The site drains to Topsail Sound, which is currently classified as Class HQW, SA Waters in the White Oak River Basin. The following observations were noted during the DEMLR inspection (please see the attached addendum for additional information about your permit): 1) Stormwater Pollution Prevention Plan (SPPP) A Stormwater Pollution Prevention Plan (SPPP) was not available for review during inspection. Mr. Lambe spoke to Chris Bubin on May 9, 2019. Bubin said that he has developed the SPPP, but it needs to be updated and implemented. Yes ❑ No ■ Other Observations: • Powerwashing must be conducted within the rules of the state as it is considered wastewater and cannot be discharged into waters of the state. Provide and clearly mark a designated wash down and pressure washing area with an impermeable surface that does not drain to surface waters, or direct wastewater over land and cause infiltration into groundwater. Process wastewater must be collected pretreated and directed to a sanitary sewer, permitted through non -discharge means such as recycling, or hauled off for proper disposal be a licensed contractor. Discharge to a septic system is prohibited. • Protocols for scraping and painting must be followed. Work must be conducted over an impervious surface (concrete pad or plastic tarps) so that waste material can be collected prior to entering Stormwater stream, • Liquid management needs to be reviewed. I spoke with a Chris Boben (sp?) of Anchors Away Boatyard in Hampstead and gave him your name for additional guidance for improving his boatyard. He is in the process of compiling a SWPPP and beginning his monitoring after a non -compliant, first inspection by Linda Willis. He seems like he is really trying to do the right thing in dealing with his boatwashing and I told him that you may be able to help with some good ideas, BMPs, etc. Apparently, the neighboring boatyard -Boatyard of Hampstead, is not permitted and has issues that affect Anchors Away (runoff and airborne paint produces). We will schedule a visit them to try to get them under our permit as well. Anyway, just wanted to give you a heads up in case he calls. Give me a call if you want more details. The inspection was conducted to determine compliance with the NPDES General Stormwater Permit NCG190000. In accordance with Division of Water Quality directives, technical assistance was provided concerning the permit requirements. As follow up, I am hereby providing you with a copy of the certified laboratories in the State. You should select one of the laboratories from this list to perform the analytical testing. While on site, a representative outfall was identified that shall serve as the outfall from which you will collect your stormwater samples for analyses. The representative outfall is located at the northeast corner of your site next to the concrete boat pad which is directly adjacent to the waterway. Please remember, you will still need to conduct qualitative monitoring on all outfalls leaving the site. A website with an interactive template was provided to you via email, just recently, to help aid you in developing a written Stormwater Pollution Prevention Plan. Further assistance can be provided to you should you have any questions concerning the development of the plan utilizing this tool. You are requested to begin monitoring your outfalls in accordance with the permit effective immediately. You are hereby granted 3 months in which to complete the stormwater pollution prevention plan. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.) The following information is included with your permit package: • A new Certificate of Coverage • A copy of stormwater General Permit NCG19000G • A copy of a Technical Bulletin for the General Permit • Five copies of the Discharge Monitoring Report (DMR) Form • Five copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. The more significant changes in the General Permit since your last Certificate of Coverage include the following: • Permit cover page — Coverage is expanded to include industrial activities similar to the categorically identified industries. • Part I Section A — This part explains that the No Exposure Exclusion from permitting option may be available to the permittee. • Part II Section A — Several minor expansions and clarifications of the required content of the Stormwater Pollution Prevention Plan have been added. Also, there is an added requirement for a Solvent Management Plan. Please be sure that your plan is updated to comply with the new requirements. • Part II Section B - Revised provisions require that stormwater discharges be sampled twice per year, and that the sampling results be compared to new numerical benchmark values. (The previous cutoff concentrations have been eliminated.) • Part II Section B — Monitoring for some metals has been added to the analytical monitoring requirements. • Part II Section B — Beginning with monitoring in Year 3-Period 1, revised provisions require the permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences. • Part II Section B — Beginning with monitoring in Year 3-Period 1, this part contains a new provision that four exceedences of any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control measures. • Part 11 Section C — Qualitative monitoring must now be conducted during a representative storm event. • Part 11 Section C — The permittee is required to keep a written record of his response to problems identified by his qualitative monitoring observations. This inspection was conducted to determine if the facility is operating in compliance with the conditions and requirements specified in NPDES General Permit Number NCG190060. Upon arrival, Wes Hare, of this office, met with Mr. Banks Hasque. During the file review, it was determined a Stormwater Pollution Prevention Plan (SwPPP) had not been developed. This is a requirement of the permit and a Plan should be implemented. Please find the attached copy of the Industrial Stormwater Inspection Report, which indicates the findings of the inspection and a summary of compliance issues. A Stormwater Pollution Prevention Plan has not been developed for the facility and monitoring is not being done. Within ten days of receipt of this notice, please submit a letter that describes the actions to be taken to achieve compliance and presents a schedule for achieving these actions. Any work should be performed in such a way that any waste material should be collected and disposed of properly. This includes hull scraping, sanding and washing. Boat hull washing generates a wastewater that exceeds Surface Water Standards and must be properly handled so as to prevent direct discharge. Temporary Storage of Waste Materials: Waste material storage is outdoors. Materials/containers should be properly labeled and stared in such a way that they are protected from rainfall. Outdoor Storage of Materials: It appears lift equipment, boats and waste fluids are stored outdoors. Spill Response and Clean-up Program: Unknown. No documentation was presented. Erosion Control On Site: This site is largely gravel. No erosion problems were noted. Illicit Discharge Elimination: All pressure washing occurs on a concrete pad where vessels are pulled out of the water for maintenance. Washwater flows to a drain, which is then discharged to the adjacent waterway. Wastewater Treatment Facilities: This facility had apparatus to filter large solids at the outfall. This will not, however, prevent discharge of soluble materials. Stream Impacts/Results of Sampling: Stream impacts are not known, as no sampling occurred. No discharge was occurring during the inspection. Continued... r' Summary: This facility holds permit NCG190060. The development of an SwPPP is a requirement of that permit. Be aware that any discharge of wastewater is in violation of NCGS 143-215.1, et al. Alternative systems should be investigated to prevent the direct discharge of washwater to the waterway. Outdoor Storage of Materials: It appears lift equipment, boats and waste fluids are stored outdoors. Spill Response and Clean-up Program: Unknown. No documentation was presented. Erosion Control On Site: This site is largely gravel. No erosion problems were noted. Illicit Discharge Elimination: All pressure washing occurs on a concrete pad where vessels are pulled out of the water for maintenance. Washwater flows to a drain, which is then discharged to the adjacent waterway. Wastewater Treatment Facilities: This facility had apparatus to filter large solids at the outfall. This will not, however, prevent discharge of soluble materials. Stream Impacts/Results of Sampling: Stream impacts are not known, as no sampling occurred.
