Wilmington, NC 28405 RE: Willis Pit Mining Permit No. 67-26 NOV-2009-PC-0765 Onslow County, NC Dear Mr. Shiver. ° This letter is in response to your letter dated September 8, 2009. As you have stated, we have not been monitoring our mine dewatering discharge. We have always been unsure exactly what we were supposed to do, and we have not been able to find a copy of our permit. We dewater using a floating pump located in the existing settling basin/pond in the rear of the mine. We are not actively mining in that area. We currently mine in another area of the mine. We typically let the water under the pump rise to a depth of about 8 feet deep, then dewater down to a depth of about 5 feet deep. Therefore, we feel that we are pumping off the cleaner liquid from the higher portions of the settling basin/pond. Per our and our consultant's (Tim Stewart of Parker & Associates, Inc.) discussions with Linda Willis, of your staff, we will begin immediately to monitor our dewatering discharge per the requirements in the permit once Ms. Willis sends us a copy of the permit. In addition, Parker & Associates, Inc. and their wetlands consultant will study the adjacent wetlands to determine if they are being impacted by our dewatering. Since we don't use wells to dewater, and only dewater after rain events, we don't think that we are impacting the wetlands. A recent inspection of the adjacent wetlands showed standing water in the wetlands areas, which indicates to us that we are not dewatering deep enough to impact the wetlands. We anticipate that it will take a month or two to study the wetlands and come up with an Operation and Maintenance Plan for the mine, since we will have to get the wetlands delineated, then surveyed, then analyze all the data and come up with a plan. We will have the plan sent to Linda Willis for her approval once it is complete. Thank you for your understanding in this matter. Discussing these comments with Mrs. Rodgers; she indicated that you provided items 2-4. 1 wanted to discuss those comments with you and tried to contact you on the afternoon of Thursday October 1 in hopes of doing so. Since Mr. Smith uses this pit for beach renourishment projects; it is imperative that his mining permit be complete on early November therefore in an effort to streamline the permitting process I wanted to discuss your comments with you directly. Please see my response/ clarification below. 2. Please see the response letter from 2002 which indicates that the Land Management group had identified 2 potential wetland areas prior to the permit modification in 2002. They have been flagged and surveyed and identified on the mining plan. Our new permit modification maintains the required 50' buffer from those areas and no other wetland areas were originally identified within the upland area. Therefore is the ACOE approval required based on the information provided above? Our concern is the timing of the approval based on the aforementioned schedule above. 3. A copy of Mr. Smith's General Permit is attached for your records. 4. When it is necessary to dewater Mr. Smith pumps through the stilling basin and any discharge sheet flows to the identified isolated wetlands. Which in fact is a small cypress pond with no outlet therefore it holds any collected water; either rainfall or dewatering discharge; and allows it to infiltrate. If additional dewatering locations are necessary then we have instructed to install the stilling basin — level spreader BMPs prior to any discharge. Also we have instructed him to maintain and abide by the sampling and effluent limitations set forth within the aforementioned permit. Your input on these items would be greatly appreciated. NCG020225 STORMWATER, MINE DEWATERING, AND/OR OVERFLOW FROM PROCESS WATER RECYCLE SYSTEMS DISCHARGES NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the Federal Water Pollution Control Act, as amended, Coastal Mine is hereby authorized to operate a pumping system and settling ponds and discharge mine de -watering water from a facility located at Coastal Mine near Holden Beach Brunswick County to receiving waters designated as an unnamed tributary to the Shallotte River, class SA, in the Lumber River Basin in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III and IV of General Permit No. NCG020000 as attached. This Certificate of Coverage shall become effective January 3, 1997. This Certificate of Coverage shall remain in effect for the duration of the General Permit. Signed this day January 3, 1997. AA A.
