During the inspection, the following items were noted: 1) Monitoring can be suspended concerning the two monitoring points on the opposite side of the train tracks. Until the tracks and loading area are used again, that area is not part of the industrial process. 2) Foam and bubbles were observed in the outfalls leading to the stormwater basin. The permittee is directed to evaluate the cause of that foam and address it. 3) Some of the drains on site were observed to be potentially clogged, causing a backup of water and an increased risk of elevated COD. He indicated that they identified some items that they have addressed and that the COD/TSS are now below the benchmarks, but that they are continuing to do monthly sampling (and will be required to do this for the duration of the permit). I told him to send us the results of the sampling and an explanation of what they have done at the site to address these issues. I told him that he could (after he has demonstrated with enough sampling that they have indeed address the sources of COD/TSS) request relief from Tier III sampling. I told him that as part of this review we would schedule an inspection to review the sampling results and the facility to determine if the issues have been permanently addressed. From: Herbert, Laura C Sent: Wednesday, January 29, 2014 5:48 PM To: Kucken, Darlene Subject: Domtar NCG210411 Rutherford County (Timber and Related) Darlene, Mr. Anthony Robinson of Domtar called and wanted to know if for Tier 11 sampling, all parameters had to be sampled (for this case COD and TSS). The permit indicates for the outfall that has exceeded benchmarks for two periods, yes all parameters must be sampled. I told Mr. Robinson this, and directed him to the details of his permit (Timber and Related Industry — NCG 2100411). He indicated that they had had one exceedance of TSS, but through the Tier I response they think that they had addressed the problems. However, they have had two exceedances of COD (in the same outfall). I told him that they would need to initiate Tier 11 response for this outfall and would need to sample for all parameters (including TSS). We can put these on our inspection list. Stormwater discharges from Wood Chip Mills are now eligible for coverage under General Permit NCG210000. The modified general permit was reissued on March 25, 2011 (effective April 1, 2011). Rather than renew your coverage under General Permit NCG220000, which expired in 2008, the Division has transitioned your facility under General Permit NCG210000 and issued you a new permit (with a different COC number). The Division does not intend to renew General Permit NCG220000. This action was noticed publicaliy from February 15 through March 18, 2011; the proposed modification to general permit NCG210000 was available on our website on February 8, 2011. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.) Benchmarks are not limits. • Monitoring results must be reported to DWQ within 30 days of lab report receipt (instead of annually). • Qualitative Monitoring must be performed twice a year (instead of monthly). You have entered this permit in "Year 3 — Period 2" of the sampling schedule, which ends June 30ih. However, because of the delayed mail -out of permit packages, your facility is expected to comply with sampling requirements beginning no later than "Year 4 — Period V' That means your facility must sample a representative storm event between July 1 and December 31, 2011 (or, if applicable, reporting "No Flow" from a representative storm event on the SDMR Form within 30 days of that deadline, as outlined in Part III, Section E.) Stormwater Pollution Prevention Plan (SPPP): • SPPP requirements reflect the current standard for most Stormwater general permits and are more detailed than the NCG220000 permit. Please review all the items thoroughly to update your current SPPP to be compliant with this permit. For example, the site location map must identify any receiving waters that are impaired, and training records must include signatures of employees trained annually. • if a facility opts out of monitoring on the basis of removing accumulated material in a week or less, a log of when material is generated and removed, as well as other details about removal, must be kept with the SPPP. • Because of the transition to a new permit, the compliance schedule in Part III, Section A does not address your facility's situation. However, many items in the SPPP are similar to those under the old NCG220000. Therefore, the Division expects your operation to have its SPPP revised and implemented to comply with this permit within six months of receipt of this permit package. Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree. You have our approval, in accordance with the attached conditions, to excavate and fill in 150 linear feet of wetlands or waters for the purpose of constructing a rail and road crossing at Union Mills, N.C., as you described in your application dated 27 June 1997 and your letter dated 19 June 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3127 and 3108. This Certification allows you to use Nationwide Permit Numbers 3 and 26 when they are issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. We expect that: 1) Willamette shall remove all of the riprap by hand to an elevation of 24 inches above the two year storm high water elevation as described in your 27 June 1997 letter. 2) After removing the riprap, Willamette shall revegetate the same locations with the species listed on the 27 June 1997 correspondence with the exception of Sweetgum. Unlike the other species listed, Sweetgum will easily colonize the site without assistance. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter.
