On October 15, 2013, a site inspection was conducted for the Norman Sand Mine facility located at 407 Yarborough
Road, in Candor, Montgomery County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your
review. Mr. Jason Conner was present during the inspection and his time and assistance is greatly appreciated. Permit
coverage authorizes the discharge of stormwater, discharge of mine dewatering wastewater and process wastewater from
the facility to receiving waters designated as Big Creek, a Class C stream in the Yadkin -Pee Dee River Basin. The site
visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit-NCG020000,
Certificate of Coverage-NCG020430.
As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG020000 permit.
Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the
inspection.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty

Activities. Met with Jason Conner of BV Hedrick Gravel and Sand Company. The facility's Stormwater Pollution
Prevention Plan, record of BMP inspections, analytical and qualitative monitoring were reviewed. All records appeared to
be in order. Qualitative monitoring and weekly visual BMP inspection records show corrective measures have been taken

Inspection Summary:
Inspection conducted to ensure compliance with the NCG020000 general permit for mining activities. Met with Jason
Conner and Dorothy Goodman with BV Hedrick. Reviewed facility's Stormwater Pollution Prevention Plan (SWPPP) and
available records. Coverage under the general permit was transferred from CEMEX to BV Hedrick on July 18, 2011. The
facility's SWPPP appeared to contain all permit -required components. Weekly BMP inspections have been conducted and
documented. According to facility personnel, there has never been a stormwater discharge from the four sediment
trapsloutfalls as identified on the mine map. It was advised to begin documenting both Analytical and Qualitative
Monitoring by recording "No Flow" or "No Discharge" on the appropriate forms within 30 days of the end of a monitoring
period if there is a lack of discharges. All process water enters a settling pit where the water is recycled back to the plant
so there are no process wastewater outfalls. Observations were made of the four sediment trapsloutfalls and all appeared
to be properly maintained.

NORMA.N QUARRY LEASE AND OPTION AGREEMENT
THIS IS A LEASE AND OPTION AGREEMENT ("Lease") by and between BV
Hedrick Gravel & Sand Company, a North Carolina corporation ("Lessee") and Cemex
Construction Materials Atlantic, LLC, a Delaware limited liability company ("Lessor") made
and entered into on November 9, 2010 (the "Effective Date"), and by which Lessee and Lessor,
in consideration of the mutual promises and the payments contained in this Lease (the mutuality,
adequacy and sufficiency of which are hereby acknowledged), hereby agree as follows:
1. Generally.
(a) Master Agreement. This Lease is being entered into in connection with that
certain Master Agreement, dated as of November 9, 2010, between Lessee and Lessor.
Contemporaneously with the execution of this Lease (i) Lessee and Lessor have entered into that
certain aggregate Suppiy Agreement dated as of iNovember 9, 2010 ("Aggregate Supply
Agreement") and (ii) Lessee's Affiliate, Southern Concrete Materials, Inc. ("Southern"), and
Lessor have entered into that certain Cement Supply Agreement dated as of November 9, 2010
("Cement Supply Agreement").
(b) Lease. Subject to the terms and conditions of this Lease, Lessor hereby leases
to Lessee (i) the real property shown on Exhibit A, located in Rocky Springs Township,
Montgomery County, North Carolina, containing approximately 182 acres (the "Property") and
(ii) the plarit and equipment located on the Property and listed in Exhibit B hereto (the
"Equipment"), for the purpose of Lessee mining fill, sand and gravel on the Property and any
activities reasonably related thereto.but specifically excluding (x) the operation of any asphalt,
concrete or concrete product manufacturing facility or any cement or cementitious material sales
or distribution facility or terminal and (y) unless Lessor consents in writing in advance, the
processing, storage or sale of sand or gravel materials sourced from off the Property.
(c) Disclaimer by Lessor. The parties acknowledge that it is impossible to
accurately determine the quality, merchantability or amount of saleable sand and gravel in the
Property and Lessor makes no representation or warranty with respect to the amount, quality or
merchantability of water, sand and gravel in the Property. Lessee is relying on its own
inspections and investigations with respect to such matters. Lessee acknowledges that it has
examined the Property, and that Lessee will be leasing and accepting the property in an "AS -IS"
condition based upon its own examination, inspection and judgment, and not through any
representations or warranties made to it by Lessor or any agent or representative of Lessor,
express, implied or otherwise, regarding the fitness of the Property including, suitability,
habitability, or usability of the Property for Lessee's purposes, as to compliance of the Property
with any laws, regulations, or ordinances. Lessee agrees that Lessor shall not be obligated to
perform or be responsible for any construction, alteration, maintenance or repair with respect to
all or any portion of the Property. In addition, the Property is leased subject to current taxes and
assessments accruing after the Effective Date, reservations in patents and all rights -of -way,
easements, covenants, conditions, restrictions, obligations, liens, encumbrances, and liabilities of

Enclosed are two copies of a Notice of Intent to obtain a General Stormwater Permit for
our sand mine located at 407 Yarborough Road, Candor, NC. Also enclosed is the
required $80.00 application fee along with the annual fee for seven other sites
A recent internal audit revealed that the stormwater permit apparently had not been
renewed upon expiration during the transition from being operated by RMC over to
CEMEX in January 2006. The site is currently implementing its Stormwater Best
Management Plan as required by General Permit NCGO20000. This sight is unique in
that all stormwater run-off associated with the mining operations does not discharge
offsite. All stormwater is directed to a centrally located make-up water pond that
maintains several feet of free board and has not been observed to overflow. The Best
Management Plan therefore focuses on inspections and protection of the man-made
wetlands associated with the make-up water pond.

reissuance of the certificate of coverage.
