The perimeter of the property was inspected to identify all potential stormwater outfalls. Only one outfall was identified. It is located along the east side of the property just north of the office building. The Division of Water Quality, Surface Water Protection Section appreciates the efforts being taken by Southern Metals Recycling, Incorporation. Your employment of an individual to handle the compliance deficiencies at these two sites should ensure progress is timely. I will work with Mr. Robbins if he requires any technical/compliance assistance and ask him to keep us informed of the progress being made towards compliance with the permit requirements. Jeremy Alpers indicated there was a discharge from their site to the bordering site which is owned by Great Neck Holdings. It is another recycle site that is currently trying to get a state stormwater permit and has been issued the NCG200. It has a stormwater pond that appears to provide a lot of storage. The 22" rain did not result in a discharge from that pond. Both facilities (on Wright Street and Hwy 421) has hired Dillon Robbins to provide environmental compliance and oversight. Regional Office (RO) inspector walked the perimeter of the site to help identify where the outfalls are located. One was found on the east side of the facility just north of the office building. This outfall could be maintained such that it is eliminated if the topography in the area allows this site to drain to the north to the stormwater pond. A structural BMP could be added here by putting in a stormdrain and drop inlet that is piped to the stormwater pond at the north end of the facility. At least 213 of the facility appears to be sloped toward the retention pond. Did not appear to be any evidence that the stormwater pond overflows from a discrete point, nor is there an overflow structure that directs stormwater to the outside of the property boundar. Inspector recommended they install a rain guage and begin documenting all rain fall events and subsequent stormwater discharges. A record will help establish the frequency in which discharges might occur. Mr. Robbins was advised to fill out the Daily Monitoring Report after the sampling window has expired and send the DMR into the Central Office. An annual summary will be required by March 1, 2010, to be recorded on an annual DMR and sent to the Regional Office at 127 Cardinal Drive Extension, Wilmington NC 28405, and to the attention of Linda Willis. Director Division of Water Quality Subject: NPDES Stormwater Permit Coverage Renewal Southern Metals Recycling Inc COC Number NCG200361 New Hanover County Dear Permittee: Your facility is currently covered for Stormwater discharge under General Permit NCG200000. This permit expires on October 31, 2005. The Division staff is currently in the process of renewing this permit. When a draft version is available for notice and public comment, it will be posted on our website at http://h2o.enr.state.nc.us/su/. Once the permit is reissued, your facility would be eligible for continued coverage under the reissued permit. In order to assure your continued coverage under the general permit, you must apply to the Division of Water Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, enclosed you will find a Permit Coverage Renewal Application Form. The application must be completed and returned by August 19, 2005 in order to assure continued coverage under the general permit. Letters confirming our receipt of the completed application will not be sent. Failure to request renewal within the time period specified may result in a civil assessment of at least $250.00. Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $10,000 per day. Please note that "no exposure exclusion" is now available to all operators of industrial facilities in any of the categories of "storm water discharges associated with industrial activity," (except construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facility industrial materials and operations are not exposed to Stormwater, you can apply for the no exposure exclusion.
