Stormwater Pollution Prevention Plan (SPPP)

The Wellons Pit is located at 4525 Claude Lee Road in Fayetteville, Cumberland County,
NC (See Attachment A, Vicinity Map). The receiving waters for the stormwater discharge is
Rockfish Creek. Rockfish is a Class C stream in the Cape Fear River Basin.
Other pertinent information for the facility includes:

No buildings or permanent structures are located at the site. The Standard Industry
Classification (STC) Code for the operation is 1442 (Construction Sand and Gravel).
The site is an active sand & gravel mine (NCDEQ Mining Permit Number26-46). The mine
was originally permitted in 1999. Currently, the mine is permitted for 70 acres, with 54 acres
bonded for land disturbance. No washing or processing of materials occurs at the site.
Limited vehicle refueling activities are conducted at the site. No refueling tanks are located
on the site. Tanker trucks periodically arrive at the site to refill the various equipment used in
the mining process.
No significant spills or leaks have occurred at the site during the previous three (3) years.
The Wellons Pit requires a permit to discharge storm water because materials are potentially
in contact with storm water. As a requirement of this permit, the outfatls associated with
storm water discharges from areas of industrial activity have been evaluated for q esence
of non -storm water discharges. Based on the evaluation, to the best of r,�'i sditli@�'a nd
belief, no non -storm water discharges exist

The Wellons Pit has one (1) discharge point (See Stormwater Plan, Sheet 1). Discharge is
from a sediment basin (Basin #2) that is used to treat stormwater runoff from the upslope
mining areas. Possible pollutants that could discharge include soil particulate. The Facility
Stormwater Plan (Sheet 1) shows the discharge point, drainage area, and the potential
pollutants that could occur from the raining activities. Basin #2 outlet is a perforated
corrugated riser pipe connected to a horizontal corrugated pipe. The perforated horizontal
pipe is surrounded by washed stone.

The drainage area for-Outfall No, l is approximately 16.95 acres and includes the active
mine area. No impervious surface is included in the watershed.area for the outfall. See
Stortnwater Plan for the location of the outfall and the drainage area.

In order. to implement, maintain and revise the SPPP, Wellons Construction,. Inc. has
assigned the following personnel to be members of the Pollution Prevention Team. The
activitiesand-responsibilities of each team member are listed below. A responsible person
shall .be on -site at, all times during .facility operations that have increased. potential to
contaminate stormwater runoff through spills or exposure of materials associated -with the
facility'operation;

Wcllons Construction, Inc. is responsible for implementing Best Management ractices at
the Wellons Pit. These practices include Good Housekeeping, Preventative Maintenance,
Spill Prevention Control .and Counter Measures for any possible spills during
vehicle/equipment refilling, record -keeping and internal reporting.
Spills and leaks are a significant potential source of stormwater pollutants, and in many
casesi are avoidable. The standard operating procedures such as spill prevention procedures,
along with proper employee training can.reduce the potential for accidental releases. The
following areas are -identified for potential spillage:
Petroleum releases from constl•nction equipment and vehicles, espechilly dwing
refueling.
Should a spill occur during refueling or at any other time, any affected soil should be
removed (excavated) and placed in appropriate containers (barrels, roll -offs, etc.). The
barrels should then be properly disposed of off -site through an appropriate disposal facility.
All releases should..be immediately reported,to the Storrnwater.Plan Coordinator or any of
the other Pollution Prevention Team Members.

The following areas require Good Housekeeping Activities to minimize stormwater releases:
Construction Equipment and Vehicle refueling
1. Refueling should be conducted in a manner to minimize spillage. Spills should
be immediately cleaned up. The ground should be checked for any ground
staining or liquid ponding before each day's use. Staining or ponding is evidence
of needed vehicle maintenance.
2. Material handling equipment should be checked for hydraulic line leaks and
other leaks that require maintenance.
3. Hydraulic lines should be checked by the operator before each day's use for
leakage. Any spill should be cleaned immediately, and repairs made when
leakage is noted.
Exposed Ground and Sediment Basin
l . Observe exposed ground for rill erosion. Flatten grade, divert upslope water
runoff, or establish groundcover.
2. Observe sediment accumulation down stream of basin outlet. Excessive
sediment accumulation could be a result of improper functioning of the basin
outlet, or excessive sediment accumulation inside the basin.

Inspection of the facility shall occur at a minimum of twice a year; once during the first half
of the year (January to June) and once during the second half (July to December), with at
least 60 days separating inspection dates.
The Bi-Annual observation by qualified personnel is conducted to perform the following:
o Inspect storm water drainage areas for evidence of pollutants entering the site drainage
system. Inspect on -site stormwater basin for damage or deficiencies.
e Evaluate the effectiveness of measures to reduce pollutant loadings and whether
additional measures are needed.
• Inspect any equipment needed to implement the plan, such as spill response equipment.
e Revise the plan as needed within two weeks of inspection (potential pollutant source
description of measures and controls).
a Implement any necessary changes in a timely manner, but at least within 12 weeks of the
inspection.
a Prepare a report summarizing inspection and follow up actions, the date of inspection
and personnel who conducted the inspection; identify any incidents of noncompliance or
certify that the facility is in compliance with the plan.
e Sign the report and keep it with the plan.

Record keeping is important to demonstrate that the facility is operated in a way that
minimizes the potential for pollutants to enter the environment. Attachment B contains
forms that address the following:
1. Site Compliance Evaluation
2. SPPP Review and Update
3. Personnel Training Record
4. Spill Documentation Report
5. Equipment Inspection and Preventative Maintenance Record
5. Future BMP implementation schedule
These forms, or ones containing similar information should be completed and kept on -site at
all times.
Employee training is essential to effective implementation of the Storm Water Pollution
Prevention Plan. Each employee that works in a particular area of the plant is trained for
proper material handling and spill prevention and good housekeeping practices.
The training program will consist of aformal training session and regular follow-up sessions
to update and reinforce the formal training. The training sessions will include an overview
of the following information included in written documentation.
• Written instructions for handling hazardous substances.
• Facility storm water pollution prevention.
• Facility spill prevention, control, and countermeasures.
• Material management practices.
• BMP's including spill prevention measures, equipment, and safety procedures.
• Recent spills or accidents at the facility or at a similar facility with discussion about
causes and corrective actions taken.
• Upcoming new equipment installations at the facility that will impact pollution
prevention planning or implementation of BMP's.
• Inspection procedures.
• Applicable environmental laws, regulations, and guidance documents.
• Procedures for preventing contact between materials and storm water runoff.
• Procedures for using, inspecting, repairing, and replacing facilities or equipment used for
spill response.
• Communications equipment and alarm systems.
• Response to spills and actions required to prevent spill from reaching storm water,
• 'People to contact in the event of a spill and what to do in the event of a spill.
• Reporting requirements for leaks and spills.
• Procedures for tank truck unloading.
• Operation and maintenance of containment equipment.

;8.0 SPPP AMMENDMENT AND ANNUAL UPDATE,
This SPPP shall be reviewed on an annual basis. The SPPP shall be amended whenever
there is a change in design, construction, operation, site drainage, maintenance, or
configuration of the physical features which may have a significant effect on the, potential
for the discharge of pollutants to surface waters. The annual update shall include the
following:
-A list of significant spills or leaks of pollutants for the previous three.(3) years,
or the.notation that no spills have occurred.
-A written"re-certification that stormwater outfalls have been evaluated for the
presence of non-stormwater discharges
-A review and comparison of sample analytical data to benchmark values
9ASITP IMPLEMENTATION
Wellons Construction, Inc. shall implement the SPPP consistent with the provisions of -the
NCG200000 permit, in order to control contaminants entering surface waters via stormwater.
Implementation of the SPPP shall include documentation of all monitoring; measurements,
inspections, maintenance activities, and training provided to employees, including the.16g of
the sampling data. Such documentation shall be kept on -site for a period of five (5).years anti
made available to the Director or Director's authorized representative immediately upon
request.

This letter is in response to the aforementioned Notice of Violation. We were recently made aware that
the employee we had assigned to manage the program had not fulfilled their duties and is no longer
associated with this project or Wellons Construction.
We have formed a three- person team that is currently implementing a plan to conform within the
corrective requirements of NPDES Stormwater General Permit. The team will report to upper
management the first of each month to review any activity related to the Wellons Cumberland Pit #1
including Stormwater.Pollution Prevention Plan, Inspections, and Reporting required by DEMLR.
In addition, we have contacted Pat Shillington of Engineering & Environmental Science Company of
Raleigh, NC and he has agreed to produce an updated map of the property which will show the drainage
area boundaries and the direction of flow in each drainage area. Sediment Basin #3 will be updated
with the addition of a surface dewatering device as requested. Once we have a confirmed date for the
completion of the updated site map we will contact you again in writing and produce our Plan of Action
and Stormwater Pollution Prevention Plan.

A site specific Stormwater Pollution Prevention Plan (SPPP) needs to be developed including all the required, applicable
information as specified in the attached NCG020000 General Permit which was given to you during our meeting.
1. In reference to NCG020000 General Permit requirements for the Site Map (Current Mine Map) should show the
drainage area boundaries and the direction of flow in each drainage area. Sediment Basin #3 should be updated with the
addition of a surface dewatering device.
2. The Stormwater Pollution Prevention Plan should be annually updated including: 1. List of significant spills/or a
statement about no spills occurring for the previous 3 years.; 2. Document effectiveness of on -site erosion control
measures (construction entrance, diversion ditch and Sediment Basin #3).; 3. Provide a review and comparison of
sample analytical data using the attached Division's Annual Summary Data Monitoring Report available on the
Stormwater Permitting website at:htt://portal.denr.org/web/Ir/npdes-stormwater. l gave you a copy of this form during
our meeting. This form should be mailed to the address on the form every year. by March 1st.
3. As long as the mine is active, all erosion control measures need to be inspected on a weekly basis. The Analytical and
Qualitative monitoring, along with the recording of rainfall, occurs twice per year: Period 1 : Jan. 1st -June 30th and
Period 2: July 1-December 31st.
4.-Active implementation of the SPPP includes documentation of all monitoring (Analytical and Qualitative),
measurements, inspections, maintenance activities and annual training provided to employees.
5. Dormant Site Status only applies if all industrial activities have been suspended and the portions of the site where
clearing, grading and/or excavated activities have occurred have been stabilized with vegetation. I would do an
inspection of the site after this has occurred and written certification about this status would be submitted by the
company. The Analytical and Qualitative Monitoring is not required, only monthly inspections of the erosion control
measures are necessary and an annual inspection needs to be conducted as part of the annual update of the SPPP. If
industrial activities will reoccur, the Regional Office needs to be notified prior to this reoccurance.
6. Please send a written response letter within 30 days of receipt of having received the Notice of Violation which would
include a reasonable eplanation for the violations which occurred and a plan of action to prevent these violations from
reoccurring.

On February 1, 2018, Melissa Joyner from the Fayetteville Regional Office of the Division of Energy, Mineral
and Land Resources (DEMLR), conducted a site inspection for the Wellons Cumberland Pit #1 facility
located at Claude Lee Road, Cumberland County, North Carolina. A copy of the Compliance Inspection
Report is enclosed for your review. The site visit and file review revealed that the subject facility is covered
by NPDES Stormwater General Permit NCG020000 under Certificate of Coverage NCG020477, Permit
coverage authorizes the discharge of stormwater'from the facility to receiving waters designated as a LIT to
Rockfish Creek, a Class C waterbody in the Cape Fear River.Basjn...
As a result of the site inspection, the following permit conditions violations are noted
1) Stormwater Pollution Prevention Plan SPPP
A Stormwater Pollution Prevention Plan (SPPP) has not been developed.
2) Qualitative Monitoring
Qualitative monitoring has not been conducted and recorded in accordance with permit requirements.
3) Analytical Monitoring
Analytical monitoring has not been conducted and recorded in accordance with permit requirements.

during the inspection.
Requested Response:
You are asked to respond to this office, in writing, within 30 calendar days from receipt of this notice. Your
written response should include a reasonable explanation as to why the aforementioned violations have
occurred as well as a Plan of Action to prevent these violations from recurring.

sent on February•6, 2009, December 17, 2013, December 4, 2015 and June 7, 2017. If corrective
actions are not taken by April 13, 2018, this Office is considering sending a recommendation for
enforcement to the Director of the Division of Energy, Mineral and Land Resources regarding these
issues. Your above -mentioned response to this correspondence will be considered in this process.
During the last three years several attempts have been made to schedule inspections at the Wellons
Cumberland Pit #1 with representatives of Wellons Construction, Inc. No company personnel have

Inspection Summary:
Melissa Joyner attempted to meet on site with Eric Deyle on 1/24/2018. Mr. Johnson contacted Ms. Joyner on 1/24/2018 to
let her know that he would be meeting with her but would not be able to meet on that date. The meeting was rescheduled for
2/1/2018 but was not attended by Mr. Johnson. Therefore the Stormwater Pollution Prevention Plan, Analytical and
Qualitative monitoring forms were not available for review at the site.
I conducted an inspection of the Wellons Cumberland Pit #1, observing the Outfail for Sediment Basin #2 and noted that
there was a tree still growing inside of the riser of this outfall which will need removal. The side slopes of Sediment Basin #2
have gully erosion in need of stabilization with permanent groundcover. NPDES General Permit.NCG020000 requires that
Best Management Practices be inspected once every 7 calendar days.
Notices of Violation have been previously sent to this facility on 2/612009, 12/17/2013, 11125/2015 and 6l712017 for not
having a Stormwater Pollution Prevention Plan, Analytical and Qualitative monitoring forms available for review.

Melissa Joyner attempted to meet on site with Erik Deyle on 311612017, 512412017 and 5/26/2017. The first two meetings
were missed by Mr. Deyle and rescheduled. The last meeting was not attended by Mr. Deyle. Therefore the Stormwater
Pollution Prevention Plan, Analytical and Quantitative monitoring forms were not available for review at the site.
I conducted an inspection of Wellons Cumberland Pit #1, looking at the Outfall for Sediment Basin #2 and noted that there
was a tree still growing inside of the riser associated with this outfall which will require removal. The side slopes of Sediment
Basin #2 have gully erosion in need of stabilization with permanent groundcover. General Permit NCG020000 requires that
Best Management Practices be inspected once every 7 calendar days.
Notices of Violation have been previously sent to this facility on 21612009, 12/17/2013 and 11/25/2015 for not having a site
specific Stormwater Pollution Prevention Plan and completed Analytical and Qualitative monitoring forms for the site.

On May 26, 2017, Melissa Joyner from the Fayetteville Regional Office of the Division of Energy, Mineral and
Land Resources (DEMLR), conducted a site inspection for the Wellons Cumberland Pit #1 facility located at
Claude Lee Road, Cumberland County, North Carolina. A copy of the Compliance Inspection Report is
enclosed for your review. The site visit and file review revealed that the subject facility is covered by NPDES
Stormwater General Permit NCG020000 under Certificate of Coverage NCG020477. Permit coverage
authorizes the discharge of stormwater from the facility to receiving waters designated as a UT to Rockfish
Creek, a Class C waterbody in the Cape Fear River Basin.
As a result of the site inspection, the following permit conditions violations are noted
1) Stormwater Pollution Prevention Plan_(SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has not been developed.
2) Qualitative Monitoring '

Melissa Joyner met on the site with Stacy Strickland, Estimator, of Wellons Construction, Inc. The Anaytical Monitoring
Forms were reviewed which had been recorded from January 1, 2014 through December 1, 2014. "No Flow" was
documented from the outfall of Sediment Basin #2 during this time period. Analytical Monitoring has not been conducted for
Period 1 of 2015 (Jan. 1, 2015 through June 30, 2015). Qualitative Monitoring has not been conducted. A Stormwater
Pollulion Prevention Plan has not been developed for this facility.
The outfall for Sediment Basin #2 was inspected. A tree is still growing inside the riser although it appears that it has had
branches removed. There is also vegetative debris on the riprap protection inside of the riser. The swale leading to Sediment
Basin #2 has gully erosion on a side slope in need of stabilization. General Permit NCG020000 requires that Best
Management Practices(BMPs) be inspected once every 7 days and within 24 hours of a rainfall which is 0.50 or more
inches.
Notices of Violation have been previously sent to this facility on 216I2009 and 12/17/2013 for not having a site specific
Storrnwater Pollution Prevention Plan and completed Qualitative and Analytical Monitoring Forms for the site.

Inspection Summary:
Melissa Joyner met on the site with Stacy Strickland, Estimator, of Wellons Construction, Inc. The Anaytical Monitoring
Forms were reviewed which had been recorded from January 1, 2014 through December 1, 2014. "No Flow" was
documented from the outfall of Sediment Basin #2 during this time period: Analytical Monitoring has not been conducted for
Period 1 of 2015 (Jan. 1, 2015 through June 30, 2015). Qualitative Monitoring has not been conducted. A Stormwater
Pollulion Prevention Plan has not been developed for this facility.
The outfali for Sediment Basin #2 was inspected. A tree is still growing inside the riser although it appears that it has had
branches removed. There is also vegetative debris on the riprap protection inside of the riser. The Swale leading to Sediment
Basin #2 has gully erosion on a side slope in need of stabilization. General Permit NCG020000 requires that Best
Management Practices(BMPs) be inspected once every 7 days and within 24 hours of a rainfall which is 0.50 or more
inches.
Notices of Violation have been previously sent to this facility on 2I612009 and 12/17/2013 for not having a site specific
Stormwater Pollution Prevention Plan and completed Qualitative and Analytical Monitoring Forms for the site.

This COC is issued pursuant to the requirements of North Carolina General Statute 143-215.1. and the

The General Permit authorizes discharges of stormwater/wastewater and specifies your obligations for
discharge controls, management, monitoring, reporting,, and record keeping. Please review the new permit to
familiarize yourself with all of the changes. Parts V and VI contain the Standard Conditions, including
Compliance and Liability; Reporting, Monitoring and Records requirements; Operation and Maintenance

We submitted a letter to your office dated January 8, 2014 to explain why our Stormwater Management
Program had feel short of compliancy due to change in management. We have since updated our
program and A Lee, a project manager has been assigned as the site manager. Mr. Lee has since
communicated with Mike Lawyer with DWQ about the monitoring and required reports.
Mr. Lee has visited the site after each significant rain fall to see if runoff was evident, but no water was
discharging from the structure. Mr. Lawyer also told Mr. Lee that he is glad to hear we were monitoring
the site and would look forward to receiving the Benchmark Exeedence Report bi-annually and the
Annual Summary DMR.
We have scheduled the submittal of the benchmark report by June 1, 2014. Mr. Lee will also continue
to visit the site to conduct rain fall and erosion control monitoring as needed.
We have compiled a binder containing all inspection forms/logs, a copy of General Permit No.
NCCO2000, Benchmark Exceedence DMR and Annual Summary SMR Reports, Stormwater Discharge
Outfall Qualitative Monitoring Report, General BMP Maintenance Instructions and sample of Storm
Water Pollution Prevention Plan.
We feel confident we are fully compliant at this time and Mr. Lee is also in the process of training a
second employee of Wellons in the event of his absence, to ensure the protocol is followed.

We are in receipt of your letter dated December 17, 2013. It was delivered to our post office box via
Certified Mail on December 19, 2013.
Our site manager, JK Lee was present at the time of the site inspection on December 11, 2013
conducted by Melissa Joyner and Mike Lawyer from the Fayetteville Regional Office. There was another
site manager for Wellons Construction prior to Mr, Lee but he retired from the company over two years
ago. The prior site manager was responsible for submitting monitoring documentation to NCDENR and
we are unable to locate his files.
Since Mr. Lee has met with your representatives at the Cumberland Pit #1 site, we have discussed and
are in the process of implementing new Storm Water Management Program for Wellons Construction.
Included in this program will be timely monitoring and testing as required by the permit. Reports (SWU-
242-112608) shall be submitted to your office once scheduled testing is performed.
We will submit a copy of our Storm Water Management Program to you within thirty days.

Energy, Mineral & Land Resources, conducted a site inspection for the Wellons Cumberland Pit #1 facility located
at Claude Lee Road, Cumberland County, North Carolina. A copy of the inspection report is enclosed for your
review. J. K. Lee, the site manager, was present during the inspection and his time and assistance is greatly
appreciated. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters
designated as a UT to Rockfish Creek, a Class C stream in the Cape Fear River Basin. The site visit and file
review revealed that the subject facility is covered by NPDES Stormwater General Perm it-NCG020000, Certificate
of Cove rage-NCG020477.
As a result of the site inspection, the following permit conditions violations are noted:

Inspection Summary:
M. Joyner and M. Lawyer met on site with the Wellons Cumberland Pit #1 mine operator, J.K. Lee.. The Stormwater
Pollution Prevention Plan, Qualitative and Analytical Monitoring Forms were not available for review because the facility
had not developed a Stormwater Pollution Prevention Plan and had not conducted monitoring activities. A Notice of
Violation was also sent to the facility on 2/6/2009 for not having a Stormwater Pollution Prevention Plan, Qualitative and
Analytical Forms. Mr. Lee was informed that if the facility did not have these documents, another Notice of Violation would
be issued. (It was later verified that the facility did not have these documents). Mr. Lee was given a.copy of the General
Permit No. NCG020000 (Mine Discharge Stormwater Permit), the Qualitative and Analytical Monitoring Forms. M. Lawyer
discussed with Mr. Lee about doing the Qualitative and Analytical monitoring and how to fill out the forms. He also said
the General Permit required that the Best Management Practices (BMP's) be inspected once every 7 days and within 24
hours of a rainfall which is 0.50 or more inches.

On December 11, 2013, Melissa Joyner and Mike Lawyer from the Fayetteville Regional Office of the Division of
Energy, Mineral & Land Resources, conducted a site' inspection for the Wellons Cumberland Pit #1 facility located
at Claude Lee Road, Cumberland County, North Carolina. A copy of the inspection report is enclosed for your
review. J. K. Lee, the site manager, was present during the inspection and his time and assistance is greatly
appreciated. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters
designated as a UT to Rockfish Creek, a Class C stream in the Cape Fear River Basin. The site visit and file
review revealed that the subject facility is covered by NPDES Stormwater General Perm it-NCG020000, Certificate
of Cove rage-NCG020477.
As a result of the site inspection, the following permit conditions violations are noted:
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has.not been developed.
2) Qualitative Monitoring
Qualitative monitoring has not been conducted and recorded in accordance with permit requirements.
3) Analytical Monitoring
Analytical monitoring has not been conducted and recorded in accordance with permit requirements.
Other Observations:
Please refer to the enclosed Compliance Inspection Report for additional comments and observations made
during the inspection.
_Requested Response:
You are asked to respond to this office, in writing, within 30 calendar days from receipt of this notice. Your
written response should include a reasonable explanation as to why the aforementioned violations have occurred
as well as a Plan of Action to prevent these violations from recurring.

Inspection Summary:
M. Joyner and M. Lawyer met on site with the Wellons Cumberland Pit #1 mine operator, J.K. Lee.. The Stormwater
Pollution Prevention Plan, Qualitative and Analytical Monitoring Forms were not available for review because the facility
had not developed a Stormwater Pollution Prevention flan and had not conducted monitoring activities. A Notice of
Violation was also sent to the facility on 2/6/2009 for not having a Stormwater Pollution Prevention Plan, Qualitative and
Analytical Forms. Mr. Lee was informed that if the facility did not have these documents, another Notice of Violation would
be issued. (It was later verified that the facility did not have these documents). Mr. Lee was given a.copy of the General
Permit No. NCG020000 (Mine Discharge Stormwater Permit), the Qualitative and Analytical Monitoring Forms, M. Lawyer
discussed with Mr. Lee about doing the Qualitative and Analytical monitoring and how to fill out the forms. He also said
the General Permit required that the Best Management Practices (BMP's) be inspected once every 7 days and within 24
hours of a rainfall which is 0.50 or more inches.
The outfall for Sediment Basin #2 was inspected. There is a tree growing inside the riser which will need removal.

In response to your renewal application for continued coverage under stormwater General Permit NCG020000
the Division of Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit
is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15,
2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG020000
• A copy of a Technical Bulletin for the General Permit
• Two copies of the Tier 21 Exceedence Discharge Monitoring Report (DMR) Form for Stormwater
• One copy each of the Annual Summary DMR Forms for Stormwater and Wastewater
• Two copies of the Limit Violation DMR Form for Wastewater
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater and wastewater, and it specifies your obligations with
respect to discharge controls, management, monitoring, and record keeping. Please review the new permit to
familiarize yourself with all the changes in the reissued permit. If your Certificate of Coverage (COC) restricts
authorization to discharge stormwater only (or other limited terms) based on your original application, or
subsequent modifications to your COC, you must continue to meet these requirements or contact the Stormwater
Permitting Unit to request a modification of this renewal COC.
The more significant changes in the General Permit since your last Certificate of. Coverage include the following:
Part ll:
• Section B — Language referencing PAMS has been changed. Flocculants may now be used if evaluated
by the Division and administered in accordance with maximum application doses and other requirements.
Part III:
• Section A — The permit now requires a Stormwater Pollution and Prevention Plan (SPPP) tailored to the
mining industry, in lieu of a Stormwater BMP Plan.
• Section A - Inactive mines may be inspected on a reduced schedule: at least once per month and after
0.5" (or more) of rain. To qualify, inactive mines must possess an "Inactive Renewal' from DLR or certify
to DWQ the site has been stabilized. The permittee must notify the DWQ Regional Office of inactive
status. Discharges from inactive mines must still be monitored on the same schedule as active mines.

• Section B — Revised provisions require that stormwater discharges be sampled twice per year (instead of
annually), and that the sampling results be compared to new benchmark .values. (The previous cut-off
concentrations have been removed.)
• Section B — Revised provisions require the permittee to execute Tier One, Tier Two & Tier Three
response actions, based on the first benchmark exceedence (Tier One) and the second consecutive
benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring
(reported to the appropriate Regional Offices) instead of twice -per -year monitoring. Monthly monitoring
shall be done until three consecutive monitoring events show no benchmark exceedences.
• Section B — This part contains a new provision that four exceedences of any benchmark will trigger
increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may
direct the permittee to apply for an individual permit, institute specific monitoring, or may direct the
implementation or installation of specific stormwater control measures.
• Section B — The definition of "Representative Storm Event" (RSE) now allows 48 hours (instead of 72
hours) of little or no precipitation to precede an RSE.
• Section B — Stormwater discharges from a basin designed to contain the 10-year storm must now be
monitored.
• Sections B & C — Failure to monitor according to permit terms triggers monthly monitoring for the
remainder of the permit.
• Section C — Analytical monitoring for Total Petroleum Hydrocarbons (TPH) has replaced the Oil & Grease
parameter in the previous permit.
• Section D — Qualitative monitoring must now be conducted during the same representative storm event
as the analytical monitoring.
• Section D — The permittee is required to keep a written record of his response to problems identified by
his qualitative monitoring observations.
• Section D — If the permittee fails to respond effectively to problems identified by qualitative monitoring, the
permittee may be required by DWQ to perform corrective action.
• Section D — Qualitative ROS: Representative Outfall Status may be granted for qualitative monitoring for
some Stormwater Discharge Outfalls (SDOs).
• Section D — If mines do not respond to problems seen in visual monitoring, DWQ may now require that
mines change the monitoring frequency, apply for an individual permit, implement in -stream monitoring,
install or modify structural stormwater controls, or implement other controls.
• Sections B, C, & D — Inability to sample due to adverse weather must be reported in the SPPP and
recorded in the Annual Summary DMR.
• Section E — A lower TSS Wastewater limit for PNA waters is included in the permit.
• Section E — All mining operations are now required to monitor TSS in wastewater effluent discharges (not
only industrial sand mines). However, TSS limits only apply to industrial sand ruining operations.
• Section E — Turbidity limits on effluent discharges have been removed; however, turbidity standards still
apply in the receiving waters.
• Section E — Approval of a Pumping O&M Plan may be required prior to coverage (for sites with
dewatering activities that have the potential to drain wetlands or other surface waters).
• Section E — ATC Requirements have been changed for clarity. These requirements are now outlined for
Mine Dewatering Wastewater, Process Wastewater, Overflow From Non -Closed -Loop Process Recycle
Wastewater Systems, and Overflow From A Closed -Loop Process Recycle (CLPR).
• Section E — Monitoring for Fecal coliforms in discharges to SA waters has been clarified. Fecal coliform
monitoring is now required for all process and mine dewatering wastewater discharges to SA waters.
Part IV:
• Section E — Items 1. and 2, require submittal of a new reporting form: the Annual Summary DMR. This
annual summary of the analytica! monitoring results should be submitted to the DWO Central Office by
March 1 of each year.
• Section E — Exceedences and violations must be sent to the appropriate DWQ Regional Office within 30
days of receipt from the lab.
• Section E — Results of "No Flow" or "No Discharge" must be recorded within 30 days from the sampling
period in the SPPP. "No flow" or "No Discharge" must also be reported on the Annual Summary DMR
form.

Your coverage under the General Permit is transferable only through the specific action of DWQ.
This permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor
does it relieve the permittee from responsibility for compliance with any other applicable federal, state, or local
law, rule, standard, ordinance, order, judgment, or decree.

This is to advise you that the above referenced mining permit expired on May 11,
2009 and has not been renewed. Inspections by personnel of the Department on
September 15, 2009 revealed little or no reclamation efforts have been undertaken on
the site. Expiration of the permit only precludes further mining operations; reclamation
requirements continue to remain in effect. Section 74-56 of the Mining Act of 1971
mandates initiation of bond forfeiture proceedings for failure to reclaim in accordance
with the reclamation plan. Also, civil penalties of up to $500.00 per day for each day of
the violation may assessed under G.S. 74-64,
Additionally, under G.S. 74-64, the penalty for operating a mine without a permit
is a civil penalty of up to $5,000.00 per day for each day of the violation. Therefore no
further mining may- _occur at the above mentioned site until you have applied for and
obtained a valid mining permit from this Department. Please contact this office

permit for this site along with the required corresponding mine
maps. The appropriate mining permit application processing fee is

may be conducted until a mining permit is issued for this site.

(1) Provide this office with three (3) copies of a complete mine map at
a scale of 1 "=50'. This map must delineate all affected areas at the
site and those items listed on page 4 of the application form.
This corrective action must be completed WITHIN 30 DAYS OF
RECEIPT OF THIS NOTICE.
(2) Provide this office with a complete reclamation plan for all affected
areas at the mine site. This plan must include final slopes
throughout the site, final cross -sections of all affected areas,
permanent measures and/or devices to ensure that all reclaimed
areas will be nonerosive, a complete revegetation plan for final
reclaimed areas, etc. Said plan must include a time frame and
sequence for each phase of reclamation for the entire mine site
This corrective action must be completed WITHIN 30 DAYS OF
RECEIPT OF THIS NOTICE.
Should you fail to comply with the terms of this letter within the prescribed time
frames, a formal Notice of Violation may be issued.
The responsibility for understanding and complying with the requirements of the
Act rests upon the individuals and firms who are subject to its requirements. The
responsibility also rests with you for notifying this office of your intentions at this site.

On January 29, 2009, Mike Lawyer from, the Fayetteville Regional Office of the Division of Water
Quality conducted a site inspection for the Wellons Cumberland Pit #1 facility located on Claude Lee Road in
Cumberland County; North Carolina. A copy of the Compliance Inspection Report is attached for your review.
Mr. Bryan Milligan, General Superintendent, was also present during the inspection and his time and assistance
is greatly appreciated. Stormwater from the facility drains to an unnamed tributary to Rockfish Creek, a Class C
water located in the Cape Fear River Basin. The site visit and file review revealed that the subject facility is
covered by NPDES Stormwater General Permit-NCG020477.
Accordingly; the following observations and/or permit conditions violations were noted during the
Division of Water Quality inspection:

Reason for Visit: Routine
Met with Mr. Bryan Milligan, General Superintendent, at the mine site. Facility does not appear to have any wastewater
discharges as there is no mine dewatering or material washing activities and no recycle system. Vehicle maintenance is
not performed onsite. The NCG020000 general permit requires the development of a Best Management Practices (BMP)
Plan in place of the usual Stormwater Pollution Prevention Plan. The BMP Plan should contain documentation pertaining
to the implementation of stormwater BMPs, management of stormwater runoff and runon, inspection and maintenance of
stormwater BMPs, implementation of the mining permit issued by Land Quality, preventative maintenance and good
housekeeping practices and the provision of secondary containment if applicable. According to Mr. Milligan, a BMP Plan
has not been developed or provided to him. The NCG020000 permit also contains visual and analytical monitoring
requirements for wastewater and stormwater discharges. Monitoring has not been conducted. This facility has a single
basin to which ali runoff is conveyed prior to discharging through outfall. Repair work has recently been done to an area of
the basin's side slope where a breach had occurred previously. Although there are no wastewater discharges at this
facility, monitoring of the site's outfall should be conducted in compliance with the stormwater monitoring section of the
NCG020000 permit. Where were no apparent water quality impacts at the time of inspection.

I did an inspection recently of a mine in Cumberland county (Wellons Construction
Company Cumberland Pit 41, Cumbe 26-46) located near the Fayetteville Regional
Airport. You take 301/Bus. 95 to Doc Bennett Rd. (W), which feeds into Claude Lee
Road. The mine is located at the end of Claude Lee Rd. There were wetland buffer and
wetland impacts due to a berm which had been breached, resulting in off -site
sedimentation (approx. 250'x154' .impact, moderate to heavy amount). Sediment was
also seen in sewer line easement. See attached photos. If you have any questions
