ATTN: Richard Taylor, President 325 Barrington Road Newport, NC 28584 Dear Mr. Taylor, Donald R. van der Vaart Secretary I received the monitoring reports you sent for Howard Pit, NPDES Permit 4 NCG 020537. The Total Suspended Solids level is still within the benchmark of 100 mgll. The turbidity is listed as 87.6 NTU which exceeds the benchmark of 50 NTU. Since the TSS dropped from 95.3 mg/l to 10.6 mg/l with re -testing it seems likely that the Turbidity level also dropped. If the turbidity was re -tested in July please send me the results. If the turbidity level was not re -tested in July please have the turbidity re -tested as soon as you can and send me the results. if the turbidity levels still exceed the 50 NTU threshold then monthly testing will be required and additional measures will need to be installed. Upon reviewing the report I realized that the Total Suspended Solids rose from 5.0 mg/1 in A4a7-ch ttl) to 95.3 mg/1 in Jt.ti7e. I also noted that one of'the samples had to be recollected because the bottle ivas cracked and this caused me great concern making me question if the samples ivere mishandled. I then called Environmental Chemists. Inc. and requested another sample be taken to recheck the Total Suspended Solids on 7-9-15. The sample iv as again collected on 7-10-15 and the result that I received today is 10.6mg/l. My question is. FACILITY ONvNER INFORMATION AND DOCUMENTATION 0,kvner - This Stortnwater Pollution Prevention Plan (SPPP) is for a sand mining pit, permitted and referred to as the Howard Pit (pit). The pit is located on Bell Frazier Avenue off Highway 24, Onlsow County, North Carolina, Permit No. NCG020537. The owner and permittee is Mr. Ricky Taylor of Bogue Sound Septic and Grading, 325 Barrington Ridge Drive, Newport, North Carolina, 28570. Documentation - All required documents will be maintained in a permanent record file. The document will be available for use by the Permittee`s designated responsible party (see Section 6) for guidance and requirements of ongoing management and inspection activities of the pit. The document will be held by the permitter at the Newport; North Carolina address above. SPPP documentation to be held, recorded and maintained includes pert sitting documentation, site maintenance and management plan, record of the maintenance activities, spills, annual sampling, testing results and annual site and outfall inspection results. In addition to the routine documentation requirements, this document satisfies a Notice of Violation (NOV- 2013-PC-0157) in July 2013.Item t of that NOV. Upon approval by the Division of Energy, Mineral, and Land Resources; Department of Environment and Natural Resources, as stated above the approved SPPP will be available for review by DENR personnel. B. SITE LOCATION AND PHYSICAL DESCRIPTION Location - As seen on the attached "Site and Existing Condition Plan, (SP-1) the pit is located off the north side of Highway 24, with access from Bell Frazier Avenue, lat and longitude N 34 4Y30", W 77 12`08", respectively. The pit is located on an 18.1 acre parcel of land and includes access road, two active mining areas and an existing wet detention area. Buffers - The parcel also includes multiple buffered areas. There is a 30 foot buffer which is unexcavated and surrounds the existing pond and a portion of the active mining areas. Per the permit, a there is also a 50 foot buffer along the sides of the mining areas which are contingent to wetlands on the adjacent parcels (flagged by USAGE). These buffers will remain in place and maintained to provide buffer from adjacent parcels. Access - Access to the active mining areas is per an 1850 feet (f/-) long access road, or Bell Frazier Avenue. Page 3 of 9 HOWARD PIT — STORMWATER POLLUTION PREVENTION PLAN 2) C. STORMWATER WATERSHED Receiving Waterbody - As seen on the USGS Topo Map, Appendix 1, the receiving waterbody is Pasture Branch, Queen Creek, within the White Oak River Basin. This is a SA;HQW stream classification, Index Number 19-14-16. Detention- As seen on attached Stonnwater Drainage Map, (SDM-1) all stormwater run off is overland flow across site, towards the existing wet detention area. This detention area has several significant features. The pond has approximately 12 feet of freeboard with two outfall discharge locations. Outfall location I (see SDM -1) discharges to a rock check darn to ensure velocities are non erosive, in keeping with NPDES permitted discharge point. Outfall location 2 (See SDM-I) discharges via F outfall pipe and valve to Meadows Pond, per agreement. SITE ACTIVITIES A. MINING This is an active sand mining site. Sand is typically mined for use as tills at other construction locations. Mining of sand is performed xvith excavating equipment, typically medium size excavators. Within the pit mined materials are either staged into stockpiles or directly loaded into haul dump trucks. As seen in the Site and Existing Condition Plan (SP-1), any stock piles are located adjacent or within the mines, but outside the buffers. All material not loaded directly, is loaded fi-om the stock piles into haul trucks. B. HAULING All hauling is per standard 10- 11 cubic yard haul dump trucks. Access to and from the pit is per compacted gravel and earthen, unpaved road. Due to the significant length of the access road, most excess sandy materials has fallen from the haul trucks prior to entering Highway 24. C. EQUIPMENT There are no permanent facilities on the site for equipment storage or stockpiling. Equipment that is to be used onsite for excavating and mining for several days is to be moved out of pit at night. The pennittee will ensure all excavating equipment will be maintained and repaired at off site locations. Page 4 of 9 HOWARD PIT — STORMWATER POLLUTION PREVENTION PLAN 3) EROSION CONTROL A. EROSION CONTROL PLAN As seen on the attached Erosion and Sediment Control Plan, (ES-1) access to the pit is along; Bell Frazier Avenue from Highway 24. The primary source of erosion would be along the mined area perimeters and along the access road. As discussed in Section 1, B above, the access road is well packed gravel and is very stable in its existing condition. This, in addition to the minimal amount of vehicle traffic, (primarily haul trucks) and the length of the access road combine to limit erosion of the site. For additional protection, silt fence was placed along the perimeter in areas where there was a possibility of erosion from mining activities to adjacent parcel. As part of ongoing maintenance and inspection activities, 4) STORMWATER MANAGEMENT A. Stormwater Management Plan As noted above; the site drains overland into the existing wet detention area. There are currently no discrete or structural controls, such as inlets or culverts, for runoff into the pond. As discussed in Section C above and seen by the existing spot elevations on the Storm-%vater Drainage Map (SDM-1), all stonrnwater runoff drains overland flow towards the site and the existing pond. Within the existing pond, there is currently approximate 12 feet of remaining freeboard. This is a significant volume for future rainfall events. Regarding volume the requircment for rainfall monitoring, a rainfall gauge is in place on site. The gauge is checked by the permittee following rainfall events greater than 2 (two) inches. B. Stormwater Outfall Certification There are no discrete BMPs to inspect. However, discharges from the existing pond are from the two outfall discharge locations, see Outfall locations I and 2 (See SDM-1). An inspection of these outfalls is to be made annually by a professional engineer. The inspection report must include any repair recommendations, as needed. A copy of the most recent inspections is provided in Appendix. This inspection record is also on permanent file with engineer of record, KSMJ Engineering, pile, 388 McCotter Blvd, Havelock, NC 28532, 252-444-5786. Potential Pollution Sources The main source of potential pollution is erosion and dust. The access road is nearly 1900 feet long. It is a well compacted gravel surface. The combination of compaction and distance preclude creation of significant dust to adjacent parcels from haul trucks. In addition, the in -situ soils of the site are very sandy in nature. These soils typically create minimal dusting conditions. As discussed below, the site mining procedures and activities are very mature in nature. The processes have been and will continue to be are repeated in the same manner. There is little to no grading or excavating outside the typical mining area. However; as discussed earlier there is some silt fence that has been installed to ensure any eroded material created is precluded from the leaving the site. The secondary potential source of pollution is from minor oil or fuel spill from excavating equipment. As part of ongoing maintenance, the responsible party will oversee equipment fueling. B. Spill Prevention To ensure accidental spills are minimized, the responsible party will be update the maintenance and inspection criteria if there are any significance changes to the mining activities or processes, including increases in excavation rates or hauling volumes. C. Recent Spills and Leaks No spills or leaks, other than those of a very minor nature from equipment, have occurred over the last three years. Responsible Party The responsible party for the overall coordination, development and implementation of this plan is the permittee, Mr. Ricky Taylor. Finally, KSM1 Engineering/Prestige Surveying will conduct annual inspection of stormwater outfalls and ensure sample testing is conducted. B. I am glad that Mr. Taylor was able to catch you and review the site. Thanks so much for taking the time to talk to him. I think it was a big help. I will try to address the 3 items that you request in your NOV letter. 1. and 2. I am sure that Mr. Taylor told you that they had a pump that the float hung up on and basically dredged sand. into the sediment retention area of the discharge and overfilled its capacity. We have since then switched the pump area to the adjoining Meadows pond per a written agreement to maintain the water level in that pond. Mr. Taylor has also began the clean up at the discharge point that overflowed. He is utilizing buckets, shovels and wheelbarrows as you have suggested. I think he has a little bit to complete and some plantings and that area should be restored. He expects that to be completed by the first week of June. He has changed his procedure that if that area is to be utilized that it can only be done when the pump and area are attended by personnel. No unmanned pumping will be allowed. 3. Mr. Taylor's office is looking for the pumping reports and will forward them as soon as possible. He has indicated that he will only be using this area in severe circumstances in the future. I think he indicated that he and you had discussed bypassing this area and hard piping to the small originally DOT pit that he is in the process of reclaiming. As for the haul road. This has been an area of confusion for some time now. The original mining map indicated this road from the beginning. I guess the permit did away with it by calling for a 50' buffer area. No one ever indicated that the haul road as show could not be built the permit just called out a buffer which in essence eliminated it but that was never translated to Mr. Taylor. I have a call into the Corps office to meet the Corps field representative on site to determine the wetlands boundary and I have finally found enough information from the original mine application to determine the original boundary. An inspection by personnel of the Department on February 25, 2011 revealed little or no reclamation efforts and that the site remained virtually unchanged since mining operation began. Expiration of the permit only precludes further mining operations; reclamation requirements continue to remain in effect. Section 74-56 of the Mining Act of 1971 mandates initiation of bond forfeiture proceedings for failure to reclaim in accordance with the reclamation plan. Also, civil penalties of up to S500.00 per day for each day of the violation may be assessed under G.S. 74-64. Additionally, under G.S. 74-64, the penalty for operating a mine without a permit is a civil penalty of up to S5,000.00 per day for each day of the violation. Therefore, no further mining maV occur at the above mentioned site until you have applied for and obtained a valid mining permit from this Department.
