This memorandum confirms that effective immediately, you have been granted
authority to sign and submit regulatory submittals to local, state and federal agencies
concerning environmental and other matters that fall within the responsibility of the
Safety & Environmental Department's Environmental Engineering, Remediation &
Compliance Group, except as otherwise provided herein. This signature authority
extends to all Norfolk Southern Corporation subsidiaries, including but not limited to
Norfolk Southern Railway Company.
In particular, this authority covers regulatory reports prepared by the Remedial
Group (i.e., remedial investigation reports, feasibility studies, risk assessments, progress
reports), inspection forms (i.e., SPCC and SWPPP inspections), annual emissions
inventory reports, discharge monitoring reports, and other regulatory submittals that are
required by permit or applicable regulations and are part of the Environmental
Engineering, Remediation & Compliance Group's responsibilities. This authority
extends to environmental regulatory submittals that require senior corporate officer
signatures provided the applicable regulations allow delegation of that authority. This
authority does not extend to management certifications of corporate plans, new permit
applications or regulatory submittals that require Vice President or executive officer level
signatures that do not allow delegation to an authorized agent (including without
limitation consent agreements with regulatory agencies).
