We are working on making it a simpler process to change the person legally responsible for the permit when there has
been a management change (as in your case). We may introduce a new form here soon and accept them electronically.
In the meantime, please fill out the Name -Ownership Change form with just the applicable information. Part III, (a.)
reason for change & (c.) the person who is the current Commander Sector Field Office Fort Macon, In Part Ill. (a.), let us
know that you are correcting the Owner Affiliation attached to this permit because it was inappropriate (contractor and
not permit -holder) at the time it was set up. Please mail the form to us so we have the signed record of the change. if
you want to email me the person's name, number, and e-mail contact, I can get the update entered into the system.
Because you are the permittee, just sign the PERMITTEE certification on the second page. I apologize for making it a
rather burdensome process for a simple update. We will work to make this much more straightforward in the future.

We do have to have a person as the designated Owner Affiliation, but I will look into your question about what we'll
require each time that legally responsible person changes just because of a new supervisor. If the original owner was a
contractor, I'd recommend that you go ahead and fill out a Name/Ownership change form with the correct information
for owner/Legally Responsible person so we can get that corrected. I will get back to you next week about procedure
for futur6 changes,

On October 28, 2013, staff from the Wilmington Regional Office of the Division of Energy,
Mineral and Land Resources (DEMLR), conducted a site inspection for the tract/project known
as US Coast Guard -Fort Macon Marina located in Carteret County, North Carolina.
A review of the file by DEMLR staff revealed that the subject project is covered by NPDES
Stormwater General Permit — NCG 190034._. _The marina is currently under Notice of Violation
circa February 12, 2013. The inspection of the site revealed that all permit conditions are
currently in compliance with the permit.
Thank you for your assistance and cooperation during this inspection. As noted in the attached
inspection report, you should continue to make efforts in reducing the copper results by using all
available best management practices.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under
the federal Clean Water Act and then delegated the program to the NC Department of
Environment and Natural Resources (NCDENR). As of August 1, 2013, the Division of Energy,
Mineral and Land Resources (DEMLR) manages the implementation of this program for
NCDENR. The NPDES permitting program for stormwater discharges was established in 1990.
Phase I focuses on site and operations planning to reduce pollutant sources.
Through the NPDES permitting program, industrial facilities that fall into one of the subject ten
categories are required to obtain permit coverage under a general permit or an individual permit,
depending upon the facilities SIC code and the industrial activity occurring at the facility. There
are currently 19 active general stormwater pernuts in North Carolina. One condition that is
applicable to both the general permits and individual stormwater permits is the requirement to
develop and implement site -specific comprehensive stormwater pollution prevention plans
(SPPP). These plans are required to include a comprehensive evaluation of the site and
operations to reduce pollutant sources and prevent pollutant discharge.

discharge monitoring forms, and a Notice of Intent [which is the application of for coverage
under a NPDES General Stormwater Permit] can be found at this web site.
The following items are a subset of permit requirements and are listed to assist you and help
bring your attention to certain permitting issues, process and condition requirements of your
permit. Please see the above mentioned web site in order to obtain a copy of the permit such that
you may fully comply with all the conditions therein. Failure to properly comply with
conditions of the permit, like those bulleted below, constitutes violations and are subject
civil penalty assessment of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain
permit coverage under a general NPDES stormwater permit or an individual NPDES
stonnwater permit
• All persons desiring to have facilities covered by a, General Permit must register with the
Division of Energy, Mineral and Land Resources (DEMLR) by the filing of a Notice of
Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior
to any discharge of stormwater associated with the industrial activity, process
wastewater, and/or mine dewatering.
• Once the Notice of Intent is received, DEMLR will review and determine whether a
Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the
facility is covered by the General Permit. That is, the permittee is authorized to discharge
stormwater, process wastewater, and/or mine dewatering pursuant to the type of General
Permit until the permit expires or is modified or revoked.

Any other point source discharge to surface water of the state is prohibited unless it is an
allowable non-stormwater discharge or is covered by another permit, authorization or
approval.
• There are currently 19 active general permits. Permit conditions vary accordingly;
however, most of the permits have following condition requirements (you must read your
entire permit to ensure full compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the
facility along with the Stormwater Pollution Prevention Plan. Copies of the
analytical monitoring results shall also be maintained on -site. The Permittee
shall retain records of all monitoring information, including all calibration and
maintenance records and all original strip chart recordings for continuous
monitoring instrumentation, and copies of all reports required by this general
permit for a period of least 5 years for the date of the sample measurement, report
or application.
o Expiration — The permittee is not authorized to discharge after the expiration date
of the general permit. In order to receive automatic authorization to discharge
beyond the expiration date, the permittee shall submit forms and fees as are
required by the agency authorized to issue permits no later than 180-days prior to
expiration date. Any permittee that has not requested renewal at least 180 days
prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested renewal at least 180 days prior to expiration, will
be subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general
permit is not transferable to any person expect after notice to and approval by the
Director. The Director may require modification or revocation and reissuance of
the Certificate of Coverage to change the name and incorporate such other
requirements as may be necessary under the Clean Water Act. The Permit is
NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to
notify the Division in writing in the event the permitted facility is sold or closed.
The Division of Energy, Mineral and Land Resources views changes of name or
ownership as a modification that requires the Director's approval and reissuance
of the permit. Name and ownership changes required you to complete a
Name/ownership Change Form from the Division and mail it back to the along

The United States Coast Guard (USCG) is in receipt of the Notice of Violation (NOV), NOV-
2013-PC-0041, dated February 22, 2013. The NOV resulted from a site inspection of USCG
Sector Field Office -Fort Macon (hereinafter, "SFO Fort Macon" or "Unit") in Atlantic Beach,
North Carolina, on February 06, 2013. The NOV was issued for three specific reasons: (1)
failure to develop and implement a Stormwater Pollution Prevention Plan (SWPP), (2) failure to
conduct analytical monitoring, and (3) failure to conduct qualitative monitoring. The USCG is
required to respond to the NOV within thirty (30) days of receipt, March 22, 2013, with
information describing the actions taken to achieve compliance and a schedule for completion of
the compliance measures. This correspondence provides the requested information.
The February 6, 2013, inspection of SFO Fort Macon brought to our attention the issues
identified in the NOV. Once discovered, the USCG took immediate steps to resolve these issues
and bring the Unit into compliance. Additionally, the USCG has also taken preventative steps
that will ensure future continued compliance for the Unit. These steps include the securing of an
outside contractor to address the shortcomings of the SWPP, which will involve contractor
analysis, travel to the site, development of the updated SWPP, and coordination with internal
USCG offices to ensure compliance. We believe that this process can yield a satisfactory SWPP
by or before June 21, 2013, and we'll update your office with the status of SWPP development.
We are also in the process of collecting and analyzing a water sample from the Stormwater
Discharge Outfall (SDO). We anticipate this process to be completed by May 01, 2013. Finally,
a qualitative analysis in the form of a visual inspection was conducted on February 23, 2013, the
results of which are currently under review.
In addition to specifically addressing the concerns listed in the NOV, the USCG has also taken
Preventative steps that will ensure future continued compliance for the Unit. The USCG is
performing a root cause analysis of the underlying issues which led to this compliance failure.
We have noted that a lack of continuity among personnel assigned to SFO Fort Macon served as
a single point of failure with respect to the items highlighted in the NOV. As you are aware,
Coast Guard personnel constantly transfer within the organization. At SFO Fort Macon, the
transfer process was not managed effectively and failed to provide for a continuity of operations
with respect to SWPP compliance. As a result, new personnel transferred into SFO Fort Macon
that were responsible for this compliance, but were not given a sufficient SWPP compliance
debrief. My office will assist the SFO Fort Macon staff to address the current concerns and
develop a plan of action to improve and more proactively manage the Unit's SWPP compliance
requirements. The primary objective will be to develop and implement processes at SFO Fort
Macon that will eliminate the compliance issues outlined in the NOV in spite of the periodic
personnel rotations that are an unavoidable aspect of a military organization.

conducted a site inspection of US Coast Guard -Fort Macon Marina in Atlantic Beach, NC. This
inspection was conducted to determine if the facility is operating in compliance with the conditions
specified in NPDES General Stormwater Permit NCG 190000. During the inspection, informational
guidance and recommendations for bringing the facility into compliance with the requirements of the

Please find attached a copy of the Compliance Inspection Report, which indicates the findings of
the inspection and a summary of compliance issues that need to be addressed. The facility was determined
to be noncompliant with conditions of the permit.
As a result, the following violations were noted:

The Stormwater Pollution Prevention Plan was incomplete with several missing sections. The
permittee is required to develop and implement the Stormwater Pollution Prevention Plan and
include documentation of all monitoring, measurements, inspections, maintenance activities, and
training provided to employees, including the log of the sampling data and of actions taken to
implement BMPs associated with the industrial activities, including vehicle maintenance activities.

Analytical monitoring of stormwater discharges shall be performed as specified in Table 1. Sampling
results shall be reported as described in Part III, Section E.

Qualitative monitoring requires a visual inspection of each stormwater outfall regardless
of representative outfall status; and shall be performed as specified in Table 4.
Please be advised that this General Permit does not allow discharges determined by the Division
of Water Quality to be wastewaters. The discharge and/or disposal of vehicle wash water or vehicle
rinse water is not permitted by this General Permit. Wash water and rinse water must be directed to a
sanitary sewer system or permitted by a separate wastewater permit issued by the Division. The
discharge and/or disposal of any paints, solvents, petroleum, diesel oil or oil/water compounds applied to
any surface of the vehicles is not permitted by this General Permit.
Accordingly, you are directed to respond to this letter in writing within 30 calendar days of receipt
of this Notice. Your response should be sent to this office at the letterhead address describing the
actions to be taken to achieve compliance and a schedule for accomplishing these actions.
Thank you for your attention to this matter. This office requires that the violations, as detailed
above, be abated immediately. These violations and any future violations are subject to a civil
penalty assessment of up to $25,000.00 per day for each violation. Should you have any questions

Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.)
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG190000
• A copy of a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the
changes in the reissued permit.
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Permit cover page — Coverage is expanded to include industrial activities similar to the categorically identified industries.
• Part I Section A — This part explains that the No Exposure Exclusion from permitting option may be available to the permittee.
• Part II Section A — Several minor expansions and clarifications of the required content of the Stormwater Pollution Prevention
Plan have been added. Also, there is an added requirement for a Solvent Management Plan. Please be sure that your plan is
updated to comply with the new requirements.
• Part II Section B - Revised provisions require that stormwater discharges be sampled twice per year, and that the sampling
results be compared to new numerical benchmark values. (The previous cutoff concentrations have been eliminated.)
• Part II Section B — Monitoring for some metals has been added to the analytical monitoring requirements.
Part II Section B — Beginning with monitoring in Year 3-Period 1, revised provisions require the permittee to execute Tier One
and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark
exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring,
until three consecutive monitoring events show no benchmark exceedences.
• Part II Section B — Beginning with monitoring in Year 3-Period 1, this part contains a new provision that four exceedences of
any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control
actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of
specific stormwater control measures.
• Part 11 Section C — Qualitative monitoring must now be conducted during a representative storm event.

monitoring observations.
• Part III Section E — Items 1. and 2. require submittal of a new reporting form, the Annual Summary DMR. This annual

Inspection Summary:
Mr. Sam Hughes requested a courtesy inspection to obtain compliance assistance from the regional office. The Region
views this inspection as a compliance assistance request, therefore any deficiencies found during this inspection (since
no water quality issues existed at the time of the inspection) will not result in a notice of violation. The actions expected
by the Wilmington Regional Office pursuant to this inspection are that the SWP3 deficiencies be. remedied and the
stormwater monitoring be implemented immediately. The condition of the site suggests psersonnel are implementing
good housekeeping and best management practices.. 'w
The following deficiencies (pertaining to the SWP3 plan) were noted:
1. Part II Sect A 1.(a and c) Site plan: A site map and general location map should be included in the plan which provide
the details specified (see permit text for guidance)
2. Part II Sect A 1.(d) List of significant spills - Show a yearly documentation (retaining records for the past 3 years) of any
spill events and any corrective action taken (if any). If none occurred, document no spills occurred for that year.
3. Part II Sect A 1.(e) The USCG's SWP3 plan touches upon certification for non stormwater discharges. The certification
must be made every year with a signature each year from the individual with signatory authorization for the permit.
4. Part II Sect A 2.(a) The plan does not have a section for feasibility study.
5. Part 11 Sect A 2.(b)The area with secondary containment where drum/hazardous solvents etc, are stored, requires
documentation of how the stormwater accumulated in that area is disposed of. If it is clean and clear of any contaminants
from the stored materials, it can be discharged, but a qualitative inspection must be conducted first and must be
documented prior to release. This should occur each time the secondary containment area is pumped out to surface
waters.
6. Part 11 Sect A.4. The SWP3 requires a preventative maintenance program with scheduled inspections for stormwater
control systems and material handling areas.
7. Part II Sect A.7. The plan should be reviewed yearly, documented that it has been reviewed yearly by the individual
with signatory authorization and amended if any areas can be improved or new BMPs or good housekeeping pracitices
have been implemented.
8. Part II Sect A.8. The plan should have a section showing facility inpsections (semi annual). This is a facility grounds
inspection to look for potential leaks from stored boats, generators, drum storage areas etc. .
9. Part 11 Sect. B and C requires analytical and qualitative monitoring. Please provide data to the Wilmginton Regioanal
Office attn: Linda Willis if the data exists. If not please ensure that monitoring is implemented immediately. Wilmington

maintained.
