COC Number NCG21002E McDowell County Dear Permittee: In response to your renewal application for continued coverage under stormwater General Permit NCG210000 the Division of Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit has been reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007. The following information is included with your permit package: • A new Certificate of Coverage • A copy of stormwater General Stormwater Permit NCG210000 • A copy of the Technical Bulletin for the General Permit • Five copies of the Discharge Monitoring Report (DMR) Form • Five copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. The more significant changes to the General Permit include the following: + Permit cover page, second paragraph — The General Permit now may cover activities that DWQ determines to be similar in either the process, or in the exposed materials, to the Timber Products Industry. • Part I Section A — A new provision that facilities draining to 303(d) listed.waters, or in watersheds with an approved TMDL, may not be eligible for continued coverage at the next renewal of the General Permit. • Part I Section B second paragraph — A new clarification that the permit does not authorize discharges that DWQ determines are wastewaters. • Part 11 Section A — The required contents of the Stormwater Pollution Prevention Plan have been expanded and clarified. • Part II Section B Table 1 —A new requirement to sample stormwater discharges twice per year for those facilities with exposed piles of certain materials remaining on site longer than seven days. • Part 11 Section B Tables 2 and 3 and following -- For permittees with exposed piles, there are new provisions requiring the permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences. • Part I I Section B — For permittees with exposed piles, a new provision that four exceedences of any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control measures. • Part I I Section C — Clarification that under the qualitative monitoring provisions of the permit, the permittee is obligated to respond to repeated observations of stormwater pollution. DWQ may impose additional stormwater management requirements if the permittee is non -responsive, or if the responses are ineffective. Your coverage under the General Permit is transferable only through the specific action of DWQ. Director Division of Water Quality BioPower in Marion You asked two questions about these facilities in early 2006 - are they in the right general permit, and if their leachate is covered by the general permit NCG21. 1. No, they are not in the right general permit. SIC4961 does accurately describe their activities (steam production), but that SIC is not covered by NCG21. SIC49 is not one of the categorically covered industrial activities in the NPDES stormwater program delineated in 40CFR122.26(b)(14). a. Laurie reports that Wanda Frazier visited one of these sites, and that the permittee is happy to have permit NCG21, and is proud of their operation, and want to keep their permit. (I'm not surprised that they want to keep a stormwater permit, now that we're beginning to learn more about the potential pollutants from leachate from sawdust piles.) b. They don't make the sawdust, they just get it and burn it. c. ARO has not so far identified these sites as problems.: But, I'm not sure they ever considered the character of the leachate, if there is in fact any leachate discharge. 2. Based on our current understanding of the drainage from a sawdust pile, the leachate from these piles would not be an authorized discharge under NCG21. a. It's not covered on two counts. First, the whole operation is not an NPDES stormwater industrial activity, so it's not reasonable to have a "permitted discharge" under our program at this site. Second, our understanding of the leachate in similar situations is that it is a wastewater. Consequently, a stormwater permit is not appropriate for this wastewater discharge. b. NCG21 expires 4/30/08. My inclination is to leave these sites alone for now, and then to decline to renew their NCG21 when it comes in for renewal. Perhaps by that time our brothers and sisters in other units will have developed an approach to address these discharges, if there are any discharges at these sites. 3. In summary, I think we should do nothing now. Wait for some clarification over the next year wrt the wastewater programs and these types of discharges. I think it is even premature to alert our permittees, because we don't know what totell them, yet. Review prompt added in RIMS (Comments section) for each permit. 4. 1 realize we may be just postponing the pain of uncertainty. But, my hope is that DWQ will have more clarity when these permits come up for renewal, and that we will have clearer direction to provide the permittee. Trigen-BioPower, Inc. North Cove Steam Generation Plant Ash Distribution Program Distribution of Residual Solids (503 Exempt) McDowell County_i Dear Mr. Leopard: In accordance with your permit renewal and modification application package received on March 26, 2004 as well as the additional information subsequently received, we are forwarding herewith a renewed and modified Permit No. WQ0010689, dated December 30, 2005, to Trigen-BioPower, Inc. for the subject ash distribution program. This permit shall be effective from the date of issuance until November 30, 2010; shall void Permit No. WQ0010689, issued on July 7, 2000; and shall be subject to the conditions and limitations as . specified therein. Make note of this permit's expiration date and the fact that a permit renewal application is due to the Division of Water Quality (Division) no later than six months prior to that date (i.e., see Condition VI. 7.), as the Division does not send reminders to apply for permit renewal. This permit has been issued to approve the operation of an ash distribution program out of Trigcn-BioPower, Inc.'s North Cove Steam Generation Plant in Marion, North Carolina for another five- year cycle. This permit has also been 'modified to allow up to 3,200 dry tons per year of ash (i.e., increased from 2,500 dry tons per year of ash) to be distributed through the program. As always, remember to take the time to review this permit thoroughly, as some of the conditions contained therein have been added, changed, or deleted since the last issuance. Pay particular attention to the monitoring requirements in this permit. Please be aware that failure to establish an adequate system for collecting, maintaining, and submitting the required operational information will result in future compliance problems. Of particular interest to you are the following (i.e., not an.inclusive list): ♦ Condition I. 2.: This condition requires that the Permittee conduct an assessment/feasibility study of alternatives to the on -site ash storage/stockpile site within 90 calendar days of permit issuance. Following the assessment/study, the Permittee must provide written notification to the Division that details which of three stipulated options is selected for implementation. Each option has additional compliance schedule requirements. You may want to i discuss the compliance status of the ash storage/stockpile site with the Division's Stormwater Permitting Unit. e Condition 11. 3.: This condition specifies the maximum volume of ash that may be distributed, the types of ash that may be distributed, as well as the uses for which the ash may be distributed. It is clarified here that ash that does not fall under the "wastewater residuals" definition such that is administered under the purview of the Division is approved to be distributed under the conditions of this permit. The Division has verified this approach as being acceptable with the Composting and Land Application Branch of the Division of Waste Management. ♦ Condition 111. 2.: This condition requires that information about how the various ash products (i.e., bottom ash, fly ash, scrubber ash, or mixture thereof) is distributed throughout a calendar year be provided with the annual report. A justification for how the ash sampling program was conducted is required as well. ♦ Condition III. 3.: The permit has been modified to require hazardous waste characterization testing (i.e., corrosivity, ignitability, reactivity, and toxicity characteristics leaching procedure) on specific schedules. Past analytical results have indicated that the ash can, on occasion, fail corrosivity (i.e., demonstrate a pH greater than 12.5). The Permittee should contact the Hazardous Waste Section of the Division of Waste Management for guidance as to what action should be taken in the event that a failed corrosivity test occurs again. Note that it may not be appropriate to distribute the ash under the conditions of this permit in such situations. ♦ Condition Ill. 4.: The permit has been modified to require metal, nutrient, and micronutrient testing of the ash on a frequency that is dependent on the volume of ash distributed. Note that, as requested in the cover letter of the permit renewal/modification application package, the analytical requirement is for the total concentrations of the parameters and not of those detected in a leachate. ♦ Condition III. 5.: This condition requires that all analytical work be completed on the ash as it is to be distributed, which means that the Permittee will have to take special care to sample appropriately and representative depending on how the various ash products generated by the steam generation plant are mixed and distributed. This condition also requires that all laboratory analyses be performed by a laboratory that is Division -certified for the parameter being analyzed. Past annual reports have indicated that the Permittee has utilized the NC Department of Agriculture and Consumer Services laboratory to analyze the ash for specific parameters. The Permittee should contact the Laboratory Certification Unit of the Division's Laboratory Section for verification that this laboratory is appropriately certified. ♦ Condition III. 6.: This condition spells out the information that must be included in the annual report that describes the activities undertaken under the conditions of this permit during each calendar year. During the last permit cycle, the Permittee has submitted the annual report such that it is received -a couple of days past the March IS` deadline. The Permittee should make a special effort to prepare and submit the annual report in a timely fashion in order to avoid potential compliance problems. Also, the Permittee should check the Division's web site prior to preparing the annual report in order to download the most - recent version of the reporting forms to use. in Mr. Tony Leopard December 30, 2005 Page 3 If any parts, requirements, and/or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within 30 calendar days following receipt of this permit. This request shall be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings at 6714 Mail Service Center, Raleigh, North Carolina 27699-6714.
