On June 8, 2018, staff froze. the Wilmington Regional Office of the Division of Energy, Mineral
and Land Resources (DEMLR), conducted a site inspection for the tract/project known as
Gillikin Marine Railways located in Carteret County, North Carolina. The site drains to the
Newport Raver; which is currently classified as Class SA HQW Waters in the White Oak River
Basin.
The following observations were noted during the DEil4LR inspection (please see the attached
addendum for additional information about your permit):
1. A stormwater pollution prevention plan has not been developed and implemented and is a
violation of Permit Condition Part II Section A.
2. Analytical sampling has not occurred for the site and is a violation of Permit Condition
Part 11 Section B which requires semi-annual sampling for 7 parameters.
3. Qualitative sampling has not occurred for the site and is a violation of Permit Condition
Part 11 Section C which requires semi-annual observations for 9 parameters.
4. The site needs general housekeeping and implementation of best management practices
to beep potential pollution sources from entering stormwater discharges.
5. Spill prevention and response procedures need to be implemented. Petroleum products
found on site were spilled on the ground.

Required response
1. You were directed to respond to the 'Notice of Deficiency letter in writing within 30
calendar days of receipt of the Notice. Respond to this letter immediately. Your
response should be sent to this office at the letterhead address and include a schedule for
compliance with the permit. The inspection established a new deadline for compliance of
July 8, 2018.
2. Develop and implement a Stormwater Pollution Prevention Plan (SPPP). Submit copy of
the SPPP to this office for review by July 8, 201 S. Include all required minimum
elements.
3. Implement the required sampling protocol as outlined in the permit.
Thank you for your attention to this matter. This office requires that the violations as described
above be properly resolved. Unresolved violations may lead to the issuance of a -",,-Iotice of
Violation and/or assessments of civil penalties.
Thank you for your assistance and cooperation during this inspection. Please be advised that
violations of the NPDES Stormwater General Permit may be subject to a civil penalty
assessment of up to 525,000.00 per day for each violation. If you have any questions,

Inspection Summary-
Met with Mr Gillikin, owner, and Mr. Clark Calloway, consultant for Mr. Gillikin. The permit requirements were discussed
including Siormwater Pollution Prevention Plan elements, sampling protocols, and general maintenance of the facility.
The SWPPP should be prepared within 30 days. An extension may be granted with significant progress in preparation.
Documentation requirements should begin immediately. Submit a copy to this office for review.
Sampling may begin in July 2018. One railway should be selected for sampling: Please remember qualitative and analytical
sampling forms.
General maintenance is required for the yard. Clean up of debris, waste materials, and used liquid containers is neccesary.

On Rdy 6, 2018- staff from the Wilmington Regional Office of the Division of Energy, %,lincral
and Land Resources (I)L-N-tI.R.), received a fax providing results for a recent sampling event for
the business known as Gillikin -\-larine Railways located in Carteret County North Carolina.
The site drains to the Newport River; which is currently classified as Class SA i-IQW Waters in
the 'White Oak River Basin.
The following observations were noted of the sampling results and required response to .the
\Notice of'Deftciency dated -March 26. 2018:
You are directed to respond to this letter in writing within 30 calendar days of receipt of
this Notice. Your response should be sent to this office at the letterhead address and
include a schedule for compliance with the permit. This office has not received a
formal response to the Notice.
Develop and implement a Storm8vatcr Pollution Prevention flan (SPPP). Submit copy of'
the SPPP to this office for review with 30 calendar days of receipt of the \Notice.
Include all required minimum elements.
Implement the required sampling protocol as outlined in the permit.- Sampling data must
be submitted by mail on the official form. All parameters must be sampled. The sample
results submitted neglected to report: Total Rainfall; Total Suspended Solids, Oil and
Grease, and Lead. The form also includes two certifications that must be signet].
4. Qualitative Sampling must also be performed -

Glllikin Marine Railways is a working boatyard construction and repair facility for large vessels

• Located on Morgan Creek on Radio Island, Beaufort, NC
• Vessels are hauled and launched by railways as opposed to a travel lift
• Materials to be contained are the byproducts of painting, sanding, and repairing
Containment
• Water Booms are used for boats under repair on railways to restrict water entering Morgan
Creek
• Ground Tarps with raised perimeters are placed beneath vessels when painted
• Grounds are cleared of Debris daily and upon launching employing Good Housekeeping
Standards
• Unused paint and other materials are stored in the enclosed building
• Excess paint and waste oil are stored in the waste drum in the fuel and wasted containment
area
Sampling
• Location — SE corner of Gillikin Marine Railways Boathouse
• sampling to be taken during first 30 minutes of measurable storm event during working hours

1. The operation of Gillikin Marine Railways and.Morgan Creek Seafood falls under the jurisdiction
of several Government Agencies including the Environmental Protection Agency (EPA), the
Departent of I=nvironment and Natural Resources (NCDENR), and the US Coast Guard.
2. The continued operation of our businesses is dependent on compliance with the regulations of
these agencies and to fulfill our responsibilities to be good stewards of the grounds and waters
which olar operations may affect.
3. Our operations include the use of materials that can be hazardous when they become mixed in
our marine environment including copper, fiberglass residue, and general debris.

4. It is required that each employee acknowledge and promise to accept personal responsibility for
ensuring that debris such as paint rollers, sanding discs, brushes, and any other materials are
remove from the work area as part of their daily duties.
5_ It Is req urired that each employee promise to ensure that tarps and otter containment devices
are used as required by the agencies with jurisdiction over these operations.
6. It is required that each employee promise to report to management any type of spill that might
be considered a contaminant_
7. It is recigired that each employee is responsible for removing hazardous materials, such as paint,
to the designated containment area on a daily basis, when the day's work is completed.

Dear Mr Gillikin:
On March 22, 2018, staff from the Wilmington Regional Office of the Division of Energy,
Mineral and Land Resources (DrMLR), conducted a site inspection for the tract/project known
as Gillikin Marine Railways located in Carteret County, North Carolina. The site drains to the
Newport River, which is currently classified as Class SA HQW Waters in the White Oak River
Basin.
The following observations were noted during the DEMLR inspection (please see the attached
addendum for additional information about your permit):
1. A stormwater pollution prevention plan has not been developed and implemented and is a
violation of Permit Condition Part 11 Section A.
2. Analytical sampling has not occurred for the site and is a violation of Permit Condition
Part 11 Section B which requires semi-annual sampling for 7 parameters.
3. Qualitative sampling has not occurred for the site and is a violation of Permit Condition
Part lI Section C which requires semi-annual observations for 9 parameters.
4. The site needs general housekeeping and implementation of best management practices
to keep potential pollution sources from entering stormwater discharges.

5. Spill prevention and response procedures need to be implemented. Petroleum products
found on site were spilled on the ground.
Required Response
1. You are directed to respond to this letter in writing within 30 calendar days of receipt of
this Notice_ Your response should be sent to this office at the letterhead address and
include a schedule for compliance with the permit.
2. Develop and implement a Stormwater Pollution Prevention Plan (SPPP). Submit copy of
the SPPP to this office for review with 30 calendar days of receipt of this Notice. Include
all required minimum elements.
Implement the required sampling protocol as outlined in the permit.
Thank you for your attention to this matter. This office requires that the violations as described
above be properly resolved. Unresolved violations may lead to the issuance of a Notice of
Violation and/or assessments of civil penalties.
Thank you for your assistance and cooperation during this inspection. Please be advised that
violations of the NPDES Stormwater General Permit may be subject to a civil penalty
assessment of up to $25,000.00 per day for each violation. If you have any questions,

Site inspection based on a complaint from USCG regarding area boat repair companies on Radio Island. Site needs general
housekeeping to ensure contaminants are not getting into the stormwater_ Chemicals used onsite should be stored under
cover and in a spill proof area. Used containers must be disposed of appropriately. Any grinding, sanding or spray painting
must be contained to isolate the area to prevent contact with stormwater. Ground tarps must be used as to easily collect
any contaminant. Any work done over the water must be contained appropriately.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under
the federal Clean Water Act and then delegated the program to the NC Department of
Environment and Natural Resources (NCDENR). As of August 1, 2013. the Division of Energy,
Mineral and Land Resources (DEMLR) manages the implementation of this program for
NCDENR. The NPDES permitting program for stormwater discharges was established in 1990.
Phase I focuses on site and operations planning to reduce pollutant sources.
Through the NPDES permitting program, industrial facilities that fall into one of the subject ten
categories are required to obtain permit coverage under a general permit or an individual permit,
depending upon the facilities SIC code and the industrial activity occurring at the facility. There
are currently 19 active general stormwater permits in North Carolina. One condition that is
applicable to both the general permits and individual stormwater permits is the requirement to
develop and implement site -specific comprehensive stormwater pollution prevention plans
(SPPP). These plans are required to include a comprehensive evaluation of the site and
operations to reduce pollutant sources and prevent pollutant discharge.
Copies of the general permits and accompanying documents can be accessed from the following

discharge monitoring forms, and a Notice of Intent [which is the application of for coverage
under a NPDES General Stormwater Permit] can be found at this web site.
The following items are a subset of permit requirements and are listed to assist you and help
bring your attention to certain permitting issues, process and condition requirements of your
permit. Please see the above mentioned web site in order to obtain a copy of the permit such that
you may fully comply with all the conditions therein. Failure to properly comply with
conditions of the permit, like those bulleted below, constitutes violations and are subject
civil penalty assessment of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain
permit coverage under a general NPDES stormwater permit or an individual NPDES
stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the
Division of Energy, Mineral and Land Resources (DEMLR) by the filing of a Notice of
Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior
to any discharge of stormwater associated with the industrial activity, process
wastewater, and/or mine dewatering.
• Once the Notice of Intent is received, DEMLR will review and determine whether a
Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the
facility is covered by the General Permit. That is, the permittee is authorized to discharge
stormwater, process wastewater, and/or mine dewatering pursuant to the type of General
Permit until the permit expires or is modified or revoked.
• Any other point source discharge to surface water of the state is prohibited unless it is an
allowable non-stormwater discharge or is covered by another permit, authorization or
approval.

• There are currently 19 active general permits. Permit conditions vary accordingly;
however, most of the permits have following condition requirements (you must read your
entire permit to ensure full compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the
facility along with the Stormwater Pollution Prevention Plan. Copies of the
analytical monitoring results shall also be maintained on -site. The Permittee
shall retain records of all monitoring information, including all calibration and
maintenance records and all original strip chart recordings for continuous
monitoring instrumentation, and copies of all reports required by this general
permit for a period of least 5 years for the date of the sample measurement, report
or application.
o Expiration — The permittee is not authorized to discharge after the expiration date
of the general permit. In order to receive automatic authorization to discharge
beyond the expiration date, the permittee shall submit forms and fees as are
required by the agency authorized to issue permits no later than 180-days prior to
expiration date. Any permittee that has not requested renewal at least 180 days
prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested renewal at least 180 days prior to expiration, will
be subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general
permit is not transferable to any person expect after notice to and approval by the
Director. The Director may require modification or revocation and reissuance of
the Certificate of Coverage to change the name and incorporate such other
requirements as may be necessary under the Clean Water Act. The Permit is
NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to
notify the Division in writing in the event the permitted facility is sold or closed.
The Division of Energy, Mineral and Land Resources views changes of name or
ownership as a modification that requires the Director's approval and reissuance
of the permit. Name and ownership changes required you to complete a
Name/ownership Change Form from the Division and mail it back to the along
with all appropriate information to the Division of Energy, Mineral and Land
Resources.
o Proper Operation and Maintenance is a requirement of the permit.

On October 31, 2013, staff from the Wilmington Regional Office of the Division of Energy.
Mineral and Land Resources (DEMLR), conducted a site inspection for the tract/project known
as Moores Marine Boatyard & Boatworks located in Carteret County, North Carolina.
A review of the file by DEMLR staff revealed that the subject project is covered by NPDES
Stormwater General Permit NCG 190089.
Thank you for your assistance and cooperation during this inspection. As noted in the attached
inspection report, you need to develop a stormwater pollution prevention plan and conduct semi-
annual monitoring of the stormwater outfalls. Please implement best management practices to
contain contaminants onsite.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under
the federal Clean Water Act and then delegated the program to the NC Department of
Environment and Natural Resources (NCDENR). As of August 1, 2013, the Division of Energy,
Mineral and Land Resources (DEMLR) manages the implementation of this program for
NCDENR. The NPDES permitting program for stormwater discharges was established in 1990.
Phase I focuses on site and operations planning to reduce pollutant sources.
Through the NPDES permitting program, industrial facilities that fall into one of the subject ten
categories are required to obtain permit coverage under a general permit or an individual permit,
depending upon the facilities SIC code and the industrial activity occurring at the facility. There
are currently 19 active general stormwater permits in North Carolina. One condition that is
applicable to both the general permits and individual stormwater permits is the requirement to
develop and implement site -specific comprehensive stormwater pollution prevention plans
(SPPP). These plans are required to include a comprehensive evaluation of the site and
operations to reduce pollutant sources and prevent pollutant discharge.

discharge monitoring forms, and a Notice of Intent [which is the application of for coverage
under a NPDES General Stormwater Permit] can be found at this web site.
The following items are a subset of permit requirements and are listed to assist you and help
bring your attention to certain permitting issues, process and condition requirements of your
permit. Please see the above mentioned web site in order to obtain a copy of the permit such that
you may fully comply with all the conditions therein. Failure to properly comply with
conditions of the permit, like those bulleted below, constitutes violations and are subject
civil penalty assessment of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain
permit coverage under a general NPDES stormwater permit or an individual NPDES
stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the
Division of Energy, Mineral and Land Resources (DEMLR) by the filing of a Notice of
Intent (NOi) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior
to any discharge of stormwater associated with the industrial activity, process
wastewater, and/or mine dewatering.
• Once the Notice of Intent is received, DEMLR will review and determine whether a
Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the
facility is covered by the General Permit. That is, the permittee is authorized to discharge
stormwater, process wastewater, and/or mine dewatering pursuant to the type of General
Permit until the permit expires or is modified or revoked.

Any other point source discharge to surface water of the state is prohibited unless it is an
allowable non-stormwater discharge or is covered by another permit, authorization or
approval.
There are currently 19 active general permits. Permit conditions vary accordingly;
however, most of the permits have following condition requirements (you must read your
entire permit to ensure full compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the
facility along with the Stormwater Pollution Prevention Plan. Copies of the
analytical monitoring results shall also be maintained on -site. The Permittee
shall retain records of all monitoring information, including all calibration and
maintenance records and all original strip chart recordings for continuous
monitoring instrumentation, and copies of all reports required by this general
permit for a period of least 5 years for the date of the sample measurement, report
or application.
o Expiration — The permittee is not authorized to discharge after the expiration date
of the general permit. In order to receive automatic authorization to discharge
beyond the expiration date, the permittee shall submit forms and fees as are
required by the agency authorized to issue permits no later than 180-days prior to
expiration date_ Any permittee that has not requested renewal at least 180 days
prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested renewal at least 180 days prior to expiration, will
be subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general
permit is not transferable to any person expect after notice to and approval by the
Director. The Director may require modification or revocation and reissuance of
the Certificate of Coverage to change the name and incorporate such other
requirements as may be necessary under the Clean Water Act. The Permit is
NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to
notify the Division in writing in the event the permitted facility is sold or closed.
The Division of Energy, Mineral and Land Resources views changes of name or
ownership as a modification that requires the Director's approval and reissuance
of the permit. Name and ownership changes required you to complete a
Name/ownership Change Form from the Division and mail it back to the along

o Proper Operation and Maintenance is a requirement of the permit.

Here is the breakdown of my involvement with Gillikin Marine Railway sandblasting complaint. Pat Durrett of the CAMA Green Marina
Program is also working with Mr. Gillikin to try to attain Green Marina status.
Oct 25, 2011 — Received complaint from my supervisor Jim Gregson (via Martin Heath EPA) RE: Sandblasting from boatyard.
Oct. 27, 2011— Conducted site inspection of Gillikin Marine Railways in response to sandblasting complaint. No sandblasting at time of
inspection but discovered facility did not have NPDES General Permit for Marinas so he was instructed to fill out a Notice of Intent to obtain
the permit.
December 13, 2013 - Certificate of Coverage for NCG19089 was issued. Coverage under the General Permit allows the discharge of
stormwater associated with activities primarily engaged in operating Marinas to the surface waters. The permittee is required to implement
a stormwater Pollution Prevention Plan that includes yearly employee training of Best Management Practices that include proper methods of
sanding boats.
I have attached site inspection report and correspondence to R. Martin Heath of EPA.

Here is the time line of actions involving the citizen's complaint.
April 30, 2013 — Received a dust complaint.
May 2, 2D13 — Investigated the dust complaint at Gillikin Marine Railway, facility was not sand blasting.
May 3, 2013 - Sent James Gillikin, owner, a warning letter because this was the second complaint.
May 14, 2013 —James Gillikin called to discuss the warning letter. Told Mr. Gillikin if we receive another complaint I will
schedule a facility inspection to see the abrasive blaster in operation.

To give you an update on Mr. Murray's complaint, I forwarded the information I received to both the Division of Water Quality
and Division of Air Quality. Because the forwarded information I received did not have contact information for the original
complaint from late April, I am sure that I don't have all pertinent information. But, Jim Gregson with DWQ sent one of his staff,
Jean Conway, up there to investigate the complaint, but I don't believe she was able to speak with Mr. Murray. However, you
may want to discuss the issues with the marina permitting, and she can be reached at Jean.Conway(@ncdenr.gov or 910-796-
7215.
Jean had previously been up there to the subject property where the sandblasting is occurring and discussed best management
practices to prevent sand from leaving the property and affecting the neighboring sites. She was told then that the owner did
not have the funds to fully re -enclose the sandblasting operation in a structure but that he would shroud it as required by Air
Quality regulations. Air Quality also sent employees to the site based on the late April complaint; Ashby Armistead and Tony
Sabetti are the two best contacts: Tony.Sabetti@ncdenr.pov and Ashby.Armistead@ncdenr.gov You can also contact them by
phone through our switchboard at 910-796-7215. Tony issued a letter discussing the shrouding that should occur during
operations at the site.
Just wanted you to have the most up to date information regarding DENR's involvement (as I know it) at this point. It may boil
down to more of a nuisance complaint that should be handled through your county ordinances as they exist. I am copying each
of the people that I've referred you to so that they are aware of what I've told you. Let me know how else I can help or if you
are not able to get an answer to questions that you have regarding this or other issues.

US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land Resources,
Coastal Area Management Act or any other federal or local governmental permit that may be
required.

A site visit was made by me and WiRo staff member, Joanne Steenhuis, to investigate the complaint of sand blasting boats at the Gilliken's boatyard
on Radio Island in Morehead City, NC.
No sand blasting or power washing of boats was occurring at the time of our visit but it was discovered that the facility does not hold a NPDES
General Permit (NCG190000) for Ship and Boat Building and Repairing. Mr. Gilliken stated that he has been in business since 1965 and his secretary
took care of all the paperwork but was now incarcerated for embezzling money from his business.
During our site inspection with the owner, proper methods of containing paint chips, storing fluids and general good housekeeping practices were
recommended. Mr. Gilliken agreed to make the changes discussed and is in the process of obtaining coverage under the NCG 190000 General Permit.
Pat Durrett, from CAMA's Clean Marina Program, will schedule a visit to the site in order to provide guidance and a copy of the BMP Manual. Our
office will conduct a follow up inspection once the General Permit has been issued.

9. NARRATWE DESCRIPTION: Mr. James D. Gillikin, the
applicant, is the owners of two successful marine trade
businesses located on the east side of Radio Island and
Morgan Creek, in Carteret County. The referenced USGS
Topographic Map and the 1984 Aerial Photography provide an
excellent overview of the project site. The commercial
property consists of approximately 3 ac. of bulkheaded
highground. Mr. Gillikin maintains a long-term lease with
the property owner who is Mrs. Cecil L. Eudy of Kinston, NC.
Mr. Gillikin and his family have operated a boat building
yard and seafood house for the past forty-five (45) years at
this location. These two separate operations are grouped
collectively as, 'Gillikin Craft, Inc.'.
Today, Gillikin Craft, Inc. proposes to expand the leased
property by developing a heavy-duty marine railway.
Although the railway and lift system are rather simplistic,
it will provide haul -out service to very large and heavy
wooden and steel boats of the 100' class. The applicant
used the new business as a significant need in Carteret
County based on the number of local fishing boats that must
travel great distances for repair services. Mr. Gillikin
was issued Permit #39-83 in March of 1983, and it allowed
construction of a similar railway at his boat building
operation on the north side of the property. That work was
successfully completed and is in a good state of operation.
The Radio Island neighborhood is characterized by light
industrial businesses such as Aviation Fuel Terminals, Radio
Island Marina, Piner Towing and Salvage, as well as, the
aforementioned Gillikin interests.
The proposed railway will extend 170' into Morgan Creek as
measured from the existing bulkhead. The steel track of the
actual railway will be 10' apart. The project will not
involve any overboard dredging or excavation work as the
natural slope (12% of the creek bottom) will provide the
necessary grade and water depth. The railways need 15' of
water at MLT at the offshore end. This will allow deep
draft vessels to be loaded onto the lifting carriage and
moved up the tracks safely. A series of heavy support piles
will be driven into the creek bottom along the railway
alignment. This will provide the necessary load bearing
support for the railway system. Looking at the underwater
profile, the support piles and the steel tracks will be
exposed only a few inches above the creek bottom. The
railway should create no obstruction to traditional or
public navigation in Morgan Creek. Morgan Creek is,
however, a federally maintained channel with dredging
requirements only needed near the mouth of the creek, a

distance of some 1000' southeast of the project site,
Morgan Creek is approximately 320' wide at the project site.
The proposed 170' long railway will actually enter the creek
at a slight angle reducing the overall projection ,into.the
creek.
In order to extend the railway onto the highground property,
a 50' section of existing bulkhead will be removed. This
will allow the 6-8' high bank to be removed by excavation
and properly sloped. It must be remembered that 100' boats
may have a 30' wide beam and the opening through the
highground must be wide enough to accommodate the load. The
applicant proposes to re -stabilize the shoreline with a low
profile.revetment of riprap material measuring approximately
15' long and 10' wide on each side of the railway alignment.
Although the intertidal zone is shallow in this area, no
marsh grass or other estuarine resources occur along the
100' section of bulkhead. The proposed railway will extend
175' onto the highground property. This length will allow
room for the mechanical wench device, as well as a safe
working area away from the waters edge.
The highground property is dominated by sandy soils
characteristic of Radio Island. The proposed railway will
be situated between Gillikin Seafood and the former Moore's
Seafood building. The old building will be converted into -a
tool and repair shop for the railway business. The entire
project area is services by a stormwater system that
collects runoff from heavy rain events. The applicant
proposes no other type of construction or development on the
highground property. The surface waters of Morgan Creek are
classified 'SA' and are closed to shellfishing.
10. ANTICIPATED IMPACTS: The onsite inspection revealed that
the 170' railway will not interfere with navigation on
Morgan Creek. The maximum extent of the railway is in
actuality no longer than the existing docks and piers on
either side of the project site. The proposed railway, like
the one permitted in 1983, will be low -profile and in close
contact with the natural bottom contours. Morgan Creek is
at least 15-18' deep within the project vicinity. The COE
will want to ensure that the railway will not preclude
Federal maintenance dredging of the creek. As mentioned
previously, no dredging will be required, and no vegetated
wetlands will be loss as a result of the project. The
applicant leases some 800' of shoreline along Morgan Creek
and has chosen this 50' section of bulkheaded waterfront
between Gillikin Seafood and the old Moore's Seafood

Building is the optimal location based on the highground
availability and offshore water depths. Although specific
calculations have not been made with reference to built -upon
and impervious surfaces, it is clear that much less than 250
of the railway site will be covered structures. No asphalt
or concrete surface areas are projected for construction.
The paint and repair services associated with the railway
may create potential pollution problems from paint chips,
dust and rust entering the open airway and runoff.
LAMA REVIEW SECTION: The 1985 Land Use Plan for Carteret
County classifies Radio Island as 'Rural/Port'. The
proposed project appears to be consistent with that
classification. In addition, the site is zoned by Carteret
County as 'PI' Port Industrial and the proposed railway
activity appears to be consistent with that zoning
classification.

Tip or Complaint: An old boat yard that works on old commercial fishing boats sand blasts
the anti fouling paint off
the bottoms of boats on a daily basis. The cloud of dust and heavy metals falls on the
ground and blows into the
adjacent creek, which empties into the bay and the ocean. No attempt is made to contain the
dust. They have been
doing this for years. I have photos I can e-mail you. This yard is located on,"Radio
Island", Beaufort/Morehead City,
North Carolina. It is a small island and the only boat yard. I took the.photos from my
balcony which overlooks the
creek.
Specific Directions: Come into Morehead City on I-7e. Cross the Intercoastal Waterway "high
Rise Bridge" and take
the first Right turn. Cross the tracks, bear left, then right along side a 4 story Condo
building. Follow that road
to the end and you will be at the boat yard.

A site visit was made by me and WiRo staff member, Joanne Steenhuis, to investigate the complaint of sand blasting boats at the Gilliken's
boatyard on Radio Island in Morehead City, NC.
No sand blasting or power washing of boats was occurring at the time of our visit but it was discovered that the facility does not hold a
NPDES General Permit (NCG 190000) for Ship and Boat Building and Repairing. Mr. Gilliken stated that he has been in business since 1965
and his secretary took care of all the paperwork but was now incarcerated for embezzling money from his business.
During our site inspection with the owner, proper methods of containing paint chips, storing fluids and general good housekeeping
practices were recommended, Mr. Gilliken agreed to make the changes discussed and is in the process of obtaining coverage under the
NCG 190000 General Permit.
Pat Durrett, from CAMA's Clean Marina Program, will schedule a visit to the site in order to provide guidance and a copy of the BMP
Manual. Our office will conduct a follow up inspection once the General Permit has been issued.
