I observe the basin periodically during my many project visits to Bald Head Island, with departure to and return from the island being through the Deep Point Ferry Terminal. Hurricane Florence on September 15 was obviously a very big storm event, and Southport wasn't accessible for many days afterward. The Marine Maintenance Mechanic I spoke to confirmed that the oil -water separator was at a drawdown level prior to the hurricane. As the ferry system was shut down on September 13, and the ferries securely tied off for the storm, no maintenance activities occurred during the rain event. By the time I visited Deep Point and Bald Head Island on September 26, the pond levels were back to normal, and there was no visual evidence of oily discharge. That is in the next semi-annual report, but is fresh on my mind from my October 7th and today's pond check. Summary of Analytical Monitoring: We have not had any outfall discharges since the opening of the facility. We had an environmental scientist come down after a 10+ inch rain event in 2010, and the wet pond during that tropical storm event was 8" below the outlet structure inlet invert. We have Continuously observed during significant rain events and have not observed outflow or the need for analytical monitoring. #3. We hove installed a "NPDES Benchmark" sign in the forebay of the Deep Point Marina Wet Pond 2. This sign is visible from the road/barge parking area at the marina. If the pond level is below the line on the sign, discharge is not occurring. Since Deep Point Marina is the departure/arrival point for ferry trips to Bald Head Island, members of the Bald Head Island Limited, LLC pass thru the area daily, and can look at the "benchmark sign" when there are any significant rainfalls. I personally go to the island once a week, and check the benchmark when conditions warrant. #4. In addition to the site being covered by state stormwater permit #SW8-951012, the Marine Maintenance Facility has an oil -water separator, to remove oily waste at the ferry maintenance facility. The oily waste is periodically picked up and recycled by a recycling company. The clear water outflow from the oil -water separator thence goes to the forebay of stormwater pond #2, which is in drainage area 3 of the permit. #5. This package included a check for $100 for application processing. However, our permit renewal process does not require a fee. See site plan(s). NCG 190000 is applicable to point source discharges associated with Marinas SIC (standard industrial classification) 4493 and Ship and Boatbuilding and Repairing (SIC 373), and like activities. A. Key Permit Requirements: 1. Implementation of a Stormwater Pollution Prevention Plan 2. The Deep Point Marina Site is a 76 acre site which includes the ferry terminal for the Bald Head Island Ferry, a 100 slip marina, 25 acres of parking, plus several buildings or future buildings. The subject of this permit is the Marine Maintenance Facility. The facility is located in the 7.29 acre "Drainage Area 3" of Stormwater Permit SW8-95101 Mod. 2.42 acres of impervious surface are permitted in this drainage area. 3. Basic premise of the NCG permit is for twice yearly water sampling requirement from the outlet pipe of wet pond #2's outlet structure. This sampling to be taken once between April Ist thru September 30`h, and once between October 1't and March 31"during a representative storm of 0.10" or more rainfall. THERE HAS 13EEN NO OUTFLOW FROM THE WET PEND OUTLET STRUCTURE SINCE THE FACILITY OPENED IN JANUARY 2010. THE SEPT 26-30, 2010 20+ INCH RECORD RAINFALL DID NOT CAUSE OUTFLOW. THE AUGUST 26-27, 2011 "HURRICANE IRENE" TROPICAL STORM 20+ INCH RAINFALL DID NOT CAUSE OUTFALL. THERE HAS BEEN NO OBSERVED OUTFLOW THRU THE END OF THE MARCH 31, 2012 REPORTING PERIOD. BI-I1 Deep Point Marina Marine Maintenance NPDES Stormwater Pollution Prevention Plan: 4-24-12 Bruce Marek, P.E. 4. If there is no outflow from the outlet pipe, then sampling does not have to be done. No outflow from the wet pond (►vet pond #2, stormwater drainage area #3) has been observed since the monitoring requirement began with the January 2010 opening of the Marine Maintenance Facility. The Bald Head Island Limited, LLC Planning Department and this engineer have been providing the monitoring services. Deep Point Marina is the departure site for the ferry to Bald Head Island, and wet pond #2 is in close proximity to the main ferry terminal & from the ferries. In the pond forebay, a benchmark sign has been placed indicating the water level required for outflow to occur from the discharge pipe. See attachments. 5. If the Stormwater BMP (Best Management Practices) Wet Pond does not discharge outflow for a 5 year reporting period the site may qualify for a "No Exposure Exclusion" to permitting. 6. Windspeed records have long been kept by the Transportation DepartmentlBarge Ticket Office for Ferry purposes. Rain is now being monitored for rainfall events greater than 0.10" or events that can cause outflow from the wet pond. An "NPDES Outflow Benchmark" located on a post in forebay of the wet pond, is set at same height at which pond orifice pipe discharges (i.e. causes outflow) into the outfall structure. See Included Pictures. 1" events have not even been discernable on the benchmark sign post. Water levels below the "benchmark" do not cause outflow. If water level is above the "benchmark" on day of, or first workday after a storm event, it is to be recorded into an a -file at the Bald Head Island Limited, LLC Planning Department Office on Bald Head Island. To date, there are no recordable entries. We do have one e-mail entry from Amy Conchas, REM, Environmental Department Manager for ECS Carolinas who was called in to potentially sample on August 27, 2010 after 10f inches of rain. She observed the pond water level as 8" below the pond discharge height. 7. For pond heights above the "outflow benchmark", during rain events of 0.10" or greater, further monitoring is required once per 6 month report period, at the outflow discharge pipe. 8. Use forms provided by the Division of Water Quality (DWQ) (available on their website) to record qualitative results. Lab results to be sent to DWQ within 30 days of receipt back from the lab. pH is a "Grab Sample" required to be tested within 15 minutes of collection. A pl-I meter is available in the Marine Maintenance Building for NPDES sampling purposes. Other samples are to be . collected, properly preserved and sent to a NC certified lab for analysis. Alternate method is to have outside vendor, such as ECS Carolinas, LLP 910-686-9114 (Amy Conchas --Wilmington Office) collect samples and test pH. 9. Monitoringltcsting is for pH, Oil & Grease, Total Suspended Solids (TSS), Copper, Aluminum, Lead and Zinc. 10. Submit an annual monitoring summary to the DWQ Wilmington Regional Office, 127 Cardinal Drive Extension, Wilmington, NC 28405 (910-796-7215) 11. Annually renew permit: Permit Period 4-1 thru following 3-31. Renewal Invoices are sent approximately early March. State Sessions law has automatically extended many permits, often without notice to the permitee. 12. Permit Transfers are only with notice to and approval of the Director of DWQ. Permittee is required to notify the Division within 90 Days in the event the permitted facility is sold or closed. 13. This permit is issued under a general permit. Certain conditions, not anticipated, could negate the appropriateness of the general permit and cause need to obtain an individual NPDES permit. If future changes are made to the Marine Maintenance Facility or its operations, consult on-line DWQ documents or contact DWQ Wilmington. 14. See site plan(s). NCG 190000 is applicable to point source discharges associated with Marinas SIC (standard industrial classification) 4493 and Ship and Boatbuilding and Repairing (SIC 373), and like activities. A. Key Permit Requirements: 1. Implementation of a Stormwater Pollution Prevention Plan 2, The Deep Point Marina Site is a 76 acre site which includes the ferry terminal for the Bald Head Island Ferry, a 100 slip marina, 25 acres of parking, plus several buildings or future buildings. The subject of this permit is the Marine Maintenance Facility. The facility is located in the 7.29 acre "Drainage Area 3" of Stormwater Permit SW8-95101 Mod. 2.42 acres of impervious surface are permitted in this drainage area. 3. Basic premise of the NCG permit is for twice yearly water sampling requirement from the outlet pipe of wet pond #2's outlet structure. This sampling to be taken once between April 1st thru September 30"', and once between October 1" and March 31"during a representative storm of 0.10" or more rainfall. THERE HAS BEEN NO OUTFLOW FROM THE WET PEND OUTLET STRUCTURE SINCE THE FACILITY OPENED IN JANUARY 2010. THE SEPT 26-30, 2010 20+ INCH RECORD RAINFALL DID NOT CAUSE OUTFLOW. THE AUGUST 26-27, 2011 "HURRICANE IRENE" TROPICAL STORM 20+ INCH RAINFALL DID NOT CAUSE OUTFALL. THERE HAS BEEN NO OBSERVED OUTFLOW THRU THE END OF THE MARCH 31, 2012 REPORTING PERIOD. No outflow from the wet pond (wet pond 02, storm►eater drainage area #3) has been observed since the monitoring requirement began with the January 2010 opening of the Marine Maintenance Facility. The Bald Head Island Limited, LLC Planning Department and this engineer have been providing the monitoring services. Deep Point Marina is the departure site for the ferry to Bald Head Island, and wet pond 142 is in close proximity to the main ferry terminal & from the ferries. In the pond forebay, a benchmark sign has been placed indicating the water level required for outflow to occur from the discharge pipe. See attachments. 5. If the Stormwater BMP (Best Management Practices) Wet Pond does not discharge outflow for a 5 year reporting period the site may qualify for a "No Exposure Exclusion" to permitting. 6. Windspeed records have long been kept by the Transportation Department/Barge Ticket Office for Ferry purposes. Rain is now being monitored for rainfall events greater than 0.10" or events that can cause outflow from the wet pond. An "NPDES Outflow Benchmark" located on a post in forebay of the wet pond, is set at same height at which pond orifice pipe discharges (i.e. causes outflow) into the outfall structure. See Included Pictures. 1" events have not even been discernable on the benchmark sign post. Water levels below the "benchmark" do not cause outflow. if water level is above the "benchmark" on day of, or first workday after a storm event, it is to be recorded into an a -file at the Bald Head Island Limited, LLC Planning Department Office on Bald Head Island. To date, there are no recordable entries. We do have one e-mail entry from Amy Conchas, REM, Environmental Department Manager for ECS Carolinas who was called in to potentially sample on August 27, 2010 after 10+ inches of rain. She observed the pond water level as 8" below the pond discharge height. 7. For pond heights above the "outflow benchmark", during rain events of 0.10" or greater, further monitoring is required once per 6 month report period, at the outflow discharge pipe. 8. Use forms provided by the Division of Water Quality (DWQ) (available on their website) to record qualitative results. Lab results to be sent to DWQ within 30 days of receipt back from the lab. pH is a "Grab Sample" required to be tested within 15 minutes of collection. A pH meter is available in the Marine Maintenance Building for NPDES sampling purposes. Other samples are to be collected, properly preserved and sent to a NC certified lab for analysis. Alternate method is to have outside vendor, such as ECS Carolinas, LLP 910-686-9114 (Amy Conchas —Wilmington Office) collect samples and test pH. 9. Monitoring/testing is for pH, Oil & Grease, Total Suspended Solids (TSS), Copper, Aluminum, Lead and Zinc. 10. Submit an annual monitoring summary to the DWQ Wilmington Regional Office, 127 Cardinal Drive Extension, Wilmington, NC 28405 (910-796-7215) 11. Annually renew permit: Permit Period 4-1 thru following 3-31. Renewal Invoices are sent approximately early March. State Sessions law has automatically extended many permits, often without notice to the permttce. 12. Permit Transfers are only with notice to and approval of the Director of DWQ. Permittee is required to notify the Division within 90 Days in the event the permitted facility is sold or closed. 13. This permit is issued under a general permit. Certain conditions, not anticipated, could negate the appropriateness of the general permit and cause need to obtain an individual NPDES permit. The Belville Riverlront Redevelopment project site is located along the Brunswick River directly south of U. S. Highways I7 and 74. The actions covered by the EA include maintenance excavation of an existing basin, construction of a private and public marina, and construction of the Belville Riverwalk System. The overall Riverfront Redevelopment project will include upland development that may include residential/retail structures, hotels, office space, a town hall, and a transportation hub (EA, p. 1). However, such upland development is currently "conceptual" and is not addressed in these comments. These comments are submitted in accordance with the Endangered Species Act (ESA) of 1973, as amended (16 U.S.G. 1531-1543). Table 2 of the EA lists the federally threatened or endangered species known to occur in Brunswick County. The list is accurate and -current. Considering the dredging and marina development currently under consideration, the federally protected species requiring consideration would be those using the aquatic and estuarine habitats to be impacted. The EA notes (p. 20) that the West Indian manatee (Trichechtrs manattrs), American alligator (Alligator inississippieusis), and shortnose sturgeon (Acipenser brevirostrunt) could be "potentially affected by this development." The alligator is only listed as threatened due to similarity of appearance (TSIA) with the American crocodile (Crocodv1us ar-wus) which only occur in southern Florida. The species is not biologically threatened and does not have protection under the ESA. The shortnose sturgeon (Acipenser brevirostrum) is federally endangered. However, the species is under the jurisdiction of the National Marine fisheries Service and that agency should be contacted regarding project impacts on the species. The EA states (p. 14) that manatees are usually considered in evaluating in -water work in the portion of the Brunswick River sdjaccnt to the project area. The North Carolina Natural Heritage Program (NCNHP) database has a current record for the manatee in the Wilmington quad and there is a recorded occurrence in the Cape Fear River south of the project area. The estuarine waters of the project area may provide suitable habitat for manatees that move along the Atlantic Coast and into coastal rivers during summer months and are seasonal transients in North Carolina, primarily from June through October. Manatees feed in water one to two meters (3.3 -6.6 feet) deep that may support submerged aquatic vegetation. The species moves extensively when in North Carolina waters and past occurrence records cannot be used to precisely determine the likelihood that it will be presence at a particular construction site. To protect manatees in North Carolina, the Service developed guidelines entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina," These guidelines address all types of in -water construction, except blasting, and should produce little, if any, additional expense. The guidelines are intended mainly to ensure that construction personnel are informed that manatees may occur in the work area, that work should cease if manatee approaches the work area, work should -not resume until the manatee leaves the work area, and procedures for reporting the death or injury of a manatee. The risk to manatees could be reduced to an acceptable level by the implementation of the Service's guidelines. The risk would be further reduced by performing; the work during the period of November through May. The Service is pleased that the EA recognizes (pp. 20-21) that increased vessel traffic in the Brunswick and -Cape Fear Rivers may affect federally protected species in these habitats. The proposal to encourage boaters to maintain slower speeds until reaching the [Hain stem of the Cape Fear River would reduce the chances of boats strikes on manatees. With the inclusion of our manatee guidelines, the Service would concur with a determination that the actions described in September 2009 EA are not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. However, the this determination must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner which was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. This determination applies only to proposed dredging and construction of the marina and boardwalk, The Finding of No Significant Impact (FONSI) issued by the NCDCM on September 16, 2009, addressed a project for "maintenance excavation of an existing basin and construction of a private and public marina." Additional upland development is considered "conceptual' (EA, p. 1) and "preliminary" (EA., p. 8) at this time. Any upland development can be evaluated when the nature and scope of such development has been determined. I don't see us having an objection with issuing another marina permit, we have a bunch out there now. My point in this earlier email was that it appears they propose activities (pressure washing and refinishing) that can result in problematic discharges that they didn't identify a means for proper disposal. But, since our permit doesn't cover those types of discharges, I guess we would permit them as we've done all those in the past. I just thought -we could address this concern now, rather than wait until after they are permitted to site them for improperly handling this wastewater. I know that's not the focus of our NCG190 (since it doesn't include wastewater discharges from said activities), but this is an opportunity to hear up front how they intend to handle this wastewater. WiRO has no objections to this permit. Let's see what shellfish sanitation (Patti) has to say, I think this one would be in an area where shellfishing is already closed, but marinas do have an impact on shellfishing water. We had a temp look into that last year. He went around to LOTS of marinas to see what they were doing (such as pressure washing etc) that is not allowed. He also took samples to see what materials were in the effluents of those processes_ The enforcement guys are looking into some options for some marinas right now. As for changes in how we are permitting, the permit expires next year and so it will be revised in the near future. I am sure that whoever writes it will take this study into account. But for now, you are right that the permit does not adequately provide restrictions in these areas.
