Director March 14, 2013 Subject: Compliance Evaluation Inspection NPDES General Permit No. NCG200344 Cranford Iron & Metal Randolph County Dear Mr. Cranford: John E. Skvatia, III Secretary On March 7, 2013, Jenny Graznak of this office performed a Compliance Evaluation Inspection at Cranford Iron & Metal located at 5039 US Highway 311 in Sophia, Randolph County. This facility holds General Stormwater Permit No. NCG200344 under the National Pollutant Discharge Elimination System (NPDES) to discharge Stormwater from manufacturing activities classified as Scrap Metal Recycling and Wholesale Trade of Scrap Metal. This inspection was in response to a complaint received by this office regarding a potential spill of petroleum products into surface waters. You and your wife were present for the inspection. This type of inspection consists of two basic parts: an in -office review of facility files and self -monitoring data and an on -site inspection of the facility's discharge- These inspections evaluated five (5) areas, and observations from each' area are addressed below: 1. Permit The General Permit was reissued January 1, 2010 and expires December 31, 2014.. A copy of the current permit was available for review during the inspection. 2. Records/Reports As required by the permit, the facility has a Stormwater Pollution Prevention Plan (SPPP). All sections of the SPPP were complete. The last revision occurred in June 2009 by Mid -Atlantic Associates. The SPPP is reviewed on an annual basis, and an annual spill list was included. 33. Facili�Site Review The facility accepts copper, brass, aluminum, steel, radiators, and appliances. You stated that no fluids are knowingly accepted at the facility. Copper is stored inside a locked building for security reasons. 4�EffluentiReceivingWatersuent/ReceivingWaters Stormwater from the facility is discharged from one outfall, which is located on the south side of the property and drains to an unnamed tributary to Caraway Creek, Class C waters in the Yadkin Pee - Dee River Basin. Some soil staining was noted, but nothing of significance. 5. Self -Monitoring Program The stormwater permit requires semi-annual analytical and qualitative monitoring at stormwater outfalls. An on -site review of the monitoring data during the inspection showed that parameters were evaluated per the specifications of the permit. Stormwater samples were analyzed by Pace Analytical, and all analytical results were available for review during the inspection. In a few instances, the analytical results were' higher than benchmark values. These instances triggered a Tier One response. Ail Tier One responses were included in the SPPP. The inspection found that Cranford Iron & Metal was in violation of the state issued stormwater permit. The specific violations are as follows: (1) the failure 'to have a Stormwater Pollution Prevention Plan and, (2) the failure to perforce the required qualitative and quantitative monitoring. This inspection evaluated the five areas designated on the attached inspection form. Observations from each area are addressed below: 1. Permit Certificate of Coverage # NCG200344 for Cranford Iron & MetaI expired on 9/30/08. The Division is in the process of preparing a draft permit for public notice. You should continue to operate under the existing permit until the new permit is reissued. 2. _Records/Reports Part I1, Section A of the permit requires the development of a Stormwater Pollution Prevention Plan (SPPP). To date, Cranford Iron & Metal has not developed a SPPP. It is strongly recommended that you obtain the services of a consultant to assist you with preparing a SPPP specific for your facility. 3. Facility Site Review A site map of the facility had not been prepared showing the outfall locations nor the material storage, disposal, processing, loading and unloading areas. 4. Effluent/Receiving Waters Stormwater from the Cranford Iron & Metal site flows to the south side of the property where it reaches an unnamed tributary to Caraway Creek, Class "C" waters in the Yadkin Pee -Dee River Basin. Monitoring Program Part II, Section B of the permit requires collection of annual analytical samples from each stormwater discharge outfall during a representative storm event. No samples data could be produced although Mr. Cranford indicated that samples were collected at some time in the past. Contact with B.J. Lineback and Denise at Engineering Consultant Service did not turn up any records. Again, it is strongly recommended that you obtain the services of a competent consultant to assist you with the collection of these samples. The results must be submitted to the Division on form SWU-256-050200 no later than 30 days from the date the facility receives the sampling data from the laboratory (See analytical reporting farm attached). Part 11, Section C of the permit requires that semi-annual qualitative (visual) monitoring be performed and documented at each stormwater outfall. No visual monitoring data could be produced by Cranford Iron & Metal. This monitoring should be performed semi-annually per the permit requirements (See ,...y • ; qualitative monitoring form attached). The qualitative records do not need to be `submitted to the F Division, however, the records must be kept on file at the facility for a period of five years_ Part II, Section D of the permit requires additional analytical monitoring if the facility uses more than .155 gallons of new motor oil per month when averaged over the calendar year. You are required to keep an annual total of motor oil consumption to deterthine if this sampling is required. Please be aware that the failure to comply with any permit conditions is a violation of the General Permit. Per the permit text in Part 111, Section A (2),-"The permittee must comply with all conditions of this general permit. Any permit noncompliance constitutes a violation of the Clean Water Act and is grounds for enforcement action...". Additionally, per the permit text in Part 111, Section A (2Xc), "Under state law, a daily civil penalty of not more than ten thousand dollars (S 10,000) per violation may be assessed against any person who violates or fails to act in accordance with the terms; conditions, or requirements of a permit [Ref. NC General Statute 143-215.6A]".
