs and posted instructions regarding restricted areas, hazards, and personal protective equipment. 9. Do not wear loose clothing or jewelry near moving machinery.. 10. Participation in the following activities will not be tolerated, and participant(s) may be subject to disciplinary action up to, and including, termination of the contract: • Participating in horseplay and/or practical jokes • Fighting • Recklessly operating vehicles or equipment • Possessing, using, or trafficking illegal drugs and/or alcohol • Being under the influence of any intoxicant, drug, or medication that may affect work performance • Possessing or transporting firearms while on Company property. Exceptions include designated security personnel or others given special written permission. See your company contact person for details. 11. All visitors, off -duty employees, and contractors must register at the office, guardhouse, or report to a supervisor. Unauthorized visitors and unauthorized off -duty employees are not permitted on Company property. Report trespassers immediately to your supervisor or to the office. 12. Compressed air is not to be used for cleaning clothing or any unauthorized uses. Directing compressed air at others is dangerous and is considered horseplay and may result in disciplinary action. 13. Three-point contact (two hands and a foot or two feet and a hand) must be used when climbing ladders. HEALTH Hearing Protection 1. Use of hearing protection is required in high --noise areas. 2. Observe high -noise area signs regarding the use of hearing protection. Respiratory Protection 1. Use of respiratory protection is required in high --dust and any other areas requiring respiratory protection 2. See MSHA training materials regarding silica hazards. Electrical Safety I. Electricity is dangerous. Its proper use requires specialized training. Only qualified persons, with the permission of Martin Marietta Materials, are permitted to install and repair electrical equipment. o 0 2. Know the location of emergency shutdown controls and procedures for electrically energized equipment in your area 3. Promptly report to Martin Marietta Materials any non -insulated electrical wires, damaged or ungrounded electrical or electrically powered equipment. 4. Do not drive over electrical trailing cables to dredges, shovels, draglines, or any other electrical power conductor cables. 5. Do not store any boxes, spare parts or other items on top of or inside electrical switch boxes or motor control centers. Keep the area around and in front of switch boxes clear and clean for a minimum distance of 36 inches. 6. Energizing or de -energizing electrically powered equipment is to be performed by properly task - trained personnel only. Lock, Tag and Try Procedures Bodily injury is possible anytime you come in contact with electrically energized parts, machinery is accidentally started -up, there is unexpected movement of equipment, or you are exposed to hazardous materials. 1. Before repair or maintenance work is performed on or near equipment, each employee must make the equipment inoperative by: de -energizing the electrical circuits; closing valves; bleeding off pressure; blocking against motion; and by placing a lock and tag on the appropriate electrical disconnects, valves and/or other parts. See your supervisor or task training materials for details. 2. De -energize, lock out, tag, and try any electrically powered equipment before entering or repairing it. 3. Locks and tags are to be removed only by the person who installed them or by authorized supervisory personnel, following established procedures. 4. Hydraulic or air powered equipment or any machinery or equipment capable of movement must be blocked to prevent any unexpected movement. See your supervisor or task training materials for details. Fall Protection A full body safety harness with a properly secured lifeline must be worn whenever you: • Work at a height of more than four (4) feet and no other protection (such as a handrail) is provided. In addition, a shock absorbing lanyard must be *-4X used when the danger of a vertical drop of more than six (6) feet exists. • Remove loose rock from a high wall or perform tasks closer than 7 feet to the edge of a highwall or flat roof. • Work on top of covered hopper and container railroad cars. Plant Safety l . Do not operate machinery or equipment unless all guards are in place. Do not remove guards while machinery or equipment is in motion. Barricades cannot be used in place of guards. See MSHA task training materials for details. 2. Unless a safe method has been provided, by your supervisor, do not grease, oil, clean, or adjust machinery or equipment while it is in motion. 3. Do not stockpile or dump material under power lines unless a clearance of fifteen (15) feet is maintained between the closest point on the equipment in a raised position and the power line. 4. Riding on belt conveyors is strictly prohibited, is considered horseplay, and may result in loss of your contract. S. Pre -start audible warning signal systems where required must be used and heeded when machinery or equipment is to be operated. 6. Do not throw or drop tools, materials, or equipment from elevated areas such as screen towers, silos, rail cars, catwalks, and quarry faces until barricades and warning signs have been erected, and it has been determined that the area below is clear. 7. Use mild steel bar, brass bar, or punch with a hammer or sledge when pounding on a hard steel surface or material. This will lessen the possibility of steel splinters striking the person using the hammer or other employees in the area. Damaged tools with split, broken or loose handles, or mushroomed heads should not be used. S. No work is to be performed in a surge or blending tunnel unless proper lighting and a start-up alarm are provided, and stop cords are in place on the conveyor(s). See your supervisor or task training materials for details. 9. All work sites, including dumpsites, must be adequately illuminated during night operations. 14. Remove safety features such as toeboards, handrails, barricades, machine guards and warning signs only after proper lockout and other security measures (like safety harness and tie -off) have been taken. 11. Replace all safety items as soon as a task is completed. 12. When the cover from any opening in the floor, ground, pit, sewer, conveyor, bin, etc. is removed, employees must place a screen over the opening or otherwise mark the area unsafe to prevent someone from falling into the opening. Confined Space Work and Permit Entry Do not enter or perform work in a confined space without authorization and proper training. Check with the Martin Marietta Materials safety department or plant personnel for the location of confined spaces in your work area. Mobile Equipment Only employees with proper task trained certification are authorized to driver-- 7 or operate mobile equipment. Equipment operators must perform and document a pre -operation inspection daily (i.e., before operating, each shift) on all mobile equipment. This includes a check of all braking systems, emergency steering systems, backup alarms, horns, windshield wipers, seat belts, fire extinguishers, tires, and lights. Any defects affecting the safe operation of the mobile equipment must be reported to your company's supervisor. 1. Tag -out unsafe or inoperable equipment until defects affecting its safe operation are corrected. A record of any defect reported will be kept until it is corrected. 2. Seat belts shall be used in all cars, trucks, front-end loaders, bulldozers, and other mobile equipment as required. 3. Use steps or access ladders when accessing and leaving mobile equipment. Maintain three (3) point (two hands and a foot or two feet and a hand) contact while on ladders. Do not jump from elevated positions or mount/dismount moving mobile equipment. 4. No employee, other than the operator, will ride on or in any mobile equipment designed for single occupancy. 5. Keep cabs of all mobile equipment free of materials such as cans, bottles, loose tools, rags, and other unsecured items. 6. Riding in or working from front-end loader buckets or on forklift tines or platforms is prohibited. However, work may be performed from an approved work platform attached to a forklift in an approved manner in a stationary position or on an approved manlift designed for that purpose. 7. Mobile equipment must not be moved until the warning horn is sounded and everyone is in the clear, out of the path of the equipment. 8. Do not operate cranes, equipment booms, or truck boxes within 15 feet of energized overhead power lines. 9. Equipment operators are not permitted to move lifted loads over areas occupied by employees. 14. Dumping into feeders, over elevated stockpiles, quarry faces, or waste piles is not permitted without a suitable backstop or berm. Truck beds must be lowered prior to moving the truck. 11. Unattended mobile equipment must have the parking brake applied. When parked on an incline, the wheels should be chocked, turned into a bank or berm, or two wheels on the same axle will be placed in a trench to prevent movement of the vehicle. Buckets on front-end loaders, cranes, shovels, draglines, blades on dozers, and pan scraper blades should be lowered to the ground, when the equipment is idle. 12. Before making repairs on mobile equipment, the wheels must be blocked, and the key removed, and/or the master switch must be placed in the "off' position. A warning tag stating, "DANGER: DO NOT START. WORK IN PROGRESS." must be placed on the operator's controls. The tag must not be removed until the work is complete and then, only by the person who placed it or by the qualified person performing the repair, following established procedures. 13. No repair or service is to be performed on or under equipment in the raised position without using blocks, pins or other means to prevent it from falling. This precaution must be independent of any hydraulic or cable support system. 14. Work between the front and rear wheels of articulated equipment must be performed in compliance with the manufacturer's guidelines. (Guidelines are often posted on equipment). If you are uncertain or can not locate the manufacturer's guidelines, contact the equipment dealer.) 15. Smoking is prohibited while fueling or servicing mobile equipment, including working on or around the batteries. 16. Front-end loader operators must visually confirm presence of truck driver in cab before loading except when the truck is not equipped with a cab protector or when loading large riprap. During these activities, truck drivers must position themselves in front of the truck in sight of the loader operator. 17. Only persons properly task trained in tire safety are permitted to perform maintenance and repair procedures on tires. Tire inflation, following maintenance or repair procedures, must be done with proper protective barriers in place. Check with the manufacturer or MSHA for details. Traffic I. Signs establishing traffic control, speed, and direction, shall be posted and obeyed. 2. Use only designated parking areas. Parking in any other area requires specific authorization from your supervisor. 3. Pedestrians must walk facing oncoming traffic. 4. Do not walk behind or between moving vehicles. 5. Do not cross between or under stopped railcars. 6. Always walk clear of mobile equipment and remain in view of the operator. 7. Loaded trucks have the right of way at all times. 8. Do not attempt to overtake and pass a moving truck on the pit haul road. 9. Keep a distance of at least 100 feet from any moving vehicle. 10. Do not approach within 100 feet of an operating loader or drop ball, from any direction, until you have made eye contact with the operator and receive a signal to proceed. Explosives 1. The use and handling of explosives, including entry into the storage magazine area, is restricted to authorized employees assigned to this work. 2. Explosives handling and loading shall be supervised at all times by a task -trained Martin Marietta employee. 3. Unauthorized persons are not permitted in the blasting area at any time. 4. Check with Martin Marietta Materials personnel before entering into any area where explosives are being used or stored 5. Smoking is prohibited within 100 feet of explosives, loaded shots, magazines, or vehicles transporting explosives. 6. In the event of an explosive fire, do not fight the fire. Evacuate and secure the area. 7. Do not handle explosives during an electrical storm or when such a storm is approaching. Evacuate and secure the area. 8. Take cover as directed by your Martin Marietta Materials personnel prior to the firing of a blast, and remain there until the "all clear" signal is sounded. Further safety procedures on handling explosives are covered in the Martin Marietta Materials Explosives Safety Manual. Welding and Cuffing 1. Welding and cutting activities are restricted to employees authorized and task trained to perform these tasks. 2. Wear the proper personal protective equipment for welding and cutting, which includes a welding hood (with safety glasses under the hood), respirator, goggles or face shield, long sleeve shirt or leathers, and welder's gloves. 3. Do not weld or burn on drums or barrels, use a spark -proof drum cutter instead. 4. Do not weld or burn on tanks or other vessels that once contained flammable or combustible materials or gases without proper training and use of inerting gases. 5. Inspect welding sites for fire and electrical hazards before, during, and after welding. An operational fire extinguisher is required within 25 feet of the welding activity. Employees are responsible to check that fire extinguishers are operational and within 25 feet of welding activities. 6. Before beginning work, position welding screens to provide protection for other employees from the welding flash. 7. Provide adequate ventilation to prevent the concentration of oxygen and toxic fumes when welding or cutting in enclosed places. 8. Secure compressed gas cylinders in an upright position to avoid falling or rolling. Close valves when tanks are not in use. Remove regulator and replace caps when storing or moving, or provide a cover over the top of the regulator and gauges to protect them from being struck by rocks, falling objects, mobile equipment, etc. 9. Do not strike, drop, or apply heat to marked oxygen, acetylene, or other compressed gas cylinders. 10. Use proper sparking devices for lighting oxygen and acetylene torches. Unprotected plastic butane lighters are not permitted in the plant. See your supervisor or task -training materials for proper sparking devices Fire Safety No smoking or open flame within 25 feet of no smoking signs or combustibles. 2. Report all possible fire hazards to Martin Marietta Materials. Possible fire hazards include grease on equipment, oily rags, oil or gas spills, etc. 3. Fire extinguishers shall be of the size, type, and quantity to extinguish fires of any class which could occur as a result of the hazards present. They should be conveniently located, readily available, plainly marked and maintained in fire ready condition. They should be checked monthly. 4. If a fire could prevent escape from mobile equipment, then the equipment should be equipped with a fire extinguisher. 5. Use of gasoline and/or diesel fuel as a parts cleaner is prohibited. 6. Small quantities of flammable liquids taken from storage for authorized use, may only be transported in approved metal safety cans. 7. All combustible or hazardous liquids must be stored in their original containers or transferred to approved safety cans that are properly labeled and sealed. 8. Open fires, fire barrels, or buckets, and salamander heaters are not allowed. 9. Empty explosive containers may be burned as instructed in the Martin Marietta Materials Explosives Safety Manual. 10. Oil spills must be contained and cleaned promptly to avoid slip and fall hazards and fire hazards. 11. The storage and disposal of oily rags is restricted to covered metal containers that are marked for such purpose. Edits 9/22/00
