Dear Mr. Willis,
The Division of Water Quality received the evaluation conducted by Pittman Soil Consulting on
March 22, 2010. The reported findings indicate there is potential for the mine pit to affect the
adjacent wetlands. As part of the operation and monitoring plan required by the NPDES
General Permit NCG0200000, you will need to install wetland monitoring wells in the adjacent
wetlands between your mine pit and Northeast Creek. The monitoring wells s be tea
depth of no less than 7 feet. Please provide documentation to this office bay 15, 201 ,that
the wells have been installed. The water levels in the wells should be monitored at least twice
per week starting June 1, 2010 and the data reported to this office quarterly. Your Operation
and Monitoring Plan should include a revised map of the mine site showing the wetland
boundary, the location of the wetland monitoring wells, and the discharge point for the
dewatering activities.

Dear Mr. Willis,
A site evaluation was conducted at your sand mine located off Halltown Road in the Jacksonville area of
Onslow County. The purpose of this evaluation was to determine the effect of the mine on the adjacent
wetlands.
The wetland boundary was flagged in the field and has been surveyed by Parker and Associates. A detailed
survey has also been provided which shows the pit, wetlands, and pit water elevation at the time of the
survey. At this time the dewatering has not drained the wetlands. This was apparent by the standing water,
saturation in first 12" of profile, wetland vegetation present, and the presence of hydrie soils.
Auger borings were dug around the edge of the pit adjacent to the wetlands and the water level in the mine.
Soils were found to be group fI to group IV soils depending on depth. Hydraulic conductivity of the soils
was found to be .01 to l" per hour. Ksat readings in the bottom of the pit were found to be 1 to 3" per hour.
This data was placed in The Skaggs Method Lateral Effect model to determine the lateral effect of the mining
on the wetlands.
Analysis #1 was calculated using a ksat of 1-3"per hour to a depth of 72", and an assumed restrictive layer of
72" (restrictive layer known to be deeper than 50'). The results of the model showed that a buffer of 86.6'
was needed before the mining activities would affect the wetlands. The survey shows that the closest
distance to the wetlands from the pit is 117', which is well beyond the 86.6'. At this time the mining
operations have not dewatered the wetlands on the site.
All permits will be issued by the state and are subject to all rules of the county and state. The findings are
based on the conditions of the site at the tune of evaluation, and any alterations may adversely impact the
results.

SCOPE
The intent of this plan is to provide a detailed plan/guide for the Operation and
Maintenance of the Willis Pit (Mine) so that it complies with Part III Section A of the
NPDES General Permit No. NCG020000 for Mine dewatering. This plan has been
prepared by Parker & Associates, Inc. and W.R. Willis Construction Company.
1. SITE PLAN
A. See the attached Exhibit 1 — Portion of USGS map, and Exhibit 2 — Portion of
Onslow County D.O.T. Map.
B. Willis Pit is a sand mining operation only. There is no processing or
stockpiling involved. Sand is excavated and loaded directly into trucks and hauled off site
to other locations. Loading is performed with an excavator and other than normal daily
maintenance all service is performed off site. No fuels or lubricants are stored near or in
mining area. Excavated material is normally wet so dust is not a problem in mine. The
haul road is monitored and dampened utilizing a water truck when necessary to control
any dust created from hauling operations. There is no waste generated from this
operation, therefore, no disposal plan is needed. The possible pollutants to be concerned
with are small amounts of fuel or hydraulic oil created by a ruptured host or pipe on
trucks or equipment. This is not a normal occurance but in the unlikely event that it does
happen there is always someone on site to minimize and contain the spill before it
reaches any water source. Any contaminated soils will be removed and disposed of at a
facility certified to treat soils.
C. See the attached Mine Site Plan by Parker & Associates, Inc. dated January
28, 1997 and last revised July 6, 2009.
D. There have been no significant spills or leaks at this location in the last three
years and no corrective actions have been needed.
E. The discharge pipe for the dewatering pump will be inspected daily when
pumping. The discharge line is located in close proximity to power source for pump and
immediately after starting pump discharge will be evaluated to determine if any non-
stormwater discharge is present. Pumping is only performed as needed and never
immediately after or during a rain event. Visual checks for clarity are performed each
time pump is operated. Any foam, discoloration or unusual odor would result in
immediate shut down of pump and discharge. Samples will be collected quarterly and
analyzed by a certified laboratory and results will be kept on site. Results will also be
forwarded to NC Division of Water Quality annually as required. At any time sampling

results exceed acceptable levels, discharging will cease until conditions become more
favorable and samples would be taken monthly for a period of one year. After such time,
if levels have been consistently lower than acceptable levels, samples would be drawn on
a quarterly basis at minimum or as deemed necessary. Daily records will be maintained
on site recording times and amounts of discharge as well as recorded rain fall.
2. EROSION AND SEDIMENTATION CONTROL
There is no gravity discharge of stormwater to the adjacent wetlands or creek,
therefore, there are no special erosion and sedimentation control measures. The mine pit
is its own sediment basin. The facility shall be operated and maintained in compliance
with the mining permit issued by the Division of Land Resources.
3. STORMWATER MANAGEMENT PLAN
A. All excavation and land disturbance is confined to the mine area with only one
controlled discharge source (dewatering pump). A diversion berm is maintained around
the mine perimeter to eliminate stormwater run-on. A perimeter ditch will be maintained
inside mine area and will act as a sediment basin for any run-off within mine area. No
discharge of stormwater (pumping) will occur until all solids have settled and water is
clear.
B. An inspection of mine slopes, entrance/exit, and stormwater protection devices
(BMP's) will be conducted weekly or within 24 hours of any storm even by the mine
operator or other competent person. No discharge will take place during or immediately
after a storm event. A rain gauge will be kept on site and monitored and all rainfall
recorded. All deficiencies and corrections will be recorded and kept on site.
C. There is no bulk storage of any kind on this site.
4. SPILL PREVENTION AND RESPONSE PLAN SPRP
There is no bulk storage of any kind on site, therefore, there is no potential for
spills.
5. PREVENTATIVE MAINTENANCE AND GOOD HOUSEKEEPING PROGRAM
All equipment and trucks will be in good working order and kept on a regular
maintenance schedule. Operators are trained and required to inspect equipment prior to
starting work each day and periodically throughout each shift. Operators will be looking
for fluid leaks as well as potential leaks and will not use equipment if any problems are
found. All equipment with any type of leak will be removed from mine immediately and
repaired. Equipment will be removed from mine and washed periodically to prevent
rainwater from washing contaminants from machine onto ground. NO equipment will be
parked or left overnight in the mine area. All equipment will be checked by mine operator
or qualified mechanic weekly.

6. EMPLOYEE TRAINING
Training for all involved in mine operation will be required semi-annually. This
training will include safety, things to look for that could possibly contaminate water,
equipment inspections, and instructions on what to do if a spill occurs. All new
employees and anyone working in mine area will be required to receive training before
entering mine. Training will be provided by mine operator. Mine operator will stay up to
date on new references and resources pertaining to stormwater management.
7. RESPONSIBLE PARTY
The mine operator will be responsible for all mine and stormwater management
practices. He will ensure that all requirements are met and all records are up to date. The
operator is also responsible for training of employees and personnel.
8. PLAN AMENDMENT
The SPPP Plan will be reviewed annually and amended as needed and all changes
incorporated into training and Best Management Practices.
9. PLAN IMPLEMENTATION
The SPPP Plan will be implemented immediately upon approval and a copy
maintained on site. Additional copies of the plan and recorded data can be provided upon
request. Information will be kept on site for a minimum period of five years.

The delineation was done by our wetlands consultant, Pittman Soils Consulting; and we are
surveying it as we email. In addition, we are getting elevation shots on the wetlands and on the
mine and Maywood Pittman is going to do some calculations to we if the dewatering is affecting
the wetlands: It doesn't appear to be since the wetlands, on the other side of the mine beim,
typically stars wet.
You sent us a copy of the permit just before Christmas. Is it the same or has it changed? If it
has changed please send us a copy and I will forward to Willis. Jeff Brown has sampled and
says he sent the results to you. Let me know if you haven't received them.
We should have the wetlands surveyed and a map done within the next couple of weeks and
Pittman will then follow up with his calculations and results.

Has the delineation been done? Let me know who you all talked to at the corps to request the
delineation, it shouldn't be taking them this long to get to it. Please have 4t' quarter quantitative
results for 2009 sent to me. Our fax number is 910-350-2004. 1 would recommend getting
started on the stormwater pollution prevention plan for this mine (new requirement in the
renewed permit Jan 1, 2010). If you don't have a copy of the new permit, let me know, I'll send
you one. Also, I don't have a good working number for Mr. Willis. Would like that for our

On August 19, 2009, Division of Water Quality Representative Linda Willis conducted a
site inspection for your mine site located off Halltown Road in Onslow County. The site
visit was to determine whether an operation and monitoring plan would be required due
to dewatering activities from the pit. While at the site, Ms. Willis learned that no
monitoring has been conducted in accordance with the General NPDES Permit
NCG020186 requirements. It was determined that active dewatering occurs from the pit
to Northeast Creek classified as C-NSW waters of the State. As a result of the site
inspection and a file review, the following violation is noted:
Item I. Failure to Monitor:
Section III Part A., B. and C. of your General Permit requires quarterly analytical
monitoring of wastewater discharges (mine dewatering wastewater) and semi annual
qualitative monitoring. Neither has been conducted to date. A previous inspection
conducted in June of 2005 by Division Representative, .Pat Durrett, was documented and
indicates you were notified of these requirements.

This Office requests that you respond to this letter in writing within 20 days of receipt of
this Notice. Your response should be sent to both this office at the letterhead address and

your NPDES General Permit NCG020186.
The dewatering activities will require you to provide an operation and monitoring (O&M)
plan to demonstrate the wetlands adjacent to your mine pit have not been impacted. You
should indicate in writing when the O & M plan will be submitted to the Wilmington
Regional Office for review and approval. No further dewatering can occur from the pit
until you receive notification that the O & M plan has been reviewed and approved by
DWQ in the Wilmington Regional Office.
Thank you for your attention to this matter. This Office is considering sending a
recommendation for enforcement to the Director of the Division of Water Quality
regarding these issues and any future/continued violations that may be encountered.
Your above -mentioned response to this correspondence «rill be considered in this
process. This office requires that the violations, as detailed above, be abated
immediately. These violations and any future violations are subject to a civil
penalty assessment of up to $25,000.00 per day for each violation. Should you have

Inspection Summary:
This facility had been inspected by Pat Durrett in June of 2005. She advised the permitlee via the inspection report that
both qualitative and quantitative monitoring was required for any stormwater and wastewater (mine dewatering)
discharges. She indicated at the time of her inspection, no dewatering was occuring, but when it resumed, the permittee
should contact the Regional Office for a follow up inspection. The pit has been dewatered from time to time as needed
based on input from heavy rain events and some groundwater infiltration.

Comment: The outfall from the mine pit discharges into the little northeast creek trib to
New River. The discharge was hazy, but clear enough that the turbidity did not appear
to be impacting the quality of little NE creek. There should be no discharge from this
mine pit until an O & M plan was developed. NOV-2009-PC-0765 permitted no further
discharge until an O & M was approved by this office.

Dear Permittee:
In response to your renewal application for continued coverage under general permit NCG020000, the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
* A copy of general stormwater permit NCG020000
* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin on this permit which outlines permit components and
addresses frequently asked questions
* A Certificate of Coverage for your facility
* DWQ fee schedule
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.
Please note that in 1998 Senate Bill 1366 established changes to the permit fee structure for DWQ permits effective
January 1, 1999. This change requires that you pay an annual fee to assure continued coverage under this permit.
You will be invoiced for this fee beginning next year. A copy of the current fee schedule is included with this letter.
