On June 20, 2018, Brian Lambe from the Wi#mington Regional Office of the Division of Energy, Mineral,
and Land Resources (DEMLR), conducted a compliance evaluation inspection for American Fish
Company and fvietal Works Oak Island located in Old Bridge Road, Brunswick County, North Carolina.
The site drains to the Intracoastal Waterway, which is currently classified as Class SA, HQW Waters in
the Cape Fear River Basin.
The following observations were noted during the DEMLR inspection (please see the attached
addendum for additional information about your permit):
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has been developed, recorded, and properly
implemented.

The boatyard has a lot of potential pollutant sources laid about the yard. No tarps were being used
under the boats for collection of pollutants. Potential exists for wastewater discharge.

of the NPIDES Stormwater General Permit may be subject to a civil penalty assessment of up to

Inspection Summary:
A notice of deficiency was issued by this office October 25, 2012. Willis noted in her notes that monitoring was due by
March 31, 2013. The stormwater pollution prevention plan (SWPPP) was to be developed a year from reciept of the notice.
Willis noted in the inspection report that time was spent educating Mr. Charles Parry on the requirements of the permit. The
site may have non permitted wastewater discharges from pressure washing.
The inspector talked with some of the mechanics on site, but Mr. Perry was not on site. No tarps were observed under the
boats. Site needs evaluation of potential pollutants with the with amount of extraneous items around the yard.

compliance with the General Stormwater Permit NCG190000. 1 trust the information provided
today will help you to understand the requirements of the permit. You indicated that the
stormwater pollution prevention plan would be written by the end of this year (December 31,
2012). Once the plan has been written, please contact me at the number provided below. You
are currently in year 4, Period 1 of the monitoring schedule (October 1, 2012 to March 31, 2013).
Please remember to conduct your analytical monitoring no later than March 31, 2013, Visual
monitoring is conducted semi annually, once during January through June and once during July
through December, therefore the next rain event would be a good time to take care of the last
half of the year 2012 requirement for visual monitoring. I would like to move your facility to a
compliant status as soon as possible. Once you have demonstrated that you are meeting the
permit requirements, 1 would be pleased to update our data base to designate your facility as

Inspection Summary:
Tommy Perry is the son of the owner (Charles Perry). Tommy asked to be made the contact person for this permit.
Charles received the notice of deficiency concerning the monitoring and stormwater pollution prevention plan
requirements. Tommy and I went through each page of the permit by section and item. I explained each of the elements
required in the stormwater pollution prevention plan and gave examples of what types of information might be provided for
each area of the plan. Also discussed the analytical monitoring and qualitative monitoring requirements. I had given Mr.
Perry a copy of the NCG190000 general permit text. Tommy indicated he had seen the permit and read parts of it. I
provided as much detail as possible to ensure Tommy understood what is required of the permittee.

Division Representative, Linda Willis, met with you on September 6, 2012, at your boat
maintenance/repair facility located in Brunswick County. Stormwater from this facility
discharges into the Intercoastal Waterway which is classified as a SA water of the State in the
Lumber River Basin.
The NPDES General Permit NCG190000 covers stormwater discharges from areas of the facility
where boat maintenance and repair activities are taking place. The permit requires that a written
stormwater pollution prevention plan be developed for the site. The permit also requires
qualitative and quantitative monitoring for the stormwater discharges from this facility. The
general permit does not authorize discharges at the facility containing waste streams including,
but not limited to, bilge and ballast water, cooling water, sanitary wastes, power and hand
washing, blasting, sanding and fish cleaning stations. A separate wastewater permit may be
required for these and other similar wastewater discharges.
During the site inspection, you indicated that stormwater runoff from areas where sanding is
occurring is being captured in a collection system that does not discharge. A copy of this
correspondence will be provided to the Aquifer Protection Section (APS) of the Division of
Water Quality. APS is responsible for permitting non discharge wastewater systems.

The following deficiencies were noted during the compliance evaluation:
1. Failure to develop a written stormwater pollution prevention plan. Part 1I, Section A of
the NPDES permit requires that a written stormwater pollution prevention plan be
developed within 12 months of receiving coverage under the general permit.
2. Failure to conduct qualitative and quantitative monitoring for stormwater discharges from
the facility. Part 11, Section B of the NPDES permit requires that a visual inspection
(Qualitative) be conducted semi annually for stormwater discharges from this facility. It
also requires analytical (quantitative) monitoring of the discharges on a semiannual basis.
The samples must be analyzed by a state certified laboratory.
Please ensure that the deficiencies noted above are corrected. Enclosed is a technical bulletin
that helps to explain the requirements of the permit. Also included is a name/ownership change
form, since you had indicated to the Division Representative that the name of the business has
changed. Also included is a list of state certified analytical laboratories.

In response to your renewal application for continued coverage under stormwater General Permit NCG190000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.)
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG190000
• A copy of a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the
changes in the reissued permit.
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Permit cover page — Coverage is expanded to include industrial activities similar to the categorically identified industries.
• Part I Section A — This part explains that the No Exposure Exclusion from permitting option may be available to the permittee.
• Part II Section A — Several minor expansions and clarifications of the required content of the Stormwater Pollution Prevention
Plan have been added. Also, there is an added requirement for a Solvent Management Plan. Please be sure that your plan is
updated to comply with the new requirements.
• Part II Section B - Revised provisions require that stormwater discharges be sampled twice per year, and that the sampling
results be compared to new numerical benchmark values. (The previous cutoff concentrations have been eliminated.)
• Part II Section B — Monitoring for some metals has been added to the analytical monitoring requirements.
• Part 11 Section B — Beginning with monitoring in Year 3-Period 1, revised provisions require the permittee to execute Tier One
and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark
exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring,
until three consecutive monitoring events show no benchmark exceedences.
• Part 11 Section B — Beginning with monitoring in Year 3-Period 1, this part contains a new provision that four exceedences of
any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control
actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of
specific stormwater control measures.
• Part 11 Section C — Qualitative monitoring must now be conducted during a representative storm event.

• Part II Section C — The permittee is required to keep a written record of his response to problems identified by his qualitative
monitoring observations.
• Part III Section E — Items 1. and 2. require submittal of a new reporting form, the Annual Summary DMR. This annual
summary of only the analytical monitoring results should be submitted to the local DWQ Regional Office. The Annual
Summary DMR reporting form will be posted on the Stormwater Permitting Unit's website in the near future.
Your coverage under the General Permit is transferable only through the specific action of DWQ.
This permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it relieve the
permittee from responsibility for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order,
judgment, or decree.
