The receiving waters for the stormwater discharge is Rockfish Creek. Rockfish is a Class C stream in the Cape Fear River Basin. Other pertinent information for the facility includes: Address: 4525 Claude Lee Road, Fayetteville, NC 28306 Phone: 910-892-6630 Latitude: 340 57' 30.96" N Longitude: 78' 53' 3.12" W No buildings or permanent structures are located at the site. The Standard Industry Classification (STC) Code for the operation is 1442 (Construction Sand and Gravel). The site is an active sand & gravel mine (NCDEQ Mining Permit Number26-46). The mine was originally permitted in 1999. Currently, the mine is permitted for 70 acres, with 54 acres bonded for land disturbance. No washing or processing of materials occurs at the site. Limited vehicle refueling activities are conducted at the site. No refueling tanks are located on the site. Tanker trucks periodically arrive at the site to refill the various equipment used in the mining process. No significant spills or leaks have occurred at the site during the previous three (3) years. The Wellons Pit requires a permit to discharge storm water because materials are potentially in contact with storm water. As a requirement of this permit, the outfatls associated with storm water discharges from areas of industrial activity have been evaluated for q esence of non -storm water discharges. Discharge is from a sediment basin (Basin #2) that is used to treat stormwater runoff from the upslope mining areas. Possible pollutants that could discharge include soil particulate. The Facility Stormwater Plan (Sheet 1) shows the discharge point, drainage area, and the potential pollutants that could occur from the raining activities. Basin #2 outlet is a perforated corrugated riser pipe connected to a horizontal corrugated pipe. The perforated horizontal pipe is surrounded by washed stone. No impervious surface is included in the watershed.area for the outfall. Document and test discharges. Provide guidance on improvement of SPPP. Wcllons Construction, Inc. is responsible for implementing Best Management ractices at the Wellons Pit. These practices include Good Housekeeping, Preventative Maintenance, Spill Prevention Control .and Counter Measures for any possible spills during vehicle/equipment refilling, record -keeping and internal reporting. Spills and leaks are a significant potential source of stormwater pollutants, and in many casesi are avoidable. The standard operating procedures such as spill prevention procedures, along with proper employee training can.reduce the potential for accidental releases. The following areas are -identified for potential spillage: Petroleum releases from constl•nction equipment and vehicles, espechilly dwing refueling. Should a spill occur during refueling or at any other time, any affected soil should be removed (excavated) and placed in appropriate containers (barrels, roll -offs, etc.). The barrels should then be properly disposed of off -site through an appropriate disposal facility. All releases should..be immediately reported,to the Storrnwater.Plan Coordinator or any of the other Pollution Prevention Team Members. 5totruwater Pollution Prevention Plan (SPPP) WeItons Pit _ _ Page 3 The following areas require Good Housekeeping Activities to minimize stormwater releases: Construction Equipment and Vehicle refueling 1. Refueling should be conducted in a manner to minimize spillage. Spills should be immediately cleaned up. The ground should be checked for any ground staining or liquid ponding before each day's use. Staining or ponding is evidence of needed vehicle maintenance. 2. Material handling equipment should be checked for hydraulic line leaks and other leaks that require maintenance. 3. Hydraulic lines should be checked by the operator before each day's use for leakage. Any spill should be cleaned immediately, and repairs made when leakage is noted. Exposed Ground and Sediment Basin l . Observe exposed ground for rill erosion. Flatten grade, divert upslope water runoff, or establish groundcover. 2. Observe sediment accumulation down stream of basin outlet. Excessive sediment accumulation could be a result of improper functioning of the basin outlet, or excessive sediment accumulation inside the basin. S O;fFACI ITZvi INSPECTIUNS�4 Inspection of the facility shall occur at a minimum of twice a year; once during the first half of the year (January to June) and once during the second half (July to December), with at least 60 days separating inspection dates. The Bi-Annual observation by qualified personnel is conducted to perform the following: o Inspect storm water drainage areas for evidence of pollutants entering the site drainage system. Inspect on -site stormwater basin for damage or deficiencies. e Evaluate the effectiveness of measures to reduce pollutant loadings and whether additional measures are needed. • Inspect any equipment needed to implement the plan, such as spill response equipment. e Revise the plan as needed within two weeks of inspection (potential pollutant source description of measures and controls). a Implement any necessary changes in a timely manner, but at least within 12 weeks of the inspection. a Prepare a report summarizing inspection and follow up actions, the date of inspection and personnel who conducted the inspection; identify any incidents of noncompliance or certify that the facility is in compliance with the plan. e Sign the report and keep it with the plan. Stormwater Pollution Prevention Plan (SPPP) Wellons Pit Pa e 4 Record keeping is important to demonstrate that the facility is operated in a way that minimizes the potential for pollutants to enter the environment. Attachment B contains forms that address the following: 1. Site Compliance Evaluation 2. SPPP Review and Update 3. Personnel Training Record 4. Spill Documentation Report 5. Equipment Inspection and Preventative Maintenance Record 5. Future BMP implementation schedule These forms, or ones containing similar information should be completed and kept on -site at all times. Employee training is essential to effective implementation of the Storm Water Pollution Prevention Plan. Each employee that works in a particular area of the plant is trained for proper material handling and spill prevention and good housekeeping practices. The training program will consist of aformal training session and regular follow-up sessions to update and reinforce the formal training. The training sessions will include an overview of the following information included in written documentation. • Written instructions for handling hazardous substances. • Facility storm water pollution prevention. • Facility spill prevention, control, and countermeasures. • Material management practices. • BMP's including spill prevention measures, equipment, and safety procedures. • Recent spills or accidents at the facility or at a similar facility with discussion about causes and corrective actions taken. • Upcoming new equipment installations at the facility that will impact pollution prevention planning or implementation of BMP's. • Inspection procedures. • Applicable environmental laws, regulations, and guidance documents. • Procedures for preventing contact between materials and storm water runoff. • Procedures for using, inspecting, repairing, and replacing facilities or equipment used for spill response. • Communications equipment and alarm systems. • Response to spills and actions required to prevent spill from reaching storm water, • 'People to contact in the event of a spill and what to do in the event of a spill. • Reporting requirements for leaks and spills. • Procedures for tank truck unloading. • Operation and maintenance of containment equipment. The SPPP shall be amended whenever there is a change in design, construction, operation, site drainage, maintenance, or configuration of the physical features which may have a significant effect on the, potential for the discharge of pollutants to surface waters. The annual update shall include the following: -A list of significant spills or leaks of pollutants for the previous three.(3) years, or the.notation that no spills have occurred. -A written"re-certification that stormwater outfalls have been evaluated for the presence of non-stormwater discharges -A review and comparison of sample analytical data to benchmark values 9ASITP IMPLEMENTATION Wellons Construction, Inc. shall implement the SPPP consistent with the provisions of -the NCG200000 permit, in order to control contaminants entering surface waters via stormwater. Implementation of the SPPP shall include documentation of all monitoring; measurements, inspections, maintenance activities, and training provided to employees, including the.16g of the sampling data. We were recently made aware that the employee we had assigned to manage the program had not fulfilled their duties and is no longer associated with this project or Wellons Construction. We have formed a three- person team that is currently implementing a plan to conform within the corrective requirements of NPDES Stormwater General Permit. The team will report to upper management the first of each month to review any activity related to the Wellons Cumberland Pit #1 including Stormwater.Pollution Prevention Plan, Inspections, and Reporting required by DEMLR. In addition, we have contacted Pat Shillington of Engineering & Environmental Science Company of Raleigh, NC and he has agreed to produce an updated map of the property which will show the drainage area boundaries and the direction of flow in each drainage area. Sediment Basin #3 will be updated with the addition of a surface dewatering device as requested. Once we have a confirmed date for the completion of the updated site map we will contact you again in writing and produce our Plan of Action and Stormwater Pollution Prevention Plan. In reference to NCG020000 General Permit requirements for the Site Map (Current Mine Map) should show the drainage area boundaries and the direction of flow in each drainage area. Sediment Basin #3 should be updated with the addition of a surface dewatering device. 2. The Stormwater Pollution Prevention Plan should be annually updated including: 1. List of significant spills/or a statement about no spills occurring for the previous 3 years.; 2. Document effectiveness of on -site erosion control measures (construction entrance, diversion ditch and Sediment Basin #3).; 3. Provide a review and comparison of sample analytical data using the attached Division's Annual Summary Data Monitoring Report available on the Stormwater Permitting website at:htt://portal.denr.org/web/Ir/npdes-stormwater. l gave you a copy of this form during our meeting. This form should be mailed to the address on the form every year. by March 1st. 3. As long as the mine is active, all erosion control measures need to be inspected on a weekly basis. The Analytical and Qualitative monitoring, along with the recording of rainfall, occurs twice per year: Period 1 : Jan. 1st -June 30th and Period 2: July 1-December 31st. 4.-Active implementation of the SPPP includes documentation of all monitoring (Analytical and Qualitative), measurements, inspections, maintenance activities and annual training provided to employees. 5. Dormant Site Status only applies if all industrial activities have been suspended and the portions of the site where clearing, grading and/or excavated activities have occurred have been stabilized with vegetation. I would do an inspection of the site after this has occurred and written certification about this status would be submitted by the company. The Analytical and Qualitative Monitoring is not required, only monthly inspections of the erosion control measures are necessary and an annual inspection needs to be conducted as part of the annual update of the SPPP. If industrial activities will reoccur, the Regional Office needs to be notified prior to this reoccurance. 6. Please send a written response letter within 30 days of receipt of having received the Notice of Violation which would include a reasonable eplanation for the violations which occurred and a plan of action to prevent these violations from reoccurring. "No Flow" was documented from the outfall of Sediment Basin #2 during this time period: Analytical Monitoring has not been conducted for Period 1 of 2015 (Jan. 1, 2015 through June 30, 2015). Qualitative Monitoring has not been conducted. A Stormwater Pollulion Prevention Plan has not been developed for this facility. The outfali for Sediment Basin #2 was inspected. A tree is still growing inside the riser although it appears that it has had branches removed. There is also vegetative debris on the riprap protection inside of the riser. The Swale leading to Sediment Basin #2 has gully erosion on a side slope in need of stabilization. General Permit NCG020000 requires that Best Management Practices(BMPs) be inspected once every 7 days and within 24 hours of a rainfall which is 0.50 or more inches. Mr. Lee has visited the site after each significant rain fall to see if runoff was evident, but no water was discharging from the structure. We have scheduled the submittal of the benchmark report by June 1, 2014. Mr. Lee will also continue to visit the site to conduct rain fall and erosion control monitoring as needed. Wellons Cumberland Pit #1, COC-NCGO20477 NPDES Stormwater General Permit-NCG020000 Cumberland County Dear Mr. Wellons: On December 11, 2013, Melissa Joyner and Mike Lawyer from the Fayetteville Regional Office of the Division of Energy, Mineral & Land Resources, conducted a site' inspection for the Wellons Cumberland Pit #1 facility located at Claude Lee Road, Cumberland County, North Carolina. A copy of the inspection report is enclosed for your review. J. K. Lee, the site manager, was present during the inspection and his time and assistance is greatly appreciated. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as a UT to Rockfish Creek, a Class C stream in the Cape Fear River Basin. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Perm it-NCG020000, Certificate of Cove rage-NCG020477. As a result of the site inspection, the following permit conditions violations are noted: 1) Stormwater Pollution Prevention Plan (SPPP) A Stormwater Pollution Prevention Plan (SPPP) has.not been developed. 2) Qualitative Monitoring Qualitative monitoring has not been conducted and recorded in accordance with permit requirements. 3) Analytical Monitoring Analytical monitoring has not been conducted and recorded in accordance with permit requirements. (The previous cut-off concentrations have been removed.) • Section B — Revised provisions require the permittee to execute Tier One, Tier Two & Tier Three response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring (reported to the appropriate Regional Offices) instead of twice -per -year monitoring. However, TSS limits only apply to industrial sand ruining operations. • Section E — Turbidity limits on effluent discharges have been removed; however, turbidity standards still apply in the receiving waters. • Section E — Approval of a Pumping O&M Plan may be required prior to coverage (for sites with dewatering activities that have the potential to drain wetlands or other surface waters). • Section E — ATC Requirements have been changed for clarity. Facility does not appear to have any wastewater discharges as there is no mine dewatering or material washing activities and no recycle system. Vehicle maintenance is not performed onsite. The NCG020000 general permit requires the development of a Best Management Practices (BMP) Plan in place of the usual Stormwater Pollution Prevention Plan. The BMP Plan should contain documentation pertaining to the implementation of stormwater BMPs, management of stormwater runoff and runon, inspection and maintenance of stormwater BMPs, implementation of the mining permit issued by Land Quality, preventative maintenance and good housekeeping practices and the provision of secondary containment if applicable. According to Mr. Milligan, a BMP Plan has not been developed or provided to him. The NCG020000 permit also contains visual and analytical monitoring requirements for wastewater and stormwater discharges. Monitoring has not been conducted. This facility has a single basin to which ali runoff is conveyed prior to discharging through outfall. Repair work has recently been done to an area of the basin's side slope where a breach had occurred previously. Although there are no wastewater discharges at this facility, monitoring of the site's outfall should be conducted in compliance with the stormwater monitoring section of the NCG020000 permit. You take 301/Bus. 95 to Doc Bennett Rd. (W), which feeds into Claude Lee Road. The mine is located at the end of Claude Lee Rd. There were wetland buffer and wetland impacts due to a berm which had been breached, resulting in off -site sedimentation (approx. 250'x154' .impact, moderate to heavy amount).
