Hall-Rackley Pit, Certificate of Coverage-NCG020353 NPDES General Perm it-NGG020000 Harnett County Dear Mr. Kirkpatrick: Dee Freeman Secretary On September 20, 2012, Michael Lawyer, Environmental Specialist from the Fayetteville Regional Office of the Division of Water Quality, conducted a site inspection for the Hall-Rackley Pit facility located on Claude White Road in Harnett County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. Mr. Jason Rollins, General Manager, and Mr. Sammy Reagan, Supervisor, were also present during the inspection and their time and assistance is greatly appreciated. Permit coverage authorizes the discharge of stormwater and/or wastewater from the facility to receiving waters designated as Beaver Creek, a Class WS-III waterbody in the Cape Fear River Basin. The site visit and file review revealed that the subject facility is covered by NPDES General Permit-NCG020000, Certificate of Coverage. NCG020353. As a result of the site inspection, the following permit conditions violations are noted: 1) Qualitative Monitoring Qualitative monitoring has not been conducted and recorded in accordance with permit requirements 2) Analytical Monitoring Analytical monitoring has not been conducted and recorded in accordance with permit requirements. Other Observations: Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Requested Response: You are asked to respond to this office, in writing, within 30 calendar days from receipt of this notice. Your written response should include a reasonable explanation as to why the aforementioned violations have occurred as well as a Plan of Action to prevent these violations from re -occurring. Met with Mr. Jason Rollins, General Manager, and Mr. Sammy Reagan, Supervisor. An overall Stormwater Pollution Prevention Plan (SWPPP) has been developed to cover multiple mines that are owned and operated by GS Materials as they are all located adjacent to one another, but have coverage under separate mining and stormwater permits. Site specific information for each mine along with copies of the applicable Certificate of Coverage is also contained within the SWPPP. Documentation of weekly BMP inspections from July 2010 to present was reviewed. Qualitative Monitoring records were available for the second half of 2010, first half of 2011 and first half of 2012. All indicated 'No Flow' during a representative storm event. There was no record for the second half of 2011. An Annual Summary DMR for Analytical Monitoring for calendar year 2010 showed 'No Flow' for all basins. There were no records of Analytical Monitoring for 2011 or first half of 2012. Discussed monitoring requirements with Mr. Rollins who had worked at the mine several years ago, but just recently returned to oversee mining operations. After the records review, rode through the mine site with Mr. Rollins and Mr. Reagan to make observations of site conditions and basins. Expressed to Mr. Rollins that the site appeared to be in need of better operation and maintenance as several internal areas had experienced major erosion and some of the basins contained significant amounts of sediment. All sediment basins should be continually maintained so that any discharges are free of turbid water and/or sediment. Any accumulated sediment in the basins should be removed and the dimensions (length, width, depth) as well as outlet structures properly maintained so they function as intended. The establishment of vegetation is encouraged near and around the sediment basins and other areas where excavation or grading is not being conducted. G.S.M. will re - vegetate side slopes to reduce sediment loads into the stormwater basins. G.S.M. understands that no stormwater pipes or connections shall be made into the closed - loop recycle system, which includes the silt ponds and the Duck Pond (Clearwater Pond) because no monitoring is required for that system. There are no stormwater pipes or discharges into the silt ponds or Duck Pond. If stormwater is piped or channelized into that system other than direct rainfall, G.S.M. knows that analytical monitoring must be performed because that is now "process water". The closed loop recycle system does operate under normal everyday conditions with at least 2-feet of freeboard (depth from water level to top of the basins). Materials understands the parameters needed for testing and will be testing any discharges from this sediment basin. However, this basin will probably not discharge. Met with Ms. Karen Hilliard, Office Manager, and Mr. J. Branch Smith, PE with GS Engineering Services, who has developed a Stormwater Pollution Prevention Plan (SPPP) to cover multiple mines owned and operated by G.S. Materials, Inc. The SPPP is complete, however there is no documentation of the required weekly BMP inspections, monitoring data, maintenance activities, etc., which constitutes failure to implement the SPPP. The Hall-Rackley Mine (NCG020353) consists of approximately 323 acres and includes the mine office, excavation areas, conveyors where material is washed and processed, and tailings ponds for recycling of wash water. An approved flocculant (Zetag 8125) is added to tailing pond #3 for aid in the settling of sediment and subsequent removal. There are eight stormwater basins with rock weirs or pipe outlet structures. After observing a couple of the stormwater basins, recommendations were made to reshape the areas to achieve a more well-defined basin, vegetate the side slopes, and maintain access to the outfalls for sampling. There is no mine dewatering and according to facility personnel there have been no overflows of the recycle system, however there were no records of inspections or Analytical/Qualitative Monitoring data at the time of inspection. If there are no discharge events during a monitoring schedule, the DMR's should be completed with 'No Discharge' noted under the monitoring results area and submitted to Central Files. The COC includes authorization'to operate a closed -loop recycle system. In addition, the location of the facility under this COC has been revised to reflect the Hall-Rackley Pit. Also in response to your renewal application for continued coverage under stormwater General Permit NCG020000, DWQ is forwarding herewith the reissued stormwater General Permit, effective January 1, 2010. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state'of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.) The following information is included with your permit package: • A new Certificate of Coverage, which now includes authorization to dperate a closed -loop recycle system • A copy of stormwater General Permit NCG020000 • A copy of a Technical Bulletin for the General Permit • Two copies of the Tier 2 I Exceedence DMR Form for Stormwater • One copies of the Annual Summary Discharge Monitoring Report (DMR) Form for Stormwater • Two copies of the Limit Violation DMR Form for Wastewater • One copies of the Annual Summary DMR Form for Wastewater • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater and wastewater, and it specifies your obligations with respect to discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. The more significant changes in the General Permit since your last Certificate of Coverage include the following: Part II: • Section B — The language referencing DAMS has been changed. Flocculants may now be used if evaluated by the Division and administered in accordance with ,maximum application doses.and any other current requirements.. Part III: • Section A — The permit now requires a Stormwater Pollution and Prevention Plan (SPPP) tailored to the mining industry, in lieu of a Stormwater BMP Plan. • Section A - Inactive mines may be inspected on a reduced schedule: at least once per month and after 05' (or more) of rain. To qualify, inactive mines must either possess an "Inactive Renewal" from DLR or certify to DWQ the site has been stabilized. The permittee must also the DWQ Regional Office of inactive status. Discharges from inactive mines must still be monitored on the same schedule as active mines. Section B — Revised provisions require that stormwater discharges be sampled twice per year (instead of annually), and that the sampling results be compared to new benchmark values. (The previous cut-off' concentrations have been removed.) Section B — Revised provisions require the permittee to execute Tier One, Tier Two & Tier Three response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two.,requires that the permittee institute monthly monitoring (reported to the appropriate Regional Offices) instead of twice -per -year monitoring. Monthly monitoring shall be done until three consecutive monitoring events show no benchmark exceedences., Section B — This part contains a new provision that four exceedences of any benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may . direct the permittee to apply for an individual permit, institute specific monitoring, or may direct the implementation or installation of specific stormwater control measures. • Section B — The definition of -"Representative Storm Event" (RSE) now allows 48 hours (instead of 72 .hours) of little or no precipitation to precede an RSE. • Section B — Stormwater discharges from a basin designed to contain the 10=year storm must now be monitored. • Sections B & C — Failure to monitor according to permit terms triggers monthly monitoring for the remainder of the permit. • Section C — Analytical monitoring for Total Petroleum Hydrocarbons (TPH) has replaced the Oil &-Grease parameter in the previous permit. • Section D — Qualitative monitoring must now be conducted during the same'representative storm event as the analytical monitoring. • Section D — The permittee is required to keep a written record of his response to problems identified by his qualitative monitoring observations. • Section D — If the permittee fails to respond effectively to problems identified by qualitative monitoring, the permittee may be required by DWQ to perform corrective action. • Section D — Qualitative ROS: Representative Outfall Status may be granted for qualitative monitoring for some Stormwater Discharge Outfalls (SDOs). • Section D — If mines do not respond to problems seen in visual monitoring, DWQ may now require that mines change the monitoring frequency, apply for an individual permit, implement in -stream monitoring, install or modify structural Stormwater controls, or implement other controls. - Sections B, C, & D — Inability to sample due to adverse weather must be reported in the SPPP and recorded in the Annual Summary DMR. Section E — A lower TSS Wastewater limit for PNA waters is included in the permit. • Section E — All mining operations are now required Jo monitor TSS in wastewater effluent discharges (not. only industrial sand mines). However, TSS limits only apply to industrial sand mining operations. Section E — Turbidity limits on effluent discharges have been removed; however, turbidity standards still apply in the receiving waters. Section E — Approval of a Pumping O&M Plan may be required prior to coverage (for sites with dewatering activities that have the potential to drain wetlands or other surface waters). • Section E — ATC Requirements have been changed for clarity. These requirements are now outlined for Mine Dewatering Wastewater, Process Wastewater, Overflow From Non -Closed -Loop Process Recycle Wastewater Systems, and Overflow From A Closed -Loop Process Recycle (CLPR). Section E — Monitoring for Fecal coliforms in discharges to SA waters has been clarified. Fecal coliform monitoring is now required for all process and mine dewatering wastewater discharges to SA waters. • Part IV: • Section E -- Items 1, and 2. require submittal of a new reporting form: the Annual Summary DMR. This annual summary of the analytical monitoring results should be submitted to the DWQ Central Office by March 1 of each year. • Section E — Exceedences and violations must be sent to the appropriate DWQ Regional,Office within 30 days of receipt from the lab. • Section E — Results of "No Flow" or "No Discharge" must be recorded within 30 days from the sampling period in the SPPP. The COC includes authorization to operate a closet! -loop recycle system. In addition, the location of the facility under this COC has been revised to reflect the Hall-Rackley Pit. Also in response to your renewal application for continued coverage under stormwater General Permit NCG020000, DWQ is forwarding herewith the reissued stormwater General Permit, effective January 1, 2010. This permit is reissued pursuant to the requirements of North Carolina Gehe�al Stattate 143-215.1 acid the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.) The following information is included with your permit package: • A new Certificate of Coverage, which now includes authorization to operate a closed -loop recycle system • A copy of stormwater General Permit NCG020000 • A copy of a Technical Bulletin for the General Permit • Two copies of the Tier 21 Exceedence DMR Form for Stormwater • One copies of the Annual Summary Discharge Monitoring Report (DMR) Form for Stormwater • Two copies of the Limit Violation DMR Form for Wastewater • One copies of the Annual Summary DMR Form for Wastewater • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater and wastewater, and it specifies your obligations with respect to discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. The more significant changes in the General Permit since your last Certificate of Coverage include the following: • Part 11: Section B — The language referencing PAMS has been changed. Flocculants may now be used if evaluated by the Division and administered in accordance with maximum application doses and any other current requirements. • Part III: • Section A — The permit now requires a Stormwater Pollution and Prevention Plan (SPPP) tailored to the mining industry, in lieu of a Stormwater BMP Plan. • Section A - Inactive mines may be inspected on a reduced schedule: at least once per month and after 0.5" (or more) of rain. To qualify, inactive mines must either possess an "Inactive Renewal" from DLR or certify to DWQ the site has been stabilized. The permittee must also the DWQ Regional Office of inactive status. Discharges from inactive mines must still be monitored on the same schedule as active mines. • Section B — Revised provisions require that stormwater discharges be sampled twice per year (instead of annually), and that the sampling results be compared to new benchmark values. (The previous cut-off concentrations have been removed.) Section B — Revised provisions require the permittee to execute Tier One, Tier Two & Tier Three response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring (reported to the appropriate Regional Offices) instead of twice -per -year monitoring. Monthly monitoring shall be done until three consecutive monitoring events show no benchmark exceedences. • Section B — This part contains a new provision that four exceedences of any benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may . direct the permittee to apply for an individual permit, institute specific monitoring, or may direct the implementation or installation of specific stormwater control measures. Section B — The definition of "Representative Storm Event" (RSE) now allows 48 hours (instead of 72 hours) of little or no precipitation to precede an RSE. • Sectiorf B — Stormwater discharges from a basin designed to contain the 10-year storm must now be monitored. • Sections B & C — Failure to monitor according to permit terms triggers monthly monitoring for the remainder of the permit. Section_C — Analytical monitoring for Total Petroleum -Hydrocarbons (TPH) has replaced the Oil & Grease parameter in the previous permit. • Section D — Qualitative monitoring must now be conducted during the same representative storm event as the analytical monitoring. • Section D — The permittee is required to keep a written record of his response to problems identified by his qualitative monitoring observations. Section D — If the permittee fails to respond effectively to problems identified by qualitative monitoring, the permittee may be required by DWQ to perform corrective. action. • Section D -- Qualitative ROS: Representative Outfall Status may be granted for qualitative monitoring for some Stormwater Discharge Outfalls (SDOs). • Section D — If mines do not respond to problems seen in visual monitoring, DWQ may now require that mines change the monitoring frequency, apply for an individual permit, implement in -stream monitoring, install or modify structural stormwater controls, or implement other controls. ` • Sections B, C, & D -- Inability to sample due to adverse weather must be reported in the SPPP and recorded in the Annual Summary DMR. • Section E — A lower TSS Wastewater limit for PNA waters is included in the permit. • Section E — All mining operations are now required to monitor TSS in wastewater effluent discharges (not only industrial sand mines). However, TSS limits only apply to industrial sand mining operations. • Section E —Turbidity limits on effluent discharges have been removed; however, turbidity standards still apply in the receiving waters. • Section E — Approval of a Pumping O&M Plan may be required prior to coverage (for sites with dewatering activities that have the potential to drain wetlands or other surface waters). • Section E -- ATC Requirements have been changed for clarity. These requirements are now outlined for Mine Dewatering Wastewater, Process Wastewater, Overflow From Non -Closed -Loop Process Recycle Wastewater Systems, and Overflow From A Closed -Loop Process Recycle (CLPR). • Section E — Monitoring for Fecal collforms in discharges to SA waters has been clarified. Fecal coliform monitoring is now required for all process and mine dewatering wastewater discharges to SA waters. Part IV: • Section E — Items 1. and 2. require submittal of a new reporting form: the Annual Summary DMR. This annual summary of the anal monitoring results should be submitted to the DWQ'Central Office by March 1 of each year. • Section E — Exceedences and violations must be sent to the appropriate DWQ Regional Office within 30 days of receipt from the lab. • Section E — Results of "No Flow" or "No Discharge" must be recorded within 30 days from the sampling period in the SPPP. PAMs applied to sediment -laden waters such as "borrow pits," settling ponds, or applied directly in run-off conveyances downstream of land disturbances also hold great potential for reducing sediments in streams. However, if PAMs are applied over certain levels, they become toxic to aquatic life. It is critical that an application system be in place that minimizes the chances of malfunctions that could result in over -application of PAMs and subsequent adverse effects to aquatic Iife. It is especially important to be cautious near sensitive streams such as those classified as "High Quality" or "Outstanding Resource Waters." The intent of this memo is to provide guidance that will allow use of PAMs to reduce sediment contributions to the streams, while preventing toxicity to aquatic life. "Floc logs" are being used in flowing water conveyances with varying degrees of success. However, very little is known about the release rate of the active ingredients, which effectively corresponds to the application rate in this type of use. Therefore, caution should be taken in approving their use. It is recognized that there is a need for development of a standard application methodology for this technology. This methodology would include guidance concerning the appropriate number `logs to be used in given situations. It would also include guidance on physical placement so that the logs do not become .Jvered with silt or dry out, thus reducing their effectiveness. In using any form of PAM, several basic guidelines should be followed: 1. PAMs should be used only after all appropriate physical BMPs have been implemented at a particular site. 2. Only anionic PAMs should be used. 3. PAMs must not be applied directly to surface waters of the state. 4. There should be a "stilling basin" or similar structure between the application point of PAMs and surface waters. 5. As individual products are evaluated, a database of products and maximum application rates will be established and made available through the Internet. Before approving the use of powder or liquid application of PAMs to a settling basin or run-off conveyance, we advise submitting a particular product's label, application instructions, and Material Safety Data Sheet (MSDS) to DWQ's Aquatic Toxicology Unit for evaluation and determination of the product's safe application rate. The product's vendor should be able to provide the required information. Once a sufficient number of products have been assessed for safety, contractors applying PAMs may refer to the Internet list to determine whether an appropriate application rate has been established for a prospective PAM. This will prevent resubmission of previously evaluated product information. The mine currently has an old closed -loop recycle systems permit that expired in 1994. G.S. Materials has not renewed it since 1994, but has paid an annual $360.00 fee for the permit since 1994. The closed -loop recycle system consists of processed sand material. The sand is washed, a PAM is added (ZETAG 8125), and is discharged through a series of silt ponds that terminate in a large pond that is the source of the water used for washing. We do not believe this follows the closed -loop recycle systems requirements found in the 2T Rules, Section .1000 and are formally requesting a modification to the NPDES permit to include the closed -loop recycle system into the active NPDES permit. The large pond is noted on the plans as the Clearwater Pond/Duck Pond that feeds Plant 1 and Plant 3 for sand washing. Plant 3 is currently not in operation (as well as Plant 2). The pond is below grade with a 4- foot berm on grade around the perimeter of the pond. Average depth ranges from 4-5 feet with water staging at 2-3 feet normally. Currently, water is only 1-2 feet inside the pond. If water stages any lower, G.S.M will turn the pumps on to add water from the ponds below. The Clearwater Pond is not pumped out for other water uses; only as the source water for Plant 1 and 3. There are no breaches and there is at least 4-feet of freeboard with the berm. Please see the plans that represent this area and a new NPDES NOI application form. The NPDES permit currently has 8 stormwater discharges leaving the mine property from sediment ponds, basins, and/or a combination of traps and basins.
