Sawdust is the only significant potential pollutant at the site. All production is done under roof. The majority of stormwater drains to the sediment pond at the rear of the site before leaving via the outfall. The facility has one diesel tank and one waste oil tank. Both have secondary containment and are under roof The facility does have a metal boneyard. This appears to be a housekeeping issue that really needs to be cleaned up. Please clean up this area, and eliminate or keep under roof, materials that will not be used in production or equipment repairs. Effluent Receiving Waters: Stormwater from this facility drains to a permanent sediment pond located at the rear of the property and discharges to Little Polecat Creek (WS-III) waters of the Cape Fear River Basin. Self -Monitoring Program: Qualitative monitoring has been performed twice annually. Analytical monitoring is not required under current permit requirements. The facility does not store sawdust or wood chips on site, except in covered. trailers, for more than seven (7) days. No raw timber is onsite. The diesel tank and waste oil tank both have secondary cover and are under roof. Continue qualitative monitoring twice annually. Keep all records in the SPPP. Box 206 Climax, North Carolina 27233 Natural Resources Dee Freeman Secretary Subject: NOTICE OF VIOLATION General Stormwater Permit Inspection — NPDES Permit No. NCG210153 Industrial Wood Products — Guilford County Dear Ms. Bell: On September 22, 2009, Jenny Graznak of this office performed a Stormwater Permit Inspection at the Industrial Wood Products located at 9205 NC Highway 22 North in Climax, North Carolina. This facility holds General Stormwater Permit No. NCG210153 under the National Pollutant Discharge Elimination System (NPDES) to discharge stormwater associated with Timber Products. You were present for the inspection. This type of inspection consists of two basic parts: a review of facility files and self -monitoring data and an inspection of the facility's storage areas and discharge points. This particular inspection evaluated five (5) areas, and observations from each area are addressed below: 1. Permit The permit became effective August 1, 2008 and expires July 31, 2013. A copy of the permit was available during the inspection. 2. Records/Reports As required by the Permit, the facility has a Stormwater Pollution Prevention Plan (SPPP) that was available for review during the inspection. The SPPP was created in 2001 by Alpha Envionrmental and has been updated several times since then as changes were made to the site. Although Employee Training did occur at the site when the SPPP was first implemented, no Training has taken place since then. Please note that Employee Training is required on an annual basis. The SPPP was also lacking a Site Map. Please refer to permit text Part 11 Section A for a list of the requirements of the SPPP. 3. Facility Site Review Industrial Woods Products cuts untreated lumber into smaller sizes for resell. Therefore, sawdust is the most significant potential pollutant at the site. Sawing takes place under large sheds. There is a sediment pond in a far corner of the property, which is designed to collect most of the storm water from the site. However, the pond is so far away that it is unclear how much sediment it actually collects from the site. The facility is equipped with a 350-gallon waste oil tank, which is routinely picked up by Noble Oil. There is also a large diesel tank on site, which is protected with secondary containment. Effluent/Receiving Waters The site has one outfall that discharges to the sediment pond. Stormwater from the property discharges to Little Polecat Creek (WS-III) in the Cape Fear River Basin. 5. Self -Monitoring Program Qualitative monitoring requirements of the General Permit were performed on January 28, 2009 and June 16, 2009. It was determined during the inspection that you have not been performing the analytical requirements of the General Permit since 2004. The stormwater permit requires semi-annual qualitative and quantitative monitoring of stormwater discharge outfalls and effluent. The last analytical monitoring event took place on September 29, 2004. Analytical samples were analyzed by Pace Analytical and all results were within permit limits. You mentioned that R & A Laboratories in Kernersville analyzes your on -site drinking water, so you could consider adding these semi-annual sampling events to this contract. On -site vehicle maintenance monitoring requirements at the site are waived regardless, since these activities do not use more than 55 gallons of new motor oil per month. The failure to comply with the above requirements is a violation of the General Permit. Therefore, this inspection report is being sent as a Notice of Violation. According to permit text Part III Section A, "the permittee must comply with all conditions of this permit. Any permit noncompliance constitutes a violation of the Clean Water Act and is grounds for enforcement action; for permit termination, revocation and reissuance, or modification; or denial of a permit upon renewal application." Under state law, a daily civil penalty of not more than twenty-five thousand dollars ($25,000) per violation may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of a permit. [Ref: NC General Statutes 143-215.6A] Please respond in writing to this office within 15 days of receipt of this letter, advising us of the actions taken to abate the violations. Please include in your response a detailed description of why these violations occurred and how -they will_be prevented in the future. Sawing takes place under large sheds. There is a sediment pond in a far corner of the property, which is designed to collect most of the storm water from the site. However, the pond is so far away that it is unclear how much sediment it actually collects from the site. The facility is equipped with a 350-g0on waste oil tank, which is routinely picked up by Noble Oil. There is also a large diesel tank on site, which is protected with secondary containment. 4. Effluent/Receiving Waters The site has one outfall that discharges to the sediment pond. Stormwater from the property discharges to Little Polecat Creek (WS-III) in the Cape Fear River Basin. 5, Self -Monitoring Program Qualitative monitoring requirements of the General Permit were performed on January 28, 2009 and June 16, 2009. On -site vehicle maintenance monitoring requirements at the site are waived regardless, since these activ;ties do not use more than 55 gallons of new motor oil per month. This permit has been reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007- The following information is included with your permit package: • A new Certificate of Coverage • A copy of stormwater General Stormwater Permit NCG210000 • A copy of the Technical Bulletin for the General Permit • Five copies of the Discharge Monitoring Report (DMR) Form • Five copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. The more significant changes to the General Permit include the following: • Permit cover page, second paragraph — The General Permit now may cover activities that DWO determines to be similar in either the process, or in the exposed materials, to the Timber Products Industry. • Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL, may not be eligible for continued coverage at the next renewal of the General Permit. • Part I Section B second paragraph — A new clarification that the permit does not authorize discharges that DWQ determines are wastewaters. • Part II Section A — The required contents of the Stormwater Pollution Prevention Plan have been expanded and clarified. • Part II Section B Table 1 — A new requirement to sample stormwater discharges twice per year for those facilities with exposed piles of certain materials remaining on site longer than seven days. • Part II Section B Tables 2 and 3 and following — For permittees with exposed piles, there are new provisions requiring the permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until Three consecutive monitoring events show no benchmark exceedences. • Part II Section B — For permittees with exposed piles, a new provision that four exceedences of any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control measures_ • Part tl Section C — Clarification that under the qualitative monitoring provisions of the permit, the permittee is obligated to respond to repeated observations of stormwater pollution.
