On February 03, 2016 Glen White and Sue White of the North Carolina Department of
Environmental Quality — Minerals & Land Resources met with you at the subject facility located
at 647 Hargrave Road, I exington, NC at the recommendation of NCDLQ staff in the Raleigh
Central Office following an internal audit conducted by JELD-WEN in December of 2015 The
internal audit found potential violations pertaining to both the air quality and industrial
stormwater environmental permits
The facility had recently been inspected by Glen White in November of 2015 1 he facility was
found to be compliant at that time and made only minor recommendations Fhe internal audit
found annual data monitoring reports missing for 2013 and 2014 1 he records were completed
on June 1, 2015 and were available for review at the November inspection a5 well as the visit
conducted on February 3, 2016
the internal audit found Annual Training records to be incomplete 1 his was found to be the
case at inspection Records were found to be complete for apart of the facility but not for all
Mr Brite said that they were in the process of completing training NCDEQ request that sign off
by each employee be made on one sign off sheet with hand written signatures of each employee
This needs to be accomplished annually I he prior computerized sign off record can easily be
falsified and is not a venfable record

Inspection Summary
On Febuary 3 2016 Glen White and Sue White with the NCDEQ Dept of Land Resources conducted a site visit by
recommendation of NCDEQ following an internal Jeld-Wen audit that identified potential violations of their air and stormwater
permits
This inspection was to review for compliance with stormwater permit issues only Glen White of NCDEQ had conducted a
compliance inspection with Aaron Brite in November of 2015 and found the facility to be compliance with minor
recommendations
Internal Audit found Annual Data Monitoring Reports missing for 2013 and 2014 The records were completed June 1 2015
prior to the November inspection and were available for review at the Feb 3 2016 visit
Internal Audit found Annual Training records to be incomplete This was found to be the case at inspection Records were
complete for a portion of the facility but not for all Mr Bnte said that they were In the process of completing training
NCDEQ request that sign of by each employee be made on one sign off sheet with hand written signatures and date This
needs to be provided annually The prior computerized sign of record can easily be falsified and is not a verifiable record

office as per below although I am unsure of his final wording Hopefully DEMLR and DAQ will get guidance on a
response in the near future

I was copied on correspondence addressed to the Secretary and the DAQ Regional Supervisor in the Winston-Salem
Regional Office (WSRO) from JELD-WEN, Inc received on January 20, 2016 1 he correspondence noted potential
violations of general statues as well as the air quality and industrial stormwater permits for their Lexington facility
identified through a self -audit of their environmental compliance program I have shared the correspondence with
our Cnvironmental Assistance Coordinator for WSRO, Ms Marcia Allocco
Fhe correspondence from JELD-WEN, Inc does not specifically ask for audit privilege but it would make sense that
it be handled via the framework set out in Session Law 2015-286/FIB 765 dealing with self -disclosure of audit
findings A review of the Session Law relative to JELD-WEN, Inc s correspondence brings to light both policy and
legal decisions required of DEQ
Section 4 1 (b) at the end of the audit privilege section notes that no later than 30 days after the bill becomes law
DEQ was to submit it to EPA to see if they would allow us to implement it We need to determine where we are in
this process In addition, DEQ would need a legal decision whether the correspondence fulfills the requirements of
voluntary self -disclosure
Since the correspondence deals with potential violations of either an issued permit or general statutes that require
permitting, I feel that the applicable regulatory programs should take the lead on any compliance decisions Ms
Allocco has had discussions with program staff for both DEMLR and DAQ relative to the correspondence Since
DAQ was addressed in the correspondence they have reviewed the correspondence and the requirements of the air
permit DEMLR staff was only made aware of the correspondence late last week and plans to review it on
2/3/16 Both programs would like direction on the next steps forward including what return correspondence is
needed
Once DEQ works through this case rt appears that the Department will need to develop a formal policy and
procedure for responding to any future voluntary audit disclosures
I and my staff stand ready to lend assistance but at this point I believe our role in facilitating discussions is
complete

See if your circumstances fit one of these two categories
1) An NCG21 manufacturing facility with an on -site or ad scent warehouse We would expect the permittee to
include the on -site or adjacent warehouse in his SPPP, and we would view any stormwater discharges from the
warehouse as regulated by federal NPDES rules and under the permit issued to the main manufacturing
activity I think this is not the circumstance you described
2) An off -site warehouse for the distribution of one manufacturer's timber/wood product, same company or same
parent company stormwater discharges from this remote operation are not regulated under NPDES 1 think this
is the circumstance you described
o Additional qualification However, if any manufacturing takes place (including parts assembly into whole
products or components), then the "off -site warehouse" would instead be considered a separate manufacturing
activity, and would be required to have separate NPDES permit coverage
o we have not normally considered packaging of lots (combining into bigger units, or splitting into smaller units) as

1 Permit
This facility holds General Storm water Permit No NC210013 to discharge Storm water from activit,es
associated with Lumber and Wood Products Except Furniture under the National Pollutant Discharge
Elimination System (NPDES) The permit became effective August 1, 2013 and expires July 31, 2018 Your
permit renewal package must be received in the Central Office in Raleigh no later than 180 days prior to the
expiration date of the permit
2 Records/Reports
Part II, Section A of the permit requires the development of an SP3 (Stormwater Pollution Prevention Plan)
The plan must indude all nine (9) subsections of Part II, Section A of the permit The SPPP plan must be
updated annually and qualitative monitoring must be conducted and properly documented semi-annually to
retain compliance with the permit This facility maintains its SP3 electronically and it was available for
review at the time of inspection

Submission of this No Exposure Certification constitutes notification that your facility does not require a
permit for stormwater discharges associated with industrial activity in the State of North Carolina because
it qualifies for a no exposure exclusion A condition of no exposure at an industrial facility means all
industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to
prevent exposure to rain, snow, snowmelt, and/or runoff
For permitted facilities in North Carolina, DEMLR must approve your application for No
Exposure Certification before this exclusion is effective Until you are issued a No
Exposure Certification and your NPDES permit is rescinded, your facility must continue
to abide by the terms and conditions of the current permit
Industrial materials or activities include, but are not limited to material handling equipment oractivities,
industrial machinery, raw matenals, intermediate products, by-products, final products, or waste products
Material handling activities include the storage, loading and unloading, transportation, or conveyance of
any raw material, intermediate product, final product or waste product A storm resistant shelter is not
required for the following industrial materials and activities drums, barrels, tanks, and similar containers
that are tightly sealed, provided those containers are not deteriorated and do not leak "Sealed" means
banded or otherwise secured and with locked or non -operational taps or valves, adequately maintained
vehicles used in material handling, and final products, other than products that would be mobilized in
stormwater discharges (e g , rock salt)
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion In
addition, the exclusion from NPDES permitting is available on a facility -wide basis only —not for individual
outfalls If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not
eligible for the no exposure exclusion By signing and submitting this No Exposure Certification form, you
certify that a condition of no exposure exists at this facility or site and are obligated to comply with the
terms and conditions of 40 CFR 122 26(g)
If approved, your conditional no -exposure exclusion must be self re -certified at least annually

exposure and obtaining an exclusion from NPDES stormwater permitting

or materials from the industrial facility or site identified in this document (except as allowed under 40 CFR 122 26(g)(2))
understand that I am obligated to submit a no exposure certification form once every five (5) years to the North Carolina
Division of Water Quality and if requested to the operator of the local municipal separate storm sewer system (MS4) into
which the facility discharges (where applicable) I understand that I must allow the North Carolina Division of Water
Quality or MS4 operator where the discharge is into the local MS4 to perform inspections to confirm the condition of no
exposure and to make such inspection reports publicly available upon request
In the event that the site no longer qualifies for a No Exposure Exclusion I understand that I must obtain coverage under
an NPDES permit prior to any point source discharge of stormwater from the facility Additionally I certify under penalty of
law that this document and all attachments were prepared under my direction or supervision in accordance with a system

inquiry of the person or persons who manage the system or those persons directly responsible for gathering the

Thank you for taking the time to meet with Jenifer Carter of the Winston-Salem Regional Office
on September 23, 2011 for a Compliance Evaluation Inspection performed at Jeld-Wen Windows &
Doors in Lexington, North Carolina The purpose of the inspections was to review compliance with the
National Pollutant Discharge Elimination System (NPDES) General Stormwater Permit The following
are the findings from the subject inspection
• A Stormwater Pollution Prevention Plan (SPPP) properly implemented and updated annually
• Qualitative monitoring has been conducted as required and recorded in accordance with permit
requirements at several points, including two (2) unique outfalls Be sure to fill out one monitoring
form for each outfall in the future
• Analytical monitoring is not required since no vehicle maintenance is performed on site
• There was some residual polystyrene on the ground, though there was no potential for it to reach
surface waters due to a substantial berm along the lower side of the property
• There was no evidence of use of, or cleaning of industrial machinery or equipment outdoors

Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit This permit has been reissued pursuant to
the requirements of North Carolina General Statute 143-215 1 and the Memorandum of Agreement between the state of North
Carolina and the U S Environmental Protection Agency dated October 15 2007
The following information is included with your permit package
• A new Certificate of Coverage
• A copy of stormwater General Stormwater Permit NCG210000
• A copy of the Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only and it specifies your obligations with respect to stormwater
discharge controls management monitoring and record keeping Please review the new permit to familiarize yourself with all
the changes in the reissued permit
The more significant changes to the General Permit include the following
• Permit cover page second paragraph -- The General Permit now may cover activities that DWQ determines to be similar in
either the process or in the exposed materials to the Timber Products Industry
• Part I Section A — A new provision that facilities draining to 303(d) listed waters or in watersheds with an approved TMDL
may not be eligible for continued coverage at the next renewal of the General Permit
• Part I Section B second paragraph — A new clarification that the permit does not authorize discharges that DWQ determines
are wastewaters
• Part Il Section A -- The required contents of the Stormwater Pollution Prevention Plan have been expanded and clarified
• Part it Section B Table 1 — A new requirement to sample stormwater discharges twice per year for those facilities with
exposed piles of certain materials remaining on site longer than seven days
• Part II Section B Tables 2 and 3 and following — For permittees with exposed piles there are new provisions requiring the
permittee to execute Tier One and Tier Two response actions based on the first benchmark exceedence (Tier One) and the
second consecutive benchmark exceedence (Tier Two) Tier Two requires that the permittee institute monthly monitoring
instead of twice -per -year monitoring until three consecutive monitoring events show no benchmark exceedences
• Part 11 Section B — For permittees with exposed piles a new provision that four exceedences of any particular benchmark
will trigger increased DWQ involvement in the permittee s stormwater management and control actions DWQ may direct
the permittee to apply for an individual permit or may direct the implementation or installation of specific stormwater control
measures
• Part II Section C -- Clarification that under the qualitative monitoring provisions of the permit the permittee is obligated to
respond to repeated observations of stormwater pollution DWQ may impose additional stormwater management
requirements if the permittee is non -responsive or if the responses are ineffective

General Statute 143-215 1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection agency dated December 6, 1983
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the nght to request an individual permit by submitting an individual
permit application Unless such demand is made, this certificate of coverage shall be final and
binding
Please take nonce that this certificate of coverage is not transferable except after notice to the
Division of Environmental Management The Division of Environmental Management may
require modification or revocation and retssuance of the certificate of coverage
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Environmental Management or permits required by the Division of
Land Resources, Coastal Area Management Act or any other Federal or Local governmental
permit that may be required
