In response to your letter dated February 10, 2011, we offer the following response:
Item 1: Failure to implement the SWPPP in accordance with permit requirements.
The Permittee has contracted with this Consultant effective February 16 2011 to re -write the
SWPPP. The new SWPPP will incorporate all of the Pcrmit requirements, and will be completed
by March 30 2011. The Permittee will begin implementation no later than April 1 2011.
The new SWPPP will provide instructions, forms, and checklists for documenting all permit
compliance activities including BMP implementation, semi-annual site inspections, semi-annual
outfall monitoring, and annual employee training.
Item 2: Failure to Monitor.
The Permittee's Board of Directors is reviewing a proposal submitted by this Consultant to
perform the semi-annual qualitative and analytical outfall monitoring tasks. The Board should
make a decision with the next two weeks; they are aware that samples are required to be
collected during this current period which ends March 31 2011, The Board is also aware that the
next monitoring period is April I through September 30 2011.
We hope this letter and our planned actions satisfy your concerns with the operations at this

Dear Ms. Garvick and Mr. Frey:
On February 3, 2011, Division of Water Quality Regional Office representatives, Linda
Willis and Joanne Steenhuis, conducted an inspection at the Crow's Nest Yacht Club
marina. The inspection was the result of a complaint received by the Division concerning
the improper handling of oil from boat maintenance activities.
During the inspection, representatives noticed oil on the pavement in the dry stack area.
Oil had over -topped a container that had been placed under a leaking motor. Division
staff recommended immediate measures be taken to clean 1.1p the oil that had spilled to
the ground to avoid contact with stormwater. The General Manager, Craig Frey, was
extremely cooperative and ensured the representatives that the spill would be cleaned
immediately. A copy of the compliance evaluation inspection is enclosed. Stormwater
from this marina drains to Bogue Sound, a class SA Waters of the State.
As a result of the site inspection and a file review, the following violations were noted:
Item 1. Failure to implement the stormwater pollution prevention plan in
accordance with permit requirements.
Part 1I. Section A. of the NPDES Permit requires the permittee to implement the
stormwater pollution prevention plan. Record keeping for activities that demonstrate
compliance with the stormwater pollution prevention plan is required.

Part II. Section B. of the permit requires both semi annual qualitative and analytical
monitoring for stormwater discharges from the marina. A list of certified laboratories in
the State is enclosed for your convenience.
A copy of the latest permit text for the NPDES General Stormwater Permit
(NCG190000) is enclosed. Please take time to read the permit. Several documents
providing educational information are enclosed. If you need technical assistance with
understanding the requirements of this permit, or any of the enclosed educational

Comment: You are required to implement the good housekeeping practices and best
management practices outlined in the SWP3, if additional improvements to these areas
are required, you should update your SWP3. The inspector will provide the permittee
with a copy of the latest permit. The permit on file at the marina had expired for two
cycles. The manager of the marina was asked to read the new permit when received.

At your convenience, would you please inspect the facility at Crows Nest?
Proper procedures for fueling; accidental spills, accidents and fires do not seem to be in
place.
Druinuge from the racked boat engines appear- to drain to water and to watershed.
Their boat cleaning procedures allow water to drain straight into water.
'Phis amount of oil and cleaning materials can not be good for the water.

In response to your renewal application for continued coverage under general permit NCG190000, the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
* A cop), of general stormwater permit NCG190000
* A Stormwater Pollution Prevention Plan (SPPP) Certification Form. Completion of this form is required to
certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.
DO NOT SEND the SPPP with the signed form.
* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin on the Stormwater program which outlines program components and
addresses frequently asked questions
* A corrected Certificate of Coverage if you indicated a name change on the Renewal Application
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.

In accordance with your application for a stormwater discharge permit received on February 6, 1996, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDLS general permit.
This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum
of Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983.
A site inspection performed by Division staff confirmed the information provided in the February 27. 1996 fax
provided by Mr- Anthony Smith that stated that the outfall draining toward the street in sheet flow from the
maintenance building should be exempt from monitoring requirements. Therefore, monitoring data collected from the
other two outfalls listed in the application will be considered representative of discharge from the site for the purposes
of future stormwater monitoring requirements..
If any parts, measurement frequencies or sampling requirements contained in ,his permit are unacceptable to you,
you have the right to request an individual permit by submitting �m individual perm:- application. Unless such demand
is made, this certificate of coverage shall be final and bindin-.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or revocation
and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the Division
