As explained to Mr. Boone, most of these items will be addressed when the stormwater pollution prevention plan is re -written to reflect the requirements of the new general stormwater permit, which we had anticipated initiating after collecting two sets of analytical data to fully evaluated current BMPs. Unfortunately, we did not have a qualifying storm event with a discharge over the last half of 2010 (see attached WS MET Data) and therefore did not have the data nceded to complete our evaluation. As for a detailed response for each deficiency/discrepancy, refer to the attached table. If you need any additional information or have any questions concerning the above matter, I can be reached via e-mail (O ine =ar u',onunisourcese.com) or phone (919.989.3102). The northwestern portion of the site, as well as the ASR Monofill and the Soil Borrow Area, drains through various ditches and catch basins and eventually discharges at Ouifall 004 to an unnamed tributary to Kerersville Lake. The ASR Monofill has another catch basin that receives run-off only from the capped northern slope of the monofill. The discharge from that catch basin is addressed under the facility's solid Nvaste permit. The southern portion of the site drains to various drop inlets and ditches that connect to two catch basins and eventually discharges at Outfali 005 to an unnamed tributary to Kerners Mill Creek. Compliance Evaluation Inspection NPDES General Stormwater Permit NCG200000 Certificate of Coverage NCG200353 OmniSource Southeast, Kernersville Forsyth County Dear Mr. Winegar: Ron Boone of the Winston-Salem Regional Office of the NC Division of Water Quality (DWQ) conducted a compliance evaluation inspection (CEI) at the subject facility on February 24", 2011. Your assistance and cooperation, as well as that of Scott McDaniel, during the inspection, was greatly appreciated. An inspection checklist is attached for your records and the inspection findings are summarized below. The facility is located at 1426 West Mountain Street, in Kernersville, Forsyth County, North Carolina. Stormwater related to industrial activity is discharged from the site to Kerners Mill Creek, which is currently classified as a class WS-Ill (water supply) water located in the Yadkin Pee Dee River Basin. Documentation & Monitoring Review The Stormwater Pollution Prevention Plan (SP3) is complete, current and has been implemented. However, there were several discrepancies noted as listed below: 1. The list of on -site tanks should be updated. The list should specify which tanks have secondary containments and which are double -walled. 2. The site map does not clearly delineate drainage areas and does not specify percentages of impervious surface for each area. 3. The stormwater discharge outfalls (SDO) have not been evaluated and certified for the absence of non-stormwater discharges. 4. The Best Management Practices (BMP) listing only talks about.the Good Housekeeping (GH) and Preventative Maintenance (PM) Programs. It does not list structural BMPs throughout the site and does not include an updated site plan to match it. The SP3 talks about the GH and PM programs in general terms and the training includes these items to a limited extent, however there are no actual schedules by which GH and PM activities are accomplished, with the exception of the monthly inspection of storage tanks, which is a requirement of the site's Spill Prevention, Control and Countermeasure Plan (SPCC). The permittee also performs full site inspections; please ensure this continues to be accomplished every six months. 6. The SP3 includes a section entitled the Spill Prevention and Response Plan (SPRP), but it refers to the site's SPCC as the primary control document. This is acceptable, if the SPCC adequately addresses spills from a stormwater standpoint. Please ensure that this is in fact the case. Also, the spill team listing needs to be updated and there is no emergency contact telephone listing. Such a listing should also include our phone numbers. 7. Training records were available for only 2009 during the inspection. 8. The SP3 was originally written in 2002. It was then reviewed in 2005, reviewed and revised in 2006, and reviewed again in 2009. Please review Part.11, Section A, Paragraph 7 of the permit in detail. These reviews and/or updates must be accomplished and recertified (as per the standard conditions) annually and they must include an updated list of spills and a recertification of the SDOs for non-stormwater discharges. . The facility currently has six SDOs identified (001-006). No analytical monitoring (AM) was accomplished in 2008 when the requirement was annual AM. 'AM was accomplished in 2009 for COD, TSS, Cadmium and Lead, which resulted in exceedences of the cutoffs for COD and TSS. Only one AM event was accomplished in 2010 and during that AM event only Oil & Grease, COD, and TSS were sampled and tested. This AM event resulted in four exceedences of the TSS benchmark. Limited actions have been taken to identify and correct the causes of the exceedences and documentation of those actions is minimal. Please review the tiered actions section of the permit in detail and initiate and better document all actions taken to identify and correct such exceedences. Furthermore, this office believes that a second sample could have been collected during 2010. Please ensure you take full advantage of every sampling opportunity for 2011 and fully implement the tiered requirements if further exceedences occur. Site Review For the most part, the site was clean and well maintained, especially for the type of work done at the site. Mr. Boone noted no violations or discrepancies. It may be beneficial to consider another full survey of the entire property to ensure that all SDOs have in fact been identified. If other SDOs are discovered in the future they may be considered unpermitted discharges. It is also noted that this inspection was prompted in part by complaints from surrounding entities. OmniSource should bear this in mind as it continues its operations and strive to meet ALL conditions of the general stormwater permit. You are reminded that violations of the NCG200000 general permit are subject to civil penalty assessments not to exceed $25,000 per day, per violation. Please correct all deficiencies noted above as soon as practical and provide a written response to this letter within 20 days of receiving it that lists corrective actions with estimated implementation schedules for each of the problems/discrepancies noted above. 41 YRC, Inc. The caller's name is William West (336-577-7625) and his concern is about runoff from the Omnisource facility on W. Mountain St into a flood plain and eventually into Kernersville Lake. I tried to call him but received a full mailbox message. This facility recently underwent a name change, formerly Atlantic Scrap and Processing. I checked with Corey this morning and Atlantic Scrap is the name on the active DWQ stormwater permit. It appears Rose inspected the facility in 2009 and it was in compliance at that time. The facility has an old landfill on it and the facility had been mining out some of that material for further processing and recycling, but it appears from Cindy that his concerns are related to the runoff generated from the whole operation (scrap metal recovery) and the potential types of things on the site (fuel tanks, car batteries, etc.) although I'm not sure they accept vehicles with batteries still in them. Solid Waste staff have been on the property in the last few months completing a recycling tax certification inspection. I believe there are groundwater monitoring wells on that property. You can confirm that information as well as determine the status of them with Jackie Drummond, Compliance Hydrogeologist in our Raleigh office, 919-508-8500, should that be needed. Our contacts at the facility are Scott McDaniel (336-996-2350) and Bill Perry (336-655-1211). Could you please follow up with Mr. West to determine his concerns as it appears they may be addressed through the stormwater permit. This permit expires on October 31, 2005. The Division staff is currently in the process of renewing this permit. When a draft version is available for notice and public comment, it will be posted on our website at http_//h2o.enr_state.nc.us/su/. Once the permit is reissued, your facility would be eligible for continued coverage under the reissued permit. In order to assure your continued coverage under the general permit, you must apply to the Division of Water Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, enclosed you will find a Permit Coverage Renewal Application Form. The application must be completed and returned by August 19, 2005 in order to assure continued coverage under the general permit. Letters confirming our receipt of the completed application will not be sent. Failure to request renewal within the time period specified may result in a civil assessment of at least $250.00. Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $10,000 per day. Please note that "no exposure exclusion" is now available to all operators of industrial facilities in any of the categories of "storm water discharges associated with industrial activity," (except construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facility industrial materials and operations are not exposed to Stormwater, you can apply for the no exposure exclusion. For additional information contact the Central Office Stormwater Staff member listed below or check the Stormwater Permitting Unit Web Site at http://h2o.enr.state.nc.us/su/. If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed Rescission Request Form. Mailing instructions can be found on the bottom of the form. The NOI shall be submitted and a certificate of coverage issued prior to any discharge of stormwater associated with industrial activity that has a point source discharge to the surface waters of the state. Any owner or operator not wishing to be covered or limited by this General Permit may make application for an individual NPDES permit in accordance with NPDES procedures in 15A NCAC 2H .0100, stating the reasons supporting the request. Any application for an individual permit should be made at least 180 days prior to commencement of discharge and must be secured prior to commencement of discharge. This General Permit does not cover activities or discharges covered by -an individual NPDES permit until the individual permit has expired or has been revoked. Any person conducting an activity covered by an individual permit but which could be covered by this General Permit may request that the individual permit be revoked and coverage under this General Permit be provided. If industrial materials and activities are not exposed to precipitation or runoff as described in 40 CFR § 122.26(g), the facility may qualify for a No Exposure Exclusion from NPDES stormwater discharge permit requirements. Any owner or operator wishing to obtain a No Exposure Exclusion must submit a No Exposure Certification NOl form to the Division, must receive approval by the Division, must maintain no exposure conditions unless authorized to discharge under a valid NPDES stormwater permit, and must reapply for the No Exposure Exclusion once every five (5) years. Any facility may apply for new or continued coverage under this permit Until a Total Maximum Daily Load (TMDL) for pollutants for stormwater discharges is established. A TMDL sets a pollutant loading limit that affects a watershed, or portion of a watershed, draining to an impaired water_ For stormwater discharges to watersheds affected by a TNIDL, coverage under this permit may depend on the facility demonstrating it does not have reasonable potential to violate applicable water quality standards for those pollutants as a result of discharges. If the Division determines that discharges have reasonable potential to cause water quality standard violations, the facility shall apply for an individual permit 180 days prior to the expiration date of this general permit, and once that permit is effective, will no longer have coverage under this general permit. [Note the facility must identify impaired waters (scheduled for TMDL development) and waters already subject to a TMDL in the Site Plan, as outlined in the Stormwater Pollution Prevention Plan (SPPP), in Part 1I, Section A.1] During the period beginning on the effective date of the permit and lasting until expiration, the Permittee is authorized to discharge stormwater associated with industrial activity. Such discharges shall be controlled, limited, and monitored as specified in this permit. SECTION B: PERMITTED ACTIVITIES Until this permit expires or is modified or revoked, the permittee is authorized to discharge stormwater to the surface waters of North Carolina or separate storm sewer system which has been adequately treated and managed in accordance with the terms and conditions of this General Permit. All discharges shall be in accordance with the conditions of this permit. Any other point source discharge to surface waters of the state is prohibited unless it is an allowable non- stormwater discharge or is covered by another permit, authorization, or approval. The stormwater discharges Part I Page i of 2 Permit No. NCG200000 allowed by this General Permit shall not cause or contribute to violations of Water Quality Standards. This General Permit does not allow discharges determined by the Division of Water Quality to be wastewaters. This permit does not relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree. Facility personnel r (or the team) responsible for implementing the SPRP shall be identified in a written list incorporated into 7 the SPRP and signed and dated by each individual acknowledging their responsibilities for the plan. A . responsible person shall be onsite at all times during facility operations that have the potential to contaminate stormwater runoff through spills or exposure of materials associated with the facility operations. The SPRP must be site stormwater specific. Therefore, an oil Spill Prevention Control and Countermeasure plan (SPCC) may be a component of the SPRP, but may not be sufficient to completely ddress the stormwater aspects of the SPRP. The common elements of the SPCC with the SPRP may be /p1 ncorporated by reference into the SPRP. 4. reventative Maintenance and Good Housekeeping Program. A preventative maintenance and good ousekeeping program shall be developed. The program shall list all stormwater control systems, X s ormwater discharge outfalls, all on -site and adjacent surface waters and wetlands, industrial activity eas (including material storage areas, material handling areas, disposal areas, process areas, loading and k u loading areas, and haul roads), all drainage features and structures, and existing structural BMPs. The ogram shall establish schedules of inspections, maintenance, and housekeeping activities of stormwater ( ontrol systems, as well as facility equipment, facility areas, and facility systems that present a potential or stormwater exposure or stormwater pollution. Inspection of material handling areas and regular 1M cleaning schedules of these areas shall be incorporated into the program. Timely compliance with the established schedules for inspections, maintenance, and housekeeping shall be recorded in writing and 11' maintained in the SPPP. s 5. Employee Training. Training programs shall be developed and training provided at a minimum on an annual basis for facility personnel with responsibilities for: spill response and cleanup, preventative maintenance activities, and for any of the facility's operations that have the potential to contaminate Part 11 Page 2 of 9 Permit No. NCG200000 y \ stormwater runoff. Facility personnel (or team) responsible for implementing the training shall be identified, and their annual training shall be documented by the signature of each employee trained. 6. Responsible Party. The Stormwater Pollution Prevention Plan shall identify a specific position(s) responsible for the overall coordination, development, implementation, and revision to the Plan. Responsibilities for all components of the Plan shall be documented and position assignments provided. See signatory requirements in Part III Section B.5 of permit. Plan Amendment. The permittee shall amend the Plan whenever there is a change in design, construction, operation, or maintenance which has a significant effect on the potential for the discharge of pollutants to surface waters. All aspects of the Stormwater Pollution Prevention Plan shall be reviewed and updated on an annual basis. The annual update shall include an updated list of significant spills or leaks of pollutants for the previous three years, or the notation that no spills have occurred. The annual update shall include written re -certification that the stormwater outfalls have been evaluated for the presence of non-stormwater discharges. Each annual update shall include a documented re-evaluation of the effectiveness of the BMPs listed in the BMP Summary of the Stormwater Management Plan. The Director may notify the permittee when the Plan does not meet one or more of the minimum requirements of the permit. Within 30 days of such notice, the permittee shall submit a time schedule to the Director for modifying the Plan to meet minimum requirements. The permittee shall provide certification in writing (in accordance with Part III, Standard Conditions, Section B, Paragraph 5) to the Director that the changes have been made. 8.
