The site drains to the Intracoastal Waterway, which is currently classified as Class SA, HQW Waters in the Cape Fear River Basin. The following observations were noted during the DEMLR inspection (please see the attached addendum for additional information about your permit): 1) Stormwater Pollution Prevention Plan (SPPP) A Stormwater Pollution Prevention Plan (SPPP) has been developed, recorded, and properly implemented. Willis noted in her notes that monitoring was due by March 31, 2013. The stormwater pollution prevention plan (SWPPP) was to be developed a year from reciept of the notice. Willis noted in the inspection report that time was spent educating Mr. Charles Parry on the requirements of the permit. The site may have non permitted wastewater discharges from pressure washing. The inspector talked with some of the mechanics on site, but Mr. Perry was not on site. No tarps were observed under the boats. Site needs evaluation of potential pollutants with the with amount of extraneous items around the yard. Brunswick County Division Representative, Linda Willis, met with you on September 6, 2012, at your boat maintenance/repair facility located in Brunswick County. Stormwater from this facility discharges into the Intercoastal Waterway which is classified as a SA water of the State in the Lumber River Basin. The NPDES General Permit NCG190000 covers stormwater discharges from areas of the facility where boat maintenance and repair activities are taking place. The permit requires that a written stormwater pollution prevention plan be developed for the site. The permit also requires qualitative and quantitative monitoring for the stormwater discharges from this facility. The general permit does not authorize discharges at the facility containing waste streams including, but not limited to, bilge and ballast water, cooling water, sanitary wastes, power and hand washing, blasting, sanding and fish cleaning stations. A separate wastewater permit may be required for these and other similar wastewater discharges. During the site inspection, you indicated that stormwater runoff from areas where sanding is occurring is being captured in a collection system that does not discharge. A copy of this correspondence will be provided to the Aquifer Protection Section (APS) of the Division of Water Quality. Failure to develop a written stormwater pollution prevention plan. Part 1I, Section A of the NPDES permit requires that a written stormwater pollution prevention plan be developed within 12 months of receiving coverage under the general permit. 2. Failure to conduct qualitative and quantitative monitoring for stormwater discharges from the facility. Part 11, Section B of the NPDES permit requires that a visual inspection (Qualitative) be conducted semi annually for stormwater discharges from this facility. It also requires analytical (quantitative) monitoring of the discharges on a semiannual basis. The samples must be analyzed by a state certified laboratory. Please ensure that the deficiencies noted above are corrected. Enclosed is a technical bulletin that helps to explain the requirements of the permit. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.) The more significant changes in the General Permit since your last Certificate of Coverage include the following: • Permit cover page — Coverage is expanded to include industrial activities similar to the categorically identified industries. • Part I Section A — This part explains that the No Exposure Exclusion from permitting option may be available to the permittee. • Part II Section A — Several minor expansions and clarifications of the required content of the Stormwater Pollution Prevention Plan have been added. Also, there is an added requirement for a Solvent Management Plan. Please be sure that your plan is updated to comply with the new requirements. • Part II Section B - Revised provisions require that stormwater discharges be sampled twice per year, and that the sampling results be compared to new numerical benchmark values. (The previous cutoff concentrations have been eliminated.) • Part II Section B — Monitoring for some metals has been added to the analytical monitoring requirements. • Part 11 Section B — Beginning with monitoring in Year 3-Period 1, revised provisions require the permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences. • Part 11 Section B — Beginning with monitoring in Year 3-Period 1, this part contains a new provision that four exceedences of any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control measures. • Part 11 Section C — Qualitative monitoring must now be conducted during a representative storm event.
