As Mike Mickey of this office explained during a site visit on March 21, 2013, stormwater discharges from scrap metal operations fall under the Phase I permitting requirements established in 1990. Specifically, coverage under General Stormwater Permit NCG200000 is applicable to all owners having stormwater discharges associated with establishments primarily engaged in assembling, breaking up, sorting, and wholesale trade of scrap metal covered under Standard Industrial Classification (SIC) 5093. To comply with the above requirement, Salvage America, Inc. needs to apply for a stormwater permit. The application is attached and is also available under the General Permits tab at the following link: http://portal.ncdenr.o[g/web/wq/ws/su/npdessw. Please send the completed application and supporting documentation, along with the $100 application fee, to the Raleigh address listed on page 7 of the application on or before April 26, 2013. A Technical Bulletin that provides an overview of the stormwater permit is also included. Please be aware that discharging stormwater into a tributary to Muddy Creek (Class "WS-V; NSW" waters) without a valid stormwater permit is a violation of North Carolina General Statute 143-215.1.
