A visit was made to Wilmington Marine Center on January 13 2005, because it was determined that the facility is
not currently covered under General Stormwater Permit NCG190000 We discussed the activities at the facility and took
a brief walk around the site Space is leased to several companies that operate marine repair sales, and maintenance
businesses The site is mostly graveled with some vegetated strips around the perimeter A travel lift is utilized for
removing boats from the water for maintenance and a marine railway is located on the site for maintenance of larger
vessels Some hull preparation and painting are done outside and most mechanical repair and maintenance is done
within a shop building Docking spaces are provided within the associated boat basin which provides access to the Cape
Fear River
These activities result in the site being subject to coverage under General Stormwater Permit NCG190000 and
the marine railway and several areas along the bulkheaded shoreline function as stormwater outlets Areas of concern
noted during the site visit were the power washing of hulls coated with antifouling paint, lack of collection during hull
sanding, outside storage of batteries, and lack of security on outlets from secondary containment structures It Is
understood that you will submit the Notice of Intent for coverage under the permit These noted activities will then be
addressed through implementation of Best Management Practices as directed by the conditions of the permit
A copy of the Notice of Intent is enclosed for your use Please call me if you wish to discuss this matter further

The Division o oas a anagement hereby acknowledges receipt of your application for State approval for
development of your property located at 3410 River Road, in Wilmington, NC It was received complete on
December 20, 2004, and appears to be adequate for processing at this time The projected deadline for making a
decision is March 3, 2005 An additional 75-day review period is provided by law when such time is necessary to
complete the review If you have not been notified of a final action by the initial deadline stated above, you should
consider the review period extended Under those circumstances, this letter will serve as your notice of an extended
review However, an additional letter will be provided on or about the 75th day
If this agency does not render a permit decision within 70 days from December 20, 2004, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project
Such a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of
your proposed development You should post this notice at a conspicuous point along your property where it can be
observed froin a public road Some examples would be Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property, or at a point along the road right-of-way where a private road would lead one
into your property Failure to post this notice could result in an incomplete application
A field report has been prepared and is in the process of being circulated to the various state and federal review
agencies for their comments If additional information is required based on this review, the agencies may contact you
directly

On Febniary 25, 1999, staff members of this office investigated a complaint regarding tine
discharge of oil at Cape Fear Yacht Sales While at the site it was observed that boats are pressure
washed on a sandy site adjacent to the bulkheaded shoreline Samples were taken of water which
was ponded within the washing area It is anticipated that wash water from tills operation can
readily enter the adjacent surface waters by overland flow or by discharge through the sand and
the bulkhead The values for heavy metals are presented below

As you can see, these values are far in excess of the Water Quality Standards for Saltwater
Action must be taken to reduce this threat to groundwater and surface water quality Please
submit a plan of action for implementing a method of handling waste generated from washing
boats and preparing hulls for painting This plan must be submitted by September 1, 1999 A
copy of the laboratory report is enclosed as well as a "Best Management Practices" guidance
prepared by North Carolina Marine Trade Association Please call me if you wish to discuss this
