Boat washing clean up

In response to criticism and strengthening state guidelines, Marina Max made the decision to invest in a
water recycling system as a solution for the wastewater runoff created by its boat pressure -washing
operations.
Marine Max has been scrutinized by local environmental watchdogs for its pressure- washing operations,
which has allowed wastewater flow into Motts Channel. Runoff water from boat pressure washing can
contain heavy metals toxic to marine life.
The marina invested in a wastewater recycling system from Clean Marine Solutions last week. The
machine captures wastewater from boat pressure washing, removes harmful pollutants and recycles the
water. The recycling system would make Marine Max compliant with state environmental regulations.
"We would like to continue the standard method [of boat washing] within the industry," said Thom Cross,
Marine Max manager. "This piece of equipment allows us to do that and meet the requirements for the
state."
In the past, eyewitnesses have seen the wastewater draining into Motts Channel from Marine Max's
pressure -washing operation. Some sent complaints to town of Wrightsville Beach officials and to
NCDENR, which caused the state to observe the pressure -washing operation during a routine stormwater
permit inspection earlier this summer.
The NCDENR sent Marine Max a notice for violating its stormwater permit along with educational
materials about marine wastewater recycling.
Marine Max has been considering investing in Clean Marine Solution's system for several weeks, but
Cross was hesitant to comment about the purchase until a final decision had been reached.
"These guys have really made a concerted effort to comply with the regulations," said David Flagler,
founder of Clean Marine Solutions.
NCDENR has been criticized by the local marinas for not providing strong enough direction about how to
manage wastewater to comply with state regulations. Cross said he believes the issue is more clearly
defined now than it has been in the past.
"As marinas, we all operate very similarly and we interpret what we should be doing maybe differently," he
said. "At this point in time, it has become more clearly defined to us as a company and we are acting
upon that definition."
The new system has not been permanently installed, but Marine Max is currently using it during its boat -
washing operations. So far, the machine has met Cross' expectations. The marina is currently trying to
determine the best location for the machine so that plumbing for the system can be installed.
That state is scheduled to inspect the new system on Friday, Aug. 3, and will discuss what permitting
requirements will be involved, said Jim Gregson, surface water protection supervisor for NCDENR,
The basic recycling system from Clean Marine Solutions starts at $13,000, Flagler said. Marinas also
purchase a containment pad, which catches the wastewater, and that is an additional cost of $5,000,
Marine Max will be the fourth business in North Carolina to buy into the Clean Marine Solution system.
Cross said the wastewater recycling system was the best option for Marine Max in handling the
wastewater issue, but it may not be the best solution for every marina.
"The only messaae that I would send is that each individual marina needs to investioate what thev need to
do on their own," Cross said. "In our case we felt that it was the right thing to do to invest in this system."

In response to your letter dated July 1 ] 2012, we offer the following:
MarineMax has contracted with us to assist them with NPDES General Permit NCG190000
compliance, and to address your concerns indicated during Jean Conway's inspection on June 5
2012. Specifically, MarineMax has contracted with us to perform the following NPDES General
Permit NCG 190000 tasks:
1. Update the Stormwater Pollution Prevention Plan. A generic SWPPP was developed for
MarineMax during the 2004-2009 permit term and is kept on site. We agree that past
inspections, monitoring, and training were either not performed or properly documented.
The updated SWPPP will contain appropriate forms and checklists to aid in documenting
compliance activities. Instruction for Permit and SWPPP compliance will be included in
the Task 5 workshop.
2. Collect & Analyze stormwater discharge samples during the second half of this. year.
There are three (3) point source discharges (outfalls) at this facility. We will submit a
Representative Outfall Status (ROS) request form in order to reduce the number of
outfalls subject to monitoring.
3. Conduct Qualitative Monitoring of stormwater discharge samples during the second half
of this year. All three outfalls will be visually observed during a representative rainfall
event.
4. Conduct a semi-annual site inspection during the second half of this year. The inspection
report will be maintained in the SWPPP binder at the facility.
5. Develop & Provide an employee training workshop on SWPPP compliance. The initial
workshop will be intended for the members of the SWPP Team. Team members will
then provide appropriate training regarding stormwater pollution prevention, good
housekeeping, and spill prevention to the other employees. RECEIVED

MarineMax appreciates; the opportunity to respond to the concerns set out in your
correspondence, to assure compliance with the NPDES Stormwater permitting program,
MarineMax takes the protection of our environment seriously and we are committed to
preserving and protecting North Carolina's water and marine life, as well as fully cooperating
with your office.
MarineMax conducted a full investigation in response to your letter and the following are the
corrective actions and information you requested related to each of the issues:
1. Failure to develop and implement a Stormwater Pollution Prevention Plan.
Corrective Action: On July 19, 2012, we retained Stormwater Services Group, LLC
(SwSG) whose address is 8916 Oregon Inlet Ct., Raleigh. North Carolina 27603, phone:
(919) 661-9954, fax: (919) 661-8108, a company that specializes in writing Stormwater
Pollution Prevention Plans in our.industry. They conducted a site inspection today and
;twill reviewtand update our current:plan.to-reflect any .changes -in our facility and add
new BMP technologies. SwSG will provide a schedule for implementation and the

analytical monitoring, reporting, and maintaining proper records. As stated above,
Stormwater Services Group, LLC has been retained and will conduct this
sampling. Following analysis by the lab, the results will be reported pursuant to Part II1,
Section E.
3. Failure to Conduct Qualitative Monitoring
Corrective Action: Staff has been instructed on the importance of compliance with
qualitative monitoring and maintaining proper records. As stated above.
Stormwater Services Group, LLC has been retained and will conduct this
sampling as specified in General Permit.
During the site inspection, the inspector also provided guidance and made recommendations for
acceptable practices for handling wastewater from vehicle washing and maintenance. As a result
of those suggestions, we retained Clean Marine Solutions (CMS) located at 2925-31 Boundary
Street, Wilmington, NC 28405, phone (910) 617-8018. As of last week, CMS has installed an
U1traTech Rapid -Rise Wastewater Containment Berm. This is a temporary solution to contain,
manage and store boatwash wastewater while the permanent 2012 Vanish 300 Wastewater
Treatment System is being constructed and installed. The Vanish 300 system is expected to be
installed within 30 days.

On ,tune 5, 2012, staff from the Wilmington Regional Office of the Division of Water Quality
conducted a site inspection of MarineMax in Wrightsville Beach, NC. This inspection was conducted to
determine if the facility is operating in compliance with the conditions specified in NPDES General
Stormwater Permit NCG190000. During the inspection, informational guidance and recommendations
regarding acceptable practices for vehicle washing and maintenance, as well as the BMP Manual for NC
Marinas was presented to the general manager. A full copy of the NCG 190000 permit may be.obtained

Please find attached a copy of the Industrial Stormwater Inspection Report, which indicates the
findings of the inspection and a summary of compliance issues. The facility was determined to be
noncompliant with conditions of the permit.
As a result, the following violations were noted:

Failure to Conduct Analytical Monitoring (Part I. Section B)
Analytical monitoring of stonnwater discharges shall be performed as specified in Table 1. SaITIpling
results shall be reported as described in Part IIl, Section E.
Failure to Conduct Qualitative Monitoring (fart 1. Section Q
Qualitative monitoring requires a visual inspection of each stormwater outfall regardless
of representative outfall status; and shall be performed as specified in Table 4.
Please be advised that this General Permit does not allow discharges determined by the Division
of Water Quality to be wastewaters. 'The discharge and/or disposal of vehicle wash water or vehicle
rinse water is not permitted by this General Permit. Wash water and rinse water should be directed to
a sanitary sewer system or permitted by a separate wastewater permit issued by the Division. The
discharge and/or disposal of any paints, solvents, petroleum, diesel oil or oil/water compounds applied to
any surface of the vehicles are not permitted by this General Permit.
Accordingly, you are directed to respond to this letter in writing within 10 calendar days of receipt
of this Notice. Your response should be sent to this office at the letterhead address describing the
actions to be taken to achieve compliance and a schedule for accomplishing these actions.
Thank you for your attention to this matter. This office requires that the violations, as detailed
above, be abated immediately. These violations and any future violations are subject to a civil
penalty assessment of up to $25,000.00 per day for each violation. Should you have any questions

Inspection Summary:
Met with the general manager and shop'supervisor to discuss permit compliance requirements, BMP implementation and
issues pertaining to vessel washing and repair procedures.
- No SPPP Plan has been developed
- No qualitative or analytical monitoring being conducted per permit requirements
- Boat pressure washing was not observed during site visit but a pressure washer machine was observed underneath a
boat on the Travelift and the manager confirmed that boats are power washed on the lift in area located adjacent to Motts
Channel. He stated that the waste water along with any solids and boat scrapings are power washed directly into the
waterway with no BMPs employed before being discharge into Molts Channel.
- Drainage for the majority of the vessel repair, maintenance and washing activity discharge to the boat lift area_ An oil
sheen was observed in the runoff from this outfall.
- Open paint containers and oii pans observed under boats being maintained and repaired without the use of tarps or
other BMPs.
-There may be a second outfall from a storm drain located on the east side of the facility where boats are being stored
The manager will investigate where this drainage discharges.

state — NPDES general permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit
are unacceptable to you, you have the right to request an individual permit by submitting an
individual permit application. Unless such demand is made, this certificate of coverage shall be
final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality.- The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, Coastal Area Management Act or any other

The North Carolina Division of Water Quality conducted an inspection of Marine Max on May 11, 2006.
This inspection was conducted to determine if the facility is operating in compliance with the conditions and
requirements specified in NPDES General Permit Number. NCG190000. Upon'arrivai, Wes Hare, of this office,
met with the Carolina District Manager, Mr. John Gaffney. it was stated that all environmental permitting issues
were handled through you and no documentation was provided. It was later confirmed that this facility did not
hold said permit. This facility is operating without a permit and will need to be permitted immediately.
Please find the attached copy of the Industrial Stormwater Inspection Report, which indicates the
findings of the inspection and a summary of compliance issues. A Stormwater Pollution Prevention Plan has
not been developed for the facility and monitoring is not being done. Within ten days of receipt of this notice,
please submit a letter that describes the actions to be taken to achieve compliance and presents a schedule
for achieving these actions.

Vehicle/Equipment Maintenance Area:
Mechanical work is performed both indoors and out on the paved area surrounding the building. No
containment areas/apparatus were observed. Any work should be performed in such a way that any waste
material should be collected and disposed of properly. This includes hull scraping, sanding and washing.
Vehicle/Equipment Wash Area:
All washing is done outdoors. Water sheet flows offsite to adjacent waterway. Any work should be performed in
such a way that any waste material should be collected and disposed -of properly. This includes hull scraping,
sanding and washing. Boat hull washing generates a wastewater that exceeds Surface Water Standards and
must be properly handled so as to prevent direct discharge.
Temporary Storage of Waste Materials:
Waste material storage is indoors, protected from rainfall.
Outdoor Storage of Materials:
It appears only boats are stored outdoors.

Summary:
This facility does not have a permit. An NCG190000 permit shall be obtained and followed. The development
of an SwPPP is a requirement of that permit. Be aware that any discharge of this wastewater is in violation of
NCGS 143-215.1, et al. Alternative systems should be investigated to prevent the direct discharge of
washwater to the waterway. Ali maintenance, repairs, etc. shall be performed in such a way that any waste
material can be collected and disposed of properly.

The stormwater permittingprogram's objective is to
reduce the pollutant load in stormwater runoff bv:
1- Educating the permitted community about stormwater
pollutants,
2- Encouraging the use of Best Management Practices
(BMPs) to minimize the entry of pollutants into
stormwater, and
3- Using collected analytical data to assess stormwater's
contribution to water pollution to help prioritize
controls in problem areas.
Changes in Reissued General Permit
Several important changes from the previous version of
this general permit are:
• Revision to the parameters list in analytical
monitoring (Lead and MBAS removed from Table
1).
• The definition of the Representative Storm Event for
the analytical monitoring has changed (see the
definitions section of the permit) and the sample
window of April through November has been
dropped.
• Discharge Monitoring Reports should be submitted to
the Division of Water Quality within 30 days of the
date the facility receives the laboratory results
instead of waiting until the end of the year.
Key Permit Requirements
❑ Implementation of a Stormwater Pollution Prevention
Plan (SPPP) (Part II, Section A).
❑ Provide secondary containment for all bulk storage of
liquid materials. (Part 11, Section A: 2. (b)).
❑ Perform annual analytical monitoring and submit the
results on the monitoring report forms. (Part 11. B). Oil
and Grease and New Motor Oil Usage monitoring is
only required for those facilities which perform
maintenance activities including mechanical repairs,
painting and/or fueling.
❑ Perform and document semi-annual qualitative
monitoring. (Part 11, Section C).
Obtaining Representative Outfall Status
If a facility has more than one stormwater outfall then the
permit requires that all outfalls subject to the permit be
monitored. However, the permit also allows for the facility
to request "Representative Outfall Status". Representative
outfall status allows the facility to perform analytical
monitoring at a reduced number of outfalls. Application is
made by a letter to the Stormwater and General Permits
Unit clearly explaining which outfall(s) is/are to be
considered representative of other discharges from the site.
A copy of the site map used in the SPPP that delineates
drainage areas, industrial activities, and any other potential
stormwater pollutant exposures shall be included with the
letter to support the application.
BMP's
The Stormwater Pollution Prevention Plan should include
the use of Best Management Practices (BMP's) to control
the discharge of pollutants from a facility's stormwater
outfalls. BMP's include a variety of things that the
industrial facility can do in order to minimize the potential
for pollutants to get into the stormwater draining from a
facility. The following outlines some potential types of
BMP's.
Non -Structural BMP's
Some examples of non-structural (practices or activities)
BMP's are as follows:
• Eliminate exposure of materials and. equipment
wherever possible by moving materials and equipment
to indoor locations.
• A very effective and cost effective BMP is to practice
good housekeeping on -site. Keep materials handled
and stored at the facility in an orderly fashion.
• Examine process and exchange hazardous materials for
non -hazardous ones wherever possible.
Establish routine leak and maintenance checks to
minimize the chance of spills before they occur. When
spills do occur, clean them up immediately.
• Establish bulk storage tank protocols that minimize the
risk of spills during loading and unloading procedures.
• Store used pallets and process waste dumpsters inside
or under a roof where water cannot flow on or around
them.
Structural BMP's
Some examples of structural (equipment or devices) BMP's
are as follows:
• Build containment dikes around the loading areas of
bulk liquid storage containers.

• Where practical, change painting operations from liquid
systems to powdered systems that don't generate
solvent wastes.
• Build roofs and secondary containment around any
materials stored outside so that stormwater doesn't run
onto them and carry pollutants away with it.

Commonly asked questions
1) Do all stormwater outfalls need to be analytically
monitored?
Only those outfalls that drain areas of the facility associated
with the industrial activity need to be monitored. Also, see
previous discussion on representative outfall status.
2) What happens if when I pull samples for my annual
analytical monitoring I'm unable to get a sample for
one of the parameters?
If this happens it is fine to go ahead and just sample for the
missing parameter during the next representative storm
event, just be sure to note the total rainfall, event duration,
and total flow apart from the initial monitoring data.
3) Does a certified lab need to be used to analyze
stormwater samples?
Yes, a North Carolina certified lab must be used to perform
analytical monitoring. The only exception to this rule is
when measuring the value of pH. pH values should be
measured in the field because they may change considerably
between when the sample is pulled and it is analyzed at the
laboratory.
4) How do you average the first year's analytical
monitoring results?
The measured concentration of a particular pollutant
collected during the first year's analytical monitoring is the
average value for that parameter since dividing it by one
gives the same value for cut-off purposes.
5) What If I Sell My Business Or The Name of My
Business Changes ?
The Division considers changes in name or ownership as
a minor modification and requires the Director's approval.
Name and ownership changes require you to complete a
Name/Ownership Change Form SWU-239. The forms
are available by contacting the Stormwater and General
Permits Unit at (919) 733-5083.
6) What Do I Do When My Stormwater Permit
Expires?
In the State of North Carolina, the Stormwater General
Permit is in force and effect and covered facilities are
allowed to continue discharging under the permit until
the general permit is reissued or a new general permit is
issued.
