On March 8, 2019, Brian Lambe from the Wilmington Regional Office of the Division of Energy, Mineral,
and Land Resources (DEMLR), conducted a compliance evaluation inspection for AIC Recycling located in
Blackwell Road, Brunswick County, North Carolina.
The following observations were noted during the DEMLR inspection (please see the attached
addendum for additional information about your permit):
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has not been developed, recorded, and properly
implemented.

Other Observations:
Evaluate the discharge from the site and ensure that the only discharge is from the pond. There was no
flow recorded for 2018, the wettest year on record.
Re-establish use of the SPPP by documenting stormwater related actions, implementing BMPs, and
providing sampling results. The SPPP should be used as a guide to compliance with permit
requirements.

Inspection Summary:
Met with Matt Abernathy, Mike Simmons on vacation.
A greater emphasis needs to be placed on implementing, maintaining, and documenting the stormwater pollution prevention
Plan Please read the manual and complete the required elements.
Sampling is documented as no flow. 2018 was the wettest on record. There should have been a sampling event Please
evaluate why the pond is not discharging. The infiltration rates may account for the lack of discharge, but i do not think that
is the case. More likely is that stormwater is bypassing the pond through the ditches_ In this case, you wilt need to install
conveyances to the pond, or sample in the road side swales
Mr. Abernathy said there was a spill with cleanup documentation, including sampling of the pond in the Fall of 2018. He said
the pond was documented to be clean.

Dear Permittee:
For coverage under Stormwater General Permit NCG200000, the Division of Energy, Mineral and Land
Resources (DEMLR) is forwarding herewith the reissued Certificate of Coverage and Stonnwater General
Permit. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1
and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental
Protection Agency, dated October 15, 2007 (or as subsequently amended.) The following information is
included with your permit package:
• New Certificate of Coverage
• Stormwater General Permit
• Technical Bulletin for the General Permit
• Discharge Monitoring Report (DMR) Forms
• Annual Discharge Monitoring Report Forms
• Qualitative Monitoring Report Forms
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with
respect to stormwater discharge controls, management, monitoring and record keeping. Please review the
new permit to familiarize yourself with all changes in the reissued permit. Significant changes to the
General Permit are outlined in the Technical Bulletin.
Your coverage under the General Permit is transferable only through the specific action of DEMLR, This
permit does not affect the legal requirements to obtain other permits which may be required by the N.C.
Department of Environmental Quality, nor does it relieve the permittee from responsibility for
compliance with any other applicable federal, state; or local law, rule, standard, ordinance, order,
judgment or decree.

ECS has been retained by Mr. Greg Weismann of AIC Recycling to assist with the monitoring,
sampling and reporting requirements as per the conditions set forth by the Stormwater General
Permit NCG2000000.
Project Background
The facility is currently operating under North Carolina General Permit No. NCG200000,
Discharge of Stormwater under the National Pollutant Discharge Elimination system (NPDES)
and Certificate of Coverage No. NCG200472. The project site is approxiamtely 6 acres and is
located east and adjacent to the intersection of Blackwell Road and Chappell Loop Road. The
site is identified by the Brunswick County Tax Office as Parcel No. 03800017. In order to
comply with the permit, the facility must perform semi-annual analytical and qualitative
stormwater monitoring at a single point stormwater discharge outfall during representative storm
events.
Site Description
The site is currently occupied by AIC Recycling, a metal recycling facility. There is a primary
and secondary stormwater pond located on the southern portion of the site. A drainage swale is
located in the central portion of the site, and drains to the primary stormwater pond. There is a
spillway connecting the primary stormwater pond to the secondary stormwater pond. A weir box
and spillway is located on the eastern portion of the secondary stormwater pond. The spillway
leads to a culvert which drains east to a ditch. The ditch ultimately flows south, towards an
unnamed tributary to Jackey's Creek,
Field Activities
On April 30, 2014, ECS performed a site visit during a rain event. Downpour conditions were
noted during the site visit. ECS did not observe stormwater discharge from the outfall pipe. At
the time of the site visit, the water level in secondary stormwater pond was approximately 2 to 3
inches below the bottom of the spillway pipe.

According to climate data recorded at Station NC-BR-2 in Leland, North Carolina, it rained trace
amounts on 0.46 inches on April 30, 2014, which was preceded by three days of no
precipitation.
A rain gauge has been installed at the site, however, the rain accumulation sensor is faulty and
data has not been recorded during the past several months. ECS has ordered a new rain
gauge for the site.
No stormwater discharge was observed, therefore, ECS did not collect a stormwater discharge
sample. ECS did not observe an oil sheen, floating solids, foam, or an unusual odor within the
secondary stormwater pond. Wetland vegetation was observed around the perimeter of the
pond.
Conclusion
The stormwater system has been designed with a spillway and discharge pipe. ECS personnel
have conducted site visits during qualifying a storm event. At the time of the site visits, ECS did
not observe discharge from the stormwater pipe. This is a report of "No Flow", therefore, no
sampling was conducted.
ECS will continue to conduct site visits on a semi-annual basis. If you have any questions or

Thank you for the update and information regarding the monitoring results. Please find the attached NPDfS Permit Compliance Inspection
Report for AFC. Now that you are on track with your r sampling requirements, please pay close attention to the monitoring schedule specified
in Table 2.
Please address the areas of non-compliance in noted in the Inspection Summary to bring the site into compliance with the NPDES General
Permit.
Due to a recent reorganization of DENR, the follow up inspection will most likely be performed by the Division of Energy, Mineral and Land
Resources (DEMLR) under the direction of Dan Sams, supervisor of DEMLR.

I've included the 2012 documentation showing what we hired ECS environmental to do and the reports for 2012. There was
some confusion between us and ECS s to the extension of their contract resulting in no samples taken Jan. 1, 2012 through June
30, 2012. Your inquiry brought this forward. We have since renewed the contract with ECS for monitoring and reporting
services. In addition, I completed a Qualitative report on Jul 12, 2013 during and event. I did not have any lab work done as I am
not familiar with what has to be tested. As ECS is now contracted to perform the services for 2013, 1 propose that we have them
perform the testing that should have been done earlier this year ASAP and submit the report to you and also have the second
report submitted on time. Is this acceptable?
I coaied_the email from ECS showing the confusion that caused a delay in reporting.

I looked through my emails to determine if we overlooked the signed proposal on our end. From what I could tell, there was some
initial concern over some typos and cost The proposal was revised Slightly and resent on December 4, 2012. 1 do see the signed
proposal in our records_ Sorry for the confusion. Since the original proposal includes reporting for the later half of this year, I did
not revise it The proposal is attached..
Also, I have attached our biannual reports from 2012. Would you like me to forward them to t7WQ? Call me with any questions_

I've included the 2012 documentation showing what we hired ECS environmental to do and the reports for 2012. There was
some confusion between us and ECS s to the extension of their contract resulting in no samples taken Jan. 1, 2012 through June
30, 2012. Your inquiry brought this forward. We have since renewed the contract with ECS for monitoring and reporting
services. In addition, I completed a Qualitative report on Jul 12, 2013 during and event. I did not have any lab work done as I am
not familiar with what has to be tested. As ECS is now contracted to perform the services for 2013, 1 propose that we have them
perform the testing that should have been done earlier this year ASAP and submit the report to you and also have the second
report submitted on time. Is this acceptable?
I copied the email from ECS showine the confusion that caused a delay in reporting.

I looked through my emails to determine if we overlooked the signed proposal on our end. From what I could tell, there was some
initial concern over some typos and cost The proposal was revised slightly and resent on December 4, 2012. 1 do see the signed
proposal in our records. Sorry for the confusion. Since the original proposal includes reporting for the later half of this year, I did
not revise it. The proposal is attached.
Also, I have attached our biannual reports from 2012. Would you like me to forward them to DWQ? Call me with any questions.

Inspection Summary:
The site visit by DWR (formally DWQ) staff, Jean Conway revealed that the site is mostly compliant with the NCG200472
permit conditions_
Analytical monitoring records were not available onsite at time of inspection but were sent to the Regional Office as
requested. Please refer to the monitoring schedule in the permit as a minimum of 60 days must separate each monitoring
event
The newly constructed secondary containment needs to have an impervious bottom and an outlet with a lock installed
Written records of any stormwater discharges need to be kept onsite.
Several permit requirements regarding the SPPP were found to be lacking:.
The SPPP did not include:
- 1(d) a list of significant spills or leaks of pollutants that have occurred at the facility during the three (3) previous years
and any corrective actions taken to mitigate spill impacts.
- 2(b) Secondary Containment Requirements and Records.
- 5 Employee Training. Yearly documentation of annual training by the signature of each employee trained.
- 9 Implementation of the Plan should include documentation of all monitoring, measurements, inspections,
maintenance activities, and training provided to employees, including the log of the sampling data and of actions taken to
implement BMPs associated with the industrial activities, including vehicle maintenance activities.
Stormwater leaving the site at the front of the property should be included as a seperate monitoring outfall or diverted
away from the roadside swale toward the 001 outfall.

The facility is currently operating under North Carolina General Permit No. NCG200000,
Discharge of Stormwater under the National Pollutant Discharge Elimination system (NPDES)
and Certificate of Coverage No. NCG200472. The project site is approxiamtely 6 acres and is
located east and adjacent to the intersection of Blackwell Road and Chappell loop Road. The
site is identified by the Brunswick County Tax Office as Parcel No. 03800017. In order to
comply with the permit, the facility must perform semi-annual analytical and qualitative
stormwater monitoring at a single point stormwater discharge outfall during representative storm
events.
The last discharge monitoring report was submitted to the North Carolina Division of Water
Quality on January 27, 2012,
Site Description
The site is currently occupied by AIC Recycling, a metal recycling facility. There is a primary
and secondary stormwater pond located on the southern portion of the site. A drainage swale is
located in the central portion of the site, and drains to the primary stormwater pond. There is a
spillway connecting the primary stormwater pond to the secondary stormwater pond. A wier box
and spillway is located on the eastern portion of the secondary stormwater pond. The spillway
leads to a culvert which drains east to a ditch. The ditch ultimately flows south, towards an
unnamed tributary to Jackey's Creek.

Field Activities
On July 31, 2012, at 11:45 a.m., ECS performed a site visit during a rain event. ECS did not
observe stormwater discharge from the outfall pipe. At the time of the site visit, the water level
in stormwater pond was approximately 6 inches below the bottom of the spillway pipe.
According to climate data recorded at Station NC-BR-2 in Leland, North Carolina, it rained 0.1
inches on July 31, 2012, which was preceded by two days of precipitation measuring 1.01
inches.
On August 10, 2012, at 10:15 a.m., ECS performed a second site visit during a rain event. ECS
did not observe stormwater discharge from the outfall pipe. At the time of the site visit, the
water level in stormwater pond was approximately 2 to 3 inches below the bottom of the spillway
pipe. According to climate data recorded at Station NC-BR-2 in Leland, North Carolina, it rained
0.02 inches on August 10, 2012 preceded by 2.2 inches of precipitation during the previous
three days.
No stormwater discharge was observed, therefore, ECS did not collect a stormwater discharge
sample. Although a sample was not conducted, a Qualitative Monitoring Report form was
completed, which depicts the water conditions within the secondary stormwater pond. ECS did
not observe an oil sheen, floating solids, foam, or an unusual odor. Tad poles, minnows and
wetland vegetation was observed around the perimeter of the pond.
Conclusion
The stormwater system has been designed with a spillway and discharge pipe. ECS personnel
have conducted site visits during qualifying and non -qualifying storm events. ECS conducted
site visits during non -qualifying storm event in order to determine if excessive precipitation
would cause the stormwater ponds to discharge through the spillway pipe. At the time of the
site visits, ECS did not observe discharge from the stormwater pipe. This is a report of "No
Flow", therefore, no sampling was conducted.

Please find attached the results for the Semi -Annual NPDES Sampling report for the period
between July 1, 2011 and December. 31, 2011. The sampling activity occurred on December
27, 2011. A copy this report should be kept on -site with the permit.
Project Background
The facility is currently operating under North Carolina General Permit No. NCG200000,
Discharge of Stormwater under the National Pollutant Discharge Elimination system (NPDES)
and Certificate of Coverage No. NCG200472. The project site Is approxiamtely 6 acres and. Is
located east and adjacent to the intersection of Blackwell Road and Chappell Loop Road. The
site is identified by the Brunswick County tax office as Parcel No. 03800017. In order to comply
with the permit, the facility must perform semi-annual analytical and qualitative stormwater
monitoring at a single point stormwater discharge outfall during representative storm events.
Site Description
The site is currently occupied by AIC Recycling, a metal recycling facility. There is a primary
and secondary stomtwater pond located on the southern portion of the'site. A drainage swale is
located in the central portion of the site, and drains to the primary stormwater pond: There is a
spillway connecting -the primary stormwater pond to the secondary stormwater pond. A wier box
and spillway is located on the eastern-portion.of the secondary stormwater pond. The spillway
leads to a culvert which drains east to a ditch. The ditch ultimately flows south, towards an
unnamed tributary to Jackey's Creek.
Field Acth ties
On October 10, 2011, at 12:15 pm, ECS performed a site visit during a qualifying rain event.
ECS did not observe stormwater discharge from the outfali pipe. At the time of the site visit, the
water leveVin stormwater pond was approximately-3 to 4 inches below the bottom of the spillway
pipe. According to climate data recorded at Station NC-BR-2,in Leland, North Carolina, it rained
0.27 Inches on October 10, 2011, preceded by three days of no measurable precipitation.
Stormwater samples were not collected during the month of October.

On December 27, 2011, at 8:45 am, ECS performed a second_ site visit during a qualifying rain
event. ECS did,not observe stormwater discharge from the outfall pipe. At the time of the site
visit, the water level in stormwater pond was approximately 1 to 2 inches below the bottom of
the spillway pipe. Photographs of the site visit are included as an at_tachmerit. According to
climate data recorded 2t Station NGBR-2 in Leland, North; Carolina, it rained 0.34 inches on
December 27, 2011, preceded by 0.03 inches of precipitation during the previous three day.

No stormwater discharge was observed,- therefore, ECS collected a representative sample, The
water sample was collected adjacent` to the spillway weir located at the, eastern end of the
secondary stormwater pond. The groundwater sample was collected using a new pair of nitrile
gloves and- laboratory prepared containers. The sample containers were labeled with the project
name,, sample location and the date and time that the samples were"collected,, placed in a cooler
containing ice (4°C), arid delivered to a tate of -North Carolina -certified analytical laboratory,, Pace
Anayyucal" Laboratoires, Inc. (Pace),in Asheville, North. Carolina under standard chain -of -custody
protocol: The groundwater samples were analyzed for chemical oxygen demand,.total suspended
solids, oil'& grease using EPA method 1664A, and metals, (cadmium, iron, lead and zinc) using
EPA method 200.7, A copy of the analytical chain of custody is attached:
The•pH. conductivity and temperature were measured by ECS at the time of sample collection.
ECS' laboratory certification for these field parameters is W7. Findings from the qualitative•
analysis are enclosed.

Based on the analytical results of the recent sampling event AIC Recycling appears to be in
compliance with applicable standards set forth by General Permit No. NCG200000, as it
pertains to stormwater discharge.

Comment: The site has a stormwater pond located at the east end of the facility. This
pond has an overflow structure that discharges to a UT to Jackey's Creek. There is
